Abstract

Characteristic of a democratic state of law, among others, is a guarantee for any person to bring an action or state governments who did or considered doing a disservice either material or immaterial. Through Law 37 of 2008 on the Ombudsman of the Republic of Indonesia, now Indonesia has had the Ombudsman, the Ombudsman called the Republic of Indonesia, which has strengthened the position and authority. In reality, at this time the function of this agency to oversee the implementation of public service less visible benefits. Society often complained about the poor public services like this. This causes that the existence of the Ombudsman less perceived by the public and cannot meet the needs of the community as a means of complaint to the public service. In addition, the output of the Ombudsman is only a recommendation which has no binding sanctions for public service agencies to implement the recommendations that have not been able to be a solution to realize the reform bureaucracy. The purpose of this thesis, namely: First, determine the existence of the Ombudsman of the Republic of Indonesia Riau Representative in the implementation of the oversight function. Second, find the efforts made by the Ombudsman of the Republic of Indonesia Riau representative in overcoming obstacles. Third, find the constraints faced by the existence of the Ombudsman of the Republic of Indonesia Riau Representative in the implementation of the oversight function to achieve good governance in the province of RiauKey word: law, banking, conventional, syariah.

Abstract

The general elections to choose Regional Head and Regional Head Vice (regional election) directly by the people under the Act (the Act) 32 of 2004 on Regional Government, as amended by Act 12 of 2008 in conjunction with the Government Regulation (PP) No. .6 in 2005, seen as a step forward in the democratic political system in our country, in order to realize the ideals of the Unitary Republic of Indonesia (Indonesian Republic) safe, orderly, fair and prosperous. However, after five years of direct election was held in the Republic (as of the month of June 2005 under the provisions of Article 233 paragraph 1 of Law 32 of 2004), it's almost always tinged with the negative impact of the various violations that gave birth to the dispute and contention, whether conducted by the contestants and supporters as well as those conducted by the organizers (Election Commission) itself.Keywords: Authority –PTUN- Dispute – Regional Election

Abstract

In accordance with the principle of state law, any legislation must be sourced and based firmly on the laws and regulations applicable higher level. As an instrument of state law, local regulations are problematic can be tested. Local legislation which contrary to the public interest and / or conflict with higher laws can be tested by two institutions authorized in two models, namely the judicial review by the Supreme Court and executive review by the Government (Home Minister). So, it shows the duality about the rules of local regulation testing that is between the Home Minister and the Supreme Court. Therefore, it needs to be revisited on how the mechanism and who exactly has the authority to examine the local regulation of district/city against provincial local regulation.Keywords: Examination – Local Regulation of District/City – Provincial Local Regulation

Abstract

As the existence of the Regional Representative Council regional representative bodies have a very important role in fighting for the aspirations of the people in the area, particularly on regional expansion due to the expansion of local government can be useful to accelerate regional development and public service approach, in stages. This has an impact on the improvement of the welfare of the community is the goal of national development. But in fact the DPD has not been able to perform its role to the fullest, especially in the area when the expansion is part of a regional expansion DPD affairs. In fact, the division of the House was most strongly associated with the expansion of the DPD. As an institution representing parts of the provinces throughout Indonesia, DPD also need to regularly monitor the progress of various legislative process at the local level.Keywords: Existence - DPD - Redistricting

Abstract

The weakness of administrative decision assesed in absence of forceful measures imposed on the defendant administrative. With law No.9 of 2004 and changed with law No.51 of 2009, known forceful measures in administrative decision. Article 116, paragraph 4 „in case the defendant is not willing to implement the binding court decision, to official concerned shall attempt a forced measures such as forced payment of money forced and/or administrative sanction‟. But until now the implementation of rules and technical instruction how both intstrument such a forceful measures implemented has not been issued by the government and by the supreme court. The purpose of this writing is to find out the urgency of forceful measures in the implementation of the binding administrative court decision. Conclusions are (1) many administrative court decision that can not be excecuted, due the factors, both in self respect of defendant and the ansence of the institution of measures. (2) forceful measures as mandated in article 166can be implemented effectively because there‟s no implementing reguletion.(3) theimplementation of forceful measures as a feature of the general principle of good governance, the rule of law. And sanction as a weapon for defendant to implement the administrative court decision.The author suggestion that examined of the problems are, first there should be forcibly implementing regulations regarding it self as the publication of government regulations. Second, confirm the dranft plan of administrative law. Third, indispensable participations of defendant in the execution of administrative court decision to determine the development of execution.Key word : Urgency – forceful measures –administrative court

Abstract

Putusan Mahkamah Konstitusi (MK) Nomor 35/PUU-X/2012 mereview beberapa pasal dalam Undang-Undang Nomor 41 Tahun 1999 tentang Kehutanan, terutama Pasal 1 angka (6) yang dinyatakan bahwa kata Negara tentang Kehutanan tidak mempunyai kekuatan hukum mengikat. Hal ini memberikan konsekuensi, yaitu memperkuat kedudukan hutan adat. Namun, disisi lain belum terbentuk suatu pola perlindungan yang pasti sehingga masih rawan konflik. Oleh karenanya, perlu dicarikan pola perlindungan hutan adat pasca putusan MK tersebut. Metode penelitian dilaksanakan secara normatif. Kedudukan hutan adat pasca putusan MK Nomor 35/PUU-X/2012, semula merupakan hutan negara berubah menjadi hutan yang berada dalam wilayah masyarakat hukum adat. Sebagai konsekuensinya memberikan perlindungan hukum bagi masyarakat adat. Pola perlindungan hutan adat pada masyarakat adat di Provinsi Riau pasca putusan MK memberikan hak membuka hutan ulayatnya untuk dikuasai dan diusahakan sepanjang memenuhi syarat dalam cakupan pengertian kesatuan masyarakat hukum adat.

Abstract

The authority of local government in forest management in the Province of Riau has not been running as yet so far, because there is deviation in it, that caused by functionaries as well as individual community around of the forest area. Forest management by the regency government is still far from the principles of well government management, transparency, participation, accountability, and professional. The obstacles for local government to do forest management authority in the Province of Riau such as, firstly, law and regulations. Secondly, permit and supervision instruments. Thirdly, law enforcement officers. Fourthly, community. While the system of local government authority farther in forest management can be done through first, the system of forest management through Unity of Forest Management (KHP) concept. Second, the system of community participation by involving the local community more broadly in planning, maintenance, management, decision making, implementation, and supervision. In order to give comprehension for local community that importance of everlasting and sustainable forest management program for future generation by increasing counseling and socialization. The implication of forest management towards local autonomy shows a dynamic transformation, authority friction in forest management that was decentralization became centralization.

Abstract

After the enactment of Law Number 6 of 2014 concerning Villages on 15 January 2014, the Republic of Indonesia now has laws specifically regulating the administration of village governance. A very important part is the arrangement of village regulations. Village regulations are set by the village head after obtaining approval with the Village Consultative Body. In the process of establishing village regulations, community participation is needed, so that the output of village regulations can fulfil aspects of local community needs that are conveyed through the Village Consultative Body. The aspirations of the local community in the form of input and contribution ideas are more effective, because community complaints and opinions are taken into consideration in decision making. Related to this matter, the formulation of the problem in this study is how is community participation in the process of establishing Village Regulations in Koto Masjid Village, District XIII, Koto Kampar, Kampar Regency? There are still very many village organizers (Village Heads and Village Consultative Bodies) and village communities who do not yet have the knowledge and expertise in the field of legislation. This has the potential to affect the success of the implementation of the Law on Villages, and even does not rule out the possibility of creating legal chaos, among others, the occurrence of conflicts and overlapping laws and regulations. So that in the future knowledge of the establishment of legislation is needed which is able to encourage people to participate in the formation of village regulations, realize Village Regulations that are aspirational, responsive, obedient, harmonious and harmonious vertically and horizontally in the framework of developing national legal systems based on The 1945 Constitution of the Republic of Indonesia, and produced a Draft Law and Regulations that could be accounted for philosophically, juridically and sociologically. Knowledge can be obtained through legal counselling, especially legal counselling related to community participation in the process of establishing village regulations in Koto Masjid Village, District XIII Koto Kampar, Kampar District.

Abstract

ABSTRACT Kampung Lalang, Kecamatan Sungai Apit is an area in Kabupaten Siak that has the potential to experience abrasion, environmental pollution, forest fires and floods due to overflowing rivers. To prevent this environmental damage from continuing, it is necessary to have a policy drawn up in the form of a policy plan by the village government (kampung) which is authorized to run the wheels of government at the village level. The village has the authority to make village regulations. Law Number 32 of 2009 concerning Environmental Protection and Management emphasizes that in order to prevent pollution and environmental damage, laws and regulations must be based on the environment. This includes village regulations that will be made by Kampung Lalang Village. Based on the background of this problem, community service activities are carried out with the aim of; Increasing the role of the community and village officials in forming environmental-based village regulations as an instrument for preventing pollution and environmental damage; Increase understanding of the community and village officials so that in making laws and regulations at the village level based on the environment; Increase the understanding of the community and village officials in understanding the importance of making and compiling village laws and regulations based on the environment in order to prevent environmental damage. Community service carried out in Kampung Lalang is carried out by the Service team using the lecture method and mentoring in training on the formation of environmentally-based village regulations. Environmentally-based village regulations are the application of basic concepts and principles of environmental protection and preservation into every drafting of Village Regulations and every village development policy. So that the end result of increasing public knowledge and understanding of environmental-based legislation is the realization of sustainable development.  Keynote: Strengthening Understanding, Village Regulations, Based on the Environment.       ABSTRAK Kampung Lalang Kecamatan Sungai Apit merupakan daerah di Kabupaten Siak yang berpotensi mengalami bencana abrasi, pencemaran lingkungan, kebakaran hutan dan banjir akibat meluapnya sungai. Untuk mencegah terus berlanjutnya kerusakan lingkungan hidup ini dibutuhkan kebijakan yang disusun dalam bentuk perencanaan kebijakan oleh pemerintah desa (kampung) yang berwenang menjalankan roda pemerintahan di tingkat desa. Desa memiliki kewenangan untuk membuat peraturan desa. Undang-Undangan Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup mempertegas bahwa untuk mencegah pencemaran dan kerusakan lingkungan peraturan perundang-undangan yang dibuat harus berbasis lingkungan. Dalam hal ini termasuk peraturan desa yang akan dibuat oleh Desa Kampung Lalang. Berdasarkan latar belakang permasalahan ini maka dilaksanakan kegiatan pengabdian kepada masyarakat  yang bertujuan; Meningkatkan peran masyarakat dan perangkat desa dalam membentuk peraturan desa yang berbasis lingkungan hidup sebagai instrumen pencegahan pencemaran dan kerusakan lingkungan hidup; Meningkatkan pemahaman kepada masyarakat dan perangkat desa agar dalam  membuat peraturan perundang-undangan di tingkat desa  berbasis pada lingkungan hidup; Meningkatkan pemahaman masyarakat dan perangkat desa dalam memahami arti penting membuat dan menyusun peraturan perundang-undangan desa yang berbasis lingkungan hidup guna mencegah kerusakan lingkungan hidup. Pengabdian masyarakat yang dilaksanakan di kampung Lalang dilakukan oleh tim Pengabdian dengan menggunakan metode ceramah dan pendampingan dalam pelatihan pembentukan peraturan desa yan g berbasis lingkungan.  Peraturan Desa berbasis lingkungan merupakan penerapan konsep-konsep dasar dan prinsip perlindungan dan pelestarian lingkungan hidup ke dalam setiap penyusunan pengaturan desa dan setiap kebijakan pembangunan desa. Sehingga hasil akhir dari peningkatan pengetahuan dan pemahaman masyarakat tentang peraturan perundang-undangan berbasis lingkungan hidup adalah terwujudnya pembangunan yang berkelanjutan. Abstract

Rumah Tangga adalah merupakan wadah dimana dua oranganak manusia yang berbeda dipersatukan dalam sebuahikatan perkawinan. Terkadang perkawinan tersebutdibumbui dengan kebahagiaan dan tidak sedikit pula yangselalu dibumbui dengan pertengkaran bahkan menimbulkankekerasan terhadap salah satu pihak. Penyebab terjadinyakekerasan dalam rumah tangga (KDRT) oleh suami terhadapisteri antara lain adalah dimana laki-laki dianggap palingdominan daripada perempuan dalam rumah tangga,sehingga mempunyai kewenangan penuh terhadap istri danberhak melakukan apa saja sesuka hatinya, karena himpitanekonomi keluarga, himpitan masalah kota besar yangmendorong stress, kondisi lingkungan dan pekerjaan yangberat mendorong tingginya temperamental seseorangmaupun karena kondisi kejiwaan seseorang.
