Abstract

This paper intends to see the extent of legal awareness of the community in the village area of the santri against family law derived from national legal products. The results of the study show two main points, first, the understanding of Islamic civil law (marriage and inheritance) of Mangkang region society is dominated to the accepted understanding of classical fiqh. The people of Mangkang region are not anti-starch against the civil law of Islam issued by the state in the form of positive law. Although the Mangkang area people see that both are ijtihadiyah products, but the existence of Indonesian civil law that has an administrative effect on others makes them accept a good denan. Second, a persuasive approach in the form of a cultural approach is more readily accepted by citizens. Mangkang area people feel comfortable when invited to dialogue and discussion related to Islamic civil law of Indonesia. In the end, by reaching the common point and the good that might be obtained, Indonesian civil law can be understood and well accepted. Tulisan ini bermaksud melihat sejauh mana kesadaran hukum masyarakat di wilayah kampung santri terhadap hukum keluarga yang bersumber dari produk hukum nasional. Hasil dari kajian menunjukkan dua hal pokok, pertama, pemahaman hukum perdata Islam (penikahan dan kewarisan)  masyarakat wilayah Mangkang didominasi kepada pemahaman yang diterima fiqh klasik. Masyarakat wilayah Mangkang tidak anti pati terhadap hukum perdata Islam yang dikeluarkan negara dalam bentuk hukum positif. Meskipun masyarakat wilayah Mangkang melihat bahwa keduanya merupakan produk ijtihadiyah, namun keberadaan hukum perdata Islam Indonesia yang memiliki dampak administratif kepada yang lainnya menjadikan mereka bisa menerima denan baik. Kedua, pendekatan persuasif dalam bentuk pendekatan budaya lebih mudah diterima oleh warga masyarakat. Masyarakat wilayah Mangkang merasa nyaman ketika diajak berdialog dan berdiskusi terkait hukum perdata Islam Indonesia. Pada akhirnya, dengan mencapai titik temu dan kebaikan yang mungkin akan didapat, hukum perdata Islam Indonesia bisa dipahami dan diterima dengan baik..

Abstract

Terdapat beberapa kasus kekerasan anak yang melibatkan guru. Keterbatasan pemahaman para guru Madrasah Diniyah Takmiliyah dan Pondok Pesantren Anak-Anak terhadap regulasi perlindungan anak berdampak terhadap kasus criminal justis yang melibatkan para guru.Guru madrasah terkadang mempunyai perspektif lain terhadap tata hubungan murid dan guru ketika proses belajar mengajar. Oleh karena itu perlu diberikan kesempatan kepada para guru madrasah untuk memperoleh penguatan pendidikan kesadaran hukum perlindungan anak.Alasan memilih guru Madrasah Diniyah Takmiliyah dan Pondok Pesantren Anak-Anak sebagai dampingan di antaranya adalah 1)mereka dalam beraktifitas kesehariannya berinteraksi dengan peserta didik yang usianya masuk kategori anak-anak, 2)mereka kurang mempunyai pemahaman yang cukup tentang hukum, 3)peran sosial guru madrasah mempengaruhi sistem tata perilaku masyarakat dan peserta didik.Metode yang digunakan adalah ceramah, diskusi kelompok, dan studi kasus untuk mencari solusi pemecahannya.Hasil akhir dari kegiatan pengabdian ini adalah terdapat peningkatan pemahaman dan pengetahuan para guru terhadap regulasi tentang perlindungan anak. Hal ini dibuktikan dengan adanya peningkatan scor tes hasil evaluasi yaitu nilai rata-rata dari 3,7 menjadi 7,9 dari total score 10.

Abstract

This article examines the fulfillment of the civil rights of extramarital children which has become a controversy since the issuance of the Constitutional Court decision no. 46/PUU-VIII/2010, which is considered as a progressive and responsive measure to guarantee children's rights. However, the content of this decision is considered to violate Islamic norms in giving family lineage to extramarital children for it will create a stigma that one does not need a sacred marriage institution if he only wants to establish a civil or lineage relationship with his biological father; instead, it only requires evidence based on science and technology or others in court. This article answers the questions of how to interpret the concept of the civil rights of extramarital children to avoid conflicts with Islamic norms and what are the philosophical and sociological benefits of fulfilling civil rights for extramarital children. This study is qualitative in nature. It is focused more on conceptual ideas based on library research using conceptual and case approaches. It was found that (1) the civil rights of extramarital children are not a lineage right but compensation from their biological father as a form of moral responsibility; (2) philosophically, the civil rights of extramarital children are to fulfill the value of social justice which is distributive and, sociologically, these rights create a prosperous social condition for society by fulfilling the civil rights of the next generation of the nation covering their physical, mental, spiritual, and intellectual needs.

Abstract

Marriage is essentially a reunification of men and women consisting of elements of  soul and body are  fused  into one  in a household  frame  for  emotional and physical welfare. Regulation of marriage embraced the principle that a man may only have a wife and vice versa. The court may grant permission  to  the husband  to a wife more than a certain requirements. Qualitative and quantitative Justice as a condition of polygamy difficult and even impossible to be realized. Abstract

People who will conduct a marriage should fulfill administrative and substantiverequirements. These marriage requirements have positive roles in theachievement of goal and meaning of a marriage for the involved parties. Amarriage is permitted if the male party has come to the age of 19 and the femaleparty has come to the age of 16. However, a marriage dispensation proposal maybe proposed by the parties with various reasons. This will open the chanche of theoccurrence of under-aged marriages. A marriage dispensation should be basedon the consideration of the benefits for children and family. Even those benefits forchildren should be put on the priority above their parents and extended family`simportance as the realization of child protection. Parents should prevent theoccurrence of marriages in minor ages for the realization of qualified, decent, andprosperous Indonesian children.Key Words: Marriage, Dispensation, Child Protection

Abstract

Penerapan hukum dalam teori hukum Islam sangat ditentukan oleh ‘ilat sebagairatio legis dengan tetap mengacu pada tujuan syara’ (maqosid al syari’ah) sertanilai-nilai mafsadat dan maslahat. Pertumbuhan dan perkembangan dinamikasosial masyarakat terus bergerak sehingga mempengaruhi sistem tata hukumyang ada di dalamnya. Oleh karena itu hukum dituntut untuk selalu mengikutiperkembangan dinamika sosial masyarakat. Metode sadd al dzari’ah merupakantawaran yang cukup fleksibel untuk menghadapi perubahan sosial masyarakat,mengingat unsur maslahat dan mafsadat serta tujuan syariat menjadi pilarutama dalam metode istinbath ahkam dalam hukum Islam. Denganmenggunakan metode sadd al dzari`ah diharapkan hukum Islam akan selalumendudukkan persoalan hukum secara proporsional serta mengedepankankemanfaatan dan kemaslahatan hukum bagi masyarakat. Abstract

Abstract: The concept of crowdfunding is rooted in the concept of crowdsourcing. It utilizes a "crowd" of people to provide feedback and solutions to develop a startup's activities. Along with its development, the crowdfunding model was adopted in the technique of collecting zakat funds to improve the management of more productive zakat assets. This study attempts to critically describe the practice of zakat crowdfunding from the perspective of maqasid asy-syari'ah, along with the concept of legal protection for muzakki (zakat payers). A qualitative method was used in this study. For analysis, the authors used a descriptive-analytical method and normative empirical approach to systematically describe and analyze the facts found factually and accurately. This study revealed the principles of hifz ad-din, hifz al-nafs, hifz al-‘aql, hifz al-mal, hifz al-nasl and hifz al-'ird are found in the application of muzakki legal protection in crowdfunding zakat, so from the viewpoint of fiqh, it is permissible. This implementation will reduce unemployment and economic disparities. Besides, it strengthens the country's economic infrastructure to achieve benefits, which become the goal of maqasid asy-syari'ah. Thus, preventive legal protection for the muzakki of crowdfunding zakat is very urgent to protect the worship interests of prospective muzakki.Abstrak: Konsep crowdfunding berakar dari konsep crowdsourcing yang memanfaatkan "kerumunan" orang untuk memberikan umpan balik dan solusi untuk mengembangkan kegiatan suatu perusahaan rintisan. Seiring perkembangannya, model crowdfunding diadopsi dalam teknik pengumpulan dana zakat demi peningkatan pengelolaan harta zakat yang lebih produktif. Artikel ini berupaya mendeskripsikan secara kritis tentang praktek zakat crowdfunding dalam perspektif maqasid asy-syari’ah, beserta konsep perlindungan hukum bagi muzaki. Penelitian ini merupakan penelitian kualitatif dengan metode analisis deskriptif serta pendekatan empiris normatif, guna menggambarkan serta menganalisis secara sistematis fakta-fakta yang ditemukan secara faktual dan cermat. Dari kajian yang telah dilakukan diperoleh temuan bahwa dalam zakat crowdfunding terdapat perlindungan hukum terhadap muzakki terutama dalam hal perlindungan agama (ḥifẓ ad-dīn), perlindungan jiwa (hifz al-nafs), perlindungan akal (hifz al-‘aql), perlindungan harta (hifz al-mal), perlindungan keturnan (hifz al-nasl) dan perlindungan terhadap kehormatan diri (hifz al-‘ird). Dengan demikian, praktik zakat crowdfunding secara fikih adalah diperbolehkan. Terwujudnya perlindungan hukum bagi muzaki dalam zakat crowdfunding telah berdampak positif terhadap berkurangnya angka pengangguran, kesenjangan ekonomi dan sekaligus memperkuat infrastruktur ekonomi negara hingga tercapai kemaslahatan yang menjadi tujuan maqasid asy-syari’ah. Dengan demikian, perlindungan hukum preventif bagi muzakki crowdfunding zakat sangat urgen demi melindungi kepentingan beribadah muzakki.

Abstract

AbstractThis paper aims to uncover the motives of the Indonesian Ulema Council (MUI) in issuing Muslim community religious edicts during the COVID-19 Pandemic. In exploring this motive, the writer uses the theory of social action and power domination initiated by Max Weber. This type of research is qualitative research, researchers do the description and interpretation of data from primary sources taken from the official MUI website and other data that supports the results of the study. The results of this paper are: First, MUI is an actor of social religious action. Second, the motives for MUI socio-religious actions through fatwas issued contain three dominant motives. Third, the instrumentally rational motives in the fatwa refer to various models of worship. Fourth, MUI uses the values of the Islamic Religion which originate from the Qur'an, Hadith, and Jurisprudence. Fifth, MUI seeks to continue the traditions of the Prophets and Friends. Sixth, the MUI's Domination of Power determines the mandatory and unlawful matters in worship. Seventh, the MUI has a very important role in the mitigation effort of the COVID-19 Pandemic.Keywords: Social Actions; Power Domination; COVID-19; Mitigation, MUI Fatwa. AbstrakTulisan ini bertujuan untuk mengungkap motif-motif Majelis Ulama Indonesia (MUI) dalam menerbitkan fatwa peribadatan masyarakat muslim saat Pandemi COVID-19. Dalam mengeksplorasi motif tersebut, penulis menggunakan teori tindakan sosial dan dominasi kekuasaan yang digagas oleh Max Weber. Jenis penelitian yang digunakan adalah penelitian kualitatif, peneliti melakukan deskripsi dan interpretasi data dari sumber primer yang diambil dari situs resmi MUI dan data lain yang mendukung hasil penelitian. Adapun hasil dari tulisan ini adalah: Pertama, MUI merupakan aktor dari tindakan sosial keagamaan. Kedua, motif tindakan sosial keagamaan MUI melalui fatwa yang diterbitkan mengandung tiga motif dominan. Ketiga, motif instrumentally rational dalam fatwa mengacu pada berbagai macam model peribadatan. Keempat, MUI menggunakan nilai-nilai dari Agama Islam yang bersumber dari Alquran, Hadis, dan Kaidah Fikih. Kelima, MUI berupaya untuk meneruskan tradisi para Nabi dan Sahabat. Keenam, Dominasi Kekuasaan MUI penentu hal wajib dan haram dalam peribadatan. Ketujuh, MUI sangat penting perannya dalam upaya mitigasi Pandemi COVID-19.Kata Kunci: Tindakan Sosial; Dominasi Kekuasaan; COVID-19; Mitigasi, Fatwa MUI.
