Abstract

Abstract The basic concept of regional autonomy is to give the authority to plan and implement the development of their respective regions in accordance with what they want and they need, and the central government will assist and maintain the activities that can not be implemented in areas such as monetary problems, development roads between cities and provinces, as well as maintenance of irrigation systems across various regions. Abstract

Capital punishment as a kind of punishment for perpetrators of corruption as contained in Act No. 31 of 1999 jo. Act No. 20 of 2001 on combating corruption, in level of implementation is not very effective in efforts to eradicate corruption in Indonesia. That's because the Act contained in the sentencing weighting against the perpetrators of corruption, as contained in article 2, paragraph (2). So until now there has been no perpetrators of corruption was sentenced to death, but the imposition of capital punishment in the criminal justice system in Indonesia is still need to be maintained in the legislation, because corruption has to be transnational crime (national trans border crime) and recall complexity as well as negative effects, while from the aspect of human rights, capital punishment is very closely related because the punishment is an impact on human values are universal and fundamental rights of human beings who are entitled to feel the divine life. Key Note : Corruption, Criminal Dead And Human Rights

Abstract

Pemilihan kepala daerah secara langsung bertujuan agar warga masyarakat secara bebas dan bertanggungjawab dapat memilih dan menemukan pimpinan daerah yang akan dapat memajukan dan meningkatkan daya saing daerahnya demi kemajuan dan kesejahteraan warga masyarakat yang bresangkutan. Jikalau politik hukum diartikan sebagai garis kebijakan resmi negara dalam menentukan tujuan suatu kebijakan dan cara mencapainya, maka pemilihan kepala daerah secara langsung nampaknya belum mampu mengekspresikan sebagai sarana (instrument) yang tepat bagi rakayt Indoneisa yang secara umum tingakt pendidikan dan penghasilannya relative rendah. Kondisi ini tentu berpengarih terhadap kemandirian dan integritas pemilih dalam menentukan pilihannya, di satu sisi dan mahalnya biaya pemlihan langsung juga berbanding terbalik dengan jumlah rakyat miskin dan langkanya lapangan pekerjaan. Kata kunci : Politik Hukum, Pemilihan Kepala Daerah

Abstract

Political law is a legal discipline that are categorized as most young compared with other legal disciplines are more classic, such as legal history, legal philosophy and so forth. But even so it does not mean that politics do not have laws that strategic position of a science, because of the axiology able to unlock the mystery of the law as well as the legal disciplines that have been there before.In a country which adheres to democratic governance system, though, still needed rules of the game through legal forms. Democracy without the rule would lead to anarchy. Abstract

Based on Law Number 32 of 2004 power up in the hands of regional regulations DPRD. Therefore ask the right plan district regulations also serve as the first right of legislative members. Previously these rights is the right of the Parliament in the institutional, so difficult for the Parliament in the implementation of the resulting DPRD never use rights. Right to file a plan with the rules and made the right district councilors, in order to better facilitate its implementation so hopefully more district plan rules derived from the authority of the Parliament as to form district regulations. Abstract

Kebijakan dibidang hukum oleh pemerintah Indonesia telah dilakukan beberapa kebijakan yang membantu para pencari keadilan  yang tidak mampu secara ekonomi untuk memperoleh bantuan hukum dalam proses peradilan pidana. Namun antara kebijakan dan implementasi belum optimal di aktualisasikan padahal pemberian bantuan hukum secara percuma merupakan hak warga negara sebagaimana diatur didalam UU No 48 tahun 2009 tentang pokok kekuasaan kehakiman, UU No 8 tahun 1981 tentang KUHAP, UU No18 Tahun 2003 tentang Advokad dan UU No 16 tahun 2011 tentang bantuan hukum masih banyak masyarakat belum  mengakses keadilan.   Penelitian ini dilakukan untuk mengetahui dan menganalisis kebijakan akan bantuan hukum terhadap orang miskin sebagaimana diatur didalam perundang-undangan dapat memberikan konstribusi akses keadilan bagi masyarakat dan implementasi kebijakan perundang-undangan tentang bantuan hukum dalam perkara pidana.

Abstract

Sistem pemasyarakatan yang merupakan proses pembinaan yang berdasarkan Pancasila dan Undang-Undang Dasar 1945, memandang narapidana sebagai individu anggota masyarakat sekaligus sebagai makhluk Tuhan. Menurut undang-undang Nomor 12 tahun 1995 tentang Pemasyarakatan, satu-satunya penderitaan yang boleh dikenakan pada narapidana adalah hilangnya kemerdekaan narapidana tersebut. Pengaturan pembebasan bersyarat bagi seorang narapidana harus memenuhi tahapan pembinaan yang telah ditetapkan dalam aturan tentang Syarat dan Tata Cara Pelaksanaan Asimilasi, Pembebasan Bersyarat, Cuti Menjelang Bebas, dan Cuti Bersyarat. Pelaksanaan pemberian pembebasan bersyarat bagi narapidana adalah apabila narapidana telah memenuhi persyaratan substantif dan persyaratan administratif yang telah ditetapkan oleh peraturan perundang-undangan
