Abstract

The research aims to analyze the positive and negative implications of the omnibus law on job creation on the development of the forestry sector. In writing, this article is normative juridical. Based on this method, this research is conducted by examining and analyzing theories, doctrines, and laws and regulations that are relevant to the issues discussed. Based on research results, the main points of amendments to regulations in the forestry sector include affirmation of forest areas, forest areas, changes in forest area designation and function, utilization of production forests and protected forests, business permits, non-tax state revenues in the forestry sector, utilization of forest areas outside forestry activities, the authority of the central and regional governments in forest protection, prohibiting activities that cause forest destruction, and imposing sanctions and procedural law on criminal acts of forest destruction. These changes have implications for forest protection in Indonesia, including increasing forest area conversion, limiting community participation in forest management plans, and weakening sanctions (eliminating absolute responsibility). Therefore, in policy formulation, it is necessary to pay attention to forest protection to harmonize human and environmental interests. Based on the results of the research, it is therefore recommended that the government be firm and concrete in regulating forest protection efforts in future implementing regulations.

Abstract

The progress of digital transformation requires efforts to protect personal data as a guarantee of individual rights to overcome the large number of cases of data leakage and misuse, one of which is population data. The concretization of the government's efforts based on Article 28 G of the 1945 Constitution is realized through providing access to population data to all institutions, both state and private institutions for data verification. In addition, there is an obligation for data user parties to implement a Zero Data Sharing Policy with provisions prohibiting the dissemination or sharing of population data with third parties. However, various basic factors are influenced by the limited aspects of legal protection related to the class of personal data, and the authority between the data owner and the user, which makes it imperative to enact the current regulation on personal data protection. In addition, the establishment of an Independent Surveillance Authority is a must in ensuring the implementation of these regulations, because their duties and authorities are in line with the government's efforts in protecting population data. This study uses a normative legal research method with an approach to legislation and literature study, and uses descriptive analysis in managing qualitative data by applying a deductive method. The results of the study indicate that the need for legal guarantees must be accompanied by an element of optimal supervision through the establishment of an Independent Surveillance Authority in accordance with the standardization of the European Union General Data Protection Regulation (EU GDPR). Its independent position will prevent intervention from various parties for certain interests. Functionally, it is considered appropriate in optimizing the implementation of the Zero Data Sharing Policy through the conception of investigative authority and collective rights as a guarantee of human rights.

Abstract

The cases of IUU Fishing often occurred in Indonesia. This is due to the lack of supervision by the Indonesian government towards foreign vessels that are still fishing in Indonesian territorial and EEZ.  IUU fishing caused huge losses to the country. One of the perpetrators of this illegal act was the Thai Silver Sea 2 ship. The ship entered Indonesian territorial waters precisely in Sabang waters, by flying the Indonesian flag to trick the Indonesian government patrolling around Sabang waters. However, gradually the Indonesian government became aware of the existence of foreign vessels which had been suspected by Indonesia for a long time because it often turned off VMS so that its existence could not be detected by the Indonesian government. This study will examine more deeply related to whether the action conducted by Silver Sea 2 Vessels violate Indonesian regulation and UNCLOS 1982? And is the legal enforcement of Illegal Unreported and Unregulated Fishing taken by Indonesian government compatible with UNCLOS 1982?. This research is a normative legal research with a statute approach, and a conceptual approach. Legal material collection techniques are carried out by examining the relevant literature, analyzing various legal references relevant to the problem related to the study to be analyzed further qualitatively and descriptively. The results showed that the actions of SS2 ships violated Indonesian legislation and UNCLOS 1982 and were appropriate when this case was handled by the Sabang district court.

The ship entered Indonesian territorial waters specifically in Sabang waters, by flying the Indonesian flag to trick the Indonesian government patrolling around the area. However, gradually the Indonesian government became aware of the existence of foreign vessels which had been suspected by Indonesia for a long time because it often turned off VMS so that its existence could not be detected by the Indonesian government. This study delves deeper into whether the actions conducted by Silver Sea 2 Vessels violate Indonesian regulations and UNCLOS 1982. Additionally, it examines the compatibility of the Indonesian government’s legal enforcement of IUU Fishing with UNCLOS 1982. The results indicate that the actions of SS2 ships violated Indonesian legislation and UNCLOS 1982. Furthermore, the handling of this case by the Sabang District Court was deemed appropriate.

Abstract

Illegal levies are the designation of all forms of levies that are unofficial, which have no legal basis, so the act of levies is referred to as illegal levies. One of the criminal acts of corruption that occurs in people's lives is illegal fees. An example of a criminal case of illegal fees is the case in Decision Number: 46/Pid.Sus-TPK/2018/PN.Tjk in that case the defendant  was acquitted. Judging from the judge's decision that acquitted the defendant, the authors conducted research on the identification of illegal fees as a criminal act of corruption and what was the basis for the considerations of the Panel of Judges in passing an acquittal in cases of criminal acts of corruption based on Decision Number: 46/Pid.Sus-TPK/2018/ PN. Tjk. The problem with this research is the identification of extortion as a criminal act of corruption. and what are the basic considerations of the Panel of Judges in passing an acquittal in a corruption case based on Decision Number: 46/ Pid.Sus -TPK/2018/PN. Tjk The research method used is normative juridical research method, sources of primary and secondary legal materials. From this study it can be concluded that illegal fees can be categorized as a criminal act of corruption, this action is regulated in Article 12 letter e of Law Number 31 of 1999 which has been amended and added to Law Number 20 of 2001 concerning Eradication of Corruption Crimes. That the basis for the judge's considerations in deciding that the corruption case was free of Decision Number: 46/Pid.Sus-TPK/2018/PN.Tjk Defendant did not meet the elements of "benefiting oneself or others" and the element of "receiving gifts or promises" as charged in the Alternative indictment by the Public Prosecutor, so that the defendant is not legally and convincingly proven guilty of committing a criminal act of corruption.

Abstract

Penangkapan ikan dengan alat tangkap terlarang merupakan salah satu bentuk illegal fishing. Bentuk praktik illegal fishing yang biasa terjadi seperti penangkapan ikan dengan menggunakan bahan peledak, alat tangkap dilarang (cantrang, trawl). Meskipun penggunaan alat tangkap cantrang telah dilarang, namun Sebagian nelayan masih menggunakan alat tangkap tersebut untuk mendapatkan hasil tangkapan yang banyak dalam waktu yang singkat. Oleh karena itu, kegiatan ini bertujuan untuk meningkatkan kesadaran hukum dan peran serta masyarakat nelayan khususnya masyarakat nelayan Desa Hanura dalam pencegahan praktik illegal fishing. Untuk mencapai tujuan tersebut, pelaksanaan kegiatan ini menggunakan metode ceramah, diskusi terarah dan tanya jawab, serta pelayananan klinis. Sasaran kegiatan ini yaitu masyarakat nelayan Desa Hanura yang berlokasi di Kecamatan Teluk Pandan Kabupaten Pesawaran. Adapun mitra dalam kegiatan ini, masyarakat nelayan Desa Hanura yang dalam hal ini telah disetujui oleh Kepala Desa Hanura. Mengingat berbagai keterbatasan sarana pengawasan instansi penegak hukum, peran serta masyarakat khususnya nelayan sangat dibutuhkan sebagai perpanjangan tangan penegak hukum dalam melakukan pengawasan dan pencegahan praktik illegal fishing. Oleh karena itu, hasil yang diharapkan setelah pelaksanaan kegiatan ini yaitu masyarakat nelayan Desa Hanura mempunyai kesadaran hukum khususnya akan perbuatan yang dilarang serta mengetahui sanksi pidana terhadap penggunaan alat tangkap terlarang, menyadari dan memahami pentingnya menjaga kelestarian sumberdaya ikan dan ekosistemnya, dan nelayan Desa Hanura berperan aktif dalam pencegahan praktik illegal fishing.
