Abstract

Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2017 tentang Perubahan atas Undang-Undang Nomor 17 Tahun 2013 tentang Organisasi Kemasyarakatan mendapat kritik karena membatasi kebebasan berserikat dan memberi peluang pemerintah untuk mencabut status badan hukum organisasi kemasyarakatan tanpa melalui putusan pengadilan. Berdasarkan perspektif demokrasi deliberatif, tidak adanya proses deliberasi dalam pembentukan hukum dapat membuka peluang represi negara terhadap masyarakat sipil. Selain itu, berdasarkan perspektif rule of law, tidak adanya deliberasi dalam proses pengundangan memperlemah basis legitimasi dalam pembentukan hukum. Analisis dengan pendekatan konseptual dan perundang-undangan dalam tulisan ini menunjukkan bahwa walaupun pemerintah memiliki alasan yang kuat terkait aspek kekosongan hukum tetapi juga memiliki kelemahan substansial. Pertama, minimnya deliberasi di ruang publik dalam pembentukan Perpu Ormas melemahkan legitimasi. Kedua, lemahnya argumentasi penggunaan asas contrarius actus sebagai alasan mendesak untuk membentuk perpu. Ketiga, pembatasan terhadap kemerdekaan berserikat kontradiktif dengan jaminan dalam konstitusi, khususnya Pasal 28 dan Pasal 28J Undang-Undang Dasar 1945, yang secara tegas menyatakan bahwa pembatasan harus ditetapkan dengan undang-undang dan tidak menyebutkan perpu sebagai instrumen yang dapat membatasi derogable rights. Principle of Contarius Actus on Government Regulations in Lieu of Law on Mass Organization: Critiques from Administravite Law and Human Rights Perspectives AbstractGovernment Regulation in Lieu of Law Number 2 of 2017 on Amendment of Law Number 17 of 2013 on Social Organizations (Perpu on Amendment to the Law on Social Organizations) is criticized for limiting freedom of association and allowing the government to revoke the status of legal body of social organizations without going through court decisions. Based on the perspective of deliberative democracy, the absence of a deliberation process in the legislation process can open up opportunities for state repression against civil society. Moreover, based on the rule of law perspective, the absence of deliberations in the legislation process undermines the legitimacy. The analysis with the conceptual and legislative approach in this paper shows that although the government has strong reasons for the legal void aspects but also has substantial weaknesses. First, the lack of deliberation in the public sphere in the formation of the perpu can undermines legitimacy. Secondly, the use of contrarius actus principle as urgent reason is a weak argument for establishing the Perpu. Thirdly, restrictions on freedom of association contradict the guarantees of the constitution, particularly Article 28 and Article 28J of the 1945 Constitution, which expressly state that restrictions must be established by law and do not mention the perpu as an instrument that may limit derogable rights. Keywords: contrarius actus, human rights, freedom of association, mass organization, government regulation in lieu of law. DOI: https://doi.org/10.22304/pjih.v4n2.a2

Abstract

Mineral and coal is one of Indonesia’s natural resource potential. Natural resources can bring prosperity for the people of Indonesia. Therefore we need a pro-mining policies of national economic interests. The experience of Indonesia during the New Order show the mining policy in favor of the interests of foreign capital through the mechanism of the work contract that puts the state as the inferior party. State’s right to control the mineral and coal mining policy does not appear in the New Order. Since the enactment of Law Number 4 of 2009, it seemed right to control the state through the licensing system. Besides the role of national capital in the mining sector also raised through divestment mechanism.

Abstract

The quality of legislation in Indonesia is often questioned when the Constitutional Court cancels several chapters of a law or even the entire law.  The poor quality of legislation is influenced by powerful political factor in the legislation process. These factors have an impact on unsynchronization of laws with the constitution   or disharmony with other legislation. Ex ante review in this context becomes an alternative way to prevent bad legislation because every bill should be reviewed first. In Indonesian context, the ideal model of ex ante review is not only concerning with the constitutionality, but also harmony with other laws as well as other parameters necessary to produce good  legislation.

Abstract

Positivisme memiliki pengaruh yang besar terhadap ilmu pengetahuan, tak terkecuali ilmu hukum. Kendati beberapa ahli hukum mengidentifikasi ilmu hukum bersifat sui generis, namun pada perkembangannya ilmu hukum tidak dapat lepas dari perkembangan ilmu pengetahuan secara keseluruhan. Pengaruh positivisme dalam ilmu hukum dapat dilihat pada keterpisahan hukum dan moralitas. Validitas pun ditentukan oleh apakah hukum tersebut dibuat oleh lembaga yang berwenang. Prinsip prinsip ini berpotensi menjadikan hukum sekedar sebagai instrumen negara.

Abstract

Hukum dalam konteks modernitas, sebagai instrumen rekayasa sosial, seringkali dibenturkan dengan konsep hukum sebagai tatanan moral yang diusung oleh hukum kodrat. Hukum sebagai instrumen rekayasa sosial oleh penganut positivisme dipandang lebih rasional, sedangkan moralitas dalam hukum kodrat cenderung diparalelkan dengan moralitas agama. Hal ini disebabkan teori hukum kodrat didominasi filsafat Thomas Aquinas yang banyak dipengaruhi oleh aspek teologis. Padahal moralitas dalam hukum modern tidak melekat pada doktrin atau dogma agama. Moralitas dalam hukum modern justru dapat dirasionalkan dengan akal budi manusia. Dengan demikian hukum tidak perlu disterilkan dari moralitas sebagaimana pendapat positivisme. Kemanfaatan dan keadilan dalam hukum justru akhirnya dapat dibangun berlandaskan moralitas yang rasional.

Abstract

Statistical data showed that in 2017 only 67.89% household in Indonesia had access to proper sanitation. On the other hand, the National Medium-Term Development Plan targeted 100% universal access in 2019 that means in 2019 each household should have access to proper sanitation. However, the 2017 data of the Ministry of Public Works and Public Housing showed that, only 34, out of 541 municipalities/ cities in Indonesia, have domestic wastewater regulations. This study aims to identify some issues hindering acceleration of the establishment of regional regulations on wastewater management; the goal of the regulations is 100% universal access in 2019. Establishment of domestic wastewater management regulation in the regions in Indonesia is hampered by multisectoral regulation in the national level that is closely related to the domestic wastewater sector. Domestic wastewater management is influenced heavily by the regulations in other sectors. Health, public housing and drinking water are three sectors connected to domestic wastewater. However, Indonesian government simplified domestic wastewater management in the regional level by putting Ministerial Decree on Domestic Wastewater Management System as the major guideline in establishment of local regulations.

Abstract

The development of legal research shows the importance of an interdisciplinary approach in examining legal issues. Apart from that, legal issues also need to be examined more critically and not to see them as a product of a vacuum without the influence of non-legal factors. This paper explains the development of critical legal geography discourse as well as the theory of social space production and spatial justice associated with this discourse. The study of spatial law has developed an interdisciplinary approach with these critical theories with a critical legal geography framework. However, studies of spatial law in Indonesia have not developed much of this discourse in examining urban problems. Only a few researches on spatial law in Indonesia uses a critical legal geography perspective based on the tracing described in this paper. In fact, urban problems in Indonesia are similar to the phenomena that underlie the emergence of discourse on critical legal geography. Therefore, the study of spatial law in Indonesia requires a more philosophical and critical approach. Various new approaches developed in legal philosophy, one of which is critical legal studies, can be an analytical method for analyzing the influence of economy and power on spatial planning in Indonesia.

Abstract

The legislation process is not only influenced by the juridical factor. Non-juridical factors also influence the legislative process. Even non-juridical factors influence sometimes is greater than juridical factors. Whereas any legislation must meet the criteria of good legislation based on legisprudence theory. The quality of legislation in DPRD Kota Surabayais also influenced by other factors beyond the text of the legislation. Therefore, it is the legislative process in DPRD Kota Surabaya interesting to analyze because of course non-juridical factors remain influential in the legislative process. These factors, however, can be accommodated in such a way to suit the demands of judicial aspect. The analysis in this study isconducted by a socio- legal approach. Based on the research by socio-legal approach, the legislation process in DPRD Kota Surabaya (2009-2014) is influenced by non-juridical factors. Non-juridical factors are influenced by the interests of the struggle for influence in the community base. On the side of the legislator, there is an interest to build a base of constituents on an on going basis. On the executive side, there is the need to build a public trust in the government. The interests of each other in the dynamics of the discussion of draft legislations relating to the budget.
