Abstract

Various studies on Pesantren have been conducted through various lenses and perspectives; however, its attractiveness is still there. In some points, the pesantren is well known as a conservative institution in which freedom of thinking is limited. This article is willing to show that not all pesantrens limit their students freedom of thinking. One of them is Mahad Aly (higher education), one of the education institution in Pesantren Salafiyah Syafiiyah Sukorejo Situbondo which focuses its teaching on fiqh. Fiqh, or Islamic jurisprudence, is one of the branches of Islamic science. In some pesantrens, the teaching of fiqh is limited to one school or madhhab, particularly school of Shafii. However, in Mahad Aly, not only one school of thought is taught, but fiqh of four schools of thought. It shows a high tolerance and respect for differences. In order to seek a new ingredient in formulating Islamic law, the teaching of fiqh is combined with other sciences such as philosophy, sociology, and anthropology. This new ingredient produces a rich discourse of fiqh and widens its scope of discussion to include to religious relationships, gender, human rights, ecology, and other contemporary issues such as interfaith marriage, the possibility of a non-Muslim being president, and the role of women in the public sphere. Looking from the curriculum, the method of teaching, and the publication of bulletin of Tanwirul Afkar, this article proves that freedom of thinking is well-maintained at Mahad Aly.

Abstract

Hubungan antara Negara dan agama di Indonesia khususnya Islam tidak selalu dalam keadaan rukun sejak kemerdekaan Indonesia. Hubungan tersebut bahkan lebih cenderung ke antagonisme, berpisah dari satu kesatuan namun saling membutuhkan. Di satu sisi, Islam adalah fondasi nasional oleh karena kesuciannya dan dipeluk kebanyakan orang Indonesia. Di sisi lain, Pancasila yang harus menjadi fondasi Negara dengan melihat kemajemukan dari bangunan sosial masyarakat Indonesia. Penelitian ini mendiskusikan tentang makna agama dalam masyarakat demokratis, khususnya di Indonesia. Ketika sekularisme meminta pemisahan agama dan negara, pada satu sisi, dan teokrasi (negara Islam) menuntut adanya penyatuan agama dan negara, pada sisi lain, Indonesia menawarkan Pancasila untuk menjembatani jurang antara keduanya. Dalam negara sekuler, peran agama dalam negara sejauh mungkin bisa diminimalkan, bahkan dienyahkan. Padahal, agama yang secara esensial mengandung prinsip-prinsip nilai dan moral memiliki posisi sentral bagi manusia. Sebaliknya, dalam negara teokrasi agama sangat mungkin untuk dialih fungsikan sebagai penindas rakyat. Dalam situasi dilematik ini, Pancasila tidak mempunyai pretensi mengenyahkan peran agama, dan juga tidak menjadikan agama sebagai alat justifikasi suatu rezim, melainkan memfasilitasi berjalannya peran agama dalam negara. Dengan begini, agama memiliki peran esensial dalam masyarakat demokratis.

Abstract

In Islam, men and women are equal before God (das sollen). However, stereotype, discrimination and violance against woman often happen everywhere. The position of women according to the Serat Yusuf as a literature that was born from the social construction and the storage author who is gender bias placed women unequally. This research that used philology theory, reception theory and feminism theory examined the picture of unequal gender in Yusuf-Zulaikha in Serat Yusuf. Based on Philology theory, it was found that Serat Yusuf who was written by Nalaputra is a sung text. It was written in 1935 that consist of 29 chapters (pupuh). While based on the reception theory, the study revealed that the reading of Nalaputra as the writer of the Serat Yusuf on YusufZulaikha story that consists in the holy Quran experienced the expansion and additional part, plot, character. In the analysis of the feminist theory, the study discovered forms of unequal position of women such as women are perceived as a passive, emotional, unable to control their desire, men servants and their faith are lower than men.Di dalam Islam, laki-laki dan perempuan adalah sama di hadapan Allah SWT (das sollen). Namun, stereotip, diskriminasi dan kekerasan terhadap perempuan sering terjadi di mana-mana. Posisi perempuan menurut Serat Yusuf sebagai sastra yang lahir dari konstruksi sosial yang bias gender menempatkan perempuan secara tidak setara. Penelitian ini yang menggunakan teori filologi, teori resepsi dan teori feminisme. Berdasarkan teori filologi, ditemukan bahwa Serat Yusuf yang ditulis oleh Nalaputra adalah syair yang ditulis pada tahun 1935, terdiri dari 29 bab (pupuh). Sementara berdasarkan teori resepsi menunjukkan bahwa, pembacaan Nalaputra terhadap Serat Yusuf, kisah Yusuf-Zulaikha mengalami ekspansi dan tambahan pada bagian, plot , karakter yang berbeda dari Al-Quran. Analisis teori feminis, menemukan posisi yang tidak sama dari perempuan seperti perempuan dianggap pasif, emosional, tidak mampu mengendalikan keinginan mereka, makhluk hamba dan iman mereka lebih rendah daripada laki-laki.

Abstract

Following the stepped down of the New Order, the movements of establishing Islamic sharia in Indonesia has increased. Some of the organizations which promote Islamic sharia on their movements are Majelis Mujahidin Indonesia (MMI), Front Pembela Islam (FPI), and Hizbut Tahrir Indonesia (HTI). This paper observes the movements of HTI by using the perspective of public reason, especially the theories of John Rawls and Abdullah An-Naim. The results show that HTI should use more democratic methods in delivering its notion. As Indonesia is a democratic nation, creating the appropriate form of discussion and conversation would be an effective way in introducing Islamic sharia to the public. Later, the decision of accepting or rejecting the idea is in the hands of the public. Keywords:Hizbut Tahrir Indonesia, Islamic sharia, and public reasonÂ
