Abstract

Tulisan ini bertujuan untuk mengetahui apakah faktor penyebab wanita melakukan perkawinan pada usia dini. Faktor utama wanita melakukan perkawinan pada usia dini adalah kematangan seks secara fisik. Wanita-wanita pelaku perkawinan usia dini tersebut telah matang dalam seks secara fisik sehingga memungkinkan mereka untuk melakukan aktivitas seksual. Karena kematangan inilah mereka ingin melakukan aktivitas seksual yang semestinya belum boleh mereka lakukan. Disusul faktor pendidikan yang dalam hal ini wanita-wanita pelaku perkawinan usia dini tesebut sudah tidak berminat lagi untuk melanjutkan sekolahnya sehingga memilih untuk menikah di usia dini. Aktivitas belajar yang tadinya mereka gemari sudah tidak menarik lagi dan membosankan bagi mereka. Menurut mereka kehidupan rumah tangga lebih menarik dan lebih menyenangkan.

Abstract

Badan Usaha Milik Negara atau BUMN adalah badan usaha yang seluruh atausebagian besar modalnya dimiliki oleh negara melalui penyertaan secara langsung yangberasal dari kekayaan negara yang dipisahkan. PT. Merpati Nusantara Airlines (PT.MNA)merupakan BUMN yang berbentuk perusahaan perseroan (Persero) yang modalnya terbagiatas saham yang seluruh atau paling sedikit 51% (lima puluh satu persen) sahamnyadimiliki oleh Negara Republik Indonesia yang tujuan utamanya mengejar keuntungan.Terhadap BUMN yang berbentuk Persero berlaku segala ketentuan dan prinsipprinsip yang berlaku bagi perseroan terbatas sebagaimana terdapat dalam Undang-UndangNo. 40 Tahun 2007 tentang Perseroan Terbatas (UUPT). Hal ini telah diatur dalam Pasal11 jo Pasal 3 UU No. 19 Tahun 2003 tentang BUMN beserta penjelasannya. Dengandemikian, segala peraturan yang berlaku terhadap perseroan terbatas berlaku juga bagiBUMN yang berbentuk Persero selama tidak diatur oleh UU BUMN.Metode Penelitian yang digunakan adalah metode penelitian yuridisnormatif, yaitu penelitian hukum yang mendasarkan kajiannya pada peraturanperundang-undangan yang ada. Terdapat pemeriksaan dokumen yang berupaperaturan perundang-undangan yang terkait dalam Putusan No.36/PID.B/TPK/2012/PN.JKT.PST., dan selanjutnya dianalisis dengan fakta-faktayang terdapat dalam persidangan, dihubungkan dengan peraturan perundangundanganyang berkenaan dengan tujuan penelitian. Teknik pengumpulan data yang digunakandengan teknik studi kepustakaan, peraturan perundang-undangan, dan wawancara.Dari hasil penelitian diketahui, bahwa adanya perluasan arti unsurMelawan Hukum Materil yang mengartikan kewajiban untuk bertindak hati-hatidalam menjalankan suatu perusahaan serta memegang prinsip Good CorporateGovernance pada Putusan No. 36/PID.B/TPK/2012/PN.JKT.PST., hal ini tidaksesuai dengan unsur Melawan Hukum Materil seperti yang termuat di dalamPutusan Mahkamah Konstitusi Nomor 003/PUU-IV/2006. Selain itu, alasan-alasan yangdapat dipergunakan oleh Jaksa Penuntut Umum untuk mengajukan permohonan kasasi atasPutusan No. 36/PID.B/TPK/2012/PN.JKT.PST, dengan terdakwa Hotasi Nababan,dihubungkan dengan Pasal 253 Kitab UndangUndang Hukum Acara Pidana, adalah alasanpada Pasal 253 ayat (1) huruf a KUHAP, yaitu mengenai suatu peraturan hukum yangtidak diterapkan atau yang diterapkan tidak sebagaimana mestinya.

Abstract

Consumer protection should receive more attention, because foreign investment has become part of Indonesia's economic development, where the Indonesian economy is also related to the world economy which can have negative implications for consumers. This study aims to determine the adoption of the ultimum remedium principle in consumer protection law and to determine the ultimum remedium principle of business actors in consumer protection law. The research method used is a normative juridical research method with secondary data source and analyzed deductively. The research desire to be achieved in consumer protection is to create a sense of security for consumers in meeting the needs of life. It is proven that all consumer protection norms in the Consumer Protection Law have criminal sanctions. The presence of criminal sanctions in consumer protection regulations is a form of ultimum remedium (the last alternative) when resolving consumer protection disputes through other legal channels is not sufficient.

Abstract

Mediation in the process of proceedings at the Court is an important stage, so the Judge can delay the proceedings. At the first session, the Judge was obliged to encourage the parties to carry out the mediation process and provide explanations to the parties regarding the procedures and costs of mediation. This is important so that the parties can know the mechanisms, procedures and costs of mediation that must be issued in the mediation process. The mediation process is divided into three stages, namely the pre-mediation stage, the stage of mediation implementation, and the final stage of the implementation of the mediation results. The mediation stage begins with important steps: preliminary remarks by the mediator, presentation and presentation of the parties' stories, sorting and clarifying issues, discussing and negotiating agreed issues, creating options, finding points of agreement and formulating decisions, recording and retelling decisions and closing mediation. Effect of the mediation process in resolving inheritance disputes in Decision No.2570 / Pdt.G / 2017 / PA. Mdn can be said to be successful, because the parties to the dispute can reconcile according to the peace deeds made and agreed by each party in litigation. Constraints faced in the mediation process in resolving disputes over the distribution of shared assets after divorce, namely the absence of a mechanism that can force one party or parties to attend mediation meetings, lack of goodwill of the parties to reconcile.

Abstract

Child Protection means all activities to guarantee and protect children and their rights so that they can live, grow, develop and participate optimally in accordance with human dignity and protection from violence and discrimination. This type of research is normative juridical and the nature of the research is descriptive-analytical. The form of legal protection for children as victims of immoral crime is by protecting and prioritizing the interests of children as victims, prioritizing recovery and protection of children through educational efforts on reproductive health, religious values and moral values, social rehabilitation, psychosocial assistance during treatment to recovery and provision. protection and assistance at every examination starting from investigation, prosecution to examination in court. The judge's consideration in giving punishment to perpetrators of immoral crimes in decision No.398 / Pid.Sus / 2018 / PN.Mdn is that the defendant's actions are disturbing to the public, that the defendant's actions have ruined the future of the child victim Intan Fitria and consider mitigating things, that the defendant has never been convicted, that the defendant acknowledged and regretted his actions, that the defendant was polite in court and the defendant would not repeat his actions. Efforts to tackle immoral crimes against minors are to supervise children, pay attention to their environment and friends, and educate and instill religious values and knowledge about sexuality at an early age.

Abstract

The problem of narcotics has now penetrated all elements of the nation, rehabilitation of narcotics addicts is a treatment process to free addicts from addiction. The implementation of rehabilitation by BNNP North Sumatra has an effect on narcotics handling more clearly and in a coordinated manner, and more young people are saved from narcotics due to undergoing rehabilitation. The factors that form the basis of North Sumatra's BNNP in implementing rehabilitation for narcotics users consist of internal and external factors. Internal factors, namely Human Resources (HR) which are still minimal and / or still lacking, facilities and infrastructure in the investigation section are still limited, including investigator unit cars, communication facilities or tapping devices, sniffer dogs and firearms personnel. The external factor is that other government agencies still assume that P4GN is only the duty of the National Narcotics Agency and the National Narcotics Narcotics Unit so that it seems that there is omission from the agency and the reluctance of the public to report to the police and the National Narcotics Agency even though there are people around the neighborhood involved in narcotics trafficking.

Abstract

This Community Partnership Program (PKM) generally aims to assist Business Groups in making Serundeng Kepah as a typical Tanjungbalai dish in making this product utilizing marine food or natural resources in Tanjungbalai City. Partners in this PKM are Business Groups in Pantai Burung Village, South Tanjungbalai District, Tanjungbalai City. The problem faced by partner members is the lack of knowledge in managing and utilizing existing natural resources as a product of the Tanjungbalai food development business. The method used to achieve the objectives of this service activity is the method of education, socialization, assistance in product manufacture, and business management on products that have been produced. The results of the activities, an increase in the quality of human resources in knowledge in the management and utilization of local natural resources and business management; Serundeng Kepah Products as Tanjungbalai Specialty Food; and Logo Making, Packaging design and product IPR.

Abstract

Penggunaan narkoba/narkotika tidak berbeda dari jenis penggunaan, status, atau derajatnya. Ada beberapa kasus narkoba dengan sasaran kejahatan. Ini merupakan masalah serius, tetapi juga masalah yang tidak dapat diselesaikan karena peredaran dan bangun selalu di tempat yang sama dan di tempat yang sama. Akibat wabah Covid-19, ditemukan narkoba di Sumatera Utara. Permintaan malah tinggi tampaknya merajalela selama pandemi Covid-19. Peredaran narkoba lebih umum di kota-kota besar, serta di Kota Medan. Data Sat Res Narkoba Polrestabes Medan lokasi yang menjadi red list untuk kasus narkotika antara lain: 1. Medan Petisah; 2. Medan Polonia; 3. Medan Sunggal; dan 4. Medan Perjuangan. Penyuluhan dan pendampingan merupakan contoh kegiatan pengabdian yang dilakukan untuk mengatasi permasalahan tersebut. Dengan menggunakan strategi ini, target dan tujuan yang akan dicapai dapat terpenuhi seperti diketahui, kawasan Jalan Mesjid Taufik, Kecamatan Medan Perjuangan merupakan basis tempat peredaran dan pengguna narkoba, namun sampai dengan Desember tahun 2021 sudah mengalami penurunan kasus. Hal ini dikarenakan telah dilakukan beberapa program oleh Sat Res Narkoba Polrestabes Medan bekerja sama dengan beberapa lembaga secara berkesinambungan  seperti Bimtek Bahaya Narkoba, Kegiatan Gotong Royong dan Kegiatan Bombardir Grebek Kampung Narkoba (GKN). Keberhasilan program yang diterapkan oleh Sat Res Narkoba Polrestabes Medan didukung oleh peran serta masyarakat dengan mengoptimalkan daya tangkal dan daya lawan masyarakat. Salah satu bentuk daya tangkal dan daya lawan masyarakat ini adalah dengan memberikan sosialisasi/ penyuluhan mengenai pemahaman bahaya narkoba serta membangkitkan motivasi masyarakat untuk bertindak dengan melaporkan informasi yang diketahui dan tidak hanya sebagai penonton. Sesuai yang dirumuskan pada Partisipasi masyarakat diatur dalam Pasal 104 sampai dengan 106 Undang-Undang Nomor 35 Tahun 2009 Tentang Narkotika 108.

Abstract

Currently, there are many illegal cosmetics circulating in the market, whether they do not have a distribution permit or contain hazardous materials, including local and imported cosmetics. Therefore, it is necessary to have legal protection for consumers so that their rights are still fulfilled for the losses they experience. Cosmetic products are supervised by the Food and Drug Supervisory Agency or BPOM which is in charge of supervising the distribution of cosmetics as well as medicines and food in Indonesia. The research objectives to be achieved in this study are to find out how the law provides protection to consumers against the occurrence of illegal cosmetic circulation, to find out how the legal rules for the circulation of illegal cosmetics in Indonesia are, and to find out how legal remedies can be taken by the public for the circulation of illegal cosmetic products. . The research methods used are: Library Research and Field Research. Types of Normative Juridical Research. The conclusion obtained is that legal protection for consumers can be done by applying the principle of Strict Liability, namely mistakes are not a determining factor, but there are exceptions that allow business actors to be released from responsibility due to compelling circumstances. With the principle of absolute responsibility, it is hoped that business actors will prioritize the interests or rights of consumers, so that consumers do not experience losses for their actions or for cosmetic products produced or sold. The legal arrangements for the distribution of cosmetics in Indonesia include Law Number 8 of 1999 concerning Consumer Protection, Law Number 36 of 2009 concerning Health, BPOM Regulation Number 2 of 2020 concerning Supervision of Production and Distribution of Cosmetics, etc. Legal remedies that can be taken by the community are through the Court (Litigation) and BPSK (Non-Litigation).
