Abstract

The present study aims to uncover the problems, aspects, solutions and strategies of halal travel and tourism in North Sumatera, Indonesia. This study employs Analytic Network Process (ANP) methods in three steps, first, problem decomposition, pair-wise comparison questionnaire, and synthesis and analysis. ANP also used to gather the opinion and responses from the experts. From this study, it was found that the problems of improving halal travel and tourism based on their level of significance are as follows: Environment, Access and Services, and Communication. Meanwhile, the priority of aspects to improve halal travel and tourism based on their level of significance are environment, access, services, and communication. Similar to problems and aspects, solutions based on their level of significance are environment, access, services and communication. In addition, top three strategies that recommended from this study are ecosystem, destination, and accessibility and connectivity. The findings of this study are also furnished with some recommendation from the industry perspective and stakeholders of halal travel and tourism.

Abstract

AbstractBased on the principle of presumption Rechmatiq / Praesumptio iustae causa thatthe decision of the State Administrative (KTUN) should be considered legal until there is a court decision stating the contrary, it is in order that the task of the government is viable in particular to provide protection, public services and welfare for people, but as a counterweight to provide legal protection to the interests of the plaintiff, the judge may issue a suspension in the implementation. Stipulation is a legal product that was originated from the requests (no dispute) but in this case there is a dispute over the State Administration, but the judge may issue a stipulation of the suspension.Keywords: Implementation Suspension of State Administrative Decisions lead tolaw situation/condition (rechtstoestand) back to the former state or position (restitutio in integrum) prior to the decision of the State Administrative being disputed.

Abstract

Artikel ini mengambarkan pemanfaatan Modal sosial dalam Pengelolaan Bum Desa. Artikel ini berangkat dari persoalan mitra (baca; Bum Desa) yang mengalami stagnasi. Solusi yang ditawarkan adalah memanfaatkan kelompok-kelompok masyarakat berbasis modal sosial. Solusi ini adalah anti thesa dari kondisi pelaksanaan bisnis Bum Desa yang bertumpuh pada mekanisme pasar murni. Kajiankali ini dilaksanakan di Badan Usaha Milik Desa (Bum Desa) Kertonegoro Desa Kertonegoro Kecamatan Jenggawa Kabupaten Jember. Kelompok sasaran sekaligus mitra adalah Pengurus Bum Desa “Kertonegoro” sebagai pihak utama. Pihak terkait adalah pengawas Bum Desa, kelompok-kelompok masyarakat yang teridentifikasi sebagai modal sosial di desa, diantara Rukun Keluarga, Pengurus Masjid, PPK dan Karang Taruna. Hasil dari pemecahan persoalan Bum Desa adalah revitalisasi Bum Desa mengacu kepada pembentukan  kelembagaan baru dan potensi desa. Pemetaan reliabilitas unit bisnis yang bisa running dan penguatan kelembagaan Bum Desa.

Abstract

Penelitian ini membahas mengenai eksekusi putusan penundaan pelaksanaan atas suatu keputusan Tata Usaha Negara. Pendekatan yang digunakan adalah pendekatan konseptual (conceptual approach) dan pendekatan perundang-undangan (statute approach). Hasil penelitian menunjukkan bahwa Penundaan pelaksanaan Keputusan Tata Usaha Negara mengakibatkan data laku (gelding) terhadap Keputusan Tata Usaha Negara yang digugat terhenti untuk sementara waktu (tijdelijik) mengakibatkan suasana/keadaan hukumnya (rechtstoestand) kembali pada keadaan atau posisi semula (restitution in integrum) sebelum adanya Keputusan Tata Usaha Negara yang disengketakan serta memberi batasan (retricteren) berlakunya asas praduga sah (praesumtio iustae causa/vormoeden van rechtmatigheid). Mengingat pengaruh yang ditimbulkan oleh adanya putusan penundaan pelaksanaan Keputusan Tata Usaha Negara, maka dalam pertimbangan hukum hakim, diperlukan alasan-alasan hukum secara filosofis, teoritis dan yuridis.

Abstract

Products are "goods and / or services related to food, beverages, drugs, cosmetics, chemical products, biological products, genetically engineered products, as well as used goods that are used, used or utilized by the public", while the halal certificate is a certificate issued by the Central or Provincial MUI regarding the case of a food product, foodstuff, beverage and medicine and cosmetics produced by the company after being examined and declared halal by an institution authorized to issue a halal product certification. In Article 4 of Law No. 33 of 2014 concerning the guarantee of halal products it states that "Products that enter, circulate and are traded in the territory of Indonesia must be certified halal". Normatively, the article clearly stipulates that drugs that enter, circulate and are traded in the territory of Indonesia must be guaranteed halal. However, the halal certification process for medicines in Indonesia is waiting for a long time due to various dynamics, this is the content of researchers seeing the gap between Law Number 33 of 2014 and the current reality, we should be able to reflect on other countries as well. Abstract

The aims of the study are to find out the process of implementing divorce case in North Sumatera. This study is a qualitative and normative study of PERMA Number 1 of 2016 with its application in the North Sumatra Religious Court as a legal product in the present aspects that applies in testing the success of the regulation being implemented in the North Sumatra Court, especially in (three) 3 big cities namely the Court Medan, Binjai and Tebing Tinggi religion. The result shows that The implementation of peace in divorce cases in the North Sumatra Religious Court is not significant. In the implementation of divorce case mediation in the North Sumatra Religious Court, many factors influence, among others, technical and non-technical factors. The technical factor is the limitations of the Mediator, namely the absence of a list of non-Judge Mediators here will further aggravate the work of the Judge because of his work being double that is as a Panel Judge and Mediator Judge. So that the work of the Judge mediator is very ineffective and so is the non-judge mediator who must have an official certificate from the Supreme Court so that the training costs are large and the costs of the mediator are not protected by the Regulation

Abstract

This research is motivated by the problem of Mustahik’s success rate in managing productive zakat at the National Amil Zakat Board (BAZNAS) North Sumatradid not show the results as expected. This research aims: 1) To know the Mustahik Mentoring and Mentoring Program in management productive zakat on the National Amil Zakat Board (BAZNAS) North Sumatra. 2) To analyze the strategy of the National Zakat Agency (BAZNAS) North Sumatra on Assistance and Guidance of Mustahik inmanagement productive zakat. 3) To analyze the strategy of the National Zakat Agency (BAZNAS) North Sumatra on Assistance and Guidance of Mustahik inmanagement productive zakat in accordance with the concept of sharia. The research method used is qualitative research methods, data collection through observation, interviews and documentation and questionnaires. The data analysis used is interactive analysis (Miles and Huberman) to analyze the potential of the National Zakat Agency. (BAZNAS) North Sumatra, Mentoring and Guidance program and Mustahik's perception. SWOT analysis as the basis for formulating the strategy of the National Zakat Agency (BAZNAS) North Sumatra in the productive Mustahik Assistance and Development program. The results show that Mustahik in managing productive zakat has not received assistance and guidance from the National Zakat Agency (Amil Zakat).BAZNAS) North Sumatra.

Abstract

It is an agreement of the ummah, that what Allah revealed in the Al-Qur'an and also what was conveyed by the Messenger of Allah in the Hadith are the basic sources of Islamic law. The two sources, of which there is an order (Amr), this Amr has various meanings such as obligatory, mustahab and others. In this study, the researcher attempted to describe the views of the scholars of jurisprudence in understanding the meaning of amar and its implications for one of the Islamic laws, and here the researcher took one case, namely the practice of worship during the Covid-19 Pandemic. Although most of the Ulama proposing fiqh are of the view that amr basically has a mandatory meaning unless there is a qarinah, in practice there are differences between them. In this study, the researcher used an analytic descriptive method in which after the researcher described the views of the Ulama with regard to the meaning of amr, the designation of the meaning of amar and the legal implications of practicing worship during the Covid-19 Pandemic, considering that at this time there were differences in worship practices that had never happened before Furthermore, the researcher provides some analysis of what the researchers understand based on the views of scholars and experts in this matter.
