Penelitian ini bertujuan untuk mengetahui Akuntabiitas Badan PermusyawaratanDesa Banjarsari di dalam menjalankan tugas dan fungsinya sebagai perwakilanmasyarakat desa,apakah sikap arogansinya menolak memberikan dokumenAPBDes di benarkan oleh Undang-Undang, Penelitian ini juga untuk mengetahuisejauh mana peran kepala desa di dalam menjalankan fungsinya sebagai pelayanmasyarakat, apakah mampu bersikap transparan dan terbuka di dalam pengelolaankeuangan desa.Dengan penolakan yang dilakukan BPD Terhadap permintaanpeneliti meminta dokumen APBDes dan Perdes tahun 2019 yang hendak di jadikanobjek penelitian, maka peneliti semakin penasaran dengan sikap tertutup kepaladesa dan BPD Banjarsari. Apa yang sebenarnya terjadi dibalik sikap tertutupnyadua punggawa desa tersebut? Apakah memang sudah terjadi penyalahgunaanwewenang? Atau memang dana desa tersebut memang sudah mereka korupsi?Diperlukan penelitian yang lebih serius untuk membuktikan kebenaranya. Abstract

This paper aimed to examine the severity of the recession experienced by Indonesia during the COVID-19 outbreak that has hit Indonesia, which has been going on for almost a year. For the discussion to be more focused, this study focuses on the government's policy and strategy efforts that have been implemented to overcome this crisis. To achieve the target of this study, we first collected preliminary reading material by reviewing articles about recession due to pandemics to obtain sufficient information related to the study plan. After the opening section is over, we next provide an overview of how we can convey an understanding of the recession and the reasons behind it. We then proceed to the middle of the study to conclude what findings are relevant. Before completing the results, we confirm that the findings of this study are valid and reliable. Finally, the findings can be summarized as follows: Recession has hit the national economy so that the government has adopted a policy of allocating fresh funds as a stimulus to the most affected residents. Another strategy from the government is to work with outside parties on systems to anticipate Covid-19 and face the risk of a domestic recession.

Abstract

ABSTRAKDari hasil penelitian ini dapat dikemukan sebagai berikut: (1). Pengaturan mengenai perlindungan hukum terhadap warga masyarakat dan penghormatan hak masyarakat atas pengelolaan sumberdaya tanah telah diatur dalam Pasal 18 B UUD 1945 (sebagai hak konstitusional), Pasal 28l UUD 1945 dan UU No. 39 tahun 1999 (sekaligus hak asasi manusia) Dalam penjelasan pasal 22 UUPA telah di jelaskan bahwa cara perolehan hak milik bisa saja dengan melakukan pembukaan tanah. Cara tersebut sebenarnya dimungkinkan menurut hukum adat. Karena dasar hukum agraria nasional adalah mendasarkan diri pada hukum adat (lihat pasal 5 UUPA). (2). Pelaksanaan perlindungan hukum terhadap warga masyarakat pemilik tanah masih jauh dari harapan, hal ini terlihat dari perlakuan pemerintah dan aparat keamanan yang melakukan penggusuran terhadap mereka dan rumah-rumah tempat tinggalnya dirobohkan dan beberapa orang warga masyarakat yang bersikeras bertahan ditangkap dan ditahan oleh aparat dengan dalih bahwa mereka telah memasuki tanah tanpa ijin pemilik yang sah. Pada hal merekalah yang pertama kali menghuni tanah tersebut sebagai tempat tinggal dan tempat penyambung hidupnya.Kata Kunci: Perlindungan Hukum Pemilikan Hak Atas TanahABSTRACTFrom the results of this study can be found as follows: (1). Regulations regarding legal protection of community members and respect for community rights over land resource management have been regulated in Article 18 B of the 1945 Constitution (as a constitutional right), Article 28l of the 1945 Constitution and Law No. 39 of 1999 (as well as human rights) In the explanation of article 22 of the BAL it has been explained that the method of acquiring property rights could be by carrying out land clearing. This method is actually possible according to customary law. Because the basis of national agrarian law is to base itself on customary law (see article 5 of the BAL). (2). The implementation of legal protection for the landowners is still far from expectations, this can be seen from the treatment of the government and security forces who carried out evictions against them and the houses where they lived were demolished and several community members who insisted on surviving were arrested and detained by the authorities on the pretext that they have entered the land without the permission of the rightful owner. In this case they were the first to inhabit the land as a place to live and a place to connect their lives.Keywords: Legal Protection of Ownership of Land Rights

Abstract

ABSTRAKFenomena Kriminalitas Remaja sudah menjadi pembicaraan umum baik di lingkungan Masyarakat, Pemerintah maupun Penegak hukum, dimana banyak sekali remaja yang melakukan tindak kriminal baik dilakukan secara sendiri ataupun secara berkelompok. Hal ini memerlukan adanya perhatian khusus serta penanganan yang tepat terhadap perilaku remaja tersebut. Peran Kepolisian sebagai Penegak Hukum dan masyarakat sekitar sangatlah penting demi terciptanya harapan untuk membimbing para remaja agar dapat berperilaku baik di dalam berkehidupan bermasyarakat. Di dalam jurnal ini penulis mencoba membahas masalah tindak kriminalitas yang dilakukan oleh para remaja yang terjadi di kota depok, antara lain; apa yang menjadi faktor penyebab perilaku remaja tersebut, apa upaya yang harus dilakukan untuk mengatasi masalah tersebut, dan bagaimana aspek hukumnya. Dengan demikian diharapkan angka kriminalitas yang dilakukan oleh para remaja khususnya di kota Depok dapat diminimalisir.Kata kunci : Remaja, kriminalitas, aspek hukum.ABSTRACTThe phenomenon of juvenile crime has become a public discussion both within the community, government and law enforcement, where a large number of adolescents who commit crimes both carried out individually or in groups. This requires special attention and proper handling of the adolescent's behavior. The role of the Police as Law Enforcement and the surrounding community is very important for the creation of hopes to guide teenagers to behave well in the community life. In this journal the author tries to discuss the problem of criminal acts committed by adolescents that occurred in Depok, among others; what are the factors causing the adolescent's behavior, what efforts must be made to overcome the problem, and how the legal aspects. Thus it is expected that crime rates committed by adolescents, especially in the city of Depok can be minimized.Keywords: Teenagers, crime, legal aspects.

Abstract

Pelaksanaan pemutusan hubungan kerja yang dilakukan oleh perusahaan harus sesuai dengan undang- undang no 13 tahun 2003 tentang ketenagakerjaan yang mennyatakan bahwa pemutusan hubungan kerja dilakukan dalam beberapa proses yaitu mengadakan musyawarah antara karyawan dengan perusahaan, bila menemui jalan buntu maka jalan terakhir adalah melalui pengadilan untuk memutuskan perkara. Akan tetapi pada kenyataanya sering terjadi pemberhentian dengan pemecatan tanpa adanya alasan yang jelas, Seharusnya pemecatan karyawan harus berdasar kepada peraturan dan perundang- undangan karena setiap karyawan mendapat perlindungan hukum sesuai dengan statusnya. Permasalahan dalam tulisan ini yaitu Bagaimanakah perlindungan hukum terhadap tenaga kerja yang di PHK secara sepihak menurut Undang-undang No. 13 Tahun 2003 tentang Ketenagakerjaan? Dan Bagaimana pertimbangan hakim dalam putusan nomor: 155/Pdt.Sus-PHI/2015/PN.JKT.PST? Dalam karya ilmiah ini metode penelitian yang digunakan adalah penelitian hukum normatif yaitu mengandalkan data sekunder sebagai sumber data utama. Hasil penelitian menunjukkan bahwa dalam putusan Majelis Hakim pada putusan Nomor 155/Pdt.Sus-PHI/2015/PN.JKT.PST, dalam pertimbanganya menyebutkan bahwa Pemutusan Hubungan Kerja secara sepihak oleh Rs. Royal Taruma terhadap Analisa Paulina Kartika melanggar hukum dan tidak sesuai dengan Undang-undang Nomor 13 tahun 2003 tentang ketenagakerjaan. Dan tanggung jawab perusahaan terhadap tenaga kerja yang telah diPHK dimana dalam undang-undang mengharuskan atau mewajibkan perusahaan untuk memberikan uang pesangon, uang penghargaan, dan uang penggantian hak.

Abstract

This study investigates the discrepancy between what should have happened during the development of the omnibus law on the work of the work and the policies relating to the Covid-19 epidemic in Indonesia and what really occurred. When the Omnibus Law and policies in the Pandemic Covid-19 are supposed to be a powerful solution to the problem, reality transforms into a field of new issues that generate a flood of negative comments from diverse individuals, resulting in a loss of faith in the government. The Omnibus Law and Covid-19 policies, which the Government and Parliament interpret as a progressive breakthrough for resolving multisectoral problems during the presidency of President Joko Widodo, are interpreted differently by some community circles and academics as laws and disabled policies, both formal and material. As a result, the aim of this study is to investigate the essence of Omnibus Law and Covid-19 policies, which have created a challenge for the Indonesian country by eroding community faith in the government.

Abstract

Indonesia declares a state of emergency due to Pandemic Covid-19. Indonesia declared a state of health emergency in 2020 via Presidential Decree No. 11. Numerous measures have been undertaken to mitigate the consequences of the Covid-19 epidemic. Vaccination is one of the government's attempts. However, in the prosocity of vaccination-related benefits and drawbacks. Numerous individuals refused to be vaccinated. This research is legal in nature and is doctrinal in nature. It employs a conceptual method and a legislative approach (statue approach) to the handling of Pandemic Covid-19 in Indonesia. The study's findings show that immunizations are provided free of charge, which, while initially a right of each citizen, may become a responsibility in light of Indonesia's present state of health emergency. This is possible because an individual who is not vaccinated has the ability to transfer the disease to others.

Abstract

The entry of foreign national citizens (foreigners) into Indonesia when emergency public activity restrictions are enacted jeopardizes citizens' rights, including the freedom of movement within the country. The aim of this study is to ascertain whether there was prejudice against citizens when the emergency public cactivity restrictions (PPKM) was at stake regarding foreign national citizens' (foreigners') admittance into Indonesia. The descriptive method combined with a literature review was employed in this investigation (literature study). This legal study employs secondary primary law materials in the form of legislation containing discussions of legal topics and legal publications such as textbooks, legal dictionaries, legal journals, and other legal literature. The findings of this study reveal that when limits on community activities are enacted, the entry of foreign citizens (foreigners) into Indonesia becomes a productive contraption, as it may jeopardize the lives of Indonesian locals.

Abstract

Since the beginning of 2021, the Indonesian government's policy has been to enforce public activity restrictions (abbreviated as PPKM) in order to deal with Covid-19 pandemics in Indonesia. Public activity restrictions (PPKM) are in place in various places that are hotspots for Covid-19 infection, most notably on the Indonesian island of Java and Bali. The government took this effort to slow the spread of Corona Virus, or Covid-19. Prior to the implementation of this public activity restriction (PPKM) program, the government imposed large-scale social restrictions (PSBB) or lockdown zones in a number of places throughout Indonesia. The government was fully supported in implementing these public activity restrictions (PPKM) by the Indonesian National Armed Forces (TNI), Police, and municipal police units (Satpol PP) as part of the Covid-19 Task Force. How effective these public activity restrictions (PPKM) are remains an open question for all stakeholders. However, the reality is that there are still numerous singers between the community and the Task Force on public activity restrictions (PPKM), resulting in damage to the community and a negative influence on society. Numerous human rights breaches and actions that contradict the nation's ideology, specifically Pancasila, result in a fall in community faith in the government.

Abstract

This Covid-19 pandemic has elevated Indonesia to emergency status, prompting the government to implement an emergency PPKM policy, as detailed in Minister of Home Affairs Instruction 15 of 2021 on the enactment of restrictions on community activities in the Java and Bali provinces. However, the strategy does not imply that the government is abdicating its duty for all facets of citizens' life. This legal research examines the laws and regulations governing the treatment of the Covid-19 epidemic in Indonesia using the conceptual approach and the statute approach. This legal research draws on secondary primary law sources, including statutes and regulations pertaining to the legal topics covered, as well as legal publications such as textbooks, legal dictionaries, legal journals, and other legal literature.
