Abstract

Imam Shafi'i was the first to have the latest ideas and ideas of his time regarding the method of extracting Islamic law (Takhrij al-Ahkam), which was systematically poured into a paper entitled Ar-Risalah (letter). This bookkeeping effort was in line with the development of Islamic science at that time. The development of this science occurred during the time of Harun Al-Rashid and culminated in the time of Al-Ma'mun. The birth of the book of Ar-Risalah was the initial phase of the development of ushul fiqh science as a scientific discipline. So this book became the main reference for USHUL experts in the later period in compiling similar works. In the book ar-Risalah, it is found that ash-Shafi'i does not mention the name of his book, and does not even give its own theme to a number of important studies that came to be known as ushul fiqh, he wrote in a broader framework, namely: Kehujjahan as-Sunnah. Ar-Risale is just a treatise written by ash-Shafi'i at the request of al-Mahdi. This Ar-Risale still contains material that is not actually ushul Fiqh, the discussion of ushul fiqh is concentrated on As-Sunnah, Ijma', and Qiya which are solely to deny istihsan. The style of thinking and the factors that intervene in the method of istinbat ash-Shafi'i are commensurate with his educational background, he is one of the Imams of Ahlu as-Sunnah wa al-Jama'ah, who in his fiqhiyyah branch sided with two groups, namely ahlu al-Hadith and ahlu ar-Ra'yi (tawasuth). These two capacities of moderate thinking are what make Ash-Syafi'i so beloved and accepted by the majority of the world's Muslims, especially in Indonesia.

Abstract

Abstract. MUI Fatwa Decree Number: KEP-952/MUI/XI/1990 has prohibited surrogate mother in its various forms because it causes far more harm than good. However, in this case the scholars differed on the law of surrogate mother, some forbidding it and some allowing it to be rented, including Jurnalis Uddin, who allowed surrogate mother. The research method in this thesis is qualitative with a normative juridical approach, and the type of data used is library data. Data collection techniques were taken from library data, namely books, scriptures, MUI fatwas, and literature discussing surrogate mother. Then data analysis was carried out by content analysis. The results of this study concluded that surrogate mother is forbidden and should not be carried out in accordance with the MUI fatwa Number: KEP-952/MUI/XI/1990 which has prohibited renting a womb based on the Qur'an, hadith, and fiqh principles. Jurnalis Uddin allowed suroogate mother because the condition of a wife experiencing infertility was equated with an emergency, in this case what was unlawful could become lawful, but surrogate mother was not included in the conditions for an emergency according to Wahbah Zuhaili. Therefore it is better to choose the MUI fatwa Number: KEP-952/MUI/XI/1990 which forbids surrogate mother. Abstrak. Keputusan Fatwa MUI Nomor: KEP-952/MUI/ XI/1990 telah mengharamkan sewa rahim dalam berbagai bentuknya karena jauh lebih banyak menimbulkan mudharatnya dibanding kemaslahatannya. Namun dalam hal ini para ulama berbeda pendapat tentang hukum sewa rahim ada yang mengharamkan dan ada yang membolehkan melakukan sewa rahim diantaranya yaitu Jurnalis Uddin yang membolehkan sewa rahim. Metode penelitian dalam skripsi ini yaitu kualitatif dengan pendekatan yuridis normatif, dan jenis data yang digunakan yaitu data pustaka (library). Teknik pengumpulan data diambil dari data pustaka yaitu buku-buku, kitab-kitab, fatwa MUI, dan literatur-literatur yang membahas tentang sewa rahim. Kemudian analisis data dilakukan secara analisis konten (content analysis). Hasil penelitian ini menyimpulkan bahwa sewa rahim diharamkan dan tidak boleh dilakukan sesuai dengan fatwa MUI Nomor: KEP-952/MUI/ XI/1990 yang telah mengharamkan sewa rahim dengan berlandaskan dari al-Qur’an, hadits, dan kaidah-kaidah fiqih. Jurnalis Uddin membolehkan sewa rahim dikarenakan kondisi istri yang mengalami kemandulan itu disamakan dengan keadaan darurat, dalam hal ini yang haram bisa menjadi halal, namun sewa rahim tidak termasuk ke dalam syarat-syarat keadaan darurat menurut Wahbah Zuhaili. Maka dari itu lebih baik memilih fatwa MUI Nomor: KEP-952/MUI/ XI/1990 yang telah mengharamkan sewa rahim.

Abstract

Abstract. This research uses a qualitative approach method by conducting observations and interviews with the samples we have determined and reviewing several sources of information from documents that support this theory and research so that it can run as it should. The results showed that: First, panaik money is one of the pre-conditions that must be implemented by the prospective bridegroom, if the bridegroom does not give panaik money to the prospective bride, the application is rejected because the panaik money is one of the social status and pride of the bugis bride-to-be. In Islamic Law there is nothing to regulate the money of panaik, secondly, in Islamic Law the dowry is the gift of a man to the woman he marries, w\hich will then become the full right of the wife. A person is free to determine the shape and amount he wants because in Islamic Law there is no provision for the amount or limit of dowry but the dowry is adjusted to the ability of the male party. In Islamic Law there is nothing to regulate the amount or limit of giving panaik money, but nevertheless the law is Urf Al-Sahih (a custom that is considered valid) as a form of custom that does not violate nash / Islamic law. Abstrak. Penelitian ini menggunakan metode kualitatif pendekatan deskriptif dengan melakukan observasi dan wawancara kepada sampel yang telah kami tentukan serta mengkaji beberapa sumber informasi dari dokumen yang mendukung teori dan penelitian ini sehingga dapat berjalan sebagaimana mestinya. Hasil penelitian menunjukan bahwa Pertama, uang panaik merupakan salah satu pra syarat yang harus dilaksanakan oleh pihak calon mempelai laki-laki, apabila mempelai calon laki-laki tidak memberikan uang panaik kepada calon mempelai perempuan maka lamaran ditolak karena uang panaik sebagai salah satu status sosial dan kebanggaan pihak calon mempelai wanita Bugis. Dalam Hukum Islam tidak ada yang mengatur tentang uang panaik, kedua, didalam Hukum Islam mahar merupakan pemberian seorang lakilaki kepada perempuan yang dinikahinya, selanjutnya akan menjadi hak istri secara penuh. Seseorang bebas menentukan bentuk dan jumlah yang di inginkan karena didalam Hukum Islam tidak ada ketentuan jumlah atau batasan mahar namun disunnahkan mahar itu disesuaikan dengan kemampuan pihak laki-laki. Di dalam Hukum Islam tidak ada yang mengatur tentang jumlah atau batasan pemberian uang panaik, namun demikian hukumnya Urf Al-Sahih (kebiasaan yang dianggap sah) sebagai salah satu bentuk adat yang tidak melanggar nash/syariat Islam.

Abstract

This research aims to examine philosophically the existence of al-'Uqûd al-Murakkabah (multiple contracts). The search is concentrated on the opinions of fuqaha and muhadisin, as well as its application in Islamic Financial Institutions. This study is urgent, because in the form of a single contract is not able to respond to contemporary financial transactions that are always moving and affected by the financial industry both nationally, regionally and internationally. By using qualitative methods and literature, this study concludes that, first, the contemporary fiqh muamalah view of the hadiths related to the hybrid contract model leads to the wording of the prohibition of bai'ataini fi bai'atin (two trades in one trade), Second, the construction of the hybrid contract model in Islamic banks is aimed at the construction of al-'Uqûd al-Mutaqâbilah (dependent or conditional contract), which is implemented in the Bank Guarantee (BG), and al-'Uqûd al-Mujtami'ah

Abstract

This study aims to explain the correlation between economics and Islam. This research uses qualitative research, with a normative juridical approach and data collection techniques by means of literature study. The results of this study indicate that Islam is a perfect religion that regulates all aspects of human life including the economy. This is proven by the concept of welfare described in the Qur'an and Sunnah. Basically, the purpose of every human being's life is to achieve welfare, although humans interpret welfare from different perspectives. Most economic understandings assume that welfare is worldly material welfare. However, Islam defines welfare with the term Falah, which means holistic and balanced welfare between the material and spiritual dimensions. The Quran and Sunnah have taught that welfare will be achieved if humans live a life in balance between their material and spiritual lives. This is because human life does not only stop in this world, but there is still a second life that humans will face in the hereafter, and welfare will be achieved truly if humans can balance the needs of the world and the hereafter, and that is what is taught in Islamic economics

Abstract

Islamic economics is an economic system based on Islamic teachings and values derived from the Koran and As-Sunnah Ijma and Qiyas or other sources. The goal is to seek the pleasure of Allah and the methods are not contrary to His Sharia. Economic activities, whether production, consumption, exchange, and distribution, are tied to divine principles and divine goals. This research aims, First: To find out the philosophical foundations of Sharia economics, Second: To find out the differences between the Capitalist, Socialist and Islamic economic systems. The approach method used in this research is normative juridical with descriptive analytical research nature. The types of data used in this research are primary and secondary data. This research is classified as a type of qualitative research. The results of this study indicate that: First, the basics of Sharia economics are based on Tawhid, Khilafah and 'Adalah, namely the Establishment of Justice between fellow human beings, the achievement of maslahah. Second: The Islamic Economic System is between the Capitalist and Socialist economic systems, both in terms of paradigms, bases and philosophical foundations.

Abstract

The purpose of this research is to analyze Akad Wakalah Bil Ujrah in the context of the preparation of Sharia Economic Law, fatwa and qanun and its impact on Islamic financial institutions. Akad Wakalah Bil Ujrah is a type of contract in Islamic finance law where one party acts as an agent to carry out transactions on behalf of another party for a fee. This study examines the rules and legal principles related to the Wakalah Bil Ujrah Agreement using the normative analysis method. The Compilation of Sharia Economic Law, Fatwa and Qanun are the main references to identify the rules governing this contract. In addition, the implementation of Wakalah Bil Ujrah in Islamic financial institutions is also analyzed using case studies of relevant Islamic financial institutions. The results of the study show that the Wakalah Bil Ujrah contract has a strong legal basis for compiling Islamic economic law, fatwa and qanun. Sharia principles are the main guidelines for the implementation of this contract, including the principles of justice, transparency and accountability. The impact on Islamic financial institutions includes investment management, pension fund management and sharia-based banking services. However, this study also identified several challenges in implementing Wakalah Bil Ujrah in Islamic financial institutions, such as the need for in-depth understanding of sharia principles and compliance with applicable regulations. Therefore, strict supervision and clear procedures are needed to ensure the fulfillment of sharia principles. In summary, Akad Wakalah Bil Ujrah plays an important role in the formulation of Sharia Economic law, Fatwas and Qanuns and has significant implications for Islamic financial institutions. To improve implementation, cooperation between Islamic financial institutions, regulators and academics should be enhanced to ensure compliance with Shariah principles and the achievement of sustainable financial goals.
