Abstract

Industri sawit merupakan komoditas utama perekonomian Indonesia, bahkan di tengah pandemi COVID-19. Pengesahan UU No. 11 Tahun 2020 tentang Cipta Kerja (UU Cipta Kerja) salah satunya bertujuan untuk mendorong perekonomian Indonesia melalui penciptaan lapangan kerja, termasuk di industri sawit. Sebelum UU Cipta Kerja disahkan, industri sawit sudah dianggap sebagai komoditas utama perekonomian Indonesia dan cenderung mengakibatkan kerusakan hutan. Di sisi lain, Indonesia perlu mencapai Tujuan Pembangunan Berkelanjutan (TPB) yang diwujudkan dengan kelestarian hutan di samping keperluan meningkatkan pertumbuhan ekonomi industri sawit. Perubahan ketentuan hukum di sektor kehutanan setelah adanya UU Cipta Kerja membawa pengaruh terhadap pencapaian TPB khususnya TPB angka 15 “Ekosistem Daratan” di Indonesia. Tulisan ini menganalisis secara normatif beberapa perubahan ketentuan di sektor kehutanan untuk mengetahui prospek pencapaian TPB angka 15 dalam industri sawit setelah adanya UU Cipta Kerja.

Abstract

The conflict between the Indigenous Law Community (ILC) of Laman Kinipan with PT Sawit Mandiri Lestari (SML) regarding Kinipan customary forest clearing into oil palm plantations is still prolonged to this day. The recognition of customary law communities is also still a matter of debate due to the unclear and overlapping national legal systems. It leads to low legal protection for indigenous people, which is likely to injure indigenous peoples' constitutional rights as Indonesian citizens, one of which is the conflict that befell the ILC of Laman Kinipan. The government's action in the conflict case between the ILC of Laman Kinipan and PT SML was deemed not oriented in terms of good governance and violated the human rights of MHA Laman Kinipan.

Abstract

Amendment to Law on Mineral and Coal Mining makes the authority to issue Mining Business Permits (IUP) shifted from local governments, including governors and regents/mayors (decentralization), to the central government (centralization). The centralization of the IUP issuance gives full authority to the central government in issuing IUP. This normative research is carried out to determine the extent to which the principle of transparency is applied after the Minerba Law 3/2020. The results show that shifting the authority of IUP issuance from the regional government to the central government does not eliminate the threat of bribery corruption as it does not strengthen the principle of transparency. Whereas the principle of transparency is the key to minimizing corruption in mining permit bribes. The solution is reforming Mineral and Coal Mining regulations and strengthening the related institutions to uphold the principle of transparency in the rezime of IUP centralization.
