Abstract

Peraturan pemerintah Nomor 6 Tahun 2021 tentang Penyelenggaraan Perizinan Berusaha di Daerah (PP-PPBD) dan Peraturan pemerintah Nomor 6 Tahun 2021 tentang Penyelenggaraan Perizinan Berusaha  Berbasis Risiko (PP-PPBBR), merupakan 2 (dua) dari 45 (empat puluh lima) PP sebagai peraturan pelaksanaan undang-undang cipta kerja. Tulisan ini mengkaji kewenangan daerah dalam perizinan berusaha yang terdapat pada kedua PP tersebut dengan permasalahan dibahas yakni; pertama, ruang lingkup kewenangan daerah dalam perizinan berusaha. Kedua, kewenangan daerah dalam perizinan berusaha tersebut dihubungkan dengan urusan pemerintahan dalam penyelenggaraan otonomi daerah berdasarkan UU No. 23 Tahun 2014 tentang Pemerintahan Daerah. Menggunakan metode yuridis normative, hasil analisis diperoleh kesimpulan. Pertama, lingkup kewenangan daerah provinsi, kabupaten dan kota (Gubernur, Bupati dan Walikota) dalam penyelenggaraan perizinan di daerah berdasarkan undang-undang cipta kerja dan PP-PPBD, PP-PPBBR berdasarkan prinsip pembagian urusan pemerintahan bersifat konkuren sebagaimana diatur UU-ODA. Kedua, kewenangan perizinan berusaha di daerah dalam PP-PPBBD dan PP-PPBBR bersifat sentralistik dengan mengakomodir ketentuan yang berkaitan dengan pembagian urusan pemerintahan dalam UU-ODA. Akibatnya kewenangan daerah dalam penyelenggaraan perizinan berusaha lebih banyak yang tidak strategis untuk melakukan inovasi dalam pengelolaan sumberdaya yang berada di daerah. Kondisi hukum seperti ini jelas bukan ciri otonomi daerah sebagaimana Pasal 18 UUD 1945.

Abstract

Perumpunan bidang dan kelembagaan merupakan ide utama tulisan ini dalam melakukan reformasi regulasi menggunakan omnibus law bidang lingkungan hidup di Indonesia. Studi ini menggunakan telaah yuridis normatif yang membahas permasalahan: Pertama, apakah aspek perumpunan bidang dan kelembagaan dapat dijadikan dasar reformasi regulasi bidang lingkungan hidup menggunakan omnibus law? Kedua, apakah bidang UU-PPLH dapat dijadikan sebagai rumpun untuk melakukan reformasi regulasi terhadap bidang-bidang sektoral lingkungan hidup di Indonesia? Kajian ini menghasilkan simpulan: Pertama, perumpunan bidang dan kelembagaan merupakan prinsip dasar penggunaan omnibus law di Indonesia untuk reformasi regulasi di Indonesia termasuk bidang lingkungan hidup. Kedua, lingkungan hidup merupakan rumpun bidang, maka omnibus law dapat dijadikan metode dalam pembentukan UU Lingkungan Hidup sebagai rumpun bidang yang mencakup sub-sub rumpun bidang di bawahnya.

Abstract

The debate on the absolute competency of the State Administrative Court in Indonesia to set the dispute over the State Financial Losses Report (LHPKKN) is proved to have caused dissenting opinion. The judgments between one administrative court to other court in Indonesia cause main problem of achieving justice and legal certainty. This research examines the issue of absolute competence of the Administrative Court in adjudicating disputes on the State Financial Losses Report published by the Financial and Development Monitoring Agency (BPKP). This article uses normative legal research and implement the statute approach, conceptual approach, and case approach. These approaches are used to discern and analyze several related legal materials or documents scientifically. The aims and objectives of this research are to find a legal solution on how this classic issue has to be approached and solved. As a result, it is found through this article that the Administrative Court has absolute competence in deciding disputes on the Report on the Calculation of State Financial Losses issued by the Financial and Development Monitoring Agency, which is supported by several fundamental reasons.

Abstract

This article aims to examine the correlation between the concept of proper enforcement of the law as stipulated in Article 5 (2) of the 1945 Constitution of Indonesia and the establishment and implementation of government regulation on environment and forestry. This article is a normative legal research with statute, historical, and conceptual approaches. The result shows that proper legal enforcement means two things, namely, establishment and enactment of government regulation by the President and the content of the regulation that does not contradict the law. Failure to comply with the law means the President does not establish or enforce a government regulation as mandated or the content of the regulation is not in line with the law.  If the President does form or enforce the implementation of government regulation, this means that the President violates his oath and promise to uphold the Constitution and to serve the nation. If the content of the regulation contradicts with the law, it can be canceled. In this situation, the government needs to realign the content of existing regulations. The ministry involved in legal drafting is called to oversee the content and follow through with revisions. All party involves in the making of law and regulation, such as the People Representatives, the President, or the Minister, is reminded to carefully formulate a government regulation.

Abstract

This research aims to analyze protection policies for health workers amidst COVID-19. Through statute approach and based on the rights theory, this study examines legal development, or legal framework is needed to formulate and to protect health worker. Since the COVID-19 outbreak spreads quickly and massively, Health worker is at the forefront of handling COVID-19, but they are also vulnerable to get infected by the virus. Some cases showed that many health workers tested positive after providing health services. The findings of the research showed that the right of medical workers to get personal protective equipment and safety guarantees were not enough to protect them. On the other hand, the community was still ignoring the risk of this disease and broke the health protocol in the public place. Health workers can perform their job effectively if people are in healthy condition and do not need to go to the hospital. To containment measures of the COVID-19 State has to choose one of the effective ways to protect people and health workers by regulating and giving a penalty to the perpetrators of the COVID-19 protocol.

Abstract

Internal audit is significant to guarantee and ensure the enforcement of laws and regulations as well as to prevent power abuse by civil servants or government officials that may cause financial loss for the country. The purpose of this study is to provide an overview of the authority of internal audit, to describe how this authority is regulated, to depict the authority to prevent power abuse, and to illustrate the protection over and enforcement of administrative law on allegation of power abuse. This study is a normative juridical study analyzing primary and secondary legal material relevant to the subject under study. The result of the study reveals that the authority of internal audit has been set in various legal products. The operating procedures for legal protection over allegation of arbitrary behavior against civil servants or government officials are filing an objection or an appeal against the discovery of the internal audit. If the case is not a subject of investigation of law enforcement officers the accused may contest the finding to Administrative Court and request the judge to review the finding. If the accused is proven to be guilty of abusing power that causes financial loss for the state and, thus, be sentenced for the alleged conduct (inkracht), he or she shall be immediately dismissed from his/her position. The regulation posits that officer who ignores the verdict and continues to keep the defendant on his/her position shall be penalized.

Abstract

Adanya perbedaan penafsiran atas norma PTDH PNS yang melakukan kejahatan jabatan berdasarkan putusan pengadilan incraht sebelum berlakunya UU ASN, menyebabkan terjadinya perbedaan penerapan penegakan hukum dalam praktik (ada yang diberhentikan tidak dengan hormat, diberhentikan dengan hormat, atau tidak diberhentikan). Perbedaan juga tercermin dalam9 putusan pengadilan di lingkungan PERATUN atas gugatan PTDH PNS, baik di tingkat judex facti maupun judex juris. Ada gugatan yang dikabulkan, ditolak, atau dinyatakan tidak diterima. Persoalan-persoalan hukum yang muncul dalam putusan hakim di lingkungan PERATUN, bersifat mendasar dan strategis dalam menentukan maju mundurnya pembangunan hukum administrasi Indonesia yang pondasinya telah diatur dalam UU No. 30/2014 tentang Administrasi Pemerintahan.

Abstract

The massive forest and land fires in Indonesia have been raging and caused haze disaster. The haze disaster is not suffered only in Indonesian territory, but it has become a transnational disaster resulting in extensive economic and health quality losses. In addition, the disaster has led damage to agricultural land and disruption of diplomatic relations among affected states. The number of perpetrators of forest and land fires that increase annually shows that the enforcement of criminal law is relatively ineffective. This article covers the problem whether the principle of strict liability can be applied to the perpetrators of forest burning. In 2019, forest fires in the Jambi Province had took placed in estimated 165.86.58 hectares. The forest fire is the main source of transnational haze disaster. Law enforcement on forest fires in Jambi has not provided a deterrent effect yet. There are forty-six companies acquiring fires in their concession land areas. Unfortunately, only four of them reached court proceedings and only two companies were declared guilty by the court. Therefore, as a deterrent effort, the principle of strict liability can be applied as the main principle to handle perpetrators of forest burning. Penerapan Asas Strict Liability (Tanggung Jawab Mutlak) terhadap Pidana Pelaku Tindak Pidana Membakar Hutan dan LahanAbstrakTingginya tingkat kebakaran hutan dan lahan yang berdampak pada bencana kabut asap, tidak hanya berdampak di wilayah Indonesia tetapi juga menjadi bencana lintas negara serta mengakibatkan kerugian yang luas, termasuk kerugian ekonomi dan kerugian akan mutu kesehatan, rusaknya lahan pertanian serta berakibat pada terganggunya hubungan diplomatik antar negara yang turut serta terdampak. Melihat pada banyaknya pelaku pembakaran hutan dan lahan yang berulang setiap tahunnya menunjukan bahwa penegakan hukum pidana melalui pemidanaan pelaku tidak efektif. Maka permasalahan dalam artikel ini adalah apakah asas strict liability ini dapat diterapkan dalam pertanggungjawaban pidana pelaku tindak pidana pembakaran hutan dan lahan sebagai upaya penjeraan pada pelaku? Kondisi empirik kebakaran hutan di Jambi pada tahun 2019 memperlihatkan luas  wilayah yang terbakar mencapai 165.86.58 hektare yang merupakan sumber penyebab utama bencana asap lintas negara. Penegakan hukum atas bencana kebakaran hutan dan lahan di Provinsi Jambi belum memberikan efek jera, dari 46 (empat puluh enam) Perusahaan yang mengalami kebakaran di wilayah konsesinya, hanya 4 (empat)  perusahaan yang perkaranya sampai pada proses peradilan dan dari 4 (empat) perusahaan tersebut hanya 2 (dua) perusahaan yang dinyatakan bersalah oleh pengadilan. Abstract

The arrangement of regional regulations in Indonesia has now become an urgent due the fact that those regulations are problematic with regards to their quantity and content. As an effort of encouraging such arrangement, this article proposes the use of omnibus law in making the regulations. Theoretically, the omnibus law is a method or technique of making regulations from which a regulation is formed in order to amend, repeal, or enact many regulations simultiniously. Such the method is worth considerations to be used in the arrangement of regulations as a way out of so many regulations, some of which are problematic in their substances. As long as the regional regulations are concerned, this method is also necessary as a response to the Job Creation Law which has already been established under the method of Omnibus Law. It is an evidence that the Job Creation Law and its implementing regulations require synchronization and harmonization in level of local regulations. The mechanism can be implemented in such a way through inventory and analysis of several regional regulations with similar content, after which they are formed and compiled into one regional regulation. Regional regulations whose contents have been merged shall be declared revoked and invalid in order to be functional in use rather than just amending or revoking some articles and inserting the new ones as in the Job Creation Law. Abstrak Penataan peraturan daerah menjadi perlu dilakukan seiring semakin terungkapnya berbagai permasalahan regulasi di daerah, baik berkenaan dengan jumlah maupun materi muatan. Dalam upaya mendorong penataan regulasi di daerah, artikel ini mengusulkan penggunaan metode omnibus law dalam pembentukan perda melalui bahasan urgensi dan mekanisme penggunaan omnibus law dalam pembentukan perda. Omnibus law sendiri adalah metode atau teknik dalam pembentukan peraturan perundang-undangan dengan cara membentuk satu peraturan untuk mengubah, mencabut, atau mengesahkan beberapa peraturan sekaligus. Metode ini layak dipertimbangkan untuk digunakan dalam penataan perda guna mengatasi jumlah perda yang banyak dan sebagian di antaranya bermasalah secara substansi. Dalam level perda, metode ini juga urgen dalam rangka merespons Undang-Undang Cipta Kerja yang telah terlebih dahulu dibentuk dengan metode omnibus law, mengingat Undang-Undang ini beserta peraturan pelaksanaannya membutuhkan pembenahan pada perda agar sinkron dan harmonis. Mekanisme yang dapat ditempuh adalah inventarisasi dan analisis beberapa perda yang materi muatannya sejenis atau serumpun untuk kemudian dibentuk dan dihimpun dalam satu perda. Berbagai perda yang materi muatannya telah digabung harus dinyatakan dicabut dan tidak berlaku lagi, agar memudahkan penggunaannya dibandingkan sekadar melakukan perubahan atau mencabut beberapa pasal dan menyisipkan beberapa pasal baru seperti dilakukan pada Undang-Undang Cipta Kerja.

Abstract

ABSTRAKArtikel ini bertujuan untuk menganalisis konsep perlindungan korban melalui kompensasi dalam peradilan pidana anak sebagai wujud tanggungjawab negara. Peradilan Pidana Anak di Indonesia melalui Undang-Undang Nomor 11 Tahun 2012 mengedepankan penyelesaian perkara anak melalui keadilan restoratif yang memberikan perlindungan yang seimbang antara perlindungan pelaku anak melalui diversi dan perlindungan korban tindak pidana anak. Diversi yang memberikan perlindungan yang seimbang antara pelaku dan korban ini merupakan pembaharuan dalam hukum pidana anak yang berkeadilan untuk semua pihak (Victim-offender oriented). Keterlibatan korban/keluarganya dan pelaku/keluarganya sangat menentukan berhasil atau tidaknya diversi dalam penyelesaian perkara anak. Posisi pelaku/keluarganya dan korban/keluarganya adalah sejajar. Kepentingan kedua belah pihak harus sama dan seimbang. Perlindungan korban melalui kompensasi merupakan wujud tanggungjawab negara terhadap warga negara yang menjadi korban tindak pidana. Kondisi empirik menurut data Badilum MA menunjukan rendahnya keberhasilan diversi (4%), kegagalan diversi ini penyebab utamanya adalah tidak tercapainya kesepakatan ganti kerugian karena kesepakatan diversi hanya diserahkan sepenuhnya pada kesepakatan pelaku dan korban. Disinilah menunjukan bahwa negara abai terhadap perlindungan korban, seharusnya ketika negara melindungi kepentingan pelaku anak melalui diversi maka seharusnya negara juga menjamin perlindungan korbannya melalui kompensasi, sehingga ke depan diharapkan tingkat keberhasilan diversi akan semakin baik. Kata kunci: kompensasi; korban tindak pidana; peradilan pidana anak; perlindungan korban. ABSTRACT This article aimed to analyze the concept of victim protection through compensation in juvenile criminal justice as a form of state responsibility. Juvenile Criminal Court in Indonesia through Law Number 11 of 2012 prioritizes the settlement of juvenile cases through restorative justice providing balanced protection between juvenile offenders through diversion and protection for victims of juvenile crimes through reform of juvenile criminal law that is just for all parties (victim-offender oriented). The involvement of the victim and his family and the perpetrator and his family will greatly determine the success or failure of diversion in solving juvenile cases. The position of the perpetrator and his family and the victim and his family are equal. The interests of both parties should be equal and balanced. Protection of victims through compensation is a form of state responsibility towards citizens who are victims of criminal acts. The empirical condition according to Badilum's data showed the low success of diversion (4%). The failure of this diversion is the main cause of the failure to reach an agreement for compensation because the diversion agreement is only left to the agreement of the perpetrator and victim. This showed that the state was ignorant of victim protection. When the state protects the interests of juvenile through diversion, the state should also guarantee the protection of the victims through compensation. Hence, the success rate of diversion will hopefully be better in the future. Keywords: compensation; juvenile criminal court; victims of crime; victim protection.
