Abstract

Political Dynasty and Corruption are like two inseparable things. In Indonesia, political dynasty has been growing since the era of reformation, right after the implementation of regional autonomy system which enables the continuation of local politics succession directly. At 2018 regional election, there were five provinces with candidates from political dynasties such as: Banten, South Sumatera, West Java, East Java, and West Kalimantan.As a causality relation, corruption is the outcome and permissive behavior is the cause. In the Province of Banten, corruption occurs due to the permissive behavior stemmed socially ad structurally in the society. One of the influence of the permissive behavior towards corruption is the level of education. The lower it is, the higher the level of poverty, thus more permissive they are towards corruption, as well as the society’s lack of knowledge about negative effects of political dynasty. The people in Banten seems don’t fully acknowledge that political dynasty is degrading the essence of democracy and prone to corruption practice. In 2016, Banten helds sixth position in Indonesia in their level of poverty, and the second lowest in Java. Based on statistical data, until 2017 the amount of people with poverty in the cities and rural areas has increased.This research used qualitative research method in explanative manner, where the target of this research was to explain the social permissive reasoning phenomenon in the society of Banten as an inherited poverty of a political dynasty which prone to corruption, with several facts that supported data and research analysis which can be used to understand issues derived from such phenomenon.

Abstract

Anak sebagai bagian dalam kehidupan bangsa dan negara dan merupakan ciptaan Tuhan Yang Maha Esa, yang harus dijaga dilindungi dari segala hambatan dan gangguan apapun juga dan kebutuhan akan sandang pangan dan papan diberikan kepadanya. Termasuk jika anak yang melakukan atau dianggap melakukan tindak pidana atau kejahatan, tetap harus diberikan perlindungan akan hak-haknya selama berada dalam tingkat penyidikan, bahkan perlu dilakukan upaya diversi atau perdamaian juga di antara para pihak yakni  korban dan pelaku dimana harus ada kesepakatan antara para pihak untuk menyelesaikannya di luar jalur pengadilan. Tujuan dari penulisan ini mengetahui diveris sebagai upaya perdamaian diantara para pihak pelaku dan korban dapat menghilangkan stigma/cap yang melekat kepada pelaku, serta memikul tanggungjawab masing-masing, Metode yang digunakan adalah metode pustaka, dengan menggunakan literatur dan juga peraturan perundang-undangan yang berkaitan satu dengan lainnya, dimana hasilnya ternyata penerapan diversi terhadap seseorang anak memang dianggap berhadapan dengan hukum masih menimbulkan berbagai kendala atau hambatan yakni ada pengecualian pemberian diversi terhadap anak yang bermasalah dengan hukum, aparat penegak hukum belum sepenuhnya memahami diversi serta ketidaktahuan dan ketidaksiapan dari masyarakat mengenai upaya perdamaian terhadap anak

Abstract

Coordination of KPK prosecution duties as stated in Article 12A of Law no. 19 of 2019 amending Law No. 30 of 2002 concerning the Commission for the Eradication of Criminal Acts of Corruption, or Komisi Pemberantasan Korupsi (KPK) raises concerns because it creates dependence on other institutions and certainly reduces the independence of the KPK institution. As for some of the problems that need to be known from the existence of this coordination concept, among others: (1) the coordination can be directed towards the form of KPK's subordination to the prosecutor's institution; (2) coordination makes the confidentiality of data held by the KPK not maintained; (3) this coordination is very prone to conflict of interest with the prosecutor's office; (4) this coordination also raises concerns that rotten politics in the resolution of corruption cases may occur. The author uses independence principle analysis. The type of research used in compiling this paper is normative or doctrinal legal research. The research shows that coordination can be done using clear boundaries. First, coordination is still allowed to the extent that it is possible to combine cases that the KPK may not handle. Second, coordination can also be carried out in the event of merging a corruption case that is not the authority of the KPK. Third, the coordination also can be done in the case of the concurrent events. Fourth, the coordination is only related to procedural law.

Abstract

There seems to be something different from the results of Transparency International Indonesia (TII) including sextortion or sexual extortion in the Global Corruption Barometer Asia 2020. This is extortion in the form of violence or sexual harassment. Generally a form of abuse of power. Sextortion is different from the corruption we know in a legal context. In terms of regulations and institutions, the practice of sextortion or sextortion is a case that occurs quite a lot but is not yet known in corruption eradication institutions in Indonesia. Sextortion is a new area that opens everyone's eyes to the fact that corruption is not only about money. This study uses a qualitative approach to answer how the form of legal protection for victims of sextortion is rife lately in the educational environment. The conclusions of this study indicate that the form of legal protection for victims of sextortion in the educational environment is in the form of assistance, protection and recovery of victims by strengthening the legal aspect in the form of SOPs for Handling Sexual Violence in each educational institution as well as the installation of detection devices. The novelty of this research can be used for extensive interpretation of legal findings by judges to protect victims of sextortion. And the importance of education on strong self-protection awareness, boldly rejecting or saying no.

Abstract

Pemahaman dalam pencegahan Kekerasan dalam Rumah tangga tidak hanya dapat dilakukan pada masyarakat pada umumnya, namun juga bagi wargabinaan/narapidana yang menjalani hukuman di Lembaga Pemasyarakatan. Penyuluhan Hukum dalam bentuk pemberdayaan warga binaan inibermaksud agar pada saat nanti bebas dan berkumpul kembali dengan keluarga dan masyarakat dapat memberikan peran berarti dalam upaya pencegahan kekerasan dalam rumah tangga. Dalam penyuluhan dalam bentuk pemberdayaan warga binaan ini peserta yang dalam hal ini parawargabinaan/narapidana yang tadinya belum sepenuhnya mengetahui terkait kekerasan dalam rumah tangga semakin memahaminya sehinggadiharapkan menjadi bekal dalam menyongsong kehidupan baru saat nanti berkumpul kembali dengan Keluarga. Kegiatan ini dilakukan dengan metode online melalui zoom dimana peserta yaitu warga binaan/Narapidana berada di Rutan Pondok Bambu sedangkan pembicara adalah dosen dari Universitas Bhayangkara berada di Kampus.

Abstract

The problem of narcotics abuse by minors must be anticipated given the rampant circulation of narcotics today and the weak supervision of government officials (law enforcers) and the surrounding family environment. Laws and regulations have explained and mandated that in resolving children's problems the use of criminal law whose application is carried out through the juvenile justice system should be avoided as a form of protection for children considering their young age and the future that is still far away. For this reason, a policy is needed that positions drug addict children as victims, not as perpetrators of criminal crimes by prioritizing the rehabilitation process as a diversion effort.

Abstract

Pelaporan dana kampanye merupakan perintah yang diatur dalam UU No.7 Tahun 2017. Dana kampanye bersumber dari partai politik, calon anggota DPRD Kabupaten/Kota, termasuk pula dari sumbangan yang sah berdasarkan hukum. Pelaporan sumbangan dana kampanye yang didapatkan dari pihak lain tidak ada pengaturannya. Pemilu tahun 2014 dan tahun 2019 telah ada peraturan KPU yang mengaturnya. Khusus untuk pemilu tahun 2024 belum dibentuk aturan pelaksananya. Ketiadaan pengaturannya, membuat tindakan tersebut tidak konsinten terhadap pemilu sebelumnya dan akan melahirkan potensi pelanggaran pemilu. Mitra kegiatan pengabdian kepada masyarakat ini adalah Bawaslu Kota Bekasi. Peserta kegiatan pengabdian diperhadapkan permasalahan apakah perlu pelaporan sumbangan dana kampanye dari pihak lain dan bagaimana dasar hukumnya. Kegiatan pengabdian ini menawarkan solusi bahwa KPU seharusnya tetap membuat peraturan pelaksana terkait pelaporan sumbangan dana kampanye yang didapatkan dari pihak lain. Adapun argumentasinya adalah konvensi ketatanegaraan pemilu tahun 2014 dan tahun 2019 yang mengatur ketentuan tersebut dan konsekuensi pasal 334 ayat 2 UU No.7 Tahun 2017.
