Abstract

Algoritma pembelajaran mesin dalam menciptakan karya menjadi permasalahan dalam menilai orisinalitas terhadap karya lagu dan/atau musik yang dihasilkan artificial intelligence dalam lingkup hak cipta. Penelitian ini bertujuan untuk mengetahui tentang pengaturan terkait orisinalitas lagu dan/atau musik yang ada dalam ketentuan nasional maupun internasioal terhadap pemanfaatan artificial intelligence dalam lingkup hak cipta. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan terkait pengaturan hak cipta, Pendekatan konseptual, dan pendekatan perbandingan. Hasil penelitian menunjukkan bahwa tidak ditemukan batasan orisinalitas yang pasti dalam ketentuan hukum internasional terkait hak cipta, sedangkan Indonesia memuat batasan orisinalitas terhadap lagu dan/atau musik yang termuat dalam undang-undang No.28 Tahun 2014 tentang hak cipta. Adapun ketentuan yang ada belum memadai dalam memberikan perlindungan lagu dan/atau musik yang dihasilkan artificial intelligence layaknya beberapa negara yang telah membentuk konsepsi perlindungan dalam menilai permasalahan terkait orisinalitas. Pembentukan peraturan dan pertegasan batas orisinalitas menjadi hal yang perlu untuk dimuat dalam peraturan di Indonesia guna mendukung perkembangan teknologi artificial intelligence.

Abstract

Indonesia is a country that has the objective of ensuring the welfare of its citizens. One effective way to achieve prosperity for its citizens is by implementing excellent public services, especially when it comes to the fulfillment of rights concerning the legalization of public documents. Therefore, this study is aimed to analyze the application of the Apostille convention in the legalization of public documents, and to investigate the changes in the law of public services related to the legalization of documents after the Apostille enactment. This legal study is categorized as a type of doctrinal analysis. Specifically, it is descriptive and analytical. Juridical and theoretical foundations were used for data analysis and the theoretical basis employed was the Theory of Legal Reform. The finding is consistent with the principles of the Legal Reform Theory. Legalization of public documents has undergone legal reform because legalization of public documents can be done online and in a short time. This shows that law, as a means of reform, has been realized because it has met the needs of society for the public. Despite the enhancement of public services, several aspects require careful consideration and improvement. This includes establishing effective cooperation with the Regional Office of Law and Human Rights, which acted as a liaison for Apostille services at the regional level. Additionally, the Regional Office of Law and Human Rights assume a pivotal role in overseeing the printing of certificates to ensure accessibility for the public.

Abstract

Di Indonesia, expo dan konferensi mengenai ketenagakerjaan, pariwisata, atau bisnis masih diorganisir secara terpisah dan, maka dari itu, perlu diintegrasikan dengan lebih baik. Kegiatan-kegiatan expo dan konferensi ini kontras dengan sifat multidimensional dari proses keimigrasian. Organisasi layanan keimigrasian selalu berada dalam dinamika tinggi karena fungsi dari keimigrasian secara langsung terkait dengan mobilitas orang yang selalu mengejar perubahan. Penelitian ini bertujuan untuk menganalisis model tata kelola strategis dalam meningkatkan informasi keimigrasian melalui expo dan konferensi. Studi ini menggunakan metodologi soft system atau SSM dalam pemodelan aktivitas terkait imigrasi. SSM cocok digunakan dalam penelitian ini karena dapat melihat situasi sosial yang kompleks dan melibatkan berbagai sudut pandang. Hasil studi menunjukkan bahwa diperlukan pendirian sebuah acara besar internasional, yaitu Indonesia Immigration Expo and Conference, sebagai forum tata kelola strategis terintegrasi dan tata kelola kolaboratif untuk menyediakan informasi yang benar tentang keimigrasian di Indonesia. Selain itu, dengan diberlakukannya Peraturan Pemerintah No. 40 tahun 2023 tentang imigrasi dalam bentuk kebijakan “Golden Visa,” perubahan dalam periode pemberian visa dan izin tinggal diharapkan dapat menarik lebih banyak investasi asing. Acara internasional besar ini diharapkan berfungsi sebagai jaringan sosial karena mengumpulkan kedutaan, pengusaha, universitas, dan agen pariwisata dalam satu tempat. Studi ini merekomendasikan keterlibatan pemangku kepentingan dalam mendorong desain tata kelola strategis dan tata kelola kolaboratif untuk setiap pemangku kepentingan.

Abstract

Secara eksplisit, ada beberapa perbedaan yang cukup signifikan antara PermenPANRB Nomor 1 Tahun 2023 dan PermenPANRB Nomor 65 tahun 2021 tentang Jabatan fungsional Perancang Peraturan Perundang undangan. Peran perancang dalam pembentukan peraturan dan penyusunan instrumen hukum lainnya membutuhkan kompetensi dan pengetahuan yang baik sehingga dapat dipahami oleh para pengguna peraturan perundang-undangan, dan dapat diimplementasikan di masyarakat. Penelitian ini menggunakan metode yuridis normatif serta empiris dan dianalisis dengan pendekatan kualitatif. Hasil penelitian ditemukan bahwa peran perancang masih terkendala, antara lain: PermenPANRB Nomor 1 Tahun 2023 adalah salah bentuk penguatan peran perancang peraturan perundang-undangan dan penyederhanaan organisasi dalam melakukan pembinaan jabatan fungsional. Masih adanya kendala dalam pembinaan, antara lain: terhambatnya kenaikan pangkat perancang disebabkan oleh minimnya informasi keikutsertaan mengikuti diklat penjenjangan yang merupakan persyaratan kenaikan pangkat; keterbatasan kuota dan kesempatan untuk mengikuti diklat perancang; tidak jelasnya perbedaan dan pembagian tugas antara fungsional perancang dan fungsional analis hukum dalam pembentukan peraturan perundang-undangan, implementasi PermenPANRB terbaru ini adalah lebih memfokuskan tugas pejabat fungsional khususnya perancang pada capaian kinerja organisasi, bukan hanya pada capaian angka kredit sehingga berdampak pada penguatan kinerja organisasi dan pelayanan publik.

Abstract

Structure-oriented or system-oriented movements will be more advanced than ordinary movements without relying on a system (normative). Structural legal aid is included in the movement of non-governmental organizations whose work system leads to structural or systemic changes, rather than changes at the individual or case-by-case level. The legal aid movement aims to ensure access to justice for people in need, especially women. With normative legal research, it is hoped that this can provide important findings about community colaboration, aid service providers, NGOs, and CSOs in societal change and equality. Thus, structural legal aid is a legal aid strategy based on the movement by eliminating power relations and gender inequality. In addition, village women paralegals can act as a movement to realize structural gender legal assistance for women, children, and other marginalized groups, and not just for the poor. The old perspective on traditional legal aid is not effective, makes structural legal aid an alternative from legal aid, that can be encouraged by movement that can eliminate gender inequality and change existing structures in society. Women’s participation as paralegals in a social movement can be optimized with support from NGOs and CSOs such as legal aid organizations. So that women’s social movements produce gender equality, fulfill women’s rights, and overcome discrimination. Apart from that, the legal aid movement needs to be focused and structured so that women’s rights are fulfilled. The challenge for paralegals is to be able to go beyond the duits stated in the UUBH.

Abstract

Advocating for the ellimination of patent maintanance feees in Higher Education, especially for Entrepreneurial Universities (EU), is essential. The number of patents is the primary indicator in determining the most innovative university. Therefore, the Minister of Law and Human Rights in 2020 adapted by issuing Permenkumham 20/2020 concerning Requirements and Procedures for Imposing Certain Tariffs on Patent and Copyright. According to Permenkumham 20/2020, in some instances, tariffs on patent services can be imposed in the amount of zero rupiahs, including for Higher Education. The research problem is How to advocate for a policy to eliminate patent maintenance fees at an EU?. This research aims to analyze Policy Advocacy for the Elimination of Patent Maintenance Fees at EU. This study uses the Advocacy Strategy Framework concept proposed by Coffman. The research employs a qualitative research method. The results of the research show that the Advocacy Strategy Framework regarding the Elimination of Patent Maintenance Costs in Permenkumham Number 20/2020 is carried out through three changes, Awareness, Will, and Action carried out to audiences, namely Public and Influencers; Influencers; Influencers and Decision Makers; and Decision Makers. The researcher recommends to the Ministry of Law to compile a Roadmap and Action Plan regarding Elimination of Patent Maintenance Costs in Policy Products in the form of Ministerial Decrees Law and Human Rights or Decision of the Director General of IP regarding the Roadmap and/or Action Plan regarding this matter.

Abstract

  Laws and regulations related to trade secrets do not explicitly stipulate that trade secrets can be used as an object of guarantee in banking, causing legal uncertainty for the public and affecting the condition of trade secrets being used as collateral objects and the execution of goods for certain reasons. Writing this article aims to examine and analyze the regulation of trade secrets as an object of guarantee and the execution of trade secrets in the banking. Then, through this article it can provide benefits in the form of juridical understanding related to trade secret legal arrangements as objects of collateral in the banking, contribute literature, and can be considered by the government in establishing laws and regulations related to trade secrets as collateral objects. The legal issue in the form of a veil of norms makes this article use normative legal research methods using a statutory and contextual approach, followed by legal materials in the form of primary, secondary and tertiary legal materials. The results of the study show that trade secrets can be used as collateral in the banking because they have economic value, can be transferred, and have no time limit as long as they are kept confidential. Then related to the execution of trade secrets can be carried out based on the execution of fiduciary guarantees considering that trade secrets can be charged with fiduciary guarantees. The method of execution is through executorial titles, public auctions, and private sales as stipulated in Article 29 of the Fiduciary Guarantee Law. Trade secrets as an object of guarantee have been explicitly regulated and execution of trade secrets can be carried out through private sales and auctions as regulated in the German Lending and Taking Security Act. Based on this explanation, the solution to the legal issues in this article is that Indonesia can amend the Trade Secrets Law by considering German Legislation so as to provide legal certainty for the Indonesian people regarding trade secrets as an object of guarantee.

Abstract

Artificial Intelligence (AI) has developed in such a way that it is capable of producing creations and inventions without human intervention through the training of a number of datasets. This normative juridical research aims to look at AI problems from the perspective of AI as a subject and AI results as an object of copyright and patent protection, as well as examining the implications of using creations in datasets to train AI. This research found that AI cannot become a creator and inventor because moral and human rights are reserved for humans, besides that AI cannot take advantage of the economic rights obtained from the protection of creation or patents. This study also found that the use of datasets containing other people’s creations as AI development material has the potential to cause copyright violations. This potential is mitigated by several countries by implementing regulations related to TDM or data scraping for AI machine learning. Finally, this study also found that creations and inventions resulting from AI in general cannot become objects protected by the copyright regime unless they receive direct human contribution or are formulated in statutory regulations such as in the CGW copyright regime in the UK. This research suggests that practices in other countries in copyright and patent protection regimes related to AI can be used as a reference for legal politics in Indonesia to create AI regulations that balance the moral and economic rights of Creators and Inventors with the pace of AI innovation.
