Abstract

The focus of this study lies on how the Islamic concept sees the phenomenon of the Eid homecoming?, and how is the legal and cultural anthropological review of the Yogyakarta society Eid homecoming?. Seeing and understanding in depth about the concept of Islam and a review of legal and cultural anthropology used as an analysis knife of the Eid homecoming phenomenon is the purpose of writing this article. While this research is a qualitative research by looking at the cultural value orientation in the Yogyakarta society. Then, the methods used to collect data are observation, interviews, and data collection through analysis of studies of various literature that have relevance to the study to be carried out with analytical descriptive properties through analysis of the Huberman and Miles model. Therefore, the results of the study show that the Eid homecoming carried out by the Yogyakarta society is one of the social actions or activities in culture that fall into the general category, namely "al Bārā'āh al-Ashlāyyāh" and contains the value of worship in Islam. Meanwhile, the review of legal and cultural anthropology serves to explain the legal and culture that develops in the life of the Yogyakarta society.

Abstract

This study discusses the progressive thinking put forward by a young pesantren kiai from Madura, namely Lora Thohir. Lora Thohir's progressive thinking brings a new color to pesantren education in general and in particular to the progress of education at Mambaul Ulum Bata-Bata Islamic Boarding School. In this study, it is very interesting to study as an effort to preserve the ideas of various figures in Islamic boarding schools who have contributed to the progress of Islamic education in Indonesia, including the results of Lora Thohir's thoughts on the progress of Islamic boarding school education. Then, library research is the type in this research with a descriptive-explorative qualitative approach. In other words, this research is a character study with data analysis using content analysis techniques through inductive patterns. Furthermore, the results of this study indicate that the existence of Lora Thohir has significantly positive impacts on the progress of education at the Mambaul Ulum Bata-Bata Islamic Boarding School. With progressive thinking, he is able to provide a new color for the development of pesantren education in the midst of modernization life with technological advances without having to leave the traditional values ​​of pesantren. The influence of Lora Thohir's progressive thinking in the field of education in general demands the formation of a complete human being or a perfect human being in the students. Meanwhile, in the implementation of Lora Thohir's progressive thinking in Mambaul Ulum Bata-Bata Islamic Boarding School Education, it is proven by the existence of several programs to develop knowledge among the students in the pesantren.

Abstract

This article examines the internalization of Islamic values ​​based on national insight into the education system. While the discussion includes; the application of Islamic values ​​based on national insight and urgency in the education system with the aim that Muslims are always enthusiastic in maintaining Islamic and national values ​​so that they are not easily influenced by various understandings that can threaten the diversity of life in the Pancasila state. Then, the preparation of this article uses a literature study through qualitative descriptive analysis because the information presented is in a descriptive form with an explanation in the form of a statement through an inductive nature. Furthermore, the results of this article state that the application of Islamic values ​​based on national insight can be carried out through the order of personal, family, social, economic, political and national life. Meanwhile, the urgency of its application in the education system aims to remind all elements of the Indonesian nation, including Muslims in particular, that the national education system must adhere to divine values, just and civilized humanity, unity, deliberation and justice, which are essentially in line with various values ​​in Islamic teachings.

Abstract

The research of polygamy law focuses on the perspective of fiqh (Islamic Jurisprudence) and family law which is only limited to four Muslim countries, namely Turkey, Tunisia, Indonesia and The Kingdom of Saudi Arabia because the four countries that have been mentioned are countries with a majority Muslim population and become a representation of the four famous jurisprudence school (Madhhabs). Not only that, the family law that exists in these four Muslim countries also has characteristics that are more responsive to all the problems of the family that exist today by being more progressive and giving a new color to Islamic law. Library research is a type of study in this article that collects data through sources of books, journals and various articles that are still relevant to this research with descriptive-qualitative analysis. This article concludes that the provisions of polygamy in fiqh in general have never been prohibited and even there are no sanctions for the perpetrators. This is different from family law regulations in Muslim countries where there are prohibitions and some even provide criminal threats or fines for the practice of polygamy and these regulations are more progressive than the existing legal provisions in fiqh.

Abstract

Memahami ajaran agama tidak bisa lagi ditafsirkan berdasarkan pada pendekatan yang secara teologis-normatif, akan tetapi terus mengalami perubahan terhadap berbagai pola paradigma yang lebih progresif. Selanjutnya, pada penyusunan penelitian ini, penulis mengambil posisi untuk berupaya melakukan integrasi-interkoneksi keilmuan dengan pendekatan interdisipliner, multidisipliner dan transdisipliner dalam memberikan jawaban atas problematika yang terjadi pada pandemi Covid-19. Sedangkan jenis dalam penelitian ini adalah library research dengan sifat kajian deskriptif-analitis melalui pola pemikiran yang sistematis menggunakan pendekatan paradigma dengan basis integrasi-interkoneksi keilmuan. Kemudian, penelitian ini menyatakan bahwa bangunan keilmuan apapun tidak bisa berdiri sendiri sehingga dibutuhkan dialog, kerjasama, saling berhubungan, saling tegur sapa dan saling koreksi apalagi dalam menghadapi pandemi Covid-19. Pandemi Covid-19 yang masuk ranah natural science mungkin bisa diselesaikan melalui ilmu medis dengan dilakukan penelitian di ruang-ruang laboratorium, akan tetapi keilmuan tersebut tidak bisa mengatasi kejiwaan dan rohani yang sedang dihadapi oleh masyarakat yang terdampak pandemi Covid-19, sehingga dibutuhkan religious science. Demikian juga ketika hendak menerapkan aturan pembatasan fisik dan sosial, maka dibutuhkan pendekatan keilmuan sosial dan humaniora.

Abstract

If the arrival of Islam equitably regulates the polygamy procedure, this is the same as the presence of marriage regulations in Indonesia. Law of the Republic of Indonesia Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage is a marriage regulation in Indonesia, one of which aims to provide legal certainty for polygamy in Indonesia. This article examines the Islamic reform in the family sector, especially on the issue of polygamy before Islam, after Islam came, and the rules of polygamy in Indonesia and how they are relevant between Islamic reform in the family sector and the rules of polygamy in Indonesia. Then, the library research is a data collection method used in writing this article with an analytical descriptive nature. Meanwhile, making it as additional knowledge and further reference in studying polygamy and its legal regulations in Indonesia is the goal expected in the preparation of this article. This article concludes that polygamy in Islam and marriage regulations in Indonesia are strictly regulated so that there is no mistreatment of women and try to provide protection and cover discrimination perpetrated by men against women in family life.

Abstract

Family without conflict is one of the effective solutions in building a happy family, but in reality there are still many conflicts that occur between family members which result in the disruption of a comfortable, safe, and happy family life. In conditions like this, the urgency of the connection with Khoiruddin Nasution's thoughts on the smart (happy) family concept he offers to realize the happiness of living in the family. library research is the type in this research by trying to collect all the data obtained from various library literature results that still have relevance to this research. Then, a descriptive-analytic model was carried out by explaining the theory and logic of thought through a contents analysis of Khoiruddin Nasution's thoughts on various works he had with a critical paradigm. This study concludes that the smart (happy) family of Khoiruddin Nasution's perspective is built on awareness among family members about the purpose of a marriage which is also the purpose of life. Then, regarding the smart (happy) family concept proposed by Khoiruddin Nasution, it is in accordance with the family concept described in the Qur'an, as described in Surah Ar-Rum [30] verse 21, At-Tahrim [66] verse 6 and Al-Anfal [8] verses 27-28.

Abstract

Penelitian ini mengkaji tentang urgensi pendidikan pra-nikah perspektif Khoiruddin Nasution dalam membangun keluarga sejahtera dengan harapan agar masyarakat Indonesia dapat memahami dengan baik segala tujuan, hakikat dan hikmah atas adanya sebuah perkawinan sehingga tidak mudah untuk melakukan perceraian. Kemudian, library research merupakan jenis penelitian ini dengan pendekatan kualitatif untuk mencari kedalaman analisis melalui sifat deskriptif analitik. Selanjutnya, penelitian ini menyimpulkan bahwa pendidikan pra-nikah sangat begitu penting sebagai bekal bagi para calon suami dan istri untuk bisa memahami secara substansial mengenai berbagai problematika kehidupan dalam keluarga. Oleh karena itu, Khoiruddin Nasution menganjurkan agar pemerintah serius dalam memperhatikan terhadap pelaksanaan pendidikan pra-nikah yang tidak hanya bersifat formalitas saja. Kemudian, pendidikan pra-nikah dibutuhkan untuk memberikan bekal wawasan pengetahuan, pemahaman, keterampilan dan penumbuhan kesadaran kepada setiap calon suami dan istri yang menghendaki untuk melaksanakan perkawinan agar bisa mewujudkan keluarga sejahtera sehingga melahirkan generasi yang berkualitas.

Abstract

This study conducts a comprehensive analysis of the right to social security in the concept of a state in Indonesia and the state's responsibility for the fulfillment of constitutional social security and the implementation of state responsibility for implementing community activities during the Covid-19 pandemic. The type of this research is legal research through a legal approach and a conceptual approach using primary and secondary legal materials and using various library materials as additional references with analytical descriptive research characteristics. Therefore, the results of this study state that awareness of the importance of the right to social security as a basic need of society must be considered by the state and the state must always be faithful to be present in providing social security for the community as regulated in the constitution. Then, the policy on the implementation of community activities should not derogate the various principle rights of the community so that it can optimize responsibilities. Furthermore, a more responsive legal formulation is needed in the social regulation of life during the Covid-19 pandemic, because the existing regulatory products are no longer relevant to the developing situation.
