Abstract

Conflict in Mesuji can indeed be categorized as a chronic agrarian conflict. This chronic condition can?t be separated from the complex dynamics of conflict, involving various parties with different interests. Case of indemnification Barat Selatan Makmur Investindo Company with the community in Mesuji is also at the same time a fact that shows that forests do not merely present ecological facts, but a landscape that is socially constructed to fulfill some functions, namely as a region of life, a place to grow the collective identity of a community group, developing the culture of society

Abstract

Outsourcing is delegation of daily management and operations of a business process to outside parties (a provider of outsourcing services). Through delegation, then the management is no longer done by the company, but rather delegated to companies outsourcing services. Protection of workers was intended to guarantee the fundamental rights of workers and guaranteeing equality of opportunity and treatment without any discrimination on the well-being of workers and for the realization of his family by remaining attentive to the developmental progress of the business world and the interests of employers. Laws and regulations related to the protection for workers, namely law No. 13 of 2003 on labor and the implementing regulations of the legislation in the field of employment.

Abstract

Perusahaan angkutan berbasis online dalam layanan jasa pengiriman  barang yang berperan sebagai pelaku usaha dalam menjalankan usahanya mempunyai kewajiban dan tanggung jawab yang sesuai dengan Undang-Undang No.8 Tahun 1999 Tentang Perlindungan Konsumen. Adapun upaya hukum yang dapat ditempuh oleh konsumen yang telah dirugikan akibat kehilangan barang yaitu melalui jalur non litigasi atau di luar pengadilan yaitu melalui Badan Penyelesaian Sengketa Konsumen karena melalui jalur ini konsumen dapat menyelesaikan sengketanya dengan waktu yang relatif cepat, biaya hemat, dan kerahasiaan konsumen terjamin. Selain itu apabila jalur non litigasi gagal dilakukan dapat dilakukan upaya penyelesaian melalui litigasi atau melalui pengadilan.

Abstract

Dengan adanya pandemi Covid-19, banyak perusahaan yang berdampak pada aturan pemerintah serta alasan kesehatan untuk melakukan kegiatan work from home, dan berdampak kepada pekerja yang dirumahkan, kebijakan ini berdampak pada pemberian remunerasi terhadap tenaga kerja. Penelitian ini mengidentifikasi perlindungan hukum terhadap tenaga kerja yang dirumahkan terkait remunerasi dalam masa pandemi Covid-19.Hal ini melatarbelakangi permasalahan mengenai bagaimanakah Perlindungan Hukum terhadap tenaga kerja yang dirumahkan terkait remunerasi pada masa pandemi Covid-19 berdasarkan Peraturan Perundang-undangan yang berlaku serta konsekuensi terhadap perusahaan yang tidak memberikan remunerasi pada tenaga kerja yang dirumahkan selama pandemi Covid-19.Dari hasil penelitian menyatakan bahwa berkaitan mengenai perlindungan dan pengupahan pekerja di tempat kerja, pengusaha dapat memberikan penangguhan pembayaran upah apabila pengusaha tidak dapat membayar upah sesuai dengan peraturan upah minimum, melalui persyaratan dimana harus melakukan perundingan dengan pekerja terlebih dahulu. Pengusaha melakukan penangguhan pembayaran upah minimum kepada pekerja dengan mengabaikan kewajiban para pengusaha untuk membayar selisih upah minimum penangguhan.

Abstract

Di perusahaan yang memproduksi alat rumah tangga berbahan plastik, hak pekerja waktu tertentu atas cuti tahunan tidak terpenuhi. Cuti tahunan tersebut hanya untuk karyawan tetap sedangkan pekerja waktu tertentu tidak mendapatkan hak cuti tahunan. Tujuan penelitian ini untuk mengetahui perlindungan hukum hak cuti tahunan pekerja waktu tertentu dan penyelesaian hukum yang dapat ditempuh pekerja jika cuti tahunannya tidak terpenuhi. Penelitian ini mengunakan jenis penelitian yuridis normatif dengan pendakatan perundang-undangan (statue approach). Hasil dari penelitian ini bahwa perlindungan hukum atas hak cuti tahunan bagi pekerja waktu tertentu telah diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja mengatur bahwa pekerja waktu tertentu berhak atas cuti tahunan ketika telah bekerja di suatu perusahaan selama 1 tahun berturut-turut, namun jika cuti tahunan tidak diberikan maka salah satu hak pekerja waktu tertentu tidak terpenuhi dan perusahaan dapat dikenakan sanksi pidana atau denda serta untuk penyelesaian hukum atas tidak terpenuhinya cuti tahunan, pekerja dapat menyelesaikannya melalui jalur non-litigasi yaitu ada bipartit, mediasi, konsiliasi dan arbitrase atau melalui litigasi yaitu melalui pengadilan hubungan industrial.

Abstract

Fenomena kasus penyebaran Covid-19 di Indonesia begitu pesat hal ini tentu sangat berdampak negatif terhadap ketenagakerjaan dan melemahnya perekonomian negara Indonesia sehingga menimbulkan implikasi nyata yang harus dihadapi banyak perusahaan untuk melakukan pemutusan hubungan kerja kepada pekerja/buruh di Indonesia secara masal. Pasal 164 dan 165 Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan kurang lebih menyatakan bahwa suatu perusahaan berhak memutus hubungan kerja terhadap pekerja apabila suatu perusahaan mengalami force majeure atau dalam keadaan memaksa. Pada prinsipnya saat terjadi force majeure maka tanggung jawab atas segala ganti rugi dan tuntutan itu akan hilang dan tidak ada pergantian biaya kerugian apabila terjadi suatu keadaan memaksa (force majeure) atau kejadian yang tidak disengaja. Penelitian ini bertujuan untuk mengetahui hukum tentang Pemutusan Hubungan Kerja bisakah dikategorikan sebagai alasan force majeure karena kondisi Pandemi Covid-19 yang sudah dikatakan sebagai bencana nasional dan memberikan informasi mengenai perlindungan hukum terhadap pekerja/buruh yang terkena pemutusan hubungan kerja dengan alasan force majeure. Abstract

The devotion to the community aims to provide mentoring and socialization of the rights that are being addressed by Labor based on legislation on Labor. Analysis of the arrangement was done with the instrument of law based on the Constitution of the Republic of Indonesia year 1945, Act No. 13 year 2003 on employment. Protection against workers is intended to ensure the basic rights of workers and ensure the similarities of opportunities and treatment without discrimination of any kind to realize the welfare of workers and their families while still paying attention to developments Business progress and entrepreneurs' interests. The legislation related to the protection of the workers of Law No. 13 year 2003 on employment and implementing regulations of the law in the field of employment. The devotion to this community is done by several phases, which are divided into three phases, namely (1) the preparatory phase for community service, the preparation phase begins with finding the problem that will be discussed in the devotion to This society. Further followed by the collapse of the title and formulation of the proposal to community devotion. (2) The stage of implementation, this stage begins with the data-keeping through the dedication of the literature by reviewing the relevant library materials with the research study then supplemented by interviews to the informant to complete the data This devotion. (3) Completion stage, at the stage of this research is conducted by analyzing the research data followed up by the preparation of reports and publications of the results of community devotion.

Abstract

Abstract This research emphasizes Today the company engaged in digital is very rapidly developing, one of them is a digital company in the field of transportation. Drivers of online transportation generally carry out professions in the informal sector through partnership with companies. The relationship that arises between the driver and the company that is not based on work relations has implications for the non-enactment of Law No. 13 of 2003 concerning Labor, This research provides a deeper understanding of how social security legal protection is accepted by online drivers. The research method in this study is normative with a case approach. The results of this study show first, the partnership-based Transportasi service company has not provided social security protection for its partner workers. Second, the regulation in partnership-based labor social security is not clearly regulated in the legislation so that the reason is used as the basis of the online transfortation company to not implement social security workers.
