Abstract

Konservasi sumber daya air memerlukan partisipasi dari masyarakat khusunya aparatur pemerintah sehingga terciptanya lingkungan yang asri dan sehat. Penelitian ini berlokasi di Kabupaten Kuningan Provinsi Jawa Barat. Tujuan penelitian ini adalah untuk mengetahui Pengaturan partisipasi masyarakat dalam konservasi menurut peraturan perundang-undangan di Indonesia dan untuk mengetahui kebijakan pemerintah daerah kabupaten kuningan untuk meningkatkan partisipasi masyarakat dalam konservasi sumber daya air. Metode pendekatan penelitian adalah yuridis empiris dan alat pengumpul data yaitu studi pustaka dan studi lapangan. Hasil penelitian yaitu:Pertama, Pengaturan partisipasi masyarakat menurut peraturan perundang-undangan di Indonesia, partisipasi masyarakat menurut Undang-Undang Nomor 37 Tahun 2014 Konservasi Tanah dan Air Pasal 2 huruf a yaitu “asas partisipatif”. Mengenai rincian bentuk partisipasinya diatur dalam Pasal 46 dan Pasal 52 berisi tentang Peran Masyarakat dan Hak Gugat Masyarakat apabila mengalami kerugian yang diakibatkan oleh kerusakan fungsi tanah dan lahan;Kedua, Kebijakan pemerintah daerah kabupaten kuningan untuk meningkatkan partisipasi masyarakat dalam konservasi sumber daya air, partisipasi masyarakat dalam pelestarian lingkungan hidup di kabupaten Kuningan khususnya Aparatur Peduli Lingkungan adalah kegiatan wajib penanaman pohon oleh aparatur pemerintah daerah kabupaten kuningan yang akan diangkat menjadi pns, kenaikan pangkat, promosi. Aparatur Peduli Lingkungan kegiatan berdasarkan kebijakan pemerintah daerah kabupaten kuningan yaitu Peraturan Daerah Kabupaten Kuningan Nomor 12 Tahun 2007 tentang Konservasi Sumber Daya Air dan Instruksi Bupati Kuningan Nomor 02 Tahun 2011 tentang Pelaksanaan Program Aparatur Peduli Lingkungan Kabupaten Kuningan. Kesimpulan adalah kebijakan pemerintah daerah kabupaten kuningan dalam konservasi sumber daya air sesuai dengan peraturan perundang-undangan dan aparatur pemerintah daerah memberikan contoh kepada masyarakat melalui program aparatur peduli lingkungan.

Abstract

Preserving environmental functions particularly water resources conservation is a shared task between government and public to achieve environmental sustainability. The purpose of this paper is to examine the effectiveness of Kuningan government policy in conserving water resources. This study uses empirical juridical method with descriptive analysis. The data collection of primary data is done by observation, interviews with related institutions while secondary data are in the form of legislation and legal theories. This research takes place in Kuningan regency, West Java province. The data are analyzed to examine the effectiveness of Kuningan Government policies in water resource conservation. The results reveal that District Regulation Number 12 Year 2007 on Water Resources Conservation and Kuningan District Regulation Number 12 Year 2011 on the Implementation of Kuningan Botanical Gardens along with other related Regulations and Government policies in Kuningan Regency have been effectively implemented. It can be seen from the sufficiently given regulations as well as community participation.Keywords: effectiveness, policy, water conservation

Abstract

Kuningan, local government districts declared as a conservation district. Kuningan district government coordination and cooperation with regard to conservation, namely: First, they Policy-makers need to understand how awareness of water conservation can help solve water shortage pro-blems while providing economic and social benefits, making environmental regulations that support conservation; Second, Water managers and the role of experts involved in the planning, develop-ment, and management of the water system, including managers and scientists working for the preservation of the environment is to create a reservoir as well as the urban forest in order to streng-then the conservation and Third ). Mass Media and Educators, their knowledge of the water sector may be little but they are experts in public relations, communications, marketing, and education is to create programs that support conservation programs such as Seruling (Students are concerned about the environment), Apel (Apparatus care environment) Pepeling (Bridal care for the environ-ment) and the Car Free day car-free day program. Kuningan district invites the public to play a role in realizing kuningan participate as a conservation district that is the existence of programs that support the conservation of water resources. Abstract

Pemerintah dalam arti luas adalah semua lembaga negara yang terdiri dari lembaga-lembaga legislatif, eksekutif dan yudikatif. Dalam arti sempit pemerintahan adalah segala kegiatan, fungsi, tugas dan kewajiban yang dijalankan oleh lembaga eksekutif untuk mencapai tujuan negara. Pemerintahan dalam arti luas adalah segala kegiatan yang terorganisir yang bersumber pada kedaulatan dan kemerdekaan, berlandaskan pada dasar negara, rakyat atau penduduk dan wilayah negara itu demi tercapainya tujuan negara. Di samping itu dari segi struktural fungsional pemerintahan dapat didefinisikan pula sebagai suatu sistem struktur dan organisasi dari berbagai macam fungsi yang dilaksanakan atas dasar-dasar tertentu untuk mewujudkan tujuan Negara. Dalam UUD 1945 Pasal 1 ayat (1), dinyatakan bahwa “Negara Indonesia ialah Negara Kesatuan yang berbentuk Republik”. Sejalan dengan pasal tersebut keutuhan suatu negara atau yang disebut juga integritas negara adalah suatu hal yang paling penting  yang menjadi dasar eksistensi setiap negara. Ketika negara bebas dari ancaman disintegrasi, maka sesungguhnya eksistensi negara tersebut telah kuat tak tergoyahkan. Hal yang sama berlaku bagi Negara Kesatuan Republik Indonesia (NKRI). Integritas Indonesia, yang disebut dengan keutuhan Negara Kesatuan Republik Indonesia. Keutuhan NKRI adalah fungsi dari pengertian dan tujuan negara, sebagaimana termaktub di dalam penjelasan Pembukaan UUD 1945. Itulah sebabnya sejak awal NKRI didirikan pemerintah dan berbagai elemen rakyat terus menerus berupaya mempertahankan persatuan dan kesatuan nasional. Setiap negara menganut sistem pemerintahan yang sesuai dengan dasar negara dan Undang-Undang Dasar yang dimilikinya. Indonesia memiliki dasar negara, yaitu Pancasila dan Undang Undang Dasar 1945. Oleh karena itu, Indonesia menganut sistem pemerintahan yang sesuai dengan dasar negara, yaitu Pancasila dan Undang Undang Dasar 1945. Kata kunci : Dana, Otonomi, Kebijakan.

Abstract

Abstrak Keterbukaan informasi merupakan bagian penting dari reformasi birokrasi yang pada hakikatnya merupakan upaya untuk melakukan pembaharuan dan perubahan mendasar terhadap sistem penyelenggaraan pemerintahaan sehingga tercapai tujuan reformasi birokrasi yaitu untuk mempercepat tercapainya tata kelola pemerintahan yang baik dan upaya memperbaiki dukungan terhadap pemerintah daerah dalam meningkatakan kinerjanya. Reformasi birokrasi berjalan terdiri dari reformasi kelembagaan, sumber daya manusia dan reformasi manajemen dukungan teknologi informasi. Reformasi birokrasi perizinan penanaman modal di kabupaten Bogor sudah dan sedang berjalan dalam upaya meningkatkan pelayanan terhadap masyarakat sehingga tata kelola perizinann yang baik di rasakan oleh masyarakat luas. Reformasi manajemen dukungan teknologi informasi dalam proses perizinan yaitu meningkatkan keterbukaan informasi melalui keterbukaan manajemen dalam mempublikasikan hal-hal yang berkaitan dengan proses perizinan mulai dari syarat, proses tahapan dan biaya dengan dukungan teknologi informasi.Kata kunci : Birokrasi , Informasi, Keterbukaan, Perizinan, Reformasi.. BUREAUCRATIC REFORM OF LICENSING IS BASED ON LAW NO. 25 OF 2009 ON PUBLIC SERVICE (STUDIES IN BOGOR REGENCY) Abstract Disclosure of information is an important part of the reform of the bureaucracy which in essence is an attempt to reform and fundamental changes to the systems of governance in order to reach the goal of bureaucratic reform is to accelerate the achievement of good governance and efforts to improve support to local governments by increasing its performance . Reform of the bureaucracy runs consisting of institutional reform , human resources and information technology support management reform . Investment licensing bureaucracy reform in Bogor district already up and running in an effort to improve service to the public so that good governance licensing felt by the wider community . Information technology support management reform in the licensing process is to increase transparency through disclosure of information management in publishing matters relating to the licensing process ranging from requirements , process stages and the cost of information technology support .Keywords: Bureaucracy, Disclosure, Information, Licensing, Reform.

Abstract

KPK is a new institution with the authority which is often referred to as a superbody institution which has extra authority compared to other state institutions. The Corruption Eradication Commission was formed with the aim of increasing the efficiency and effectiveness of efforts to eradicate corruption. Corruption is indeed an extraordinary crime, and therefore its eradication must also be carried out in an extraordinary way. The purpose of this paper is to find out how the authority of the Corruption Eradication Commission (KPK) in the Corruption Eradication Code of Ethics and how the Theory of the State of Law in the Eradication of Corruption Crimes. The method used in writing this paper is normative juridical. Sources of data used are primary and secondary data sources. The results of this study are in carrying out the task of coordinating with agencies, supervising agencies, conducting investigations, investigations, and prosecutions, taking preventive actions, monitoring the implementation of state government, the authority of the Corruption Eradication Commission is regulated in Articles 7 to 14 of the Law. Law Number 30 of 2002 concerning the Commission for the Eradication of Criminal Acts of Corruption. In order to achieve the legal objectives as stated in Article 1 paragraph 3 of the 1945 Constitution of the Republic of Indonesia that Indonesia is a state of law, a State Institution that is Special in terms of eradicating Corruption Crimes is needed for the implementation of law and justice.

Abstract

The purpose of this study is to find out and analyze how the arrangements regarding the principles of good governance in Indonesia. The research method uses a normative juridical approach. The results of the study are found that the arrangements regarding the principles of good governance have been regulated in Law Number 28 of 1999 concerning State Administration that is Clean of Corruption, Collusion and Nepotism, Article 24 of Law Number 6 of 2014 concerning Villages, Article 58 Act Number 23 of 2014 concerning Regional Government and Article 10 of Act Number 30 of 2014 concerning Government Administration. Conclusion that the regulation of the principles of good governance in Indonesia has been very good, the administration of government depends on a shared commitment to run the wheels of government in accordance with the objectives of the state.Keywords: principles of good governance, good governance, governanceAbstrakTujuan penelitian ini adalah untuk mengetahui dan menganalisis bagaimana pengaturan mengenai asas-asas penyelenggaraan pemerintahan yang baik di Indonesia. Metode penelitian menggunakan pendekatan yuridis normatif. Hasil penelitian yaitu ditemukan bahawa pengaturan mengenai asas-asas penyelenggaraan pemerintahan yang baik sudah diatur dalam Undang-Undang Nomor 28 tahun 1999 tentang Penyelenggaraan Negara yang Bersih Bebas dari Korupsi, Kolusi dan Nepotisme, Pasal 24 Undang-Undang  Nomor 6 Tahun 2014 tentang Desa, Pasal 58 Undang-Undang  Nomor 23 Tahun 2014 tentang Pemerintahan Daerah dan Pasal 10 Undang-Undang  Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan. Simpulan bahwa pengaturan mengenai asas-asas penyelenggraan pemerinthan yang baik di Indonesia sudah sangat baik, penyelenggaraan pemerintahan tergantung komitmen bersama dalam menjalankan roda pemerintahan yang sesuai dengan tujuan bernegara.Kata Kunci: asas-asas penyelenggaraan pemerintahan yang baik, good governance, pemerintahan

Abstract

Water resources management requires the support of all parties involved in the commitment to jointly maintain sustainable and beneficial water resources and requires a focused and comprehensive institution so that the benefits of water availability are felt by the community. The goal is to analyze the Institutional Management of the Citarum Watershed; and Effectiveness of Government Policy in Conservation of Water Resources to Realize the System of Environmental-Based Water Management. The results of the study are that government policies in Citarum must be equipped with more comprehensive regulations, especially strengthening the permits for housing development must pay attention to the concept of conservation of water resources; Government commitment is strengthened, namely 1 (one) policy in the management of the Citarum River, namely the Citarum Authority Agency that replaces the function and role of agencies that have been managing the Citarum River, then with 1 (one) water resource management.Keywords: government; citarum authority agency; conservation of water resources.

Abstract

This study aims to determine the regulation of converting agricultural land into housing and the suitability of its implementations. This study employed a juridical empirical approach which is a research done by looking at and paying attention to applicable legal norms associated with existing facts from the problems encountered. In this case,  the local government policies on converting agricultural land into housing. The findings revealed the perpetrators of the land conversion process that occur in Kuningan Regency are the landowners. Some of the causes are: social, economic, population density, and the lack of socialization of Law Number 41 of 2009. Efforts made by local government officials and related agency officials to realize sustainable food land protection are still limited to carrying out their main duties and functions. The guideline in controlling the use of space, licensing and controlling mechanisms for the implementation of development, stated in the Regional Regulation of Kuningan Regency Number 26 of 2011 on regional Spatial Planning and Regulation of the Head of the National Land Agency Number 2 of 2011 concerning guidelines for technical land considerations in controlling location permits and determining locations and permits for changes in land use. The study concluded that converting the function of agricultural land to non-agriculture in Kuningan Regency is carried out by the landowner. In addition, efforts made by local government officials and related agency officials to realize sustainable food land protection are still limited to carrying out their main duties and functions. Accordingly, it is necessary to socialize Law Number 41 of 2009 on Protection of Sustainable Food Agricultural Land and Regional Regulation of Kuningan Regency Number 26 of 2011 concerning Regional Spatial Planning continuously to the community level. Furthermore, local governments need to coordinate with the village officials to monitor the use of agricultural land and the development of housing areas. This can be done by providing socialization to village officials.

Abstract

Bureaucratic reform is essentially an attempt to reform and fundamental changes to the system of governance in order to reach the goal of bureaucratic reform to accelerate achievement of good governance and efforts to improve support for local government in increasing performance. Bureaucracy reform program runs which is principally consisted of institusional reform, human resources reform and management information technology support in the licensing process. Institutional reform is by estabilishing a new agency that handles the licensing process in the past, licensing process has to go through the different agencies and with the reform of the bureaucracy in the licensing process united in one body that is unified, improve human resources through training and increase the transparency of information through the management information technology support. Bureaucratic reform in investment licensing in the area is already under way in an effort to improve the service to the community, so good governance is not just a dream and soon will become a reality. Key words: licensing, service, bureaucratic reform.
