Abstract

This research aims to identify and explain the causative factors of unutilized land with its Cultivation Right (HGU) and legal aspects of abandoned land settlement. There are 119.400 ha (31.48%) abandoned land of 379.374,02 ha HGU in Aceh Province. This condition is important to be concerned since the national government and the local government of Aceh has the same vision to increase the farmer’s welfare through the government strategic program “Agrarian Reform”, which has the main objective to redistribute assets related land in order to decrease the economic gap in the country. Therefore, this research is important to be conducted in order to understand the possible alternative ways to curb and use of HGU, which is identified as abandoned land. The results show that there are four factors that cause land unexploited with its HGU, namely: the land is used for supporting facilities; the physical condition of the land, which cannot be utilized; the land is used as a reserved area; and possible dispute that may occur. There are several regulations of indicated abandoned land settlement: first, the inventory of land of rights or basic tenure of indicated abandoned land; second, identification and research of indicated abandoned land; third, warning against rights holders; and last, the determination of the abandoned land. Land with HGU that is indicated to be abandoned in Western Aceh, identifications and research have been conducted and none have been designated as abandoned land.

Abstract

Law No. 11, 2006 concerning Aceh Government determines the existence of decentralization of authority in the land sector to the Aceh Government. However, in reality, the decentralization of authority could not be accomplished.  Therefore, this research aims at studying the authorities which have been decentralized and factors that led to the failure in implementing these authorities. The data were collected through literature research and field research. The literature research was conducted by reviewing the Law No. 11, 2006 and other statutory provisions as well as the views of relevant experts. Field research was conducted by interviewing officials of technical institutions and other relevant stakeholders. The results of the research show that the authorities in the land sector that are especially decentralized to the Government of Aceh through Law No. 11, 2006 are the autorithies to grand The Right to Cultivate and The Building Rights on Land. However, these rights have not been implemented due to the inavailability of more concrete rules and local officials whose fundamental duties and functions are specifically in the land sector.Key words: decentralization, authority, the land sector

Abstract

ABSTRACT: In accordance to Article 22 Number 5, 1960 states that the ownership right of land can be issued based on customary law and the procedure of issuing the title right ruled by the law as regulated by Government Regulation. In fact, recently such regulation has not been enacted yet; hence it cause different views on issuing the ownership right of land. Therefore, the problem raised in this research are what is the legal basis regarding the issuance of the title right based on customary law and what is the position such right based on the issuance. To answer the questions, this research is conducted towards the legislation, doctrines, and previous researches that are relevant to this research. The research shows that the legal basis for the issuance of such right is the customary principles found in customary law, the value of customary law in the place. Substantially, the customary ownership right has similar position as ownership right issued based on government decision, the distinction is on the ownership right proof of certificate of the right that is issued based on government decision but the land owned by customary right namely physical owning evidence and the acknowledgement of the people living the in the place where the right issued.  The Study on Ownership Right of Land Issued Based on Customary Law

Abstract

Abstract: Certificate is an evidence tool based on Article 19 of the Act Number 5 Year 1960 regarding to the Fundamental Rules of Agrarian (UUPA). However, in practice, the evidence degree of land owning certificate might be nullified by the evidence of opponent which was an underhand deed like a civil case Number 04/Pdt.G/2009/PN-Sgi so that the letter from the head of village brought by the prosecutor to the court could able to defeat the Usage Right Certificate that was brought by the defendant in the court. Normative law method was used in this research. The results showed that the evidence degree of the Usage Right Certificate Number 02 Year 1986 really depended on the belief and trust of the judges on the correct procedure of getting the Usage Right Certificate and the ability of the defendant in providing land book of the certificate in the court. Although the defendant had provided the certificate to prove that the disputed land was legally owned showing from the legal land certificate, but if the judges did not believe the defendant, the certificate was then finally determined by the judges as an illegal and had no legal binding.  Keywords: Degree of evidence, certificate, land right. Abstrak: Sertifikat merupakan alat pembuktian menurut Pasal 19 Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-pokok Agraria (UUPA). Namun dalam prakteknya kekuatan pembuktian sertifikat hak atas tanah dapat dipatahkan oleh alat bukti lawan berupa akta di bawah tangan, seperti dalam kasus perdata No.04/Pdt.G/2009/PN-Sgi sehingga Surat Keterangan Kepala Desa yang disampaikan oleh penggugat kepada Majelis mampu mengalahkan alat bukti Sertifikat Hak Pakai yang disampaikan oleh tergugat di persidangan. Penelitian ini menggunakan metode penelitian hukum normatif. Hasil penelitian menunjukkan bahwa kekuatan pembuktian Sertifikat Hak Pakai Nomor 02 Tahun 1986 ternyata sangat tergantung kepada keyakinan dan kepercayaan hakim terhadap kebenaran prosedur perolehan sertifikat hak pakai dan kemampuan tergugat dalam menghadirkan buku tanah/warkah dari sertifikat tersebut ke persidangan. Walau pihak tergugat telah memberikan data untuk menguatkan bahwa tanah sengketa telah dikuasai dengan cara sah bahkan telah memperoleh sertifikat hak atas tanah, namun apabila Majelis tidak mempercayainya, sertifikat tersebut akhirnya tetap dinyatakan oleh majelis cacat hukum dan tidak mempunyai kekuatan hukum.Kata Kunci : Kekuatan pembuktian, sertifikat, hak atas tanah.

Abstract

ABSTRACT: Based on Article 19 (2) of the Act Number 5, 1960 nd Article 32 of the Government Regulation Number 24, 1997 state that in registering land, the certificate of land functioning as a strong evidence. Whether a freehold right can only be proved by a certificate, and to that extent of such evidence in judicial process. In terms of obtaining the answers from the questions, library research is conducted by exploring, discussing and analysing the laws, research reports and relevant experts views. The findings show that such freehold right certificate is issued by National Land Authority by registration process. If there is a land without certificate hence it can be proved through witnesses statements, prediction, acknowledgemen and oath. The certificate has the strong and complete power of proving can only be admitted if there is no challenge before the court. The challenge towards the certificate can be done if there are a defect on issuing it, good faith of the holder and/or the right holder does not really own the land. A Certificate of Land as an Evidence of Land in Judicial System

Abstract

ABSTRACT: This article aim is to describe concerning the existency of customary rights to the land for the further named hak ulayat in the structure of the power rights acces to the land. The requirements so that it can be recognized as hak ulayat to the land based on the national agrarian law. The study in tihis article is a normative study by using analyse any kind of nasional law, research result and also the expert insight in relation to issue studied. The analyse result shows that hak ulayat in which as the Indiginous rights has position as an entity of rights to the land in Indonesia’s agrarian national law. The rights of those indigenous peopleis recognized its existency if it fulfills two requirements cumulatively are as follow: 1) that indigenous people’s rights are still available/exist, not have ever been, and 2) The application of those rights of indigenous people has to be pro- to Indonesia’s insight. The symbolization of the state recognition to rights of indigenous people is: 1) the legalization into regional law (Qanun) in Districts level; or president decree depends on the location of that indigenous right present; or in kind of related regional leader decree, 2) compensation for hak ulayat which is used for public and even personal needs/interrest.    The Structure and Recognation of Customary Rights to the Land / Hak Ulayat on Indonesia’s Agrarian National Legal System

Abstract

ABSTRAK. Tulisan ini dimaksudkan untuk mengidentifikasi, menjelaskan dan menganalisis ketentuan perundang-undangan yang mengatur kewenangan pemerintah daerah dalam penyelesaian sengketa tanah. Untuk mendapatkan data bagi kepentingan penulisan ini dilakukan penelitian kepustakaan, dengan cara menelaah ketentuan perundang-undangan dan literatur yang relevan. Hasil penelitian menunjukkan bahwa ketentuan yang secara khusus menentukan kewenangan pemerintah daerah dalam bidang penyelesaian sengketa tanah  terdapat dalam Keppres Nomor 34 Tahun 2003 tentang Kebijakan Nasional Dibidang Pertanahan dan dalam Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Berdasarkan ketentuan tersebut pemerintah daerah berwenang; (a) penyelesaian sengketa tanah garapan; (b) penyelesaian masalah ganti kerugian dan santunan tanah untuk pembangunan; (c) penyelesaian masalah tanah ulayat; dan (d)  penyelesaian masalah tanah kosong. The Authority of Legal Government in Solving Land Dispute  ABSTRACT. This research aims to identify, explain and analyse the rules regulating the authority of local government in settling land dispute. In order obtain data library research is conducted by exploring relevant rules and literatures. The research shows that the special rule regulating the authority of local government in settling land dispute ruled in the Presidential Decree Number 34, 2003 on National Policy on Land and the Act Number 23, 2014 on Local Government. Based on these, the local government is eligible to: (a) settling the cultivating land, (b) reparation and remedy for land used for the development, (c) customary land dispute, and (d) unoccupted land.

Abstract

Akta Jual Beli dibuat oleh pejabat yang berwenang yaitu Pejabat Pembuat Akta Tanah (PPAT), namun kenyataannya di lapangan banyak pelanggaran prosedur yang telah ditetapkan oleh ketentuan perundang-undangan. Tujuan Penelitian ini adalah untuk mengetahui kewenangan PPAT dalam pembuatan akta jual beli dan apa akibat akta jual beli yang dinyatakan cacat hukum oleh putusan No. 32/Pdt.G/2011/PN.BNA. Penelitian ini menggunakan jenis penelitian hukum normatif. Hasil penelitian menunjukkan bahwa kewenangan PPAT dalam pembuatan akta jual beli yaitu melaksanakan sebagian dari kegiatan pendaftaran tanah dengan tugas pembuatan akta otentik sebagai bukti telah dilakukan perbuatan hukum tertentu mengenai hak atas tanah atau Hak Milik Atas Satuan Rumah Susun yang dijadikan dasar bagi pendaftaran perubahan data pendaftaran tanah yang diakibatkan oleh perbuatan hukum itu di daerah kerjanya yang ditentukan dan untuk pelanggaran undang-undang yang terdapat pada Putusan No. 32/Pdt.G/2011/PN.BNA mengakibatkan akta jual beli tersebut cacat hukum dan tidak mempunyai kekuatan hukum yang mengikat.

Abstract

Berdasarkan ketentuan Pasal 13 ayat (1) Undang- undang Nomor 4 Tahun 1996 tentang Hak Tanggungan Atas Tanah Beserta Benda- Benda Yang Berkaitan Dengan Tanah (UUHT) menyatakan: “Pemberian Hak Tanggungan wajib didaftarkan pada Kantor Pertanahan”. Pendaftaran yang dimaksud bertujuan agar tercapainya kepastian hukum bagi jaminan ataupun kreditur jika sewaktu-waktu debitur cidera janji (wanprestasi). Pendaftaran ini diberikan batas waktu oleh peraturan perundang-undangan, yaitu dalam Pasal 13 ayat (2) UUHT Jo Pasal 40 ayat (1) PP No. 24 tahun 1997 tentang Pendaftaran Tanah yang menyebutkan “Selambat-lambatnya 7 (tujuh) hari kerja sejak tanggal ditandatanganinya akta yang bersangkutan. Pelaksanaan pendaftaran APHT oleh pejabat pembuat akta tanah di Kabupaten Langkat belum berjalan sesuai dengan peraturan perundang-undangan yang berlaku. Penelitian ini bertujuan untuk mengetahui dan menjelaskan pelaksanaan pendaftaran akta pemberian hak tanggungan (APHT) oleh PPAT di Kabupaten Langkat dan penyebab terjadinya keterlambatan pendaftaran APHT oleh PPAT serta akibat hukumnya. Untuk memperoleh data, dilakukan penelitian Yuridis Empiris. Penelitian ini dilakukan untuk mendapatkan data primer melalui wawancara dengan responden maupun informan dan pendekatan perundang-undangan. Hasil penelitian di Kantor Pertanahan Kabupaten Langkat diketahui bahwa proses pembebanan Hak Tanggungan terdiri atas dua tahap yaitu tahap pemberian Hak Tanggungan yang dilakukan dihadapan PPAT dan tahap pendaftaran Hak Tanggungan yang dilakukan oleh Kantor Pertanahan. Keterlambatan pendaftaran Akta Pemberian Hak Tanggungan oleh PPAT di Kabupaten Langkat disebabkan oleh keterlambatan pengecekan sertifikat hak atas tanah Oleh PPAT, keterlambatan pengembalian berkas APHT oleh kreditur, PPAT menunggu APHT sampai sejumlah tertentu,pada saat cek bersih tanah, data fisik dan data yuridis belum ada di kantor pertanahan. Oleh karena itu timbul akibat hukum yang berlaku kepada PPAT dan juga Kreditur.

Abstract

Tujuan penelitian ini untuk mengetahui dan menjelaskan pelaksanaan tanggung jawab pemerintah daerah dalam perlindungan alih fungsi lahan pertanian berkelanjutan di Kabupaten Pidie. Adapun masalah yang menjadi kajian adalah bagaimana pelaksanaan tanggung jawab pemerintah daerah dalam perlindungan alih fungsi lahan pertanian berkelanjutan di Kabupaten Pidie?Secara metodologis, penelitian ini merupakan penelitian yuridis empiris menggunakan Data Primer, yaitu data yang diperoleh dari sejumlah keterangan atau fakta di lapangan melalui wawancara dengan pejabat Badan Pertanahan Nasional Kabupeten Pidie, Pejabat Pembuat Akta Tanah di Kabupaten Pidie, Pejabat Dinas Pertanian dan pangan Kabupaten Pidie, serta pejabat yang betanggung jawab terhadap izin mendirikan bangunan di Kabupaten Pidie. Penelitian ini menyimpulkan tanggung jawab yuridis Pemerintah Kabupaten Pidie dalam perlindungan alih fungsi lahan pertanian pangan berkelanjutan belum terlaksana. Adanya Qanun tentang LP2B akan memberikan kepastian hukum tentang kewenangan Perlindungan Lahan pertanian Pangan pada tingkat SKPD dan terbentuknya pola koordinasi antar instansi sehingga dapat menjadi pedoman teknis dalam pengendalian alih fungsi lahan. Tanggung jawab pemerintah daerah berkaitan dengan kewajiban hukum secara administrasi terhadap publik dengan adanya akuntabilitas, responsibilitas, dan responsivitas
