Abstract

Law enforcement (judges, prosecutors and police) in Indonesia is still dominated by the positivistic paradigm and-legalistic way of thinking, especially in the legal meaning of the Criminal Code. The way to think of this kind proved to make the process of law enforcement in Indonesia is arid dry from morality. As a result, justice becomes the ultimate goal of law is often not achieved. Especially is justice and Human Rights (HAM) women. The inequality of women is certainly contrary to the concept of Indonesia as the "rule of law". As in Article 1 (3) UUD 1945 Indonesia is the "rule of law". The hallmark of the Rule of Law (Rechtsstaat / Rule of Law) is a rule of law that protects human rights (Human Rights). Law as supreme commander (commander) should not ignore the value of the legal basis of "justice" and "human rights protection". Legal positivism in the Criminal and Code is a sharp criticism of the various theories, especially the law of Islam. In Islamic law the concept of justice, equality and the protection of human rights is a philosophy or principles that should not be overlooked. Therefore, efforts to dismantle legal positivism in the Criminal Code is a necessity.

Abstract

The decision of “haram” which is coming from The Indonesian Islamic Scholar Council (MUI ) against such a group which has homo sexual oriented and the death penalty for sexual offenders "deviant" make the people of Indonesia shaken, especially those who feel they have gender identity "third". "Religion" which should give way ease, as if to bury alive a person who has a gay sexual orientation. In fact, legal instruments, regional, national and international human rights recognize their rights as human beings. By using contemporary humanities social approach, this paper presents the Lesbian, Gay, Bisexual And Transgender group as a human's dignity to be treated like a human being which must be respected.

Abstract

Every nation who wants to stand firm and know clearly where the goal is to achieve it requires a view of life. With this view of life a nation will look at the problems it faces and determine the direction and the way how to solve these problems. Without a view of life then a nation will feel vacillated in facing big problems that will surely arise, both the problems within the community itself, as well as the big problems of human beings in the association of the peoples of the nations of the world. With a clear view of life a nation will have guidance and guidance on how it solves the political, economic, social and cultural problems arising in the advancing societies. By referring to the view of life that also a nation will build itself. As the philosophy of the state, of course Pancasila there who formulate it. Pancasila is indeed the greatest gift of Allah SWT and it turns light for all the Indonesian people in the future, both as a guideline in fighting for independence, as well as a unifying tool in the life of national harmony, as well as a view of life for everyday Indonesian human life, and which has clearly been expressed as the basis and philosophy of the Republic of Indonesia. Pancasila has existed in all forms of Indonesian people's life, except for those who are not Pancasila. Pancasila was born June 1, 1945, set on August 18, 1945 together with the 1945 Constitution. The correct sounds and speech of Pancasila based on Presidential Instruction No. 12 of 1968 is one, Belief in the One Supreme. Two, a just and civilized humanity. Three Unity Indonesia. Four, Democracy led by the wisdom of wisdom in deliberations / representation. And fifth, social justice for all the people of Indonesia.

Abstract

The oldest Indonesia Islamic educational institutions until today has a strategic role as one of the institutions of education transformation. This paper attempts to describe the character of the development efforts of the students among the students. Pesantren which is identical with the yellow book in their work have given the considerable influence for Indonesian. Even boarding in method always apply wisdom values ​​lokn applies traditional education pattern surrounding communities. In Indonesia, there are so many boarding schools, which number in the thousands. In general, the existing boarding schools to implement a traditional education and modern education pattern. However, despite the different patterns of educational learning patterns, but in substance likely to have similarity. One thing that does not seem to be separated from the school that the educational pattern using yellow book as a study. This research method is descriptive analysis with a qualitative approach. There are several local moral values ​​that can be used as a boarding school a learning model that can be adopted by our education today, one of which is a pattern of education that emphasizes the moral values ​​of learners. Such as : courtesy, discipline, exemplary, manners, patience and gratitude, cooperation, faith, responsibility, wisdom, faith. If these values ​​can be applied in all lines of education in Indonesia, then bunalah an impossible thing if the country of Indonesia will experience a period of glory in the future.

Abstract

This research explains about the function of “bank sampah cangkir hijau” in conducting creative economy movement through garbage craft as an action to save the environment in Metro City, Lampung. “Bank Sampah” creates by Lecturer and Students of STAIN Jurai Siwo Metro purposed to save the environment by managing the rubbish into creative craft. “Kresbag” is a cloth bag which has interesting pack and it help people to be aware to bring their own bag shopping. “Bank Sampah” which manages by students helps them to pay their study independently. This empowerment use ethnographic approach to answer the submitted questions. This research applied Pierre Bourdieu's theory of Intellectual Collective which has meaning as a diverse movement of multidisciplinary knowledge and profession to make social change.

Abstract

This article tries to explain associated with various conflicts resulting from a false understanding of the text in response to a context. Text sometimes translated in a way that is narrow and indiscriminate, resulting in a narrow understanding of people and tend to be wrong.Apart from a narrow understanding conveyed by religious leaders, the real conflict in society is due to the knowledge of understanding of individuals who tend to be limited. In the global society, the paradigm of a narrow understanding that should be fought, because in turn, peacefulness will never arise when religious believers insists assume that the religion which he believes most true and other religions shall be fought and led to other religions. Then there must be understanding in the community comprehensive of religious attitudes in order to create a more harmonious atmosphere

Abstract

In the era of globalization, the exsisting of Internet has viewed a global information network that completely transparent, it was directly or indirectly affect and create challenges to find the way of arranging a transaction in the economics side, the development of technology has met the method of transactions known as e-commerce. Islam has set up a mechanism in the property development, and one of the efforts for arrange the wealth development is through business activities. Young age is not an obstacle to starting a business, even many people who success in the field of business at a young age. Based on the background above, the formulation of the problem in this study: How big is the impact of e-commerce on Soul Entrepreneurship Growth Student Faculty of Economics and Islamic Business, UIN Raden Intan Lampung ?. Research Objectives to analyze how big is the impact of e-commerce on the Growth of Enterpreneurship Student Life of Faculty of Economics and Islamic Business, UIN Raden Intan Lampung. The method cunducted in this research is using survey research design with quantitative research methods, the sample in this study as many as 19 people with simple random sampling method, data collecting techniques that used was through questionnaires, data analysis techniques is using a simple regression by SPSS program ver. 16. The results showed: There are positive and significant impact between e-commerce with the growth of soul students entrepreneurship.

Abstract

One of the most challanging problems of our nation is mocal decadence and this problem needs to be solve urgently. There are many factors that lead to the moral decadence, among those factors are inconsistence in law enforcement, lack of role model, reduced role of parents and teachres, and inconducive environment. Given the fact of moral decadence, the government has made an effort in moral education or character building. This effort cannot be solely done by single authority or party, rather it need wider engagement and comprehensive involvement from all stakeholders. Using this method and strategy, it is expected that moral education or character building may succeed. In the context of family education and school, parents and teachers play very significant roles in moral education and character building. This paper aims at revitalizing the roles of parents and teachers in inculcating moral values for our children through family education and school education.

Abstract

Abstrak Pancasila membentuk pendidikan karakter bangsa melalui proses pendidikan ke-Islaman. Pancasila adalah ideologi dasar bangsa Indonesia yang diwariskan dari para pendiri bangsa. Pancasila terdiri dari dua kata dalam bahasa Sansekerta, Panca artinya lima dan Sila berarti prinsip atau asas. Perkataan Pancasila memiliki lima sendi utama yaitu Ketuhanan Yang Maha Esa, Kemanusiaan yang adil dan beradab, persatuan Indonesia, kerakyatan yang dipimpin oleh hikmata kebijaksanaan dalam permusyawaratan/perwakilan, dan keadilan sosial bagi seluruh rakyat Indonesia. Ini semua tercantum dalam paragraf keempat dalam pembukaan UUD 1945. Pancasila harus melekat dalam kepribadian setiap manusia Indonesia. Mereka yang menjalankan Pancasila bukan sebatas hafalan di ruang kelas, akan mudah menyadari ada persinggungan yang erat antara Pancasila dan kehidupan berbangsa. Pembangunan karakter di sekolah juga sangat terkait dengan manajemen atau pengelolaan sekolah. Pengelolaan yang dimaksud adalah bagaimana penguatan karakter nasionalisme direncanakan, dilaksanakan, dan dikendalikan dalam kegiatan-kegiatan pendidikan di sekolah secara memadai. Pengelolaan tersebut antara lain meliputi, nilai-nilai yang perlu ditanamkan, muatan kurikulum, pembelajaran, penilaian, pendidik dan tenaga kependidikan, dan komponen yang terkait lainnya dalam proses pendidikan Islam untuk menanamkan nilai-nilai tauhid sebagai pondasi kehidupan berbagsa dan bernegara, sebagaimana perjungan Rasulullah SAW di Makkah dan Madinah. Aktualisasi Pancasila adalah bagaimana proses nilai-nilai Pancasila benar-benar dapat tercermin dalam sikap dan perilaku seluruh warga negara mulai dari pimpinan negara, aparatur negara sampai kepada rakyat biasa. Aktualisasi nilai-nilai Pancasila dalam kehidupan bermasyarakat, berbangsa dan bernegara memerlukan situasi dan kondisi yang memungkinkan seluruh lapisan masyarakat yang dapat mencerminkan nilai-nilai Pancasila itu dan dapat terlihat dalam perilaku bermasyarakat, berbangsa, dan bernegara.

Abstract

Perempuan dan gender merupakan isu yang kait-mengait, yang tak terpisahkan bahwa isu tersebut yang dirasakan adanya telah memenjarakan, telah termarginalkan dan menjadi objek yang panas terdiskriminasi. Secara otomatis, kondisi ini meresahkan baik secara akademis maupun kultur social. Dalam konteks ini, visi yang dapat ditawarkan adalah visi pembebasan, dengan orientasi dan metode pertama, mendudukan derajat perempuan secara sama dengan laki-laki, kedua menolak bias-bias gender, dan ketiga berlaku adil dan tidak dikotomis.
