Abstract

The research aims to know and comprehend the customary law principles as a rule in the exploration of natural resources, to know communities behavior on customary law in exploring the natural resources, and to explain the customary law as a beneficial rule to conserve the natural resources in lore lindu region. It will be conducted through the research method of socio-legal by data collecting will be done by direct observation of the research object as well as interview and participatory appraisal. Secondary data such as documented policy, law and regulations, political agreements, village demographic data, and other supporting data will be collected from various sources of concerns. The result of the research could be revealed as that the customary law principles as a rule in the explorations of natural resources still influence their rule in using its of course lead by head of tribe (totua Ngata) for a long time ago. As well as the communities behavior on customary law in using the natural resources in general. Then the customary law as a beneficial rule to conserve the natural resources in lore lindu region in particular can be assumed, but the intervention of state law or policy made it diminish gradually. Customary law related to forest conservation as a part of their values such as ombo (forbidden) cutting or bring tree or fish in a certain time. Keyword: Formation; Customary Law; Natural Resources; National Park

Abstract

Birokrasi pemerintah memegang peran utama dalam mengendalikan kegiatan-kegiatan administrasi dalam pembangunan suatu negara. Oleh karena itu, birokrasi merupakan alat bagi pemerintah untuk menyediakan pelayanan publik, sebagai perencana, pelaksana dan pengawas kebijakan. Dalam rangka mencapai tujuan negara, maka pemerintah dituntut melakukan peningkatan kinerja pemerintahan khususnya berkaitan dengan fungsi dan tugas-tugas pemerintah sangatlah diharapkan masyarakat. Dibalik era reformasi yang sedang berjalan sekarang ini khususnya reformasi di bidang tata kelola pemerintahan. Kondisi pelayanan seperti ini perlu segera direformasi guna mewujudkan kinerja birokrasi dan pelayanan publik yang berkualitas sehingga dapat memberikan kepuasan kepada masyarakat. Metode kegiatan ini adalah metode ceramah dan dialog dengan penyampaian materi pokok yang bersifat teoritis, di mana materi dibawakan oleh beberapa orang sebagai pemateri dengan sasaran yakni Aparatur Sipil Negara (ASN) di Kelurahan Besusu Tengah Kota Palu. Dengan menggunakan teknik demikian dapat mengetahui tingkat pemahaman Aparatur Sipil Negara (ASN) tentang kualitas pelayanan publik. Hasil kegiatan yakni kinerja ASN dalam memberikan pelayanan publik telah berjalan secara optimal. Akurasi pelayanan publik dalam memberikan pelayanan kepada masyarakat lebih teliti dan berhati-hati sehingga minim terjadi kesalahan. Kesopanan dan sikap ramah yang diberikan juga tergambar dalam pelayanan yang diberikan

Abstract

Establishment of Regional Owned Enterprises (BUMD) An effort to reduce the dependence of local governments on balancing funds from the central government. This Regionally Owned Enterprise is mostly or wholly owned by regions of wealthy regions. This BUMD is a government instrument that has a role to develop the regional and even national economy. The existence of BUMD in successful regional economic activities is a new thing, but has been going on for a long time. The obligation to establish BUMD is to carry out regional development through services to the community, implementing public benefits and increasing the level of local government. The purpose of this study is to determine the legal description of BUMD in taking legal actions and what factors are obstacles for BUMD to achieve their orders. The research method used is normative juridical research method.
