Abstract

Until the entry into force of the Rome Statute, the definition of the crime of aggression was not also found in it. This leaves the International Criminal Court (ICC) without jurisdiction over crimes of aggression. The absence of ICC jurisdiction over crimes of aggression has resulted in military aggression that has not been processed by the ICC during the time when the proxy war / cold war was initiated. This means that the violation of delicto jus gentium juice is allowed even after the ICC has been established. This study aims: (1) to identify and identify the definition, limitations, and jurisdiction of the ICC for crimes of aggression; and (2) to determine the enforcement of ICC jurisdiction over crimes of aggression after the Kampala Amendments were adopted into the Rome Statute. The research method uses a type of normative research with a statutory approach and a historical approach. The results show that the ICC's definition, limitations, and jurisdiction over the crime of aggression have existed in the Rome Statute since Kampala Amendments were adopted into the Rome Statute. However, until now the enforcement of the ICC's jurisdiction over crimes of aggression has not been carried out concretely.

Abstract

Limiting the freedom of judges in expressing legal logics in each particular case will only hinder the process of seeking true values of justice. This freedom does not mean being free without being accompanied by legal responsibilities. the philosophical aspect of the principle of freedom of judges, and the ideal model for the application of the principle of freedom of judges in Indonesia in the minimum rules straf system, is the subject that will be discussed in this article. The normative research method used in this article uses a statutory, historical and conceptual approach and uses primary and secondary legal materials that are presented descriptively. The conclusion obtained confirms that the aspect of judges' freedom philosophically in principle begins with the application of the division of powers namely, legislative, executive and judicial which is the philosophical basis that the judicial branch of power is an independent branch of power and judges have the freedom to make interpretations, legal findings based on the conscience and conviction of the judge. As for the straf minimum rules case, the ideal model for implementing the principle of judge freedom can be realized through the theory of balance, namely that judges in deciding cases are not based on the context of laws and regulations and must consider aspects of the judge's belief even though the decision is contrary to the law, but as long as it is related to the judge's belief, then it can be justified on the basis of the judge's freedom.

Abstract

Tujuan penulisan ini adalah mensosialisasikan secara tertulis tentang Musyawarah Lingkungan Hidup sebagai salah satu cara penyelesaian kerusakan lingkungan di Desa Tupa yang dilakukan oleh Tim Pengabdian Fakultas Hukum Universitas Negeri Gorontalo. Musyawarah Lingkungan Hidup merupakan strategi yang diatur dalam draf Peraturan Desa Tupa tentang Pelestarian Lingkungan Hidup sebagai perwujudan dari hasil yang ingin dicapai dalam pengabdian, yaitu terbentuknya dokumen kebijakan pemerintah desa tentang bagaimana penyelesaian kerusakan lingkungan dan kesadaran hukum masyarakat Desa Tupa Kecamatan Bulango Utara. Metode yang digunakan dalam mencapai tujuan tersebut adalah (1) Pendampingan Rancang Bangun Strategi Penyelesaian Kerusakan Lingkungan Desa Tupa; (2) Penyuluhan, Sosialisasi dan Diseminasi Percepatan Strategi Penyelesaian Kerusakan Lingkungan dan Kesadaran Hukum Masyarakat Desa Tupa; (3) Launching Pembentukan Kelompok Gerakan Masyarakat Sadar Hukum Desa Tupa. Dalam pelaksanaan Program Pengabdian  dapat ditarik kesimpulan bahwa meskipun telah terdapat beberapa peraturan baik di tingkat pusat maupun daerah terkait pengelolaan lingkungan hidup dan pengelolaan hutan, namun peraturan tersebut belum dapat mengatasi kerusakan lingkungan di Desa Tupa. Selan itu, peran serta semua pihak terkait, khususnya masyarakat merupakan poin utama dalam penyelesaian kerusakan lingkungan. Terakhir, pembentukan Musyawarah Lingkungan Hidup sebagai wadah masyarakat Desa Tupa untuk melestarikan lingkungan hidup merupakan salah satu strategi yang dapat digunakan menyelesaikan permasalahan kerusakan lingkungan di Desa Tupa. The purpose of this writing is to socialize in writing about the Environmental Consultation as a way to resolve environmental damage in Tupa Village, which was carried out by the Community Service Team of the Faculty of Law, State University of Gorontalo. The Environmental Deliberation is a strategy regulated in the draft Tupa Village Regulation on Environmental Preservation as a manifestation of the results to be achieved in community service, namely the formation of a village government policy document on how to resolve environmental damage and raise the legal awareness of the people of Tupa Village, North Bulango District. The methods used in achieving these objectives are: (1) assistance in the design of environmental damage settlement strategies for Tupa Village; (2) Counseling, socialization, and dissemination of the acceleration of environmental damage settlement strategies and legal awareness of the Tupa Village community; (3) Launching of the Formation of the Tupa Village Law Aware Community Movement. In the implementation of the Community Service Program, it can be concluded that although there have been several regulations both at the central and regional levels related to environmental management and forest management, these regulations have not been able to overcome environmental damage in Tupa Village. In addition, the participation of all related parties, especially the community, is the main point in solving environmental damage. Finally, the formation of an environmental conference as a forum for the Tupa Village community to preserve the environment is one of the strategies that can be used to solve the problem of environmental damage in Tupa Village.

Abstract

Badan Usaha Milik Desa (selanjutnya ditulis BUMDes) merupakan elemen yang ada di desa yang dapat menjadi lokomotif perekonomian desa. Oleh sebab itu, dibutuhkan adanya berbagai langkah diantaranya salah satunya adalah kegiatan pengabdian masyarakat yang dilakukan oleh Perguruan Tinggi dalam memberikan serta menghadirkan solusi permasalahan yang ada di desa. langkah yang dapat dilakukan oleh perguruan tinggi adalah dengan melakukan langkah preventif dan pengawasan, dimana langkah preventif dapat dilakukan dengan pemetaan permasalahan, penyuluhan dan pelatihan dalam mengatasi persoalan tersebut. Sementara itu, perihal pengawasan dapat melibatkan seluruh masyarakat yang ada didesa dengan sebelumnya telah mendapatkan penyuluhan dan pelatihan yang dimaksud. Merujuk pada persoalan tersebut, maka pemecahan masalah di atas melalui Program Pengabdian dengan menetapkan tema “Pengawasan Dan Pendampingan Dana Desa Dalam Mewujudkan Transparansi Badan Usaha Milik Desa (BUMDes) Saripi” dengan beberapa kegiatan yaitu; a. Penyusunan dan Penetapan Raod Map pengelolaan BUMDES, b. Penyuluhan Hukum, serta c. Dan Pelatihan dan pembentukan promosi pengelolaan BUMDES melalui media digital. Keseluruh program tersebut melibatkan seluruh unsur yang ada didesa, mulai dari pengelola BUMDES, pemerintah desa, hingga masyarakat desa dengan menghasilkan kajian berupa pengawasan masyarakat merupakan bentuk pengawasan partisipatif sebagai pemegang tertinggi kedaulatan rakyat serta pendampingan dalam pelaksanaan pengelolaan dana desa yang dapat dilakukan oleh Kejaksaan menjadi bentuk lain dalam mewujudkan transpransi pengelolaan dana desa termasuk pengalokasian dana untuk pengembangan BUMDes

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis Kompetensi Absolut Peradilan Militer yang tertuang dalam Pasal 9 angka 1 Undang-Undang Nomor 31 Tahun 1997 tentang Peradilan Militer (HAPMIL) berkaitan dengan implementasi prinsip-prinsip negara hukum Indonesia khususnya asas equality before the law. Kemudian sebagai salah satu upaya ius constituendum hukum positif di Indonesia. Penelitian ini tergolong dalam penelitian normatif dengan pendekatan perundang-undangan, pendekatan historis dan pendekatan konseptual. Bahan penelitian dihimpun melalui studi dokumen, kemudian dianalisis secara preskriptif. Hasil Penelitian menunjukkan bahwa Kompetensi absolut peradilan militer khususnya Pasal 9 Angka 1 HAPMIL atau khususnya dalam perkara pidana menegaskan peradilan militer memiliki kompetensi untuk mengadili tindak pidana didasarkan pada subjek (pelaku), yaitu prajurit (militer) atau yang dipersamakan. Dengan kata lain, selama pelaku adalah militer, dan melakukan tindak pidana apa saja akan diadili di peradilan militer. sekalipun pelaku tindak pidana bukan prajurit atau yang dipersamakan dengan prajurit akan tetapi melakukan tindak pidana di mana tindak pidana tersebut merugikan kepentingan militer serta dilakukan semata-mata dengan militer (perkara koneksitas) dapat diadili di peradilan militer. Kompetensi absolut peradilan militer tersebut bertabrakan dengan ketentuan yang tertuang dalam Pasal 3 ayat 4 (a) TAP MPR Peran TNI/POLRI, Pasal 25 Ayat (4) UU KK dan Pasal 65 Ayat (2) UU TNI yang merupakan bentuk perwujudan dari asas persamaan di hadapan hukum atau equality before the law yang tertuang dalam Pasal 27 Ayat (1) UUD 1945. Konsepsi tindak pidana militer sebagai kompetensi absolut peradilan militer dalam perkara pidana dapat mengacu pada ketentuan Pasal 3 ayat 4 (a) TAP MPR Peran TNI/POLRI, Pasal 25 Ayat (4) UU KK dan Pasal 65 Ayat (2) UU TNI di mana apabila prajurit melakukan tindak pidana umum akan tunduk pada peradilan umum namun bilamana prajurit melakukan tindak pidana militer akan tunduk pada peradilan militer. Ketika suatu tindak pidana yang dilakukan oleh militer tidak dapat ditentukan apakah merupakan tindak pidana militer atau tidak, maka dapat mengacu pada prinsip yang dipakai dalam perkara koneksitas yang tertuang dalam Pasal 90-91 KUHPM.Untuk dapat menjadikan tindak pidana militer sebagai kompetensi absolut peradilan militer dalam perkara pidana, mesti dilakukan revisi terhadap Hukum Acara Pidana Militer. Kata Kunci : Tindak Pidana Militer; Kompetensi Absolut; Peradilan Militer.

Abstract

This research examines the Implementation of the Law of Evidence: Comparative of the State of Indonesia and the United States of America. This study aims to analyze the application of evidence in Indonesia and the United States. This study uses normative research methods. The results of this study explain that there is a comparison between the application of evidence before and during the process in trials between the two countries, but over time and Indonesian law has implemented several processes in evidence that were previously used by the United States. It is hoped that lawmakers in Indonesia will be able to quickly find a new law that will not hinder the process of proof, and will not complicate the judiciary.

Abstract

Through Article 2 paragraph (1) of Law of the Republic of Indonesia Number 1 of 2023 concerning the Criminal Code (National Criminal Code), customary law opportunities are open to existing through the prerequisites contained in the Explanation to Article 2 paragraph (1). For this reason, this study aims to determine the opportunities for the existence of Gorontalo customary law through the prerequisites contained in the Explanation of Article 2 paragraph (1) of the National Criminal Code. This research uses normative legal research methods with a statutory approach and conceptual approach and uses primary, secondary and tertiary legal materials. The legal material is then analyzed qualitatively using grammatical, systematic, and historical interpretations. The results showed that Gorontalo customary law exists through the presence of several regional regulations, including (1) Gorontalo Provincial Regulation Number 2 of 2016 concerning the Implementation of Customary Institutions; (2) Gorontalo Mayor Regulation Number 10 of 2020 concerning the Implementation of the Dulohupa Customary Institution of Gorontalo City; and (3) Regional Regulation of Bone Bolango Regency Number 8 of 2020 concerning the Implementation of Customary Institutions. Furthermore, through regulations at the regional level, Gorontalo customary law is also present through concrete events such as the management of customary institutions carried out periodically. Based on this, the regulation of concrete norms related to acts prohibited under living law in regional regulations as required by the Explanation to Article 2 paragraph (1) of the National Criminal Code will have a very large opportunity.

Abstract

The research objective is to find out the role of investigators in the umrah scam in Gorontalo and the factors causing the umrah scam in Gorontalo. The method used in this current research is empirical legal research. The research findings show that the Umrah scam cases in Gorontalo increase in, and they are not only committed by unlicensed travel agencies but also those who have obtained permits. There are various forms of scam, ranging from cancellation of departure, abandonment of pilgrims to promise breaking of Umrah travel service providers so that pilgrims experience disappointment. In this case, there has been an increasing number of detrimental cases against Umrah pilgrims, including in Gorontalo. In addition, the factors that cause hajj and umrah travel scam are divided into several types including: factors originating from the perpetrator, family factor, economic factor, environmental factor, cultural factor, and community factor or victims. In the meantime, the roles of police or investigators in dealing with hajj and umrah travel scam are to conduct examination of potential suspects and witnesses who corroborate a report, and conduct a review of the scene of the case after having a strong testimony from witnesses and then carry out an investigation. Also, the police’s efforts are to enlighten and do socialization from the Ministry of Religious Affairs and the people related to the office regarding the list of travel that has a permit as an Umrah Travel Organizer.

Abstract

Disparity is the difference in deciding one case with another, this is often a question in a society about how this disparity can occur, which is when there is one case that is the same, but the way of giving sanctions is different, this also causes a Indonesian law is questioned whether the sanctions or punishments are appropriate or not and whether justice exists or not. This distinction will also stem from how a decision has been made by a judge, which basically judges give punishment based on several aspects, and where judges also have authority to decide a case. The purpose of this research is to find out what disparity is, and how considerations and legal aspects are used to decide a case. In this case, there is a disparity that will be discussed regarding the Disparity in Judges' Decisions Against the Crime of Defamation on Social Media (Analysis of Decisions Number 755/Pid.Sus/2020/Pn.Gtlo and 331/Pid.Sus/2019/Pn Gtlo). Where the method used is qualitative research with a statutory approach, conceptual approach, and a comparative approach and this type of research is normative juridical research.

Abstract

One of the crimes of physical violence was ever committed by a child until the victim died, as the child who committed physical violence resulted in the death of the victim. For the actions committed by the child as the perpetrator of the crime, the judge sentenced the child to 4 years in prison. The purpose of this research is to find out the factors that cause children to commit crimes of physical violence that result in death, criminal responsibility by children who commit physical violence that result in death, as well as the application of sanctions to children who commit crimes of physical violence that result in death. The type of research used is normative juridical research with a statutory approach and a case approach, which is supported by data obtained from library data including books, laws and regulations, and court decisions, and in this case the data is processed using qualitative analysis. Based on the results of the study, the factors that cause children to commit crimes of physical violence which result in death are due to several factors, both internal and external factors. Criminal liability by children who commit physical violence resulting in death can be seen from the provisions in Article 351 paragraph (3) of the Criminal Code, as the criminal responsibility is imposed on children when the child is proven to have fulfilled the criminal elements in the form of mistakes made by children, violence The physical violence that was done was done by the child, and the victims who were victims of physical violence were known to have died during or after the physical violence was carried out. The application of sanctions to children who commit acts of physical violence resulting in death, namely imposing prison sanctions on children, therefore, is sentenced to 4 years in prison.
