Abstract

The development of Sharia Cooperatives in Indonesia has experienced a significant increase. Islamic cooperatives are one of the alternatives for some members who will build cooperatives based on several sharia principles. The establishment of sharia cooperatives has encountered conflicts, which are not only in Law Number 25 of 1992 on Cooperatives but are also regulated in Law Number 1 of 2013 concerning Micro Financial Institutions. The formulation of the problem of this research is to find legal clarity in the registration and establishment of a sharia cooperative legal body. The research system used in reviewing the registration and establishment of the legal body of Islamic cooperatives uses normative legal research, which is called library research. From the results of this research, the establishment of a sharia cooperative legal body still refers to Law Number 25 of 1992 concerning Cooperatives as replaced by Law Number 11 of 2020 concerning Job Creation. This is because the Microfinance Institution Law only states that the cooperative is a form of MFI legal entity and does not control in detail the cooperative. This system uses statutory provisions as special legal material and is supported by secondary legal materials in the form of books and journal articles.

Abstract

Tidak bisa dipungkiri lagi bahwa perkembangan koperasi syariah di Indonesia mengalami perkembangan yang signifikan. Lembaga ini berdiri dengan berkonsep menghindarkan dari unsur-unsur aktivitas maupun transaksi yang di dalamnya terdapat unsur maysir (judi), gharar (tidak jelas), risywah (suap), dan riba (bunga). Dalam aktifitas yang dilakukan oleh Koperasi Syariah, memiliki satu komponen yang dinamakan Dewan Pengawas Syariah. Penelitian ini dilakukan guna mengetahui aturan manakah yang tepat untuk menjadi landasan bagiu Dewan Pengawas Syariah pada Koperasi Syariah. Penelitian ini dilakukan oleh penulis dengan menggunakan metode penelitian hukum normatif. Dimana penelitian ini juga dilakukan dengan pendekatan Undang-Undang, serta dengan teknis analisis deskriptif kualitatif serta berdasarkan pada bahan hukum primer yaitu berupa Peraturan Perundang-Undangan dan didukung bahan hukum sekunder yaitu kajian kepustakaan seperti buku-buku dan jurnal-jurnal. Dari penelitian yang dilakukan bahwa dapat dilihat bahwa peraturan yang tepat untuk menjadi rujukan bagi Dewan Pengawas Syariah pada Koperasi Syariah ada pada Peraturan Perundang-Undangan terbaru. Hal ini dikaji dan diperdalam dengan menjelaskan asas-asas hukum yang menjadi teori dalam penelitian normatif ini.

Abstract

A building permit is a permit granted by a regional head to a building owner to construct a new structure, expand an existing structure, maintain existing facilities, and reduce the size of existing structures while adhering to all applicable technical and administrative standards. The requirements to apply a building permit had been governed in Article 7 of Banjarmasin City Regulation Number 15 of 2012 concerning Building Permits. The Investment and Integrated One-Stop Services Agency/DPMPTSP Banjarmasin City was the subject of this study. The research aimed to discover and examine the mechanisms for issuing a building permit and the roadblocks during the application process. This study employed empirical juridical research methods. The data gathered were then analyzed using descriptive qualitative methods, i.e., describing and interpreting data about societal conditions, attitudes, viewpoints, disputes between two or more situations, factual differences, and their impact on a position. The development of a planned and systematic method of granting building licenses in Banjarmasin had gone smoothly. However, there were impediments to the procedure and its implementation, making the process of granting building licenses difficult.
