Abstract

This study is entitled "The Authority of Tourism Village Management in the Perspective of Bali Provincial Regulation Number 4 of 2019 Regarding Desa Adat." The initial idea of this study originated from the norms in the formation of a tourist village so that the principles and objectives of tourism have not yet been achieved, especially the welfare of the local community, namely “Krama Desa Adat”, as implementers, implementers, conservationists and agricultural developers in Bali. Balinese culture as the main foundation of tourism development that is able to prosper the local community. This research focuses on two legal issues namely, How is the authority of the Provincial Government of Bali in preparing Local Regulations on Tourism Villages? How is the authority of Desa Adat in the management of Tourism Villages based on Regional Regulation Number 4 of 2019 About Desa Adat.?The research method that used in this thesis is normative legal research methods. Normative legal research is done by analyzed relevant legislation and literature. The approach used is statue approach and conceptual approach Both of these problems were examined using normative legal research methods and using relevant legal theories to analyze these problem.Based on the analysis, it is known that the Provincial Government has the authority to cerate Regional Regulations to guarantee legal certainty in organizing a Tourism Village in the Province so that it is in accordance with the principles and objectives of tourism, namely the welfare of the community, especially Krama Desa Adat.Keywords: Authority, Tourism Village, Tourism, Customary Village.

Abstract

ABSTRAK Kerja lembur adalah pekerjaan yang dilakukan oleh karyawan atau tenaga kerja yang melebihi jam kerja, atas perintah atasan. Perhitungan upah lembur di atur dalam Keputusan Menteri Tenaga Kerja Dan Transmigrasi Nomor 102 Tahun 2004 Tentang Waktu Kerja Lembur Dan Upah Kerja Lembur .Masih ada perushaan yang melakukan pelanggaran atau ketidak pastian terhadap pengaturan upah lembur. Meskipun di perusahaan tersebut memberikan atau tidak memberikan slip gaji, tidak di jelaskan bagaimana sebenarnya perhitungan upah lembur yang diterima. Penelitian ini menggunakan penelitian hukum empiris yaitu penelitian yang dilakukan dengan meneliti implementasi yang ada di lapangan berdasarkan aturan yang ada. Meneliti implementasi upah lembur terhadap tenaga kerja berdasarkan Keputusan Menteri Tenaga Kerja dan Transmigrasi Nomor 102 Tahun 2004 tentang Waktu Kerja Lembur dan Upah Kerja lembur pada PT. Puji Surya Indah dan bagaimana sistem pemberian upah yang ada pada perusahaan tersebut. Dengan cara melakukan penelitian langsung kelapangan sehingga peneliti mendapatkan data yang diperlukan dalam penelitian. Berdasarkan hasil penelitian disimpulkan bahwa Implementasi pemberian upah Lempur tenaga kerja pada PT. Puji Surya Indah Bali belum sesuai dengan peraturan yang ada dalam Keputusan Menteri Tenaga Kerja Dan Transmigrasi Nomor 102 Tahun 2004 Tentang Waktu Kerja Lembur dan Upah Kerja Lembur, karena jumlah upah lembur yang diberikan lebih kecil dari pada ketentuan aturan yang ada. Sistem pemberian upah lembur pada PT Puji Surya Indah Bali pemberian upah lembur tenaga kerja, upah lembur akan di rekap oleh bagian admin gudang, melaui data absen harian selama satu minggu akan diberikan setiap hari sabtu bersamaan dengan pemberian uang makan secara tunai. Kata Kunci : Upah Lembur, Kerja Lembur, Tenaga Kerja. ABSTRACT Overtime work is work performed by employees or workers who exceed working hours, on the orders of their superiors. The calculation of overtime wages is regulated in the Decree of the Minister of Manpower and Transmigration Number 102 of 2004 concerning Overtime Time and Overtime Wages. There are still companies that violate or are uncertain about overtime wage arrangements. Even though the company provides or does not provide salary slips, it is not clear how the actual calculation of overtime pay is received. This research uses empirical legal research, namely research conducted by examining the existing implementation in the field based on existing rules. Researching the implementation of overtime pay for workers based on the Decree of the Minister of Manpower and Transmigration Number 102 of 2004 concerning Overtime Work and Overtime Wages at PT. Praise Surya Indah and how is the wage system in the company. By conducting direct research in the field so that researchers get the data needed in the study. Based on the results of the study, it is concluded that the implementation of Lempur's wages for labor at PT. Puji Surya Indah Bali has not complied with the existing regulations in the Decree of the Minister of Manpower and Transmigration Number 102 of 2004 concerning Overtime Work and Overtime Wages, because the amount of overtime paid is smaller than the existing regulations. The overtime pay system at PT Puji Surya Indah Bali provides labor overtime wages, overtime pay will be recapitulated by the warehouse admin, through one week of daily absences data will be given every Saturday along with cash feeding. Abstract

This research is entitled "Community Based Tourism in Welcoming the New Normal Tourism Village in Bali Province". This research was motivated by the economic crisis that occurred in Bali Province, due to the outbreak of the corona virus. For the Province of Bali, tourism is the leading sector of the Balinese economy because the majority of Balinese people depend on the tourism industry directly or indirectly. The outbreak of the corona virus throughout the world has caused countries in the world to implement various policies to limit the space for their people, which have implications for the decline in tourism activities in Bali. Bali has 116 Tourism Villages which are now excellent tourist destinations amid the Covid- 19 pandemic. Tourist villages offer natural beauty more ideally visited in the midst of the Covid-19 pandemic compared to other tourist destinations. However, it turns out that until now the local government of the province of Bali has not had a norm in the formation of a tourist village, which implies difficulties in developing a Tourism Village, so it is necessary to construct norms that specifically regulate tourism villages by implementing the concept of community based tourism that promotes community participation. The formulation of the problem in this study, namely; 1. What is the authority of the Regional Government in developing the Tourism Village in Bali Province? 2. How is the development of a tourism village based on the concept of community based tourism in welcoming the new normal of Bali tourism? In this study, it is known that the local government of the province of Bali has the authority to construct tourism village norms as a guideline for organizing tourist villages in Bali Province. The provincial government of Bali is expected to form a Regional Regulation as a guideline for regencies / cities in developing tourist villages so that they can realize the tourism implementation objectives contained in article 4 of Law no. 10 of 2009 concerning Tourism.

Abstract

This reseach focuses to analyze the authority of the Desa Adat (traditonal village in Bali) in managing Balinese Culture Tourism, because Balinese Culture is the main attraction of Balinese tourism which is determined by the government as the main foundation in the development of Balinese tourism. Balinese culture is implemented, maintained and developed by the Balinese customary law community in Desa Adat, so that in this reseach the writer is interested in two legal problems; 1. What is the arrangement of village dualism in Bali to managing Balinese Culture Tourism? 2. What is the authority of Desa Adat in managing Balinese Culture tourism based on Regional Regulation Number 4 of 2019 regarding Desa Adat?. The research method used in this study is a normative research method with a focus on legislation and literature that is relevant to the research topic. Based on research study, there are several forms of villages in Bali are overlapping (Desa Adat and Desa Dinas).However, based on Regional Regulation Number 4 of 2019 regarding Desa Adat, the Desa Adat is authorized to manage tourist destinations which are the original right of the Adat Village moreover.

Abstract

This study aims to identify and elaborate the Non-Discrimination Principles of the GATS related to the use of foreign workers in the provisions of tourism. The main non-discriminatory principle used in this study is the principle of Most Favoured Nation (MFN) and National Treatment. Indonesia agreed to be bound on GATS by promulgating law Number 7 the year 1994 regarding the Ratification of Agreement on Establishing the World Trade Organisation, that ensures Indonesia to obedient non-discrimination principle on Indonesia’s regulations. As a member of GATS, Indonesia must submit a schedule of commitments that explain the types of services that are ready to apply the principle of non-discrimination. This research is a normative legal research by examining norms, principles, and related legal aspect of foreign labor in Indonesia. The authors found that there was a conflict of norms in the application of the GATS non-discrimination principle in Indonesian labor law in the trade of foreign labor services. Indonesia actually has its own sovereignty that can not be imposed by any party and in the application of GATS non-discrimination principle not by contradicting Pancasila and the 1945 Constitution of the Republic of Indonesia as the basis of the development of employment. Tulisan ini bertujuan untuk mengidentifikasi dan mengelaborasi Prinsip Non Diskriminasi GATs terkait penggunaan Tenaga Kerja Asing dalam ketentuan kepariwisataan. Prinsip non diskrimininasi yang utama digunakan dalam penelitian ini adalah prinsip Most Favoured Nation (MFN) dan National Treatment. Indonesia setuju untuk terikat pada GATS dengan meratifikasi Undang-Undang Nomor 7 tahun 1994 tentang Pengesahan Agreement Establishing The World Trade Organization yang mengikat Indonesia untuk mematuhi prinsip-prinsip non diskriminasi dalam pengaturan perdagangan jasa di Indonesia. Sebagai anggota GATS, Indonesia harus menyerahkan komitmen yang berisikan jenis perdagangan jasa yang siap menerapkan prinsip non diskriminasi. Penelitian ini merupakan penelitian hukum normatif dengan meneliti norma, asas, dan bahan-bahan hukum penunjang terkait tenaga kerja asing di Indonesia. Hasil studi menunjukkan bahwa ada konflik norma dalam penerapan prinsip non-diskriminasi GATS dalam hukum ketenagakerjaan Indonesia, khususnya dalam penggunaan tenaga kerja asing. Indonesia sebenarnya memiliki kedaulatan tersendiri yang tidak dapat dipaksakan oleh pihak manapun dan dalam penerapan prinsip non-diskriminasi GATS tidak boleh bertentangan dengan Pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 sebagai dasar pengembangan ketenagakerjaan.

Abstract

Kondisi perekonomian di Bali yang bergantung pada kegiatan pariwisata menjadi terpuruk sebagai dampak dari Covid-19. Hal ini menjadi pelajaran kepada setiap lapisan termasuk Desa Adat di Bali untuk bersama-sama menangani Covid-19. Penelitian ini bertujuan untuk menganalisis dan mengkaji implementasi otonomi Desa Adat serta mengelaborasi model sinergi yang tepat dalam rangka percepatan penanganan Covid-19. Hasil penelitian menunjukkan bahwa otonomi Desa Adat dalam penanganan Covid-19 ditempatkan pada peran strategis Desa Adat dalam pembentukan aturan hukum adat yaitu Pararem yang bertujuan untuk mengatur kehidupan masyarakat hukum adat Bali sesuai dengan hukum nasional yang berlaku di Indonesia. Hal ini menunjukkan model sinergi berlakunya hukum adat dan hukum nasional sesuai dengan konsep pluralisme hukum dan regulatory compliance.

Abstract

Bali is one of the most popular tourist destinations in the world. The tourism model that is developed in Bali is Bali Cultural Tourism which is based on the philosophy of Tri Hita Karana which is the source of the teachings of Hinduism. The rise of the phenomenon of illegal guides who are not certified in explaining the uniqueness of Bali's Cultural Tourism, has implications for the harassment of Balinese culture into the background of the writing of this study. This study focuses on examining the role of guides and government in preventing harassment of the Bali Cultural Tourism. In this research, there are two problem formulations studied; what are the competency certification procedures of guides in the Province of Bali and how is the supervision of the Government Guide in the Province of Bali. The research method used in this study is a normative research method with a focus on studying the legislation and literature relevant to the research topic. Based on the provisions of Article 15 of the Bali Province Regulation Number 5 Year 2016 Regarding Tour Guides, it is known that the authority of guide supervision is owned by the Governor of Bali Province which is carried out by the department. However, the provisions of Article 15 (5) of Regional Regulation of the Province of Bali Number 5 of 2016 concerning Guides mentioned that the Governor of the Province of Bali formed a team of guides to carry out supervision of guides. Furthermore, Bali Provincial Regulation Number 5 Year 2016 About Guides does not explain further the work mechanism of the supervisory team, therefore the government needs to form more stringent regulations relating to the supervision of guides to maintain the image of Bali's Cultural Tourism and provide legal protection to Certified tour guide in Bali Province.

Abstract

Preventing early childhood marriage (ECM) can protect children’s rights from the perspective of human rights. There are several rules regarding the age limit for marriage. In Indonesia, the minimum age for marriage is nineteen years. However, in fact, early child marriage is still relatively high, with the seventh highest ranking in the world. This study aims to elaborate on the rights of children, which ECM potentially violates, and to identify who is responsible for minimizing and/or combating this phenomenon. This normative legal research with a human rights approach occurs in the childhood protection context. The results show that ECM has implications for violations against the right to life, the right to education, the right to develop, and the right to health. Thus, more stringently applying international and national law and combining with local wisdom (Balinese Customary Law) in protecting children's rights in the context of preventing ECM can prevent ECM effectively and minimize violations of other children's rights. Moreover, it is believed that the responsibility to reduce and combat ECM not only belongs to the government but also to all stakeholders within the community, such as families, academics, the media, non-profit organizations, entrepreneurs, and customary.
