Abstract

AbstrakPasca berlakunya Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah dan Undang-Undang Nomor 6 Tahun 2014 tentang Desa terdapat beberapa hal yang harus dicermati, terlebih dalam hal pengaturan distribusi urusan pemerintahan yang menjadi alas pelaksanaan kewenangan pemerintahan daerah. Apabila dibandingkan dengan Undang-Undang Nomor 32 Tahun 2004, maka terdapat perubahan dalam distribusi urusan pemerintahan. Tulisan ini berusaha memberikan penjelasan terhadap pemahaman mengenai urusan pemerintahan dengan membandingkan dua undang-undang untuk membingkai kerangka pemikiran daerah dalam mengidentifikasi urusan pemerintahan. Pola distribusi urusan pemerintahan dalam politik hukum desentralisasi di Indonesia secara simultan melahirkan otonomi daerah, tidak sepatutnya hanya dimaknai sebagai strategi untuk mengelola hubungan kewenangan antara pemerintah pusat dan pemerintahan daerah. Desentralisasi yang sejatinya mendistribusikan urusan harus secara jernih dikaitkan dengan kewenangan sebagai alas pelaksanaan urusan karena konsep kewenangan dalam otonomi daerah tidak bisa ditukar pengertiannya dengan urusan yang kemudian hanya sekedar dimaknai dengan hubungan keuangan sebagaimana rezim Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah.The Transformation in the Regulation on Distribution of Government Affairs Between Central and Local GovernmentsAbstractAfter the enactment of Law Number 23 of 2014 Concerning Local Government and Law Number 6 of 2014 Concerning Village, there are several things to be observed, specifically regarding the regulations on the distribution of government affairs upon which the authority of local government is based. Concerning government affairs, there are several missing aspects in the Law Number 23 of 2014 Concerning Local Government and Law Number 32 of 2004 Concerning Local Government. This paper seeks to compare the two regulations to determine the distribution pattern of government affairs in Indonesia’s decentralized legal politics that simultaneously spawns local autonomy should not only be interpreted as a strategy to manage the relationship of authority between central and local governments. Decentralization, which genuinely distributes affairs, should be transparently linked with authority as the legal basis of conducting the affairs and the concept of authority regarding local autonomy should not be simplified into financial matters as regulated by the Law Number 23 of 2014 Concerning Local Government. DOI: https://doi.org/10.22304/pjih.v2n3.a3

Abstract

Post-enactment of Act Nr. 12 of 2011, MPR Decree was put again the hierarchy of legislation, which cause problems in the context of the state of law of Indonesia. This was normative legal research. Now, the number of MPR Decree is only 6 decrees remaining, so re-existence and placement of MPR Decree is not relevant. Hierarchy should be made by simplification approach by reducing the nomenclature of law in the hierarchy of legislation. MPR Decree should have not been included in the hierarchy, especially under the Constitution. If the MPR Decree still be placed under the Constitution, we need to hold the mechanism to review MPR Decree, if there is a contradiction with the Constitution or the restriction of human rights, which actually should not be limited by the MPR.

Abstract

Through the decision No. 117/PUU-VII/2009, Constitutional Court applies Rawls conception of justice that emphasizes the equality of all people with equality  of opportunity by applying fair or equal opportunity principle. Institutional design between the DPR and DPD viewed by Constitutional Court as an inequiality condition, so that to reach a value of justice, equal opportunity principle should take precedence and priority. Stregthening DPD is necessary to uphold the checks and balances mechanisms in Indonesia.

Abstract

The result of this legal research show the existence of conditionally constitutional and conditionally unconstitutional decision in reviewing laws from 2003 to 2015, although that model of decision is not regulated in the positive law.  There are 5 characteristics of conditionally constitutional decision, those are (1)  Court  gives interpretation or certain requirements in order to remain constitutional provisions tested throughout implemented according to the specified requirements of the Constitutional Court; (2) based on the rejected verdict; (3) a conditionally constitutional clause can be found only on the consideration of the Court, or can be found on the judgment and injunction; (4) conditionally constitutional decision require re-judicial review if the norm is not in line with the interpretation of the Constitutional Court; (5) encouraging legislative review. Regarding the conditionally unconstitutional decision, there are 4 characteristics, those are (1) the verdict certainly include a conditionally unconstitutional clause; (2) a conditionally verdict can be the meaning or interpretation of a norm, or give the terms of the norm is unconstitutional; (3) based on the granted verdict either partially or completely; (4) does not substantially different from the conditionally constitutional clause.

Abstract

Reklamasi hampir selalu menjadi polemik di Indonesia karena diduga berdampak buruk pada lingkungan. Namun, reklamasi juga sebagai opsi untuk meningkatkan fungsi ruang. Terlepas dari masalah ini, penelitian ini mencoba untuk melihat dari perspektif lain, yaitu dari aspek hukum perencanaan tata ruang. UU Nomor 26 Tahun 2007 tentang Penataan Ruang menetapkan bahwa “ruang” tidak hanya tentang ruang darat, tetapi juga ruang laut. Namun, dalam UU tersebut, penataan ruang laut tidak diatur. UU menegaskan bahwa tata ruang laut diatur dengan UU tersendiri. Kemudian, dasar penataan ruang laut diatur dalam UU Nomor 27 Tahun 2007 jo. UU Nomor 1 Tahun 2014 tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil. Hal ini menunjukkan adanya dualisme pengaturan antara perencanaan tata ruang darat dan laut dalam UU yang berbeda. Ini menimbulkan pertanyaan yang menarik ketika dikaitkan dengan reklamasi, yaitu terkait dengan status ruang sebagai hasil dari reklamasi, apakah itu menjadi bagian dari tata ruang darat atau laut? Peneliti bermaksud untuk menjawab pertanyaan berikut: (a) bagaimana pengaturan tata ruang sebelum dan sesudah reklamasi? (b) bagaimana status hukum ruang yang dihasilkan dari reklamasi? Apakah tunduk pada peraturan tata ruang darat atau laut? Ini adalah penelitian hukum normatif yang menggunakan tinjauan pustaka untuk membedah data sekunder. Hasil penelitian ini menunjukkan bahwa dualisme mengenai peraturan tata ruang daratan dan laut membuat perencanaan tata ruang non-integratif, yang hampir selalu menyebabkan polemik reklamasi di Indonesia.

Abstract

Salah satu bagian dari sistem pemilihan umum (pemilu) yang terlihat sangat sederhana dan bahkan hampir tidak diperhatikan secara khusus adalah metode konversi suara pemilih menjadi kursi anggota legislatif. Sejatinya pengaturan mengenai metode konversi suara menjadi kursi telah diatur dalam UU, setidaknya sejak tahun 2004. Muncul pertanyaan mendasar bagaimana implikasi perpaduan antara sistem presidensial dan sistem kepartaian multipartai di Indonesia? Bagaimana politik hukum metode konversi suara menjadi kursi dalam sistem pemilu legislatif? Bagaimana evaluasi dan alternatif solusi terhadap penerapan metode konversi terhadap upaya penyederhanaan sistem multipartai di Indonesia? Penelitian ini adalah penelitian hukum normatif untuk mendapatkan data sekunder. Tentu perdebatan yang dibangun dalam konteks hukum tata negara bukanlah mana yang benar dan mana yang salah, namun lebih pada konteks implikasi yang ditimbulkan dari pilihan kebijakan terhadap sistem ketatanegaraan Indonesia. Dalam konteks kompleksitas perpaduan sistem pemerintahan presidensial dan sistem kepartaian multipartai, sudah selayaknya apapun pilihan kebijakan yang dibangun dalam kerangka politik hukum sistem pemilu di Indonesia haruslah mendukung terciptanya efektivitas sistem presidensial.The simple part of election system is vote conversion method. The method to convert the total amount of votes into the seats of legislator almost abandoned. Actually, the method should be regulated in 2004 Legislative Election Act. Arise a basic question, how the implication of combination between presidentialism and multiparty system in Indonesia? How the regulation on vote conversion method in legislative election system? And, how the evaluation and solution alternative toward the implementation of vote conversion method in order to simplify the multiparty system in Indonesia? This is a normative legal research that collect secondary data. In the context of constitution law debate whether what is right or what is wrong, but rather in the context of the implications from the legal policy. In the context of complexity of fusion presidentialism and multi-party system, that is proper that any legal policy is built within the framework to support presidentialism effectiveness.

Abstract

Penataan regulasi dalam Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja (UU CK) dengan metode omnibus law membawa perubahan mendasar dalam penataan peraturan perundang-undangan di Indonesia. Fokus penelitian ini adalah mengenai pengaturan penerimaan permohonan fiktif positif yang sebelumnya diatur dalam Pasal 53 UU Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan (UU AP) yang turut diubah dalam Pasal 175 UU CK. Penelitian ini mencoba menjawab: (a) Bagaimana dinamika pengaturan mengenai fiktif positif dalam sistem hukum Indonesia? (b) Apa implikasi pengaturan penerimaan permohonan fiktif positif dalam Undang-Undang Nomor 11 Tahun 2020 tentang Cipta? Penelitian ini menggunakan metode yuridis normatif, dengan menganalisis data sekunder berupa peraturan perundang-undangan dan pustaka yang terkait dengan fiktif positif dan kewenangan PTUN. Hasil dari penelitian ini menunjukkan bahwa dinamika pengaturan mengenai fiktif positif dapat dilihat sejak diadopsinya KTUN dengan konstruksi fiktif negatif dalam UU Nomor 5 Tahun 1986 dan perubahannya, yang kemudian diubah menjadi KTUN dengan konstruksi fiktif positif dalam UU AP, yang selanjutnya diubah melalui UU CK dengan menghapuskan kewenangan PTUN dalam memutus permohonan penerimaan fiktif positif. Pengaturan penerimaan permohonan fiktif positif dalam UU CK setidaknya membawa implikasi terhadap: (a) hilangnya alas kewenangan PTUN untuk memutus permohonan penerimaan fiktif positif; dan (b) fiksi dianggap telah dikabulkan secara hukum terhadap KTUN dengan konstruksi fiktif positif tanpa putusan PTUN menimbulkan ketidakpastian hukum.

Abstract

The arrangement of Islamic law in the Indonesian legal system, which is manifested in statutory regulations, is an indication that Islamic law has become part of the Indonesian legal system. This is interesting when viewed using Thomas Aquinas' legal theology which introduces a legal dichotomy based on its sources, namely lex aeterna, lex naturalist, and lex humana. The dichotomy becomes a perspective to see at what level Islamic law is embedded in the Indonesian legal system. This research examines the existence of arrangement of Islamic law in statutory regulations from the perspective of legal theology, with research questions: (a) What is the justification for the arrangement of Islamic law substance in the Indonesian legal system? (b) How is the arrangement of the substance of Islamic law in the Indonesian legal system when viewed from the teachings of Thomas Aquinas' legal theology? This is normative legal research, by analyzing secondary data in the form of laws and libraries related to the arrangement of Islamic law and the teachings of the legal theology of Thomas Aquinas. The results indicate that the justification for the arrangement of the substance of Islamic law in the Indonesian legal system has a strong foothold because it is stated in the Pancasila "God Almighty" and Article 29 of the 1945 Constitution of the Republic of Indonesia. The teachings of legal theology of Thomas Aquinas show that arrangement of the substance of Islamic law in statutory regulations does not necessarily reduce the degree of Islamic law, because the substance of Islamic law in statutory regulations does not transform lex aeterna into lex humana.
