Abstract

The Covid-19 vaccination program in Indonesia, practically has received a pro and contra in the society. In this context, the Majelis Ulama Indonesia (MUI) came through its fatwa to respond the contra-productive of the community over the succession of the vaccination program. This study analysis the epistemological basis of Islamic law in the construction of the MUI Fatwa Number. 02 of 2021 about Covid-19 Vaccine Products from Sinovac Life Sciences Co. Ltd. China And Pt. Bio Farma (Persero). This qualitative research used philosophical approach, statute approach and conceptual approach. The results show, the epistemological construction of the MUI fatwa No. 02 of 2021 about the Covid-19 vaccine, Sinovac tends to integrate the paradigm of idealism and realism of Islamic law. The tendency of the integrative paradigm can be seen from the epistemological basis of the MUI fatwa formulation on the halalness of the Sinovac Covid-19 vaccine, which is normative-deductive and empirical-inductive, beside that still use preventive fiqh rules (sad al-dhariah) and benefit (maslahatul mursalah) as the basis for formulating a fatwa. This conclusion can be seen in various elements in the epistemological construction of the MUI Fatwa. First, universal ethical moral values ​​('am) are taken from the texts (al-Qur'an and Hadith). Second, several fiqh rules emphasize the sadd al-zari'ah (preventive action) and maslahah mursalah (public benefit). Third, the opinion of classical scholars. Fourth, the thought of experts regarding the Covid-19 vaccine.

Abstract

AbstractThe biggest spiritual orientation for every Muslim in performing Hajj is getting predicate Hajj Mabrur. So whether the predicate is just a spiritual title? This research will describe Nurcholish Madjid's Sufistic social fiqh thoughts about the meaning of the predicate hajj Mabrur. This type of research is a qualitative research in the form of library research. The main data source used was a book by Nurcholish Madjid entitled Hajj and Umrah. Meanwhile, secondary sources are used, namely various studies that are relevant to the focus of this research study. The method used in this study is the method of interpreting the thought of figures. There are two big conclusions of this research. First, the integrative paradigm of nurcholish Madjid, namely the paradigm of integration between fiqh, social and Sufism. This integrative paradigm according to Nurcholish Madjid can make fiqh as a medium for the social reform movement. Second, the predicate Hajj Mabrur in the perspective of Nurcholish Madjid is not a predicate based on success in fulfilling the formal legal of the Hajj fiqh, but rather a predicate that has spiritual and social implications in social life.Keywords: Hajj mabrur, fiqh, social, sufismAbstrakOrientasi spritual terbesar bagi setiap muslim dalam menunaikan ibadah haji yakni mendapatkan predikat haji mabrur. Lantas apakah predikat tersebut hanya sekedar predikat spritual? Penelitian ini akan mendiskripsikan pemikiran fikih sosial sufistik Nurcholish Madjid tentang makna predikat haji mabrur. Jenis penelitian ini merupakan penelitian kualitatif yang berupa kajian pustaka (library research). Sumber data utama yang digunakan, yakni buku karya Nurcholish Madjid yang berjudul Haji dan Umrah. Sementara itu, sumber sekunder yang digunakan, yakni berbagai penelitian yang relevan dengan fokus kajian penelitian ini. Metode yang digunakan dalam penelitian ini, yakni metode interpretasi pemikiran tokoh. Terdapat dua kesimpulan besar penelitian ini. Pertama, paradigma fikih integratif nurcholish Madjid, yakni paradigma integrasi antara fikih, sosial dan tasawuf. Paradigma integratif ini lah yang menurut Nurcholish Madjid dapat menjadikan fikih sebagai medium gerakan reformasi sosial. Kedua, predikat haji mabrur dalam perspektif Nurcholish Madjid bukanlah sebuah predikat yang berdasarkan pada keberhasilan dalam memenuhi legal formal fikih ibadah haji, melainkan sebuah predikat yang memiliki implikasi spritual (tasawuf) dan sosial dalam kehidupan bermasyarakat. Kata Kunci : Haji mabrur, fikih, sosial, tasawuf

Abstract

This study compares Zakat and tax relations in three countries in the Southeast Asian region, where most of the population is Muslim (Indonesia, Malaysia, and Brunei Darussalam). This type of research is normative, empirical legal analysis with a comparative approach. The results showed relational and functional distinctions in Zakat and tax positions in Indonesia, Malaysia, and Brunei Darussalam. In Indonesia, paying Zakat can reduce taxable income. Meanwhile, Malaysia uses Zakat as a deduction for individual taxes, even up to 100%. Meanwhile, in Brunei Darussalam, the Zakat and tax relationship are not interrelated.

Abstract

 The problem of the motive or ideological pattern of da'wah that is scattered, both in the real and virtual world, has prompted the Indonesian Ulema Council (MUI) in 2017 to set guidelines for preachers in Indonesia. These guidelines are intended to be a code of ethics for da'i who carry out da'wah activities in Indonesia. This qualitative research in the form of a literature study intends to identify the dimensions of mainstreaming religious moderation values in the orientation of da'wah in Indonesia as formulated by the MUI. This study uses a normative-philosophical approach. The analytical theory used, namely four indicators of religious moderation formulated by the Ministry of Religion of the Republic of Indonesia in the form of anti-radicalism values, national commitment, tolerance, and accommodative to local culture. The results of the study conclude that there are dimensions of mainstreaming religious moderation values, dimensions of religious moderation values in da'wah orientation in Indonesia which were formulated by the Indonesian Ulema Council. First, the value of anti-radicalism in the orientation of religious-humanist Islamic religious character formation. Second, the value of national commitment and tolerance in the orientation of forming a nationalist and pluralist Islamic religious character. Third, the accommodative value of culture in the orientation of forming an innovative and harmonious Islamic religious character. The theoretical implication of this research shows that the prophetic Islamic social values contained in the da'wah orientation can be objectified in the life of a country that has a pluralistic social and religious background.

Abstract

This study aims to explore and identify the philosophical basis and features of Abdurrahman Wahid's approach to Islamic law regarding the implementation model of Islamic law in Indonesia. This research is a qualitative research in the form of literature review. This research is included in the category of philosophical normative Islamic law research. The theory used as a theory of analysis is the theory of the formalization paradigm of Islamic law. There are two major conclusions in this study. First. First, the indigenousization of Islam is Abdurrahman Wahid’s philosophical foundation for the implementation model of Islamic law through the method of contextual interpretation and contextualization of classical Islamic law. Second, Abdurrahman Wahid’s approach related to the implementation of Islamic law in the context of people's life in Indonesia is a cultural substantive approach

Abstract

This library research intends to identify the foundation and pattern of the Islamic tolerance paradigm that is made by KH. Ahmad Shiddiq in responding to life of life in Indonesia. This type of normative-philosophical research uses the theory of analysis in the form of a typology of religious attitudes (exclusivism, inclusivism, pluralism, eclectism, and universalism). The five typology will be used to identify the foundation and pattern of Ahmad Shiddiq’s paradigm about Islamic tolerance. This research data collection technique uses documentation techniques. Data analysis of this study through three stages in the form of data reduction, data presentation, and conclusion. The results of the study concluded that the foundation of the Islamic tolerance paradigm KH. Ahmad Shiddiq in responding to the pluralism of the life of the Indonesian people can be found in the two big ideas that he made, namely the idea of ​​ukhuwah and society. In this case, there is a tendency for the pattern of the Epistemological Exclusivism of KH. Ahmad Shiddiq, namely making the foundation of the Islamic teachings in formulating the idea of ​​ukhuwah in the form of Islamic values ​​of Islamiah, Ukhuwah Watonis, and Ukhuwah Basyariah. Meanwhile, the foundation of Islamic teachings in the idea of ​​society in the form of the value of tasamuh, tawasuth, tawazun, and amar makruf nahi munkar. Whereas in the axiological aspects there is a tendency of KH. Ahmad Shiddiq universalism, which is in the objectivity of the idea of ​​ukhuwah and society in the reality of pluralism in Indonesia through various attitudes. First, the accommodation attitude, in the form of willingness to accommodate a variety of opinions (aspiration) from various parties. Second, selective attitude, which is to sort out which is useful and not useful. Third, integrative attitude, namely the willingness to harmonize, record and balance the variety of individual interests, minority groups and majority.

Abstract

Not only in the interpretation of classical scholars, the discourses on the interpretation of contemporary scholars are also diverse and often contradictory even though they are based on the same textual basis of the Qur'anic verse. This study intends to identify trends in the interpretation of contemporary scholars regarding the legal sanctions for cutting hands in al-Maidah verse 38. Two figures are studied, namely Ibn 'Asyur and Muhammad Syahrur. The main data objects of this research, namely the book (kitab) entitled al-Tahrîr wa al-Tanwîr by Muhammad Tahir Ibn 'Asyur  and al-Kitâb wa al-Qur'ân Qirâ'ah Mu'âsirah by Muhammad Syahrur, and. The research approach used is a philosophical normative approach. The analytical theory used is the typology of textualism and contextualism of interpretation which was coined by Abdullah Saeed. Meanwhile, the nature of the research approach is descriptive-analytic. The results of the study conclude that the interpretation of Ibn 'Asyur  regarding al-Ma'idah verse 38 can be categorized as a textual interpretation. This can be seen from his interpretation of the literal meaning of the verse. In addition, Ibn 'Asyur also tends to view the punishment of cutting off hands for thieves to be a deterrent as well as a preventive measure. In contrast to Ibn 'Asyur, Muhammad Syahrur's interpretation of the legal case of cutting off hands for thieves includes contextual interpretation. This can be seen when he understands the verse of cutting off hands for thieves, he gives a meaning that gives space for ijtihad for an area and conditions to enforce punishments that have a deterrent effect, provided that it must not exceed the punishment of cutting off handsas the maximum limit.

Abstract

In realizing the benefit and social justice of waqf goals, efforts to innovate the management of waqf forms in Indonesia are inevitable. This study aims to find the legality of profession waqf in the review of the Waqf Law in Indonesia on the implementation of profession waqf. This type of research is literature review. Meanwhile, the type of legal research approach in this research is normative legal research. The source of this research data in the form of a variety of literature that explains the concept of profession waqf. While the knife analysis used in this study, namely Law Number 41 of 2004, Compilation of Islamic Law (KHI) and Government Regulation Number 28 of 1977. This study concludes two big conclusions. First, profession waqf is a form of innovation of  waqf instruments aimed at increasing the benefit of waqf for public benefit. Second, the existence and purpose of profession waqf is in line with positive law in Indonesia which explains that waqf aim at the general welfare by utilizing the potential and economic value of waqf

Abstract

 The spread of hoax news related to whether it is safe or not and whether or not the use of the Covid-19 vaccine is lawful has created a pro-contra attitude among the Indonesian people towards the Covid-19 vaccination program. For this reason, the Indonesian Ulema Council (MUI) has issued a fatwa to provide legal enlightenment on the halal use of the Covid-19 vaccine. This study examines in depth the construction of the fatwa and identifies the Islamic law development model used in constructing the fatwa. This research is purely philosophical normative and uses the models of Islamic legal development proposed by Jasser Auda. The results of the study conclude that the construction of the MUI fatwa on the halalness of the Sinovac vaccine had used a holistic model of Islamic law. This is indicated by some characteristics inherent in the construction of the fatwa namely : (i) the wholeness and multidimensional character, which is indicated by the use of universal textual arguments ('aam). (ii) the purposive character, which isindicated by the use of various fiqh rules emphasizing the realization of benefit as the basis and orientation of legal determination. (iii) the openness characterwhich is indicated by the acceptance of the health and medical science principles which incidentally is outside the field of Islamic law

Abstract

This research aims to reveal the typology of transformation of the Arabic meanings to the sex-related language in the ḥadiṡ. This library research utilizes contextual semantic theory with linguistic and historical approaches. The results show that several factors influenced the transformation of the meaning of sex-related language in the ḥadiṡs. The first is social and cultural contexts. There were several sexual behaviors in the prophetic era that were considered deviant (sexual deviation) because they were not in accordance with Arab social culture at that time. The second is emotive and psychological context by refining a word نيك / intercourse which later was translated into بُضْعُ/goods, يفضى/ irrigating and يلمس / touching. The third is linguistic context. It is not idiomatic, such as a word خاتم / sealing, which can change the compilation meaning when the word is structured with other words as in the ḥadiṡ لا تفتح الخاتم إلا بحقه. The word is a metaphor meaning of the 'virginity' term. The fourth is the context of situations and conditions. This context explains that the ‘sex term’ can transform in meaning because it was conveyed in different situations and conditions with the euphemism and kināyah (metaphor) expressions, such as يجبون, الغيلة and حولت رحلي البارحة.
