Abstract

Weak implementation of the recognition and respect for Indigenous Peoples of Iban Semunying be problems related to their discriminatory practices in running a government policy. Why is the implementation of the recognition and respect for the Indigenous People of  Dayak Iban Semunying still weak and how the principles of human rights and the Sustainable Development Goals are the two issues raised in this article. In this study it aims to find out what are the things that form the basis of the weak protection of indigenous peoples. The results of this study are expected to provide insight into the protection of the rights of indigenous peoples with a perspective of sustainable development goals.

Abstract

Access to justice by the rights of migrant workers in essence needs to be improved both in terms of transparency and accountability of protection. In realizing the protection of migrant workers abroad, the role of embassies and consulates is a very important role. The form of state responsibility in providing protection for the rights of migrant workers by the help of representatives of embassies and consulates, as well as how the effectiveness of the assistance is a problem that will be studied in this study. The research method used is the juridical-normative method, which is then reviewed with a conceptual approach and a case approach. This study aims to ascertain whether legal assistance carried out by the Embassies and Consulates has been running properly in accordance with the legal rules that pay attention to the rights of migrant workers who have a justice perspective in human rights or not. The results of this study recommend a more efficient standard procedure for protection procedures, and ensure that there is transparency and fairness on target, so that protection can be received by all migrant workers.dalam transparansi maupun akuntabilitas perlindungannya. Dalam mewujudkan perlindungan pekerja migran di luar negeri, peran Kedutaan dan Konsulat menjadi peran yang sangat penting. Bagaimana bentuk Tanggung Jawab negara dalam memberikan perlindungan hak pekerja migran oleh bantuan perwakilan Kedutaan dan Konsulat, serta bagaimana efektifitas bantuan tersebut merupakan permasalahan yang akan dikaji dalam penelitian ini. Metode penelitian yang digunakan yaitu metode yuridis-normatif, yang kemudian dikaji dengan pendekatan konseptual dan pendekatan kasus. Penelitian ini bertujuan untuk memastikan apakah bantuan hukum yang dilakukan oleh Kedutaan dan Konsulat sudah berjalan semestinya sesuai dengan aturan hukum yang memperhatikan hak pekerja migran yang berperspektif keadilan dalam hak asasi manusia atau belum. Hasil dari penelitian ini merekomendasikan mekanisme prosedur standar perlindungan yang lebih efisien, serta menjamin adanya transparansi dan keadilan yang tepat sasaran, sehingga perlindungan dapat diterima semua pekerja migran.

Abstract

Lemahnya implementasi pengakuan dan penghormatan terhadap Masyarakat Hukum Adat Dayak Iban Semunying menjadi persoalan terkait adanya praktek-praktek diskriminasi didalam menjalankan suatu kebijakan pemerintah. Mengapa implementasi pengakuan dan penghormatan terhadap masyarakat hukum adat Dayak Iban Semunying masih lemah serta bagaimanakah prinsip-prinsip hak asasi manusia dan Sustainable Development Goals merupakan dua permasalahan yang diangkat dalam artikel ini. Dalam penelitian ini bertujuan untuk menemukan apa saja hal-hal yang menjadi dasar lemahnya perlindungan terhadap masyarakat adat. Hasil dari penelitian ini diharapkan dapat memberikan pandangan terhadap perlindungan hak-hak masyarakat adat yang berperspektif tujuan pembangunan berkelanjutan

Abstract

AbstractAs a law enforcement agency, the police have duties and responsibilities in realizing the democratic values of the community. One form of democracy that is often done by the community is demonstration. However, democracy is often interpreted as unlimited freedom, even though the freedom of association and assembly, expressing thoughts verbally and in writing which are our human rights as humans are indeed guaranteed and protected by law, even as stated in Article 28 of the 1945 Constitution of the Republic of Indonesia and specifically regulated in the Law Number 9 of 1998 concerning Freedom to Express Opinions in Public, so that basically, demonstrations are legally permitted, but must be carried out in a civilized manner and not by violating the law. Related to this, how the effectiveness of the role of the police as a rule of law institution which is a means of social control in carrying out democratic values will be studied in this study, with the aim of analyzing it. The research method used is the juridical-normative method, with the assessment using a conceptual and case approach. The results of this study explain that the role of the police is still not effective, especially as a means of social control. In this case, preventive measures to prevent demonstrations that lead to anarchy, such as holding educational activities and legal socialization, have so far been lacking, both in intensity and creativity. AbstrakSebagai lembaga penegak hukum, kepolisian memiliki tugas dan tanggung jawab dalam mewujudkan dihidupinya nilai-nilai demokrasi oleh masyarakat. Salah satu bentuk cara berdemokrasi yang sering dilakukan oleh masyarakat adalah demonstrasi. Namun, demokrasi seringkali dimaknai sebagai kebebasan tanpa batas, padahal kemerdekaan berserikat dan berkumpul, mengeluarkan pikiran dengan lisan dan tulisan yang merupakan hak asasi kita sebagai manusia memang dijamin dan dilindungi oleh hukum, bahkan tercantum pada Pasal 28 UUD NRI Tahun 1945 dan secara khusus diatur dalam Undang-Undang Nomor 9 Tahun 1998 Tentang Kemerdekaan Menyampaikan Pendapat di Muka Umum, sehingga pada dasarnya, demontrasi diizinkan secara hukum, namun harus dilakukan dengan cara-cara yang beradab dan tidak dengan melanggar hukum. Terkait hal tersebut, bagaimana efektivitas peran kepolisian sebagai lembaga rule of law yang merupakan sarana kontrol sosial dalam mengemban nilai-nilai demokrasi akan dikaji dalam penelitian ini, dengan tujuan menganalisis hal tersebut. Metode penelitian yang digunakan yaitu metode yuridis-normatif, dengan pengkajian menggunakan pendekatan konseptual dan kasus. Adapun hasil penelitian ini menjelaskan bahwa peran kepolisian masih belum efektif, khususnya sebagai sarana kontrol sosial. Dalam hal ini, tindakan-tindakan preventif untuk mencegah agar tidak ada lagi demonstrasi yang berujung anarkis, seperti dengan mengadakan kegiatan pendidikan dan sosialisasi hukum, selama ini masih kurang, baik secara intensitas maupun kreativitas.

Abstract

Introduction to The Problem: The Sustainable Development Goals or SDGs are development goals in 2030 to carry out environmentally sound development, which explicitly aims to carry out development that is to meet environmental sustainability and is based on human rights. It is also an adaptation of the principles of the Stockholm Declaration 1972.Purpose/Objective Study: This research is to find the principles of environmentally sound development, both within the principles of international law and the SDGs principles, that are expected in future development policies to be carried out in the perspective of the right to the environment, both the central and regional governments.Design/Methodology/Approach: In this doctrinal law research, it is examined using the conceptual approach contained in the principles of development and environmental principles contained in the substance of international law.Findings: In the principles of international law, there are seven principles of sustainable development goals agreed by the international community in the Rio Conference as a guideline in implementing equitable development based on human rights, which also must be guided by the targets of sustainable development within the SDGs.Paper Type: Research Article

Abstract

Introduction to The Problem: The right to immunity in international law is a privilege granted to Diplomatic Officers in the context of carrying out missions, in particular, representing the state. The immunity rights of a Diplomatic Officer must be protected and respected by the recipient state as an obligation in diplomatic relations. The rights of immunity respected in customary international law under the 1961 Vienna Convention are inversely proportional to those stipulated in the 1998 Rome Statute regarding the abolition of immunity rights before the International Criminal Court. This thing then raises the status of immunity rights problems between the 1961 Vienna Convention and the 1998 Rome Statute of the International Criminal Court.Purpose/Objective Study: This study aims to examine the problematics of applying immunity rights for diplomatic officials, namely how the respect and protection of immunity rights regulated in the 1961 Vienna Convention and how the abolition of immunity rights held in the 1998 Rome Statute of ICC. This thing then looks for problems in immunity rights between the two conventions in practice and occurred-cases.Design/Methodology/Approach: This study used a normative research method. The assessment is carried out using a conceptual approach, a statute approach, and a case approach so that the relevance between the problem and the final purpose of this research is found.Findings: This study found several reasons regarding the status of immunity rights before the International Criminal Court, which raises the problem of weaknesses in international law related to immunity rights. The flaw was triggered due to the lack of legal certainty associated with the lack of hierarchy used in the provisions of international law. So that between the 1998 Rome Statute of ICC and the 1961 Vienna Convention, there was a dilemma in its application. Based on the case, the UN Security Council, as an international institution, influences the decision on how the status of the right to immunity can be applied or not.Paper Type: Research Article

Abstract

The Village Forest Society Institution is present on the basis of the existence of a Joint Community Forest Management (CBFM) program from one form of Corporate Social Responsibility (CSR). This PHBM policy seeks to empower communities around forest areas with managed areas under the authority of Perum Perhutani in the Provinces of Central Java, East Java, West Java and Banten, except for conservation forests which are implemented to provide welfare efforts for forest village communities so that they can participate in enjoying the results. forest production through a sharing system based on SK. Directors of Perum Perhutani No.682 / KPTS / DIR / 2009 concerning Guidelines for Collaborative Forest Resource Management, Law on Forestry, Village Law, and other supporting legislation..The role of LMDH is needed so that the partnership system in PHBM is able to reach forest village communities through an institution that is formed as an institution that receives delegations from the central / regional government in the management of production forests in the area specified in PP No. 72 of 2010 concerning State Forestry Public Company. With the existence of this LMDH, it is ecpected to be able to provide welfare for the communites around the forest and jointly manage forests based on sustainable development, so that the sustainability and availability of forest resources for future generations can be maintained.

Abstract

The International Criminal Court is an international criminal justice institution established in the context of struggle against impunity. Eighteen years of operation of the ICC since 2002, ICC experienced a case where the state it one by one withdraw from membership, such as South Africa, Burundi, Gambia and the Philippines, which is due to the inclusion of ICC investigations related to these state as well as several reasons related to the existence of discriminatory ICC judicial operations patterns. What is the implementation of ICC legal norms by state parties, and how the impact on the existence of ICC is what will be discussed in this study. The research method used is Socio-Legal Research, which examines the relationship between juridical and political aspects. The results of this study conclude some evidence related to the implementation of ICC legal norms by withdrawing party states, such as the background to ratifying the Rome Statute 1998, the implementation of the law, and the reasons for withdrawing the country, as well as some juridical and political impacts affecting the existence of the ICC.

Abstract

Intervensi Militer merupakan tindakan campur tangan suatu negara yang diwujudkan dengan mengirimkan ekspedisi militer untuk menunjang suatu pemerintahan atau kelompok pemberontak, dimana hal ini tidak dapat dibenarkan menurut hukum internasional maupun didalam prinsip Jus Cogens. Tulisan ini bertujuan untuk mengkaji tindakan intervensi militer yang dilakukan Amerika Serikat terhadap Venezuela di tahun 2019 dengan maksud melakukan kudeta politik. Metode penelitian dalam penelitian ini adalah penelitian doktrinal, melalui conseptual approach dan case approach. Hasil penelitian yaitu : pertama tindakan intervensi militer merupakan sesuatu yang dilarang berdasarkan Pasal 2 ayat (4) Piagam PBB, namun jika dalam keadaan ancaman terhadap perdamaian internasional maka tindakan intervensi militer dapat dilakukan dalam batasan yang diberikan oleh Dewan Keamanan PBB sesuai Pasal 39 Piagam PBB. Kedua, dalam keadaan ancaman tindakan kudeta yang mempengaruhi kedaulatan negara, tindakan intervensi militer merupakan suatu pelanggaran menurut prinsip Jus Cogens sebagai norma hukum internasional dimana setiap negara harus saling menghormati kedaulatan suatu negara.
