Abstract

Perbankan syariah di Indonesia merupakan refleksi kebutuhan atas sistem perbankan yang dapat memberikan kontribusi stabilitas kepada sistem keuangan nasional. Industri perbankan syariah juga mencerminkan permintaan masyarakat yang membutuhkan suatu sistem perbankan alternatif yang menyediakan jasa perbankan yang memenuhi prinsip-prinsip syariah. Dalam kegiatan Perbankan Syariah diajarkan prinsip-prinsip ajaran Islam, dimana dalam melaksanakan kegiatan ekonomi harus dilandasi oleh Al-Qur'an dan as-Sunnah sebagai referensi utamanya.Perbankan syariah juga harus dapat mengimplementasikan nilai-nilai syariah dengan sebaik-baiknya agar dapat menggerakkan demand masyarakat melalui produk, dan layanan perbankan syariah (perspektif mikro) serta dapat menciptakan perilaku investasi yang konsisten (perspektif makro).

Abstract

This study aimed to (1) analyze the condition of Financing to Deposit Ratio (FDR) of Islamic Banking in Indonesia; (2) analyze the profitability of sharia banking in Indonesia; and (3) to analyze the influence of Financing to Deposit Ratio (FDR) of the profitability of sharia banking in Indonesia. This study took samples at Islamic banks in Indonesia including 11 Islamic Banks (BUS), 23 Business Units of Sharia Banking (UUS). The research data is from Islamic Banking Statistics published by Bank Indonesia from January 2008 until December 2010 (Financial Ratio Study to BUS and UUS period 2008-2010). The number of Islamic banks used is 34 banks. The technique uses simple linear regression analysis with the help of the program EVIEWS version 5. The results of analysis is further illustrated as follows: First: Financing to Deposit Ratio (FDR) of sharia banking has an average of 103.65% during the year 2008,  89.70% in 2009 and 94.37%   in 2010. Overall, the average Financing to Deposit Ratio (FDR) in the three years is about 98.79%. Second: Return on Asset (ROA) is one of the profitability ratio used to measure the effectiveness of the company in generating profit by leveraging its total asset. Based on the description of the variables, it shows the average Return on Asset (ROA) in 2008 is of 1.77%, 1.98% in 2009 and 1.74% in 2010. This result indicates that the average Return on Asset (ROA) in three years of observation is still above the prevailing bank. Third: The result of regression analysis indicates no significant of Financing to Deposit Ratio (FDR) for Return on Assets (ROA). The quantity t count is 0.475 far below the t table 2.032. The result of study differs from the study of Adi Stiawan (2009), but supports the study of Nurkhosidah Siti (2010) and Yuliani (2007). This study shows  no significant effect on bank profitability.

Abstract

Artikel ini mengkaji tentang sejarah lahirnya Undang-Undang No 21/2008 yang memberikan landasan hukum bagi keberadaan lembaga perbankan syariah. Pendekatan yang dipergunakan dalam kajian ini adalah pendekatan sejarah dengan tujuan untuk memahami latar belakang lahirnya UU perbankan syariah dan implikasi yang timbul dari peraturan tersebut. Sebagai penelitian sejarah, artikel ini diharapkan tidak hanya sekedar memberikan gambaran sejarah semata. Akan tetapi sebagaimana penelitian sejarah lainnya, penelitian ini juga bertujuan untuk mengkaji bagaiman peluang dan tantangan masa depan perbankan syariah di Indonesia. Banyak faktor  akan mempengaruhi percepatan pengembangan perbankan syariah di masa depan. Salah satu faktor yang sangat penting adalah faktor hukum. Jadi setelah dikeluarkan Undang-Undang 21 Tahun 2008 tentang perbankan syariah, menjadi jelas bahwa perbankan Islam telah diakui oleh hukum positif di Indonesia.Kata kunci: perbankan syariah, regulasi, hukum Islam IMPACT AND CHALLENGE OF ISLAMIC BANKING AFTER THE LAW No21/2008AbstractThis article discusses about historical background of the Law No 21/2008 which provides legal basis for the establishment of Islamic banking. Historical approach is chosen in order to get a better understanding of the background of the Law and its implications. As a historical study, this article aimed at finding chances and challenges for the future of Islamic banking in Indonesia. There are several factors contribute to the development of Islamic banking in Indonesia, among those is law. Therefore, the enactment of the Law No 21/2008 proves the status of Islamic banking as legal.Keywords: Islamic banking, regulation, Islamic law.

Abstract

The development of Islamic economic practices in Indonesia shows an encouraging fact. Since the last fifteen years, the development of Islamic economic discourses in Indonesia has attracted the attention of many academicians and practitioners. From the academic view, the development of Islamic economics is marked by many educational institutions that offer training programs and courses of Islamic economics. Islamic economics study should lead to formation and internalization of Islamic values in the economiclife. Therefore, the suitable teaching method to increase the quality of Islamic economics is competency-based curriculum that combines textual and contextual approach. Both approaches should be incorporated in formal and nonformal education. Thus the development of Islamic economics are expected to line between conceptual and business practices in accordance with recent guidance that will eventually form an Islamic economic system truly in accordance with basic principles of sharia.Keywords: education, islamic economics.

Abstract

This paper discusses the concept of human rights enforcement and humanist Islamic universal values. Islamic law is a set of religious rules that govern the behavior of the Muslims in all aspects, both individual and collective nature. Due to the comprehensive characteristic, Islamic law occupies an important position in the view of Muslims. Islam claims that the idea stemmed from the Medina Constitution or the Charter of Medina 624 AD. In Islamic perspective, human right is based on theocentric approach while the West uses anthropocentric approach. This difference often raises a controversy in seeing the same issue.
