Abstract

The form of wage protection is the goal of the worker/laborer in doing the work to earn sufficient income to finance his life with his family, which is a decent living for humanity. During this time workers always neglected their rights in doing the work. Issues discussed in this paper are Is legal protection for workers/laborers in North Halmahera Regency in compliance with Law Number 13 Year 2003 on Manpower and What are the Barriers in Legal Protection for Workers? This research is conducted by using type of juridical Normative legal research. so the source of the Law material is analyzed is the legal material by using the Law and Case Approach. Against the results of the study "a Legal Study on the Protection of Workers/Workers in North Halmahera Regency Based on Law Number 13 Year 2003 on Manpower.

Abstract

The State Civil Apparatus hereinafter abbreviated (ASN) is the profession of Civil Servants who are subsequently written (PNS), Provisions regarding the dismissal of Civil Servants are regulated in Law Number 5 Year 2014 concerning State Civil Apparatus, then Law No. 5/2014 is written. Matters that are reasons for dismissal of civil servants in article 87 paragraph 1 (one), paragraph 2 (two) and paragraph 4 (four) are civil servants dismissed with respect because: a. Dies; b. at own request; c. reaching retirement age; d. organizational downsizing or government policies that result in early retirement or e. incompetent physically and / spiritually so that they cannot carry out their duties and obligations, paragraph 2 (two) civil servants can be dismissed because they are sentenced to imprisonment based on court paragraph 4 (four) commit fraud against Pancasila and the 1945 Constitution of the Republic of Indonesia, b. sentenced to imprisonment or confinement based on a court decision that has permanent legal force because of committing a crime of occupational crime or a criminal offense related to position and / or general criminal offenses.

Abstract

Constitutional Court Decision(MK) who is final and binding as stated in Article 24 C paragraph (1) of the 1945 Constitution of the Republic of Indonesia, and Saccording to the provisions of article 47,and explanation of article 10 paragraph (1), Law no. 24 year 2003. The final nature of this Constitutional Court decision includes binding legal force (final and binding).. It turns out, in amarConstitutional Court Decision No 57/PHP.BUP-XIX/2021 cause new legal problems or conflicts of norm because it does not yet have final and binding power in the North Halmahera election dispute, because the Constitutional Court's decision still opens the opportunity for new applications to be resubmitted in the Constitutional Court. MKNumber 14/PHP.BUP-XV/2017, and Decision Number 42/PHP.BUP-XV/2017, on amarthe decision is very clear, the decision has binding power after the decision so that the Constitutional Court can no longer re-hear the election results case after the PSU has been carried out, only the determination is carried out after the KPUD reports the PSU results.This study aims to analyze, first,Is the Constitutional Court's decision no longer final and binding in dealing with regional election disputes, especially the North Halmahera regional election dispute, second, how are the legal problems of the Constitutional Court's decision which is no longer final and binding?. This research is qualified into normative legal research, with an approach Legal approach (Statute Approach), Concept Approach and Case approach. The results of the study show, firstly, that the Constitutional Court's decision creates new legal problems in its decisions which are different from the previous decisions, Second, there is a need for Consistency of the Constitutional Court in deciding disputes that are final and binding so that it does not cause new problems in constitutional law

Abstract

Legal regulation The role of the State Administrative Court in the practice of settling government administration in Indonesia needs to be properly regulated, because in the implementation of the Administrative Court decisions according to Article 116 of Law no. 51 of 2009 concerning the Second Amendment to Law No. 5 of 1986 is a regulation regarding forced money which is not clear and there is no final settlement of a decision that has permanent legal forcethe execution cannot be carried out properly, and the absence of an executive or foundational institution strong law causes the decision of the State Administrative Court to have no power force. Even the State Administrative Court Law does not regulate firmly and clearly regarding the issue of the coercive power of the State Administrative Court's decision, so that in the implementation The decision really depends on the good faith of the State Administration Agency or Official in obey the law. This situation is quite alarming, because the principle of justice is State Administration, to put juridical control in the government to be lost meaning in the Indonesian constitutional bureaucratic system even though the decision should bind the disputing parties and have executive power when they already have a decision that has permanent legal force, according to the legal principle Erga omnes states thatThe decision of the State Administrative Court is publicly binding, not only binding on the disputing parties. This is a consequence of the nature of the state administrative dispute which is a public legal dispute, so that the Administrative Court Decision must bind all interested parties and have the obligation to comply with every decision;This research analyzes the problem, How about The existence of the Implementation of Administrative Court Decisions in the law enforcement system? And Has the execution of the Administrative Court Decision been effective in the law enforcement system. The research methodology used in this study is normative juridical with the approach used is the Statute Approach and the Case Approach, the approach carries out an assessment of laws and regulations related to the central theme of research with the procedure for collecting legal materials. Both Primary and secondary legal materials are collected based on the topic of the problem that has been formulated based on the Legislation which is reviewed comprehensively to provide new legal ideas for legal reform.

Abstract

Desa Posi-Posi adalah salah satu desa di Kecamatan Loloda Utara. Berdasarkan pengamatan awal menunjukan permasalahan yang masih dihadapai oleh pemerintah desa yaitu belum adanya pengelolaan administrasi desa secara baik, contohnya belum memiliki Standar Operasional Prosedur (SOP) dalam pelayanan administratif di desa, penataan arsip dokumen desa juga tidak teratur. Permasalahan kedua adalah selama ini pemerintah desa posi-posi belum memiliki dokumen profil desa yang dibuat melalui mekanisme partisipasi masyarakat, hal ini disebabkan oleh kurangnya partisipasi keterlibatan masyarakat dalam bebagai kegiatan yang dilakukan oleh pemerintah desa. Berdasarkan potensi yang ada dan permasalahan yang dihadapi oleh pemerintah desa dan masyarakat setempat, maka diadakan kegiatan pengabdian masyarakat oleh dosen bersamaan dengan program kuliah kerja nyata oleh mahasiswa (KKN-PPM) dari Universitas Halmahera (UNIERA). Program pembelajaran pemberdayaan masyarakat (PPM) yang dilaksanakan di Desa Posi-posi Kecamatan Loloda Utara dengan mengambil tema “Melalui Pengelolaan Administrasi dan Profil Desa Kita Tingkatkan Partisipasi Masyarakat Demi Mewujudkan Desa Posi-Posi Yang Mantap”. Kegiatan pembelajaran yang dilakukan oleh dosen dari FISHUM bersama mahasiswa yang memprogram KKN ini meliputi penataan administrasi desa dengan pembuatan Standar Opersional Prosedur (SOP) Pelayanan Administratif, penguatan kompetensi perangkat desa melalui pendampingan pembuatan arsip desa, serta meningkatkan partisipasi masyarakat melalui kegiatan pembuatan profil desa.Metode kegiatan pemberdayaan yang digunakan adalah Participatory Learning And Action (PLA) atau Proses Belajar dan Praktek secara Partisipatif. PLA digunakan dalam upaya pendampingan kepada pemerintah desa dan masyarakat yang terdiri dari proses belajar (Pelatihan, curah-pendapat dan diskusi) tentang  pengelolaan administrasi desa dan mekanisme pembuatan profil desa secara partisipatif.Adapun tujuan yang sudah dicapai dari kegiatan KKN-PPM ini adalah pertama, telah memberikan pendidikan pengelolaan administrasi desa dan pembuatan profil desa, kedua penguatan sekaligus pendampingan kepada pemerintah desa dalam pembuatan SOP pelayanan administratif di desa, tata cara pengarsipan dokumen dan pembuatan profil desa.

Abstract

Dalam perspektif undang-undang No 6 Tahun 2014 tentang desa, sangat mengganggu penyelenggaraan pemerintahan desa, karena masing-masing pihak saling mengklaim batas desa dan potensi desa, sehingga berakibat bagi konflik pemerintahan desa, yang disebabkan dalam perspektif Hukum administrasi semestinya kedua Pemerintah Kabupaten Halmahera Barat dan Halmahera Utara tidak boleh melaksanakan lagi Tugas-Tugas Pemerintahan Kabupaten dalam satu desa administrasi atau Pemerintahan desa pada wilayah desa tersebut tetapi selama aktivitas pemerintahan masih terus berjalan. Olehnya melalui penelitian ini penulis mengunakan Metodologi penelitian Hukum Yuridis Normatif dengan pendekatan yang digunakan adalah Pendekatan Perundang-Undangan (Statuta Approach) dan pendekatan Kasus (Case Approach) pendekatan tersebut malakukan pengkajian peraturan-undangan yang berhubungan dengan tema sentral penelitian dengan prosodur dari bahan hukum Baik bahan hukum Primer atau sekunder berdasarkan topik permasalahan yang telah dirumuskan berdasarkan peraturan peraturan-undangan yang dikaci secara komperensif

Abstract

Sesuai hasil penelitian pada putusan Nomor:15/pid.sus/2016/PN.Tob. dimana majelis hakim menjatuhkan Putusan Terhadap terdakwa terbukti secara sah dan meyakinkan melakukan percobaan persetubuhan terhadap anak dan divonis 5 tahun penjara. Yang menjadi permasalahan adalah terdakwa dalam melakukan Tindakannya tidak melakukan Perbuatan Percabulan sebagaimana yang dimaksud dalam pasal Pasal 81 UU No. 35 tahun 2014, Jo Pasal 53 KUHP sehingga jika dilihat dari sudut pandang keadilan sangat tidak adil karena hukuman yang dijatuhkan tidak sesuai dengan apa yang dilakukan. Penelitian ini mengunakan penelitian normatif menggunakan pendekatan kasus (case approach). Menurut pendekatan kasus dipakai untuk mengkaji alasan pertimbangan pengadilan dalam membuat suatu putusan. Kaitannya dengan pendekatan ini maka yang dikaji adalah pertimbangan hakim Pengadilan Negeri Tobelo dalam memutus perkara delik percobaan persetubuhan terhadap anak yang di dalamnya terdapat permasalahan hukum mengenai putusan yang dijatuhkan dalam memutuskan perkara delik percobaan persetubuhan terhadap anak

Abstract

Crime of Trial Against Children can be punished if the commencement of implementation is real, Criminal acts of sexual abuse are generally acts or acts that violate decency that intentionally damage politeness. The threat of criminal offenses for underage children according to Article 82 of Law No.23 of 2002 concerning Child Protection is punishable by imprisonment of a maximum of 15 (fifteen) years and a minimum of 3 (three) years and a maximum fine of Rp.300,000,000. 00 (three hundred million rupiah) and at least Rp. 60,000,000.00 (sixty million rupiahs). Abstract Bentor is short for Becak Motor which is a tricycle from Tobelo. According to the data obtained from the Tobelo City Traffic Unit and the Pehubungan Service, the number of traffic violations committed by the bombing vehicle amounted to 70 cases of violations by 2015 and traffic accidents involving the collision vehicle which amounted to 39 cases of traffic accidents in 2015 The problem discussed in this paper is how the application of the Law for Violations against Terrorism?
