Abstract

ABSTRACT: This research is to investigate and evaluate the implementation of special autonomy as it is regulated in the act No. 11, 2006 on the Government of Aceh. Data far this research was gathered by library resources, such as primary, second, tertiary law resources. Field study by interviewing some parties who were related this research was done in order to support secondary resources. The research findings show that the special autonomy in Aceh did not effectively implementation yet, this factor was caused by procedures of implementation (peraturan pelaksanaan) was not fulfilled by the center government. Special Autonomy Implementation in Province Aceh based on the act Number 11 of 2006

Abstract

Development activities independently by society Gampong is not a new thing in the country of Indonesia, it's just that more development activities based on the limitations of the use of the resources of the gampong both in terms of both financial resources his human. Therefore, mutual is the main way for people to development Gampong. In tune with the enacted law on Gampong, then mutual culture be reduced, where as the presence of State money in Gampong development in to additional energy from the spirit of Indonesia. The results showed that implementing the construction of Gampong, there are still many obstacles, but the existence of the deliberations conducted by Lord Peuet has been able to solve the problem, because the deliberations deliberations remained the leading solutions in gampong daam resolves the problem. In order for the deliberation can be meaningful so any executing development must be open to problems occurred, likewise should willingly and respect any result of deliberation a mutually agreed. Keywords: Gampong, Keuchik, Finance

Abstract

Tujuan penelitian ini adalah menganalisis asas lex spesialis terkait dengan keharmonis-an Undang-Undang Perseroan Terbatas dalam Pendirian Perseroan Daerah. Perusahaan perseroan daerah merupakan salah satu badan usaha dari sejumlah badan usaha yang dikenal dalam sistem hukum di Indonesia. Ciri khas hukum perusahaan di Indonesia, masing-masing jenis perusahaan diatur dengan undang-undang yang terpisah. BUMD diatur dengan Undang-Undang Pemerintah Daerah, sedangkan perseroan terbatas diatur dengan Undang-Undang Perseroan Terbatas. Penelitian ini menggunakan metode yuri-dis normatif, dengan mendalami upaya harmonisasi hukum. Hasil penelitian menunjuk-kan bahwa perseroan daerah pada dasarnya juga perseroan terbatas yang dapat dimiliki sepenuh sahamnya oleh satu pemerintah daerah, namun dalam UUPT, tidak diakomodir sebagai perseroan terbatas dengan saham tunggal dapat didirikan oleh satu pemerintah daerah. Namun dalam praktiknya sebagian notaris berupaya melakukan terobosan yang kemudian diakui oleh pemerintah dengan memberikan status badan hukum pada perseroan yang didirikan sepenuhnya oleh satu pemerintah daerah sebagai satunya pendirinya Perseroda. Hal ini, menimbulkan pertanyaan hukum, apakah landasan hukum yang dapat digunakan oleh notaris dan pemerintah untuk menerobos UUPT untuk memenuhi kaedah yang terdapat dalam Undang-Undang Pemda. Bringing the Harmony of the Limited Liability Law in the Establishment of Regional Company The purpose of this study is to analyze the lex specialist principle related to the harmony of the Law on Limited Liability Companies in the establishment of regional companies. Regional company is one of business entities in Indonesia legal system. The characteristic of company law in Indonesia is each type of company regulated by a separate law. BUMD (regional company) is regulated by the regional government law while limited liability company is regulated by UUPT. This study uses a normative juridical method, by exploring efforts to harmonize the law. The results showed that the regional company is basically also a limited liability company that can be fully owned by regional government, but based on the company law, it is not accommodated as a limited liability company because the company has only a single share which is one local government. However, in practice some of notaries tried to make a breakthrough which was later recognized by the government by giving legal status to regional company. This raises the question of what legal basis can be used by notaries and the government to break through the company law so that it meets the methods contained in the regional government law.

Abstract

ABSTRACT: Both province and regional may establish Regional or Provincial Company that can be formed as Regional Company or Limited Company. The establishment of such company shold be based on local regulation aiming to collect the revenue supporting the development and public facilities. The establishment of such company must be in obligatory implementation and optinal matter owned. The option is based on special patent owned by the area. Abstract

The licensee is interesting point for business entity and goverment. The system of district licensee should make good condition    for every  side. Therefore, the local  goverment   should do reformation and deregulation about the local of licensee. The license is related with retribution that must be paid by business when need licensee from local goverment. Abstract

The country of Indonesia is a large country, in addition to its vast territory, as well as its large population. Therefore Indonesia has become a large market share, so it has become the target of selling goods from other countries. This large market will also be a big capital for domestic products if domestic products can be competitive in their own countries, even if they are exported to other countries. Abstract

Lahirnya Undang-Undang No. 7/2016 tentang Perlindungan dan Pemberdayaan Nelayan, Pembudidayaan dan Petambak Garam, memunculkan masalah baru bagi nelayan kecil. Undang-undang ini memperbesar ukuran gross tonnage kapal nelayan kecil dari ukuran 5 GT menjadi 10 GT. Ketentuan ukuran 5 GT diatur dalam Undang-Undang No. 45/2009 tentang Perubahan Undang-Undang No. 31/2004 tentang Perikanan. Perubahan GT tersebut tidak sederhana. Masalah utama adalah terdapat perbedaan antara undang-undang yang mengatur perlindungan nelayan dengan undang-undang yang mengatur perikanan. Implikasi dari perbedaan ini tidak terbatas pada kapal semata, melainkan pada jalur penangkapan ikan, fishing ground, hingga proses perizinan kapal. Dengan semakin besar GT, maka fishing ground yang selama ini dipakai oleh kapal nelayan ukuran 5 GT, turut dipakai oleh kapal berukuran 10 GT. Hal ini berpotensi konflik sesama nelayan. Tawaran pemetaan untuk harmonisasi hukum diharapkan akan menjawab permasalahan hukum perlindungan nelayan. Legal Arrangement of Small Fishermen Protection The birth of the Act No. 7/2016 on Protection and Empowerment of Fishermen, Cultivation and Fishers of Salt, raises new problems for small fishermen. This act enlarges the gross tonnage size of small fishing vessels from 5 GT to 10 GT. The 5 GT size requirement is regulated in the Act No. 45/2009 on Amendment of the Act No. 31/2004 on Fisheries. The GT changes are not simple. The main problem is that there are differences between laws governing the protection of fishermen and the laws governing fisheries. The implications of this difference are not limited to ships alone, but to fishing lanes, fishing ground, to the licensing process of ships. With the bigger GT, then the fishing ground that has been used by fishing boats size 5 GT, also used by the ship size of 10 GT. This has the potential to conflict among fellow fishermen. The legal to harmonization mapping offer is expected to address legal protection issues of fishermen.

Abstract

ABSTRACT: This research to present whether economic democration as Stated in the 1945 Constotution, Article 33, has been able to be operationalized in to the Qanuns of Aceh for developing production athmosphir. This research refers secondary data, such as primary, secondary, tertiary resources. However emperical data was also used for quiding analysis of the research. Research finding shows that the effort of developing production athmosphir in case of the special authonomy in Aceh through regional and procedures regulation was not effectively achieved. This was indicated by unability of Aceh Government in constructing legislations product either for implementing obligation affairs or section of choices as there were mentioned in law Number 11, 2006 on Government of Aceh. Abstract

Pelaksanaan pengelolaan yayasan bertumpu pada prinsip keterbukaan dan akuntabilitas dalam kaitannya dengan upaya mencegah penyalahgunaan lembaga yayasan. Di Aceh terdapat sejumlah yayasan yang bergerak dibidang sosial dan kemanusiaan, dibidang sosial dan pendidikan. Namun, pada kenyataaan tidak semuanya telah secara penuh menerapkan asas keterbukaan dan akuntabilitas sebagaimana yang diatur dalam Alinea ke 4 (empat) Penjelasan Umum UU Yayasan. Tujuan penelitian ini adalah untuk mengetahui dan menjelaskan tanggung jawab perdata yayasan apabila tidak melaksanakan secara penuh asas keterbukaan dan akuntabilitas. Penelitian ini menggunakan jenis penelitian hukum normatif dan penelitian hukum empiris. Hasil penelitian mengungkapkan bahwa pelaksanaan prinsip akuntabilitas dan keterbukaan merupakan tanggung jawab yayasan sebagaimana yang diatur dalam UU Yayasan dan Anggaran Dasarnya. Ketika prinsip tersebut tidak dilaksanakan oleh organ yayasan, maka hal itu dikategorikan sebagai perbuatan yang bertentangan dengan Anggaran Dasar dan lalai dalam melaksanakan tugas. Sehingga akibat hukum yang ditimbulkan dari perbuatan tersebut yayasan dapat diajukan ke pengadilan untuk permintaan pemeriksaan.

Abstract

Pelaku  Usaha  Makanan  dan  Minuman  Industri  Rumah  Tangga  berkewajiban  untuk  mengikuti ketentuan hukum sertifikat halal berdasarkan ketentuan Pasal 4 Undang-Undang Nomor 33 Tahun 2014 tentang Sistem Jaminan Produk Halal. Namun, dalam pelaksanaannya masih juga terdapat pelaku usaha yang tidak taat akan  aturan  kehalalan  tersebut.  Hal  ini  dapat  dilihat  berdasarkan  hasil  penelitian  yang  menyimpulkan  bahwa pelaksanaan  kewajiban  sertifikat  halal  oleh  pelaku  usaha  industri  rumah  tangga  di  wilayah  Kota  Banda  Aceh pada  tahun  2019  belum  terlaksana  sepenuhnya.  Adapun  yang  menjadi  faktor  penyebabnya  adalah  kurangnya kesadaran  pelaku  usaha  untuk  menggunakan  label  halal  dan  belum  adanya  sanksi  hukum  yang  tegas  dari pemerintah mengenai hal itu. Upaya pemerintah dalam melakukan pengawasan belum merata dan sanksi yang diberikan  hanya  berupa  teguran  semata.  Disarankan  kepada  pelaku  usaha  industri  rumah  tangga  untuk  segera mengajukan permohonan sertifikat halal di LPPOM MPU Aceh dan meningkatkan kesadarannya terkait betapa pentingnya  label  halal  pada  suatu  produk,  serta  kepada  pemerintah  agar  memperketat  pengawasan  dan  juga memberikan sanksi yang tegas kepada pelaku usaha industri rumah tangga yang tidak taat akan aturan hukum tentang sertifikat halal.
