Abstract

Abstract Restorative Justice is the conflict solution which focus on recoverable original state. The child who did the crime, the Bajo tribal law to finish the problem. The purpose of the mediation conducted by customary law of Bajo is, returning the losses suffered by the victims, so their actions can be accounted. This research is field research or often called empiric law research, by using juridical sociology approach, analysis in this paper used descriptive qualitative, i.e. to describe clearly overall object to be studied in the field in order to achieve the clarity with problems that would be discussed. The result of study children who did morality criminal acts on Bajo custom society show that from the year of until 2010 until 2013 is about 41 person children did morality criminal acts, and all of the finishing process are done with custom way by tribal chief which is called Punggawa without include the police. Key words: restorative justice, children, criminal acts of indecency, bajo customary law. Abstrak Restorative Justice merupakan bentuk penyelesaian konflik yang mengedepankan pada terpulihkannya keadaan  semula.Anak yang melakukan tindak pidana kesusilaan diselesaikan dengan hukum adat Bajo. Tujuan dari mediasi yang dilakukan oleh hukum adat Bajo ini adalah untuk mengembalikan kerugian yang dialami korban, sehingga hasil perbuatan yang dilakukan oleh pelaku dapat dipertanggung jawabkan.Penelitian ini merupakan penelitian lapangan atau sering disebut penelitian hukum empiris.Dengan menggunakan pendekatan yuridis sosiologis, analisis dalam penelitian ini menggunakan deskriptif kualitatif yaitu dengan cara mengambarkan secara keseluruhan keadaan yang akan diteliti di lapangan secara jelas, sehingga mencapai kejelasan dengan masalah yang akan dibahas. Hasil dari penelitian ini menunjukkan bahwa anak yang melakukan tindak pidanakesusilaan pada masyarakat adat Bajo dari tahun 2010 s/d tahun 2013 sebanyak 41 orang anak yang melakukan tindak pidana kesusilaan, dan keseluruhan proses penyelesaiannya dilakukan secara adat oleh ketua adat yang disebut Punggawa tanpa melibatkan pihak kepolisian. Kata kunci: restorative justice, anak, tindak pidana kesusilaan, dan hukum adat bajo.

Abstract

Problems with indigenous people in Boalemo district, Gorontalo Province often occur, especially the issues about the imposement of costumary sanctions. Imposing costumary sanctions without clear relugations will absolutely cause legal consequences in the future. Eventhough constitutional rights for indigenous people is already granted by the government as stated In article 18B paragraph (2), and Article 28 I paragraph (3) of The 1945 Constitution Of Republic Indonesia. This regulation is a mandate from the state and given to the regions. This regulation is oftenly referred when discussing the existence and rights of indigenous peoples and become a crutial issues when it comes to the implementation of the protection of the constitutional rights for indigenous peoples in Boalemo district Gorontalo Province. Therefore, This research aims to analyze the Legal standing for indigenous people and constitutional rights for costumary sanctions in Boalemo district Gorontalo Province. This normative research utilized secondary data as resourch and used statute approach and case approach. The results of the study discover that the costumary law and the imposement of costumary sanctions are still mantained and implemented in Indonesia. Government should more concern about constitutional rights compliance for indigenous people. However, the imposement of customary sanctions are not regulated in a regional regulation. So the constitutional rights which should become the spirit for regional autonomy to provide justice in a judiciary are only resolved by way of deliberation, This can not give the satisfaction for some parties.

Abstract

Kuala Lumpur Village is oone of the villages in Paguyaman District, Boalemo Regency. The Kuala Lumpur Village community can be said to be a society that is responsive to change of Sawah Tourism Villae, thus making it a prosperous and prosperous village. The purpose of this Thematic Community Service Program is to develop and advance Kuala Lumpur Village into a village where the management of village-owned enterprises will further advance Kuala Lumpur Village into a rice field tourism village. With the flow of activities, namely the preparation and debriefing of KKN students, then continued with the implementation of the program starting with village observations, looking bact at what programs have not been implemented and followed by determining the priority of the problem, determining the priority of the program to be implemented.

Abstract

Command responsibility is essential in international human rights enforcement, namely the 1998 Rome Statute. This is also regulated in Article 42 of Law No. 20 of 2000 on the Human Rights Court. Along the way, there are several areas for improvement in Law No. 20 of 2000 concerning the Human Rights Court, namely mistranslations, interpretations and unclear norms relating to command responsibility. This study aims to: (1) To be able to identify and analyze the Command Responsibilities in Law No. 26 of 2000; and (2) To be able to find out and analyze the comparison of Law No. 20 of 2000 on the Human Rights Court and the 1998 Rome Statute of command responsibility. This research is classified as normative research with a philosophical and analytical approach. Materials are collected through document studies and then analyzed prescriptively. The study results show that the Command Accountability in Law Number 26 of 2000 concerning the Human Rights Court has several weaknesses, interpretations and unclear norms related to command responsibility. Therefore, it is necessary to synchronize the 1998 Rome Statute with the Elaborated Approach, namely by adopting the provisions in the Rome Statute, which are elaborated with the National Legal Interest.

Abstract

This research was carried out at the Suwawa Religious Court Office as well as places related to the author's discussion. This study aims to determine the factors that cause the occurrence of a right for a child born from an unregistered marriage. Primary data and secondary data were collected and analyzed based on a descriptive qualitative problem formulation. Already pregnant out of wedlock, 2) Not getting permission for polygamy, 3) lack of attention or knowledge of the importance of having a legal marriage in the eyes of the law.

Abstract

Disparity is the difference in deciding one case with another, this is often a question in a society about how this disparity can occur, which is when there is one case that is the same, but the way of giving sanctions is different, this also causes a Indonesian law is questioned whether the sanctions or punishments are appropriate or not and whether justice exists or not. This distinction will also stem from how a decision has been made by a judge, which basically judges give punishment based on several aspects, and where judges also have authority to decide a case. The purpose of this research is to find out what disparity is, and how considerations and legal aspects are used to decide a case. In this case, there is a disparity that will be discussed regarding the Disparity in Judges' Decisions Against the Crime of Defamation on Social Media (Analysis of Decisions Number 755/Pid.Sus/2020/Pn.Gtlo and 331/Pid.Sus/2019/Pn Gtlo). Where the method used is qualitative research with a statutory approach, conceptual approach, and a comparative approach and this type of research is normative juridical research.

Abstract

One of the crimes of physical violence was ever committed by a child until the victim died, as the child who committed physical violence resulted in the death of the victim. For the actions committed by the child as the perpetrator of the crime, the judge sentenced the child to 4 years in prison. The purpose of this research is to find out the factors that cause children to commit crimes of physical violence that result in death, criminal responsibility by children who commit physical violence that result in death, as well as the application of sanctions to children who commit crimes of physical violence that result in death. The type of research used is normative juridical research with a statutory approach and a case approach, which is supported by data obtained from library data including books, laws and regulations, and court decisions, and in this case the data is processed using qualitative analysis. Based on the results of the study, the factors that cause children to commit crimes of physical violence which result in death are due to several factors, both internal and external factors. Criminal liability by children who commit physical violence resulting in death can be seen from the provisions in Article 351 paragraph (3) of the Criminal Code, as the criminal responsibility is imposed on children when the child is proven to have fulfilled the criminal elements in the form of mistakes made by children, violence The physical violence that was done was done by the child, and the victims who were victims of physical violence were known to have died during or after the physical violence was carried out. The application of sanctions to children who commit acts of physical violence resulting in death, namely imposing prison sanctions on children, therefore, is sentenced to 4 years in prison.

Abstract

Child abuse usually occurs due to negligence of parents or other caregivers. There are examples of cases that require action in child protection, namely child violence that occurs in orphanages. Based on these problems, the latest research is needed regarding the protection of child violence against orphanage children. This study uses empirical legal research methods. This research shows that children should get protection against violence or anything that can harm or hinder their growth and development in accordance with children's rights. Criminal sanctions for orphanage owners who commit violence against foster children can be given as an effort to protect the law from law enforcement officials against victims. Application of criminal sanctions against orphanage owners who commit violence against their foster children. That is, the perpetrator is subject to a penalty of 10 years in prison, the sentence is still not commensurate with the suffering experienced by the victim.
