Abstract

ABSTRAKPenelitian ini berjudul Implementasi Undang-undang Nomor 30 Tahun 2014 Tentang Administrasi Pemerintahan Terhadap Proses Penyidikan Tindak Pidana Korupsi di Polres Rembang. Tujuan penelitian ini : 1) Mendeskripsikan studi kasus tindak pidana korupsi sejak berlakunya UURI Nomor 30 tahun 2014 studi kasus di Satreskrim Polres Rembang. 2) Menganalisis kendala–kendala yang dihadapi oleh penyidik satreskrim Polres Rembang dalam penanganan tindak pidana korupsi sejak berlakunya UURI Nomor 30 tahun 2014 studi kasus di Polres Rembang. 3) Menganalisis solusi terhadap kendala penanganan tindak pidana korupsi di satreskrim Polres Rembang setelah berlakunya UURI Nomor 30 tahun 2014.Hasil penelitian : 1) Keberadaan Pasal 21 Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan mencabut kewenangan yang dimiliki penyidik dalam melakukan penyidikan dalam rangka mengetahui apakah telah terjadi penyalahgunaan wewenang yang dilakukan oleh seorang tersangka selaku pejabat pemerintahan.Kata Kunci : Implementasi, Administrasi Pemerintahan, Korupsi.ABSTRACT               This research entitled Implementation of Law Number 30 Year 2014 About Government Administration Against Corruption Crime Investigation Process in Polres Rembang. The purpose of this study: 1) Describe the case study of corruption since the enactment of UURI Number 30 year 2014 case study in Satreskrim Polres Rembang. 2) Analyzing the constraints faced by the investigator satreskrim Rembang Police in handling corruption since the entry into force of UURI Number 30 of 2014 case study in Polres Rembang. 3) Analyzing the solution to the constraints handling corruption crime in Satres Polres Rembang after the enactment of UURI Number 30 of 2014.Result of research: 1) The existence of Article 21 of Law Number 30 Year 2014 concerning Government Administration revokes the authority of the investigator in conducting an investigation in order to know whether there has been misuse of authority carried out by a suspect as a government official.Keywords: Implementation, Government Administration

Abstract

Research titled Role of the Police Community policing (CBP) In Dealing Deeds Due to Drinking Alcohol In Semarang Police Jurisdiction.The method used in this research is a sociological juridical approach namely legal research study and research which is a reciprocal relationship between law and social institutions to another. The results showed that the role of the Community Police in dealing with acts from drinking liquor in the jurisdiction of Police Semarang focused on law enforcement by means of a non-penal pioneered by Bhabinkamtibmas in collaboration with community leaders. Shape optimization of track non penal in the sense of seeking common ground in the effort of deliberation and consensus that includes all the criteria in the agreement in the peace process outside the courts by using means of mediation or deliberation in achieving justice expected by the parties involved in the criminal law that is the perpetrator the crime of family and victims of crime family to find the best solutions that are approved and agreed by the litigants. Constraints faced by Community Police in dealing with acts from drinking liquor in Semarang Police Jurisdiction is the human resources inadequate, infrastructure, budget and finance, behavioral factor of habit with authorities or employers, and is not well understood and the culture ministry, yet fully have an understanding of the behavior as protectors and servants of the people and have not understood the Police professional code of ethics, limited ability to carry out the function of patrol officers, guard and Escort to the prevention of crime and the lack of ability to perform an analysis of crime, not communicative with the public, limited facilities, infrastructure supporting Samapta officer. In order to overcome the difficulties of handling acts from drinking liquor in the jurisdiction police station Semarang, Semarang Police Community Policing take steps as follows: Increasing the resources the Police in providing services in the field of law enforcement, emphasizing an understanding of the behavior of the police as protectors and servants of the people and the professional code of ethics police, improve the ability of officers to carry out the function of patrol, guard and escort to prevention of crime, to improve facilities, support infrastructure Bhabinkamtibmas officers, and conduct legal counseling to the community as well as the effects of drinking alcohol. Abstract

Fraud against the implementation of Umrah worship in violation of authority and rights, although the government has issued Law Number 13 Year 2015 on Umroh Worship Implementation which has been experiencing approximately 4 years in effect, but there are still many Umrah travel agencies who commit fraud to prospective Umrah pilgrims. The related fraud case in question is about the criminal act of fraud which has the objective element for the victim to be used for umroh fee by using false profession and institution (umroh distributor) guile or set of lies to fool the victim. The purpose of this study is to find out how the law enforcement of police in investigation of criminal acts of fraud of prospective pilgrims umroh, knowing factors inhibiting the police in the investigation of criminal acts of fraud prospective pilgrims umroh and to find a solution about police barriers in the investigation of criminal acts fraud prospective pilgrims umroh at the stage of investigation on investigator Sat Reskrim Polrestabes Semarang. The methodology used is the empirical approach. Adapaun source and type of data in this study is the primary data generated from field studies with 3 investigators at Sat Reskrim Polrestabes Semarang City. And secondary data from literature study. The conclusion of this research is the mention of anti-disaster against the evidence, make a list of people (DPO) and arrest the suspect. Abstract

The village treasury is one of the village's assets / wealth which is highly expected to support the wheels of village government. As one source of village income and income of village apparatus, village cash lands should be productive land. With the existence of Law No. 6 of 2014, related to the management of property owned by the village has changed that is with the enactment of the Minister of Home Affairs Regulation No. 1 of 2016 on the Management of Village Assets, which provides an opportunity for the village to be able to implement the transfer of village assets in the form of land through exchange, not only to be used for the public interest, but also not for the public interest, and the village cash lands in addition to the public interest and not for the public interest.However, in fact Permendagri Number 1 Year 2016 which serve as a legal basis for the exchange of assets of villages in the form of land can not be fully implemented. Abstract

AbstractThis study is made to know and understand about the roles that are performed by the political parties in doing some supervisions of the cadres on DPRD. So that, based on the supervisions above are expected to improve the performances and qualities for the citizen’s representation. The council members are the representation of their citizen. They must be able to reflect on their wishes of their represented people in country. But, in fact the roles of the political parties are the most dominant and able to shift the meaning of the actuality representatition it self.The authority is strenghtened with the right of politic parties to make an interm change for all the members of council who are unfollow their rules and make the cadres are unfreely to vote.This study is using Descriptive Analyst Method through by some interviews with the most valuable competent persons to answer all the problems. The council members are the representation of their citizen. They have a responsibility in accomodating people’s aspiration. In other hand, they also as a representation of their political parties because they are chosen by political parties they have joined. So, they are bound indirectly with the rules and the decisions made by their parties. So that, with this fact can show that the council members are unfreely speak out on behalf of their citizen’s aspirations.Keyword : The Council Members, Political Parties,Supervision, Citizen. AbstrakPenelitian ini bermaksud untuk mengetahui serta memahami bagaimana peran yang dilakukan partai politik dalam melakukan pengawasan terhadap kadernya yang duduk di DPRD, dengan adanya fungsi pengawasan yang dilakukan partai politik diharapkan dapat meningkatkan kinerja dan kualitas perwakilan bagi anggota DPRD sebagai wakil rakyat. Anggota Dewan merupakan representasi masyarakat yang diwakili, maka harus mampu mencerminkan atas keinginan masyarakat yang diwakili. Namun, besarnya peran partai politik mampu menggeser makna dari representasi yang dimiliki anggota dewan. Kewenangan partai politik diperkuat dengan hak partai untuk melakukan pergantian antar waktu bagi anggota dewan yang tidak mengikuti garis partai, yang menjadikan anggota dewan tidak mempunyai kekuasaan secara bebas dalam bersuara mewakili konstituen. Penelitian ini menggunakan metode deskriptif analisis, melalui wawancara dengan pihak-pihak terkait yang dipandang kompeten, untuk menjawab permasalahan yang ada. Anggota DPRD merupakan wakil rakyat, yang mempunyai tanggungjawab menampung aspirasi masyarakat, namun anggota DPRD juga merupakan representasi partai politik karena mereka dipilih melalui partai politik, sehingga secara tidak langsung mereka terikat oleh aturan atau keputusan yang dibuat oleh partai politik. dengan kenyataan ini menunjukkan bahwa anggota dewan tidak dapat secara bebas dalam bersuara mewakili aspirasi konstituenya.Kata kunci: Anggota Dewan, Partai Politik, pengawasan, Masyarakat / Konstituen

Abstract

The role of Political Parties in the provision of political education to the public is a duty that must be implemented to realize the ideals of this nation's democracy, with the great participation of the community in voting in the general election, especially the people in Semarang City. The high number of votes given by the people in the general election indicates the role of political parties in providing political education materials.Political education given to the community implemented by political parties in the city of Semarang include: Gerindra Party, Golkar, and Democrats do not run as expected, therefore the author makes this thesis with the formulation of the problem: 1. The role of political parties in providing political education to community of Semarang City. 2. Does the political education undertaken provide an innovative impact and the active role of the community in following the elections. 3. Constraints and solutions of political education from political parties in Semarang City.Writing this thesis aims to determine the implementation of political education conducted political parties in the city of Semarang whether it is in accordance with the ideals of democracy as stipulated in Law No. 2 of 2011 on Political Parties.The results of this study indicate that political education conducted by political parties in Semarang City has been successful with marked improvement of public vote and general election. Keywords: Role, Political Education, Political Party

Abstract

This study aims to determine the status of children due to underhanded marriages whose parents have remarried (new) and are registered with the Marriage Registrar, without marriage isbat for their previous marriages. This study uses a normative juridical research method, which focuses on examining the laws and regulations and the determination of the Religious Courts regarding the status of children born as a result of underhanded marriages. Based on the results of the study, it can be concluded that the Religious Courts in determining the application are guided by the rule that the legal status of a child born as a result of an underhand marriage depends on the validity of the marriage (marriage contract) of both parents which at that time was carried out under the hands, namely the marriage must meet the pillars and conditions of marriage and there are no obstacles to marriage according to Islamic law in accordance with statutory regulations. If these things are not fulfilled, then the child's status is only related to his mother and his mother's family. The re-marriage (new) that is registered is not retroactive so that it does not necessarily have legal consequences on the legitimacy of the child.

Abstract

 The criminal act of theft with a denunciation that occurred at Sat Reskrim Polres Kendal is handled through the process of investigation process in accordance with the revision of Law No. 8 of 1981 on the Criminal Code (KUHAP). The legal basic for the revision of Law Number 8 Year 1981 is the decision of the Constitutional Court Number 130 / PUU-XIII / 2015. This Constitutional Court ruling has changed some of the stages in the pre-prosecution process where previously in the pre-prosecution phase the investigator only gave the Order of letter of notification commencement investigation (LNCI) to the public prosecutor has now been amended and requires the investigator to grant LNCI not only to the public prosecutor but also to the reported and the victim / complainant. However, this Constitutional Court Decision is allegedly a bit of a hindrance and complicate the task of investigators, especially in handling the crime of theft with a denunciation, which with the implementation of this LNCI submission stage especially to the reported, making report easy to eliminate the evidence, influence the witnesses and even reported trying to run self. To overcome this, the action taken by the investigating team is to provide LNCI with several stages while still guided by the decision of the Constitutional Court Number 130 / PUU-XIII / 2015.Keywords: Implementation, Constitutional Court Decision, Theft with Objection

Abstract

Kabupaten Demak dengan jumlah penduduk 1.063.763 jiwa , 99,45 ber agama Islam, fakir miskin 198.800 jiwa, zakat merupakan sumber potensial dalam penaggulangan kemiskinan. Data yang diperoleh akan dianalisis dengan memperhatikan kualitas data yang berupa fakta terjadi dalam praktek maupun dari kepustakaan. Pengelolaan zakat di Kabupaten Demak berdasarkan Keputusan Bupati Demak Nomor 451/20/2010 tentang Pembentukan Badan Amil Zakat Daerah (BAZDA) Kabupaten Demak, dan Keputusan Bupati Demak Nomor: 451/455/2011 tentang Himbauan Berzakat. Ketentuan umum UU No.23/2011 disebutkan zakat adalah kewajiban bagi umat islam yang mampu sesuai syariat islam, zakat merupakan pranata keagamaan yang bertujuan untuk meningkatkan keadilan, kesejahteraan masyarakat dan penanggulangan kemiskinan.
