Green Open Space (RTH) diminishing lead to the emergence of insecurity and social diseases and influence the improvement of micro-climate, air pollution, floods, and various other negative environmental impacts. The study was conducted by looking at the green open space in a holistic manner. This method is expected to explain the policy of the green space in West Java and the policy implications of the Spatial Plan. Research results indicate the overall amount of green space in West Java has not fulfilled the amount of 30% as mandated by the Law on Spatial Planning, so the RTH policy directed at meeting the quota of 30%, with a range of strategies for improving the quality and quantity of green space Regency/City. RTH is an important part of City Spatial System, the procurement of green space is part of planning in the protection and management of the environment. As part of the layout, RTH is an instrument of prevention of pollution and/or damage to the environment. Keywords: Policy, Green Open Space, Spatial

As a vehicle for social interaction, open spaces are expected to be able to link all of members of society (or the local community) without differentiating between their social, economic and cultural background. Green open space forms part of the urban space available in a region that has been filled with plants in order to bring ecological, social, cultural and aesthetic benefits. From the research conducted previously, it may be gathered that reaching the green open space proportion of 30% in the city region could only have been accomplished by involving many stakesholders, especially the local community members. This phenomenon piqued the interest of the researchers to conduct further research into the active participation of society (local community members) in the management of green open space and into the policies issued by the government to increase this effort. The outcome shows that the active participation of the local community members in the utilization of green open space serves not only to supervise the government policies, but it also plays an important role in managing and maintaining the green open space in their neighborhood. The expansion of the local communityâs grasp of the concept being not only the party affected by its impact, but also as the interest and pressure group broadening its active participation by participating in managing the green open space, and even expanding the green open space by making agreements with the government. On the other hand, the government itself has been making various efforts to increase the active participation from society by encouraging the usage of Corporate Social Responsibility to manage the green open space and offer training sessions and courses to the local community involved.

This study is based by the cancellation of Act No. 7 of 2004 on Water Resources by the Indonesian Constitutional Court. Over the past 10 years, the law is the basis for the water resources management in Indonesia. The cancellation of the law would provide great impact for water resources management policy, especially with regard to the provision of right to water. Hence, this study aimed to determine the legal status of Right to Water provided by the local government after the cancellation of Act No. 7 of 2014 on Water Resources. The object of this normative study includes legal principles and systematic. This is due to the focus of this study is the meaning of the right principle to ruled state in the context of realizing the peoples’ prosperity and the position of Water Resources Act as the basis for the issuance of Government Regulation and Right to Water. The results of study indicate that in order to provide legal certainty for permit holder for Right to Use Water and Right to Commercialize Water, the ministry has issued various ministerial regulations, although the nature of these regulations only fills a legal vacuum. In the case of permit to Use of Water Resources, all permits for use of water resources that use surface water issued before the decision of Constitutional Court No. 85/PUU-XI/2013 are still valid. To permit referred to it, evaluation is conducted based on 6 (six) the principles of water resources management. Request new permit are in the process or for renewal of permit to use water resources that use surface water, processed as 6 (six) principles of water resources management. Although, in order to ensure legal certainty, the government should immediately issues the Act in Lieu of Water Resources Management which will be the basis for water resources management in Indonesia.

Berbagai wilayah di Indonesia seringkali menjadi objek wisata yang dapat meningkatkan kesejahteraan masyarakat sekitarnya. Potensi tersebut dapat dimanfaatkan dengan mengembangkan dan melestarikan sumber daya alam melalui ekowisata, yang merupakan suatu bentuk wisata yang erat dengan prinsip konservasi, menggunakan strategi konservasi untuk mempertahankan keutuhan dan keaslian ekosistem di wilayah yang masih alami, sekaligus meningkatkan kesejahteraan ekonomi masyarakat di wilayah tersebut. Salah satunya objek wisata yang terdapat di Kecamatan Cihurip Kabupaten Garut. Artikel ini akan membahas bagaimana ekowisata dapat mendukung perlindungan dan pengelolaan lingkungan, dan bagaimana konsep ekowisata diterapkan pada objek wisata yang terdapat di Kecamatan Cihurip Kabupaten Garut.Penelitian ini dilakukan dengan menggunakan metode pendekatan juridis normatif dalam arti menggunakan data kepustakaan/sekunder sebagai bahan utama penelitian. Dalam hal ini digunakan metode penelitian yang bersifat deskriptif analitis dengan pendekatan sistemik.Pengembangan ekowisata harus memperhatikan prinsip ekowisata dan kesinambungan antara lingkungan, masyarakat dan pergerakan perekonomian yang terjadi sebelum dan selama ekowisata dijalankan. Selain itu, dalam penyelenggaraan dan pengelolaan kawasan ekowisata, harus memperhatikan unsur pendidikan, perlindungan, keterlibatan masyarakat lokal, pengawasan, dan konservasi. Keterlibatan penduduk lokal harus dimaksimalkan dengan tujuan meningkatkan ekonomi masyarakat setempat.

ABSTRAKPandemi COVID-19 yang sedang melanda dunia saat ini memiliki dampak yang sangat signifikan terhadap berbagai sektor, utamanya pada sektor pangan. Ancaman krisis pangan menjadi hal yang paling dikhawatirkan saat ini. Pembangunan food estate sebagai penyedia cadangan pangan nasional menjadi solusi yang ditawarkan. Keterbatasan lahan pertanian yang ada menjadi hambatan pemerintah dalam mengembangkan program ini. Kawasan hutan menjadi salah satu area yang dapat digunakan untuk program food estate, sebagaimana diatur dalam Permen Nomor 7 Tahun 2021 melalui skema kawasan hutan untuk ketahanan pangan. Penelitian ini menggunakan metode yuridis normatif dengan mengkaji berbagai data sekunder mengenai program food estate dan kawasan hutan. Kawasan hutan lindung dan/atau kawasan hutan produksi menjadi dua kawasan yang dapat digunakan dalam skema kawasan hutan untuk ketahanan pangan. Namun, Pemerintah masih perlu untuk memberikan batasan yang jelas terkait penggunaan kawasan hutan lindung yang tidak berfungsi lindung pada skema kawasan hutan untuk ketahanan pangan ini, karena dikhawatirkan akan berdampak kepada kawasan hutan lindung yang masih berfungsi lindung, mengingat area yang dibutuhkan oleh food estate ini sangat luas. Pemerintah juga perlu untuk memperhatikan hak-hak pemanfaatan sebelumnya agar persengketaan antar pemilik hak dapat terhindarkan.Kata kunci: ketahanan pangan; pembangunan food estate; perlindungan kawasan hutanABSTRACTThe COVID-19 pandemic that is currently engulfing the world has a very significant impact on various sectors, especially in the food sector. The threat of a food crisis is the most worrying thing. The development of a food estate as a provider of national food reserves is the solution offered. The limited available agricultural land is an obstacle for the government in developing this program. The forest area is one of the areas that can be used for the food estate program, as regulated in Ministerial Regulation Number 7 of 2021 through the forest area scheme for food security. This study uses a normative juridical method by examining various secondary data regarding the food estate program and forest areas. Protected forest areas and/or production forest areas are two areas that can be used in the forest area scheme for food security. However, the Government still needs to provide clear boundaries regarding the use of protected forest areas that do not function in this forest area scheme for food security because it will have an impact on forest areas that are still working as protected areas, considering the area required by this food estate is very large. The government also needs to pay attention to previous utilization rights so that disputes between rights owners can be avoided.Keywords: food development; food security; forest area protection.

AbstractLegal pluralism in Indonesia provides a place for indigenous peoples to manage their natural resources where their lives are based on a living philosophy that is in harmony with nature, produces a pattern of management of natural resources that is environmentally friendly and sustainable. This article focus on studying water resource management practices based on traditional wisdom carried out by indigenous peoples in Indonesia and whether the management of water resources based on traditional wisdom can be used as an example of sustainable water resource management. The results of research conducted on the Ciptagelar indigenous people, Subak practices in Bali and 9 (nine) regions in Indonesia show that the practices of water resource management carried out in these areas are in line with the approach of sustainable water resource management. Some forms of community practice can even be adopted in the management of water resources carried out by the government. Furthermore, regulation of water resources based on values that live in society is easier to implement in the life of the community itself, therefore, regulation of water resources in the future must pay more attention to the values that live in the community. Abstrak Pluralisme hukum di Indonesia memberikan tempat bagi masyarakat adat untuk mengelola sumber daya alamnya, yang kehidupannya dilandasi falsafah hidup yang selaras dengan alam, menghasilkan pola pengelolaan sumber daya alam yang ramah lingkungan dan berkelanjutan. Artikel ini fokus pada mempelajari praktek pengelolaan sumber daya air (SDA) berdasarkan kearifan tradisional yang dilakukan masyarakat adat di Indonesia dan apakah pengelolaan SDA berdasarkan kearifan tradisional ini dapat dijadikan contoh pengelolaan SDA yang berkelanjutan. Hasil penelitian yang dilakukan pada masyarakat adat Ciptagelar, praktik Subak di Bali dan 9 wilayah di Indonesia menunjukkan bahwa praktik-praktik pengelolaan SDA di wilayah tersebut sejalan dengan pendekatan pengelolaan SDA yang berkelanjutan. Beberapa bentuk praktik masyarakat bahkan dapat diadopsi dalam penyelenggaraan pengelolaan SDA yang dilakukan oleh pemerintah. Pengaturan SDA yang berbasis nilai-nilai yang hidup di masyarakat lebih mudah diterapkan dalam kehidupan masyarakat itu sendiri, sehingga ke depan pengaturan SDA harus lebih memperhatikan nilai-nilai yang hidup di masyarakat.
