Abstract

Indonesia is a state of law as stipulated in article 1 number 3 of the 1945 Constitution. Indonesia is one of the countries in the world, which is a state of law. Indonesia's position as a state of law has very broad implications in various other fields. The reality of Indonesian society's life cannot be separated from the existence of the law inherent in a multi-ethnic, multi-cultural society. The term legal state (Rechstaat) is no stranger to constitutional knowledge from ancient times to the present. It's just that in the practice of state administration people are still witnessing whether the rule of law has been fully implemented or not. This research is a type of normative research, and uses descriptive qualitative analysis through critical studies. The results of this study indicate that the concept of rechstaat prioritizes the wetmatigheid principle which then becomes the rechtmatigheid. Elements of Rechstsst: 1) The existence of protection of human rights, 2) The separation and distribution of state power to guarantee the protection of human rights, 3) Governance based on regulations, and 4) The existence of administrative justice. However, the implementation of the said rule of law has not yet been implemented well and comprehensivelyKeywords: Critical Study, Variety of Concepts, State, LawABSTRAKIndonesia ialah negara hukum sebagaimana tertuang dalam pasal 1 angka 3 Undang-undang Dasar Tahun 1945. Indonesia sebagai salah satu negara di dunia, yang merupakan negara hukum. Kedudukan Indonesia sebagai sebuah negara hukum, membawa implikasi yang sangat luas pada berbagai bidang lain. Realitas kehidupan masyarakat Indonesia yang tidak bisa dilepaskan dari keberadaan hukum yang melekat pada masyarakat yang multi-etnis, multi-kultural. Istilah negara hukum (Rechstaat) tidak asing lagi dalam pengetahuan ketatanegaraan sejak zaman purba hingga sekarang ini. Hanya saja dalam praktek ketatanegaraan, orang masih menyaksikan apakah negara hukum itu sudah dilaksanakan sepenuhnya atau tidak. Penelitian ini merupakan jenis penelitian normatif, dan menggunakan analisis deskriptif kualitatif melalui studi hukum kritis. Hasil penelitian ini menunjukkan bahwa Konsep rechstaat mengutamakan prinsip wetmatigheid yang kemudian menjadi rechtmatigheid. Unsur-unsur rechstaat: 1) adanya perlindungan terhadap hak-hak asasi manusia (HAM), 2) adanya pemisahan dan pembagian kekuasaan negara untuk menjamin perlindungan HAM, 3) pemerintahan berdasarkan peraturan, dan 4) adanya peradilan administrasi. Akan tetapi pada aspek implementatif negara hukum dimaksud belum terlaksana dengan baik dan komprehensifKata kunci: hukum, negara, ragam konsep, studi kritis

Abstract

This study aims to study and to analyze the legal protection for plant breeders and law enforcement for Plant Variety Protection (PVP). This research is a normative legal research, which is based on written legislation and various literatures related to this issue. The form of legal protection for plant breeders is Law Number. 29 of year 2000 concerning Protection of Plant Varieties, has provided legal protection for plant breeders, through Law No. 12 of year 1992 concerning the Plant Cultivation System (UUSBT) and Law No. 29 of year 2000 (UUPVT), UUPVT provides protection for breeders 'economic rights, while UUSBT provides protection for breeders' moral rights. Law enforcement against violations of PVP has been done well, this is evidenced by several cases submitted to the Court, but there are still some cases that are wrong in the application of the law. It is expected that the implementation of the PVP Invitation Act is more optimal

Abstract

The use of the internet in changing the way consumers communicate and consume television media content is known as "media disruption". This disruption or disruption occurs because of technological changes and the innovations that follow. This disruption or disruption to innovation has made a number of televisions competing to take advantage of the development of the internet in creating content, both entertainment and news content, where in this era of disruption television broadcast content is filled with content that takes content from the internet such as Youtube and other streaming social media.With the existence of broadcast program regulations that take snippets of images and / or sound clips from other broadcasting institutions, researchers are interested in knowing more about broadcast programs and the implementation of Law Number 32 Year 2002 concerning Broadcasting.This study aims to determine the implementation and obstacles of Law Number 32 Year 2002 concerning broadcasting by Lombok TV9 broadcasting media in the era of disruption.This research is a normative empirical research with a research approach using a statutory approach, a conceptual approach, a case perspective and a comparative perspective. Types and sources of research data are primary data and secondary data with primary and secondary legal materials. Data collection techniques in the form of interviews, literature study and documentation.The results of this study indicate that TV9 Lombok in implementing Law Number 32 of 2002 concerning Broadcasting in the era of disruption has not been implemented properly due to several obstacles including: lack of coordination and knowledge of broadcasting regulations and not carrying out the stages of television program programs properly.

Abstract

This study aims to determine: the form of legal protection for the parties due to the law from the cancellation of the land purchase agreement and the factors underlying the cancellation of the binding deed of sale and purchase of land in Babakan Village, Sandtubaya District, Mataramt City.     This type of research is normative-empirical research, using the statute approach, conceptual approach, case analysis approach (case approach) and fact approach. The sources of legal material used are in the form of primary legal materials, secondary legal materials and tertiary legal materials. Field data collection using interview techniques, then analyzed qualitatively.     From the results of the study, it can be concluded that 1) The legal strength of the sale and purchase rights agreement on land rights made by a Notary in the implementation of the Deed of Sale and Purchase is very strong. Because it is an authentic deed, 2) Legal consequences arises from the cancellation of the Land Purchase Sale deed: (a) The parties may be liable to a fine which has been agreed upon from the amount that must be paid by the buyer to the seller or buyer, for each day of delay. These fines must be paid instantly and at once, (b) The agreement ends and insofar as both parties need to break away from what is stipulated in Article 1266 and Article 1267 of the Civil Code, and the Seller Party is obliged to return the money paid by the Party The buyer after deducting a few percent from the selling price of the land and building in lieu of the costs incurred by the Selling Party plus the fine that must be paid by the Purchaser to the Seller

Abstract

   The purpose of this paper is to find out the procedure for making agreements in medical actions in health services between doctors and patients in handling medical measures. The research is a normative legal research study with an approach based on laws and regulations, a conceptual approach and a case approach.   From the results of the study it can be concluded that, the Agreement on Medical Action (informed consent) is carried out in accordance with statutory procedures, for that doctors are bound by professional code of ethics in carrying out their functions as medical personnel, so that in carrying out medical actions there must be an agreement and written agreement between the doctor and the patient. The legal consequences arising between the doctor and the patient after the medical action is carried out are in the form of legal responsibility, both in the form of civil, criminal and administrative law related to his profession.

Abstract

This study aims to analyze and examine how the consequences and legal remedies for holders of Building Use Rights that have expired in terms of PP no. 40 of 1996 concerning Cultivation Rights, Building Use Rights and Land Use Rights. This research uses a normative-empirical research method, with the statute approach, conceptual approach, case analysis approach and facts approach. The sources of legal materials used are primary legal materials, secondary legal materials and tertiary legal materials. Field data collection using interview techniques and then analyzed qualitatively.The results of the study show that: 1) The legal consequences for the holders of Building Use Rights that have expired or have expired, in order to remain as the holders of Building Use Rights can be done in two ways, first through the extension of rights and secondly by renewal of rights. 2) Legal remedies against holders of Building Use Rights whose validity period has expired are through administrative measures, namely increasing the rights to property rights and legal remedies through the decisions of the State Administrative Court
