Abstract

Abstrak   Pegawai Negeri Sipil (PNS) merupakan sebuah jabatan yang mana masyarakat membantu negara dalam menjalankan tugas dan kewenangan pada pelaksaaan fungsi pemerintahan. Pasal 202 Ayat (3) Undang-Undang Republik Indonesia Republik Indonesia Nomor 32 Tahun 2004 tentang Pemerintahan Daerah mengamanatkan pengisian jabatan Sekretaris Desa diisi dengan jabatan PNS, tentu ini menjadi kabar gembira bagi Sekretaris Desa yang ada karena berpeluang menjadi PNS. Seiring berjalannya waktu dasar hukum penyelenggaraan Pe-merintahan Daerah yang lama telah dicabut dan memberlakukan Undang-Undang Republik Indonesia Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. pemberlakuan Undang-Undang Pemerintahan Daerah yang baru ini tentu memiliki dampak terhadap beberapa aspek pengaturan dalam hukum pemerintahan daerah, tidak terkecuali jabatan sekdes yang dapat diangkat menjadi PNS.   Kata Kunci: Pegawai Negeri Sipil, Sekretaris Desa   Abstrak   Civil servants are a position when the community assists the state in carrying out its duties and authorities in the implementation of goverment fungtions. Article 202 paragraph 3 of the republik of Indonesia law number 32 of 2004 concering regional goverment mandates filling the position of village secretary to be filled by civil servant, of course this is good news for the exiting village secretaries because they have the opportunity to became civil servant. Over time the old legal basis for the adminstration of regional goverment has been revoked and the Republik of Indonesia law No.23/2014 on regional governance has been enacted. The enactment of this new regional goverment law certainly has an impact on several regulatory aspects in regional goverment law, including the position of village secretary who can be appointed as a civil servant.   Keyword: Civil Servant, village secretary

Abstract

Abstrak   Peraturan tentang penyandang disabilitas telah dimulai dengan diratifikasinya Convention On The Rights Of Person With Disabilities (Konvensi Mengenai Hak-Hak Penyandang Disabilitas) melalui Undang-Undang Nomor 19 Tahun 2011 Tentang Pengesahan Konvensi. Kemudian dilanjutkan pada Tahun 2016 dengan diterbitkannya Undang-Undang Nomer 8 Tahun 2016 Tentang Penyandang Disabilitas dan kemudian diakomodir oleh Pemerintah Daerah Kabupaten Jember melalui Peraturan Daerah Nomor 7 Tahun 2016 Tentang Perlindungan dan Pemenuhan Hak Penyandang Disabilitas. Keseluruhan peraturan tersebut sudah sinergi dalam mewujudkan pemenuhan hak penyandang disabilitas. Namun secara realisasi peraturan tersebut sangatlah minim dan cenderung susah untuk dicapai. Pelaksanaan Perda Kabupaten Jember Nomor 7 Tahun 2016 di Kabupaten Jember, masih belum efektif dalam realisasi penyelengaraan pemerintahan daerah, terbukti dengan kurang pahamnya masyarakat tentang Perda. Kemudian minimnya fasilitas dalam menjamin hak-hak penyandang disabilitas di Kabupaten Jember.   Kata Kunci : Hak, Disabilitas, Kabupaten Jember   Abstract   Regulations on persons with disabilities have started with the ratification of the Convention On The Rights Of Persons With Disabilities through Law Number 19 of 2011 concerning Ratification of the Convention. Then continued in 2016 with the issuance of Law Number 8 of 2016 concerning Persons with Disabilities and then accommodated by the Regional Government of Jember Regency through Regional Regulation Number 7 of 2016 concerning Protection and Fulfillment of Rights of Persons with Disabilities. All these regulations have synergies in realizing the fulfillment of the rights of persons with disabilities. However, in reality, these regulations are minimal and tend to be difficult to achieve. The implementation of the Regional Regulation of Jember Regency Number 7 of 2016 in Jember Regency, is still not effective in the realization of the implementation of regional government, as evidenced by the lack of understanding of the community about the Regional Regulation. Then the lack of facilities in guaranteeing the rights of persons with disabilities in Jember Regency.   Keywords: Rights, Disability, Jember Regency

Abstract

Chemical castration and installation of electronic detectors are additional punishments for perpetrators of sexual crimes against children. The problem in this research is how the procedures and installation of electronic detection devices for perpetrators of sexual violence against children are based on Government Regulation number 70 of 2020 concerning Procedures for the Implementation of Chemical Castration, Installation of Electronic Detection Devices, rehabilitation, and Announcement of the Identity of the perpetrators of Sexual Violence against Children and what the impact that will be felt by perpetrators of sexual violence against children after receiving additional punishment in the form of chemical castration. The method used is a normative legal research method. The conclusion of this study is that the procedures for implementing chemical castration and the installation of electronic detection devices are in accordance with applicable government regulations and procedures, although there are still many bad impacts that will be experienced by perpetrators of sexual violence against children, on the other hand the government has implemented appropriate punishments and has thought about consequences and of course providing rehabilitation, all for the common good and efforts to reduce the level of sexual violence that occurs and is experienced by children.

Abstract

A debtor who feels aggrieved then submits a judicial review of the validity of Article 15 paragraphs (2) and (3) of Law no. 42 of 1999 which are considered to have violated the debtor's constitutional rights so that the Constitutional Court Decision No. 18/PUU-XVII/2019. Requirements for the debtor to be declared in breach of contract in the fiduciary guarantee after the decision of the Constitutional Court Number 18/PUU-XVII/2019, namely the breach of contract as referred to in Article 15 paragraph (3) of the Fiduciary Guarantee Law is not determined unilaterally by the creditor but on the basis of an agreement between creditors and debtors or on the basis of a legal remedy that determines that a breach of contract has occurred. Legal considerations of the Constitutional Court in deciding case No. 18/PUU-XVII/2019 is based on legal considerations that the norms contained in Article 15 paragraph (2) of the Fiduciary Guarantee Law do not reflect the existence of equal legal protection between parties bound in fiduciary agreements that are directly related to the norms of Article 15 paragraph (3) The Fiduciary Guarantee Law, namely the absence of legal certainty regarding when the debtor can be declared in breach of contract.
