Abstract

Problems partners in the Community Service activities are the lack of public knowledge Kelurahan Kampung Melayu Kecamatan Sukajadi Kota Pekanbaru on mediation procedure in court. The solution offered in community service activities are increased knowledge of Kelurahan Kampung Melayu Kecamatan Sukajadi Kota Pekanbaru on mediation procedure in court. Method of implementation of Community Service is using lectures, dialogues and discussions in the framework of legal counseling on increased knowledge of Kelurahan Kampung Melayu Kecamatan Sukajadi Kota Pekanbaru on mediation procedure in court. Partner participation in the activities of Community Service is to provide the time, providing a place and other supporting facilities, and represents the community as participants legal counseling on increased knowledge of Kelurahan Kampung Melayu Kecamatan Sukajadi Kota Pekanbaru on mediation procedure in court. Target outcomes of Community Service activities are the publication of scientific articles in the Journal of Law Respublica, as well as part of the implementation of the Tri Dharma college. The conclusion was that community service activities have been successfully implemented and the benefits can be felt directly by the participants, namely to increase public knowledge Kelurahan Kampung Melayu Kecamatan Sukajadi Kota Pekanbaru on mediation procedure in court. It can be seen from the answers of the participants in the questionnaire given after the implementation of the activities. Of the 31 participants, 95% answered have understood. Her advice is preferably routine activities with this theme carried out in other villages so that people can know and understand about the mediation procedure in court, especially after birth of Supreme Court Regulation No. 1 Year 2016 on Procedures for Mediation in the Court.

Abstract

Companies that run their business causing pollution to the environment and society, such as air and water pollution, are required to carry out social and environmental responsibility (Corporate Social Responsibility / CSR). This paper intends to analyze the implementation of CSR in the context of optimizing environmental preservation, obstacles and legal efforts. This research is a normative legal research assisted by sociologist. The main data sources used in this study are secondary data and primary data only as secondary data support. The primary data were obtained at the study site in Pekanbaru, Riau. Data collection techniques used in this study are literature studies and field studies. The data analysis technique used in this study is qualitative analysis. Basically, companies that carry out pollution have implemented CSR, but the implementation has not generally met the expectations of the community because it is not comparable with pollution and environmental damage caused by the company's operational activities. The obstacle from the company side is the limited budget of CSR funds owned to be able to meet all the needs of the community, while from the community side is the lack of public legal awareness about CSR. Legal remedies that can be taken by the community when the company does not implement CSR is that the community can express their aspirations to the central, regional and local provincial DPRD so that the company is recommended to receive administrative sanctions or to report to law enforcement. Abstract

Berdasarkan Pasal 78 Undang-Undang Nomor 13 Tahun 2003 ditegaskan bahwa perusahaan yang mempekerjakan tenaga kerjanya melebihi waktu kerja sebagaimana yang diatur pada Pasal 77 undang-undang tersebut wajib membayar upah kerja lembur. Penelitian ini bertujuan untuk menjelaskan pelaksanaan upah kerja lembur pada PT Asia Forestama Raya berdasarkan Keputusan Menteri Tenaga Kerja dan Transmigrasi Republik Indonesia Nomor Kep.102/Men/VI/2004 tentang Waktu Kerja Lembur dan Upah Kerja Lembur. Metode yang digunakan dalam penelitian ini adalah penelitian hukum sosiologis. Hasil penelitian menjelaskan bahwa PT Asia Forestama Raya tidak membayarkan upah kerja lembur kepada buruh pabriknya yang telah bekerja melebihi jam kerja sebagaimana yang diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Hambatannya karena kondisi keuangan perusahaan tersebut saat ini sedang dalam keadaan yang tidak stabil serta adanya kesepakatan antara manajemen perusahaan dan buruh pabrik bahwa PT Asia Forestama Raya tidak mampu untuk membayarkan upah kerja lembur kepada buruhnya. Penyelesaian hukumnya apabila PT Asia Forestama Raya tidak membayar upah kerja lembur kepada buruhnya yang telah bekerja melebihi jam kerja, maka perusahaan tersebut dapat dikenakan sanksi pidana berdasarkan Pasal 187 Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan.

Abstract

Abstract: In principle, the relationship between the bank and its customers are saving money in the bank based on the relationship of trust, so that each bank is required to have to continue to maintain the level of health. Solutions that can be taken by the banks, both conventional banks and Islamic banks, to maintain the existence and level of health is with the implementation of the principles of good corporate governance. Therefore, it is interesting to examine the comparison of implementation of the principles of good corporate governance in conventional banks and Islamic banks. The method used in this study is a normative legal research. This research use approach legislation. The results showed that in essence, the implementation of the principles of good corporate governance in conventional banks and Islamic banks are the 'same', because it refers to the "Code of Good Corporate Governance Indonesian Banking" issued by the National Committee on Governance (NCG). The fundamental difference lies in Islamic principles used by Islamic banks. In addition to guided and supervised by the Financial Services Authority as conventional banks, Islamic banks are also supervised by the National Sharia Board MUI and Sharia Supervisory Board who served in each Islamic bank. Abstract

Sharia banks are banks that carry out their business activities based on the principles of Islamic law in banking activities based on fatwas issued by the National Sharia Council of the Majelis Ulama Indonesia. This research aims to explain the Good Corporate Governance principles in Indonesia sharia banking. The method used in this research is normative legal research. The results of the research explained that to maintain the trust of Indonesian people who are predominantly Muslim, sharia banking must apply the Good Corporate Governance principles in its management. The application of the Good Corporate Governance principles in sharia banking is strictly regulated in Article 34 Paragraph (1) of Law Number 21 of 2008, which emphasizes that sharia banks must implement good governance that includes the principles of transparency, accountability, responsibility, professionalism and fairness in carrying out its business activities. Form of application of the Good Corporate Governance principles in sharia banking is supervision conducted by the National Sharia Council of the Majelis Ulama Indonesia in general and the Sharia Supervisory Board specifically in each sharia bank.

Abstract

PT Asia Forestama Raya is a forest product processing factory for the wood industry's raw materials. Based on Article 74 Paragraph (1) of Law Number 40 of 2007 concerning Limited Liability Companies, it is stipulated that companies that carry out their business activities in the natural resources sector and / or fields related to natural resources are required to implement CSR. In Article 10 of Riau Provincial Regulation Number 6 of 2012 concerning Corporate Social Responsibility in Riau Province, it is stated that CSR programs can take the form of community economic empowerment. This research aims to explain the implementation of PT Asia Forestama Raya's CSR on community economic empowerment during the Covid-19 pandemic. The method used in this research is socio-legal research. During the Covid-19 pandemic, the public really expected a real contribution from PT Asia Forestama Raya. PT Asia Forestama Raya's obstacle in implementing community economic empowerment in Limbungan Village is that the financial condition of PT Asia Forestama Raya is currently in an unstable state. Efforts that can be made by the people of Limbungan Village if PT Asia Forestama Raya doesn’t carry out a CSR program are to convey their aspirations to Commission IV of DPRD Pekanbaru City. Based on Article 32 of Riau Provincial Regulation Number 6 of 2012 concerning Corporate Social Responsibility in Riau Province, it is stated that if PT Asia Forestama Raya doesn’t carry out CSR towards empowering the community's economy, the company can be subject to administrative sanctions by the Pekanbaru City Government.

Abstract

This research aims to explain the influence of law on the social dynamics of society. The method used in this research is normative legal research. One of the sciences that studies the social dynamics of society is the Sociology of Law. Every dynamic that occurs as a result of social change requires a legal response. Social dynamics is a general phenomenon that occurs throughout the ages in every society, changes that occur in accordance with the nature and nature of humans who always want to make changes. The occurrence of social dynamics is influenced by several factors, including law, technology, community structure, culture, an open system of social stratification, and advanced education. Community institutions are considered truly valid if their norms fully assist the implementation of social patterns. The system of social layers can occur by itself or is deliberately structured to pursue a common goal. Legal coercion in the implementation of social institutions that apply as regulations is not always used. Instead, the emphasis is on the coercion of society.

Abstract

Bank syariah adalah bank yang menjalankan kegiatan usahanya berdasarkan prinsipprinsip hukum Islam dalam kegiatan perbankan berdasarkan fatwa yang dikeluarkan oleh Dewan Syariah Nasional Majelis Ulama Indonesia. Penelitian ini bertujuan untuk menjelaskan prinsip Good Corporate Governance pada perbankan syariah di Indonesia. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Hasilpenelitian menjelaskan bahwa untuk menjaga kepercayaan dari masyarakat Indonesia yang mayoritas beragama Islam, maka perbankan syariah wajib menerapkan prinsip Good Corporate Governance dalam pengelolaannya. Penerapan prinsip Good Corporate Governance pada perbankan syariah diatur secara tegas dalam Pasal 34 Ayat (1) Undang-Undang Nomor 21 Tahun 2008, yang menegaskan bahwa bank syariahwajib menerapkan tata kelola yang baik yang mencakup prinsip transparansi,akuntabilitas, pertanggungjawaban, profesional, dan kewajaran dalam menjalankan kegiatan usahanya. Bentuk penerapan prinsip Good Corporate Governance pada perbankan syariah adalah pengawasan yang dilakukan oleh Dewan Syariah Nasional Majelis Ulama Indonesia (MUI) secara umum dan Dewan Pengawas Syariah secarakhusus di masing-masing bank syariah. Berdasarkan data Otoritas Jasa Keuangan tahun 2017, saat ini bank umum syariah di Indonesia berjumlah 13 bank, unit usaha syariah dari bank konvensional berjumlah 21 bank, dan bank pembiayaan rakyat syariah berjumlah 102 bank. Inilah bukti eksistensi dan perkembangan perbankan syariah yang  signifikan dalam sistem perbankan nasional.

Abstract

Bank adalah lembaga keuangan yang kegiatan usahanya yaitu menghimpun dana dari masyarakat, menyalurkan dana kepada masyarakat, dan memberikan pelayanan jasa keuangan. Salah satu kegiatan utama perbankan adalah menghimpun dana dari masyarakat dalam bentuk tabungan, deposito, dan giro. Masyarakat menyimpan dananya di bank karena percaya bahwa keamanan dananya tersebut akan jauh lebih terjamin daripada menyimpannya di dalam rumah. Menurut Kitab Undang-undang Hukum Perdata, dana nasabah yang disimpan di bank tidak termasuk ke dalam kelompok piutang yang diistimewakan apabila sebuah bank dinyatakan pailit. Permasalahan yang akan dibahas dalam penelitian ini adalah bagaimanakah perlindungan negara terhadap dana simpanan nasabah pada perbankan yang mengalami kepailitan? Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan. Sumber data yang digunakan dalam penelitian ini adalah data sekunder, yaitu data yang diperoleh dari peraturan perundang-undangan, jurnal-jurnal ilmiah, dan literatur hukum. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah studi kepustakaan. Teknik analisis data yang digunakan dalam penelitian ini adalah analisis kualitatif. Hasil dari penelitian ini adalah bahwa berdasarkan Undang-Undang Nomor 24 Tahun 2004 tentang Lembaga Penjamin Simpanan, perlindungan terhadap dana simpanan nasabah pada perbankan yang mengalami kepailitan dijamin oleh lembaga negara bernama Lembaga Penjamin Simpanan, bahkan hingga Rp2.000.000.000,- (dua miliar rupiah).

Abstract

At the time of the economic crisis in 1998, many conventional banks collapsed while Islamic banks were not affected. After the crisis, Islamic banking experienced significant development in Indonesia. The problem is what is the direction of policy regarding supervision of Islamic banking in the national banking system in Indonesia? The method used in this research is normative legal research using the statutory approach. Data sources used in this study are secondary data, namely data obtained from statutory regulations, scientific journals, and legal literature. The data collection technique used in this research is literature study. The data analysis technique used in this study is qualitative analysis. The results of this study are policies regarding supervision of Islamic banking in the national banking system in Indonesia towards a better direction. In Act Number 7 of 1992 and Act Number 10 of 1998 it is stated that supervision of Islamic banking is carried out by Bank Indonesia as the central bank. However, based on Act Number 21 of 2008, supervision of sharia banking is not only carried out by Bank Indonesia, but is also monitored internally by the Sharia Supervisory Board. After the ratification of Act Number 21 of 2011, supervision of Islamic banking moved from Bank Indonesia to an independent institution called the Financial Services Authority.
