Abstract

Post the first amendment of Religious Courts Bill that provides wider authority toward Religious Courts in investigate and decide Islamic economics disputes has responses, whether support or pessimistic, especially among Religious Court judges themselves. This paper examines the Gorontalo Religious Courts judges response about their authority in resolve Shariah economy disputes. This paper is a qualitative descriptive research and the data was collected using observation, interviews and document reviews. The finding of this study revealed that the Gorontalo Religious Courts judges response well to trust laws in handling disputes Shariah economy. In other words, in principle, they are ready to handle disputes Islamic economics. Readiness, such as: the handling disputes Shariah economy is Religious Courts judges authorities and it is a professional responsibility as a judge; Religious Courts formed a special judge to handle falling out or cases of Shariah economy, and Religious Courts judges provides knowledge of Shariah economy without trainings or workshops. -----Pasca amandemen pertama undang-undang Peradilan Agama yang memberikan perluasan kewenangan penyelesaian sengketa ekonomi syari’ah telah memberikan berbagai tanggapan dari berbagai kalangan, khususnya hakim-hakim Pengadilan Agama. Tulisan ini mengkaji respon para hakim di Pengadilan Agama Gorontalo terhadap kewenangan tersebut. Penelitian ini adalah deskriptif kualitatif dengan metode pengumpulan data melalui observasi, wawancara dan dokumentasi. Hasil penelitian menunjukkan bahwa hakim Pengadilan Agama Gorontalo merespon baik terhadap amanah undang-undang dalam menangani sengketa perekonomian syari’ah. Dengan kata lain pada prinsipnya mereka telah siap menangani sengketa ekonomi syariah. Kesiapan itu antara lain: penanganan sengketa ekonomi syariah adalah sebuah tanggung jawab profesi sebagai hakim; Pengadilan Agama membentuk majelis hakim khusus menangani sengketa atau perkara ekonomi syari’ah, dan hakim-hakim Pengadilan Agama dibekali dengan pengetahuan tentang perekonomian syari’ah melalui pelatihan-pelatihan.

Abstract

Discourse on the cooperation system of agricultural land in the Islamic jurisprudence has to be specific regulated with a familiar term: mudharabah, muzara’ah, musaqah, and mukhabarah. This paper examines the system for the agricultural community in the district of Gorontalo sharecroppers perspective of economics Islamic law. It is a descriptive qualitative research and the data was collected using observation, interviews, and document review. Finding of this study revealed that adapted form of profit sharing land with the agreement of both parties, such as one-half, one-third and one-quarter to see who the provider of seed and operational costs and see nature if crop failure. Implementation of the system for this result is in line with the legal concept of Islamic economics by eliminating injustice to the parties whom to contract it. In addition, these practices have a positive impact for smallholders to raise the level of the economy.

Abstract

This research discusses to study and analyze the legal considerations of the Panel of Judges' judgments in Stipulation Number 20/Pdt.P/2012/PA.Smi and Stipulation Number 6/Pdt.P/2013/PA.Sgr. about itsbāt nikah in marriage of muallaf women with marriage guardians of religious leaders, then comparing the results of the two determinations. This research is a type of library research that acts descriptive-analytical-comparative. The choices used are juridical-normative and syara. The results of this study indicate that the contextual interpretation of the legal text more fulfills a sense of justice in favor of textual interpretation. Stipulation Number 6/Pdt.P/2013/PA.Sgr. which departs from contextual interpretation by considering socio-cultural and legal awareness of the community and contra legem by way of questioning the meaning (supported legal interpretation) of terminology). Honower Stipulation Number 20/Pdt.P/ 2012/PA.Smi which starts from textual-legalistic interpretation cannot fulfill the sense of justice of the community, but can only fulfill procedural demands.

Abstract

Interaction between tradition and religion in Indonesia cannot be denied. Historically, the development of national law was based on three difference laws: customary law, western law (particularly Dutch law), and Islamic law. This affects on the acceptance of the tradition that does not contradict with the religious law.  This paper examines the tradition of hileyiya or funeral ceremony which is prominent among Gorontalo’s society from the sociology of Islamic law perspective. It is a descriptive qualitative research and the data was collected using observation, interviews, and document review. Finding of this study revealed that tradition of hileyiya consisting of the reciting of the Qur’an, tahlil, tahmid, shalawat and dzikir has become a legacy for Gorontalo’s society. In the sociology of Islamic law perspective, this practice provides various benefits to the dead family and the visitors. For instance, the benefits of reciting the Qur’an believed can be passed on to the dead, serve to tranquil the dead family, and remind people about the death. It can be regarded as al-urf-shahih (and it was legitimized by the basis of Islamic law as al-adat al-muhakkamah (customs can be law).

Abstract

Economic globalization as a legitimate child of the capitalist economy is believed does not able to provide prosperity for all people. This fact is born out of the basic vision of the capitalist economy is not shared prosperity but the economic domination by the capital owners, so what happens is that the rich become the richer and the poor become the poorer. Starting from the phenomenon around 1997's, the economists began to look at the economics practices based on sharia as practiced by the Prophet saw. The economic practices applied by the Prophet is started from the sources of Islam, namely the Qur'an. This paper describes on the concept of financial institutions in the Islamic history, concepts and basics of finance in Islam. Keywords: financial institutions, the basic concept of Islam

Abstract

In reality, women are still considered to be second to men, both from the private and social aspects. This article discusses the contextuality of women in the private and social spheres in Indonesia. This research was studied with a juridical, normative and sociological approach. The results show that the understanding of some people in understanding religion still places religious arguments related to misogynism in positioning men and women in the private and social spheres. Even though in some religious arguments it does not differentiate it. Likewise, in the state guarantee through statutory regulations in Indonesia, the position of citizens is equal before the state, both men and women in the private and public or social spheres.

Abstract

Tulisan ini bertujuan untuk menggambarkan keterkaitan hukum Islam dalammultikulturalis pluralitas di Indonesia. Penulis berpendapat bahwa multikulturalis pluralisme adalah paradigma yang menganggap adanya kesetaraan antar ekspresi budaya yang plural. Hal ini menyangkut kesadaran sosial bahwa di dalam kehidupan masyarakat terdapat keragaman budaya. Kesadaran tersebut berdimensi etis yang menuntut tanggung jawab yang terarah pada tindakan baik dan benar, yang selanjutnya terwujud ke dalam berbagai bentuk penghargaan, penghormatan, perhatian, kasih sayang, cinta, dan pengakuan akan eksistensi terhadap sesama. Abstract

The position of the headman in marriage and household matters is very important. This is because the headman is in direct contact with the bride and groom's life. This article discusses the existence of the prince in minimizing divorce in North Gorontalo District. This research is a field study with a sociological approach to Islamic law. Data were collected by observation, interview and documentation methods which were processed using qualitative descriptive methods. The results of the study showed that the presence of the headman in North Gorontalo District was very large in his role in minimizing the occurrence of divorce. This success is due to an effective communication effort by the prince with the troubled family and the desire of the troubled party to resolve the problem in a family way.

Abstract

This article describes the concept of children fiqh in Indonesia with discussions covering status and child care. A child can legitimately be said to have a blood relationship with her/his father if she/he was born in a legitimate marriage. If the child is born illegitimately; then, she/he cannot be attributed to his/her father, except his/her mother alone. In the case of child care, most scholars have differed fiqh perspective. Many fiqh scholars stated that women has the authority to care for and educate children is more appropriate care for and educate children because their feminine nature. However, Hanafi and Maliki schools of thought argued that nurturing, caring and educating children is the right caregiver (mother or a representative). Associated Muslim scholars contended that the right of al-hadhanah is the rights of the two parents. Wahbah al-Zuhailiy argued that the rights of alhadhanah belong to association between mother, father and children. If a dispute arises among these three parties; then, the priority is focused on the rights of the cared-child.
