Abstract

The implementation of Islamic economy in Indonesia is due to the fact that Islam has a comprehensive and universal teaching in all human life aspects, including economy. One encouraging Islamic banking development in Indonesia is indicated by the operation of banks accommodating the Sharia principles. The rapid development of Sharia banking requires an immediate implementation of Good Corporate Governance (GCG) System to provide a maximum protection for the stakeholders, especially customers. The implementation of GCG is expected to help Sharia banking minimize the poor financing quality, increase the bank assessment accuracy, infrastructure, and business decision making quality as well as become the early detection to high risk business areas, products, and services. The implementation of GCG system is greatly important since Sharia banking is the intermediary institution requiring the public or stakeholders’ trust.

Abstract

This article aims to describe the position of contract work in the legal agreements relating to mining activities in Indonesia. Based on the study of this article, formulated conclusion a few things, first, Indonesia is a country that has abundant natural resources, one of which in mining. In terms of exploration and exploitation of mining, Indonesia still apply cooperation with foreign parties. This provision is stipulated in the law of investment. This cooperation came to be known by the work contract. Second, the work contract is born started when the Indonesian government in April 1967 signed the first contract with Freeport McMoRan mining of the United States. The contract, known as first-generation contract of work. In the contract in principle the right of state control provides the authority to organize, manage and supervise the management or operation of the mine. However, it turns out in praktinya, the management of foreign and precisely controlled by the central government as powerless and not exercise its authority to the fullest.

Abstract

Penelitian ini merupakan penelitian literatur dengan pendekatan kualitatif-filosofis. Dari hasil penelitian memberikan kesimpulan bahwa: Pertama, Menurut al-Sha>fi’i<, hakikat hadirnya hukum adalah kebaikan manusia di dunia dan akhirat. Hukum Islam dipahami al-Sha>fi’i<  sebagai institusi yang tidak berakar maupun dicangkokkan pada sosiologi sebagaimana positivisme hukum. Hukum Islam merupakan sarana mengabdi kepada Tuhan, dan bukan kepada masyarakat, meskipun pada aspek teknisnya sangat memahami kondisi masyarakat. Kedua, Al-Sha>fi’i<  membangun teori hirarkhi hukum Islam didasarkan pada empat sumber yaitu, al-Qur'an, sunnah Nabi, konsensus ulama (ijma’), dan metode analogi (qiyas). Jika ditilik secara konseptual dari perspektif positivisme hukum, maka teori sumber hukum Islam yang dibangun oleh al-Sha>fi’i< kurang lebih sama dengan teori tingkatan norma Hans Kelsen. Ketiga, Dalam konteks  eksistensi positivisme hukum ditujukan untuk mengatur kehidupan manusia selaku anggota masyarakat agar tercipta kepastian hukum. Tentu eksistensi ini berbeda dalam sistem hukum Islam, hukum hadir dalam Islam untuk mengatur kehidupan manusia, baik selaku pribadi maupun selaku anggota masyarakat agar dapat bertingkah laku yang sesuai dengan kehendak Sang pencipta. Keempat, Sumber positivisme hukum yang terbagi dalam hukum material dan formal juga memiliki aspek perbedaan dengan hukum Islam. Hukum Islam juga mempunyai sumber hukum material, namun memiliki substansi berbeda dengan positivisme, yaitu bahwa sumber hukum Islam berasal dari wahyu, sedangkan hukum positif bersumber kepada perilaku dan realitas dalam masyarakat.

Abstract

Kajian  ini  bertujuan  untuk  mengeksplorasi  hasil  pengabdian  masyarakat  yang  telah dilaksanakan  dalam  1  bulan.  Pengabdian  ini  bertujuan  terciptanya  perubahan  dan kesadaran  dari  kepribadian  remaja  untuk  dapat  lebih  bisa  memanfaatkan  potensi  dan  aset yang  dimiliki.  Usaha-usaha  yang  dilakukan  sengaja  diarahkan  agar  bagaimana  remaja  ini bisa  berubah,  berinisiatif,  dan  berkreativitas  secara  mandiri  untuk  merubah  mindset  diri yang  sebelumnya  malas  dan  pasif.  Pengabdian  ini  menggunakan  pendekatan  pendampingan ABCD  (Asset  Based  Community  Development).  Dengan  melakukan  pemberdayaan remaja  di  Dusun  Penanggungan  diharapkan  mampu  meningkatkan  pengetahuan  dan kemampuan  komunitas  remaja  dalam  mengidentifikasi  masalah  yang  dihadapi,  potensi yang  dimiliki,  merencanakan  dan  melakukan  pemecahannya  dengan  memanfaatkan  potensi setempat.  Setelah  dilakukan  pengabdian  yang  dilakukan,  terlihat  perubahan  dari  hasil pengabdian  yang  telah  dilakukan.  Adapun  perubahan  yang  paling  utama  dari  remaja yakni  lebih  bisa  mengembangkan  kreatifitasnya  untuk  belajar  dan  mengikuti  pelatihan Qasidah Rebana  yang telah diadakan sekaligus memperkuat  komunitas remaja  tersebut.

Abstract

This article explanes about urgency of signatures and stamp duty in giving legal certainty to the franchise contract. This theme departs from the rise of business model franchise today in Indonesia. This business is considered to minimize the risk of failure, as well as to provide various facilities. This research is a descriptive analytical research. In franchise contract are still many things that can happen in the future that might be detrimental to the parties. Therefore we need the legal umbrella to shade and protect with the aim to create a sense of fairness and legal certainty for the parties, not just for profit (profit oriented), but there is accountability for the impact of the overall business operations. To provide legal certainty every contract franchise must be in writing and include the signature and the stamp in order to obtain a force of law and can be evidence, so the purpose of legal certainty can be realized.

Abstract

This study aims to explore the construction of Village autonomy arrangements to realize people's welfare. As it is understood, the issuance of Law No. 6 of 2014 on Villages has become a new chapter of autonomy regulation in Indonesia, which opens space for villages to be independent and autonomous. This research is juridical-normative research, which includes a descriptive-qualitative type—using secondary data from primary and secondary legal materials. This study applies statute, conceptual and hermeneutic approaches to data analysis. The findings of this study are that in realizing people's welfare, the construction of village autonomy arrangements is based on comprehensive and integrated planning based on each region's potential. So that each region gets benefits and benefits together. The realization of this welfare includes two components: the provision of essential services in the village and the development of the village economy based on local resources' potential.

Abstract

Legislation as a political product is ideally a representation of the people's aspirations and, at the same time, can impact the benefit of the people at large. However, in practice, the dominance of the interests of the political elite makes the resulting legal products represent political interest groups. This article explores the dynamics of Sharia economic law after reform in Indonesia. This research uses a conceptual-juridical approach and is a type of qualitative research. Data collection techniques are carried out by digging library sources relevant to the study topic. This study finds that the internal socio-cultural dynamics of Muslims largely determine the dynamics of Sharia economic law in post-reform Indonesia on the one hand, Islamic-leaning political parties in parliament, as well as fluctuations in the relationship between Muslims and the state. A conducive political climate enables the development of the Islamic financial industry in the region and nationally. This dynamic contributes to strengthening Sharia economic values ​​in the legislative process and bureaucratization of Sharia economic law in the national legal ecosystem.
