Abstract

Almost all countries in the world including Indonesia give serious attention to the existence of Islamic banking that using religion approach in all activities and services. Institutional development it should be followed by the availability of legal basis, which is an established and clear. During the six years of its inception, the Islamic banking law stands with a very limited law basis, although the limitations of regulations have been describing aspects of sharia in Islamic banking for sure. The improvement of law is done by replacing Law No. 7 of 1992 by the Law No. 10 of 1998. This law has explicitly mention sharia aspects of Islamic banking, however Islamic banking regulation still governed together with conventional banking. The birth of Law 21 of 2008 became an important change for the development of Islamic banking. This law has given limits and a clear boundary line between Islamic banking and conventional banking in various aspects. The development of Islamic banking regulation are gaining its momentum with the enactment of Law No. 21 of 2008 concerning Islamic Banking. The strategic value of this law is increasingly opening up opportunities and legal certainty to accelerate the development of Islamic banks in the future

Abstract

This paper discussed on how to resolve disputes over the muḍārabah musytarakah contract in sharia insurance by looking at the applicable sharia insurance dispute settlement regulations and sharia insurance policies. This research was normative legal research using the documentation method. The results showed that in various regulations and policies regarding sharia insurance, there are various alternatives (choice of forum) in dispute resolution, including in the muḍārabah musytarakah contract. In general, sharia economic dispute resolution can be done in two ways, namely litigation and non-litigation. Litigation dispute resolution was guided by the mandate of Law Number 3 of 2006 on Religious Courts. Several alternative non-litigation dispute resolutions are mentioned in various regulations, including: by deliberation and consensus; through mediation institutions that are independent and impartial; through an association by the business activities of a sharia insurance company; or the Shari'ah Arbitration Board. Then, in the sharia insurance general policy, there are also various alternative dispute resolutions, including amicably reaching a mutual agreement. But if it is not successful, then the dispute resolution will be carried out through the Indonesian Insurance Mediation Board (BMAI); through the Sharia Arbitration Board; Religious Courts/District Courts in the policy area are issued, or the participant chooses one of the dispute resolution options and is obliged to notify the company.

Abstract

Konflik yang terjadi ada yang dapat terselesaikan dengan baik oleh masing-masing pihak, namun juga banyak yang berujung menjadi sengketa di meja hijau. Penyelesaian melalu jalur litigasi merupakan upaya penyelesaian sengketa melalui jalur peradilan. Penyelesaian model ini acapkali menimbulkan rasa ketidak adilan, karena secar prinsip litigasi melahirkan kemenganagan bagi satu pihak dan loss bagi sebagian yang lain. Peradilan Agama, sebagai salah satu institusi penegak hukum di Indonesia, yang memiliki fungsi judicial dalam sengketa hukum keluarga dan sengketa hukum ekonomi syariah. Sebagaiaman yang diatur dalam Sebagaimana telah diatur dalam Undang-Undang Nomor 7 Tahun 1989 jo. Undang-Undang Nomor 3 tahun 2006, tentang Perubahan atas Undang-Undang Nomor 7 tahun 1989 tentang Peradilan Agamali meliputi perkara-perkara perkawinan, waris, wasiat, Hibah, wakaf, zakat, infaq, shadaqah, dan ekonomi syariah. Proses penyelesaian alternatif ini belum dianggap sebagai bentuk termudah dalam mengurai perselisihan, terlebih terkait dengan sengketa dalam keluarga dan bisnis syariah. Untuk itu ada beberapa alasan penting dari keterlibatan mediator profesional sebagaimana yang diamanatkan oleh PERMA tersebut, yaitu; Pertama, eksistensi mediator non-hakim dalam menyelesaikan sengketa-sengketa keluarga dan bisnis syariah dapat lebih maksimal baik dalam jalur peradilan maupun di luar peradilan. Kedua; Kekuatan prosedur mediasi non-hakim, semestinya dapat lebih memberikan peluang kepada para pihak yang bersengketa untuk menyelesaikan perselisihan. Ketiga; lartar belakang pendidikan serta wawasan mediator profesional pada prinsipnya akan dapat menjadi kekuatan tersendiri dalam mengupayakan perdaiaman dari para pihak.

Abstract

Taman Nasional Komodo, merupakan salah satu bagian yang penting dalam pengelolaan Pariwisata Nasional Indonesia. Pengembangan dalam pengelolaan distinasi menjadi sebuah yang tak terhindarkan. Pemerintah Pusat melalui Kementerian Pariwisata, telah mencanangkan TNK menjadi salah satu distinasi pariwisata ekslusif. Pengembangan dan pengelolaannya dilakukan oleh satu Otoritas, tugas badan otoritas ini adalah merancang dan mengembangan pariwisata di kawasan ini. Pembanguanan membutuhakan satu strategi agar bisa berjalan dengan lancar dan sukses, terutama bila pembangunan tersebut bersentuhan dengan masyarakat desa. Persoalan masyarakat lokal dalam sebuah progam pembanguanan menjadi persoalan yang pelik apabila salah dalam pilihan starateginya. Untuk itu perlu ada satu nilai yang dikembangkan dalam perancanagan program-program pembangunan. Bagi masyarakat pulau dengan tingkat homogenitas kultur akan sangan kuat untuk mempertahankan budayanya. Untuk kelompok-seperti ini dibutuhkan kemampuan khusus yang mengikut sertakan komponen masyarakat dalam perancangan dan eksekusi program pembangunan.

Abstract

BMT merupakan suatu lembaga keuangan syariah yang kegiatan utamanya yaitu menghimpun dana dari masyarakat yang berbentuk simpanan serta deposito dan menyalurkan lagi kepada masyarakat dengan bentuk pinjaman atau pembiyaan usaha dengan sistem bagi hasil maupun jasa berdasarkan prinsip syariah. Namun dalam rangka penyaluran dana tidak jarang BMT mengalami sengketa pembiayaan bermasalah yang disebabkan oleh adanya faktor kelalaian yang disengaja maupun tidak sengaja baik oleh nasabah maupun BMT sendiri. Sengketa tersebut tentu dapat mengakibatkan kerugian bagi para pihak, untuk menghindari terjadinya kerugian tersebut maka perlu adanya penyelesaian sengketa antara BMT dengan nasabah, dalam hal ini terdapat beberapa cara penyelesaian sengketa baik melalui jalur litigasi maupun non litigasi. Penelitian ini merupakan jenis penelitian kualitatif dengan menggunakan metode pengumpulan data studi kepustakaan (library research), karena sumber data yang digunakan dalam penelitian ini adalah berupa jurnal ilmiah, laporan penelitian, buku ilmiah, dan publikasi ilmiah lainnya yang membahas mengenai penyelesaian sengketa pada BMT.

Abstract

Meluasnya pandemi Covid-19 di berbagai negara khususnya Indonesia telah memberikan dampak buruk terhadap tatanan negara. Dampak tersebut meliputi bidang ekonomi, pendidikan, kesehatan, sosial dan keagamaan. Maka dari itu, dalam penanganan dampak Covid-19 dibutuhkan kerjasama antara pemerintah dengan lembaga-lembaga lain semisal Badan Amil Zakat Nasional (BAZNAS) sebagai lembaga pengelola zakat di Indonesia. Salah satu bentuk peran dari BAZNAS di masa pandemi Covid-19 dapat dilihat dari kegiatan distribusi zakatnya. Penulisan paper ini bertujuan untuk mengetahui bagaimana program pendistribusian zakat yang dilakukan oleh BAZNAS dalam penanggulangan pandemi Covid-19 dan diakhiri dengan pola distribusi zakat yang dilakukan BAZNAS guna menanggulangi pandemi Covid-19. Abstract

Dispute resolution institutions can be used both for litigation and non-litigation dispute resolution. One of the dispute resolution institutions is the Consumer Dispute Settlement Agency (BPSK), which is regulated in Law Number 8 of 1999 concerning Consumer Protection. The UUPK and BPSK procedural law spell out the responsibilities and authorities of the BPSK. Currently, there are no restrictions on the types of consumer disputes that can be handled by BPSK with business actors and consumers. Regarding the authority of the BPSK in solving problems, especially in the field of Islamic finance, it is often the subject of discussion considering that each institution has different juridical foundations. The research method used is qualitative research using a juridical-normative approach. In Dispute Resolution at BPSK, the parties must first reach an agreement in the form of a contract before proceeding with dispute resolution through BPSK, which is basically a voluntary choice between the parties. BPSK cannot be used to resolve disputes if one party disagrees. Although envisioned as a weapon for consumers seeking justice, implementation remains challenging. This is because legal arrangements do not conform to assumptions, in particular answering buyer inquiries online quickly, effectively and efficiently. Apart from that, the UUPK articles are inconsistent, only contradictions between articles and horizontal conflicts with other statutory products. Legal certainty in dispute resolution requires gradual improvement of three components in the Consumer Dispute Settlement Agency: legal structure, legal substance, and legal culture. Abstract

This study aims to determine the law of guarantees in working capital financing (muḍārabah contracts) in Islamic banks from the perspective of maqāṣid syarī’ah. This type of research is qualitative research that is literary. The approach in this study uses the sharia maqāṣid system. The results of the study show that the guarantee applied by Islamic banks to working capital financing contracts (muḍārabah contracts) is a must that must be carried out by the bank in implementing the precautionary principle. While the maqāṣid sharia view, the application of guarantees carried out by Islamic banks in financing working capital specifically to secure the assets of ṣāḥib al-māl (hifẓ al-māl), and in general the guarantee law has entered into the elements of daruriyat al-khamsah, namely hifẓ al-dīn, hifẓ al-nafs, hifẓ al-‘aql, hifẓ al-nasl dan hifẓ al-māl. Therefore, applying the guarantee law is permissible to protect the assets of ṣāḥib al-māl.

Abstract

AbstractThis article aims to analyze the legal protection of consumers digital gold savings in e-commerce transactions on Tokopedia. Digital gold savings is a product of gold buying and selling services with deposit facilities at very affordable prices. This service is one form of the business operation of pawnshop companies as a deposit service provider institution that has been mandated in SEOJK No. 52/SEOJK.05/2017. Along with the development and advancement of technology, PT. Pegadaian collaborates with e-commerce, one of which is Tokopedia, to encourage the public to invest in gold only through their smartphones. This authorship uses normative juridical methods. The results showed that legally, the regulation regarding business actors (PT. Pegadaian and e-commerce) is required to guarantee legal protection of consumer rights, including ensuring legal protection for consumers in the event of an increase or decrease in gold prices that fluctuate every day. While digital ownership of gold in Islamic law is included in imperfect ownership because it is only in the form of gold balances (intangible).Keywords: legal protection; online gold savings; e-commerce.

Abstract

One of the methods used to calculate margins on murabahah financing is using an annuity calculation system. There is a problem of taking large profits at the beginning of payment causing customers to complain, setting annuity margins is considered not to provide justice for customers. In this case the author wants to examine and analyze the determination of the annuity method in the financing of Bank Aceh Syariah in terms of the principle of justice. In this research, the type of research used is library research. Based on this research, it was concluded that the determination of the annuity method used by Bank Aceh Syariah in the category of fulfilling the principle of justice for the customer is injured because the application of the annuity method at Bank Aceh Syariah contains a pattern of principal installment payments that changes to be higher and determination of profits whose value changes to be small. In the concept of Islamic justice or contained in Law Number 21 of 2008 regarding the concept of justice explains that transactions between customers and banks must obtain a form of justice. In practice the application of the annuity method tends to be manipulative so that the disbursement procedure seems burdensome to the customer. The application of the customer annuity method will incur a loss when the customer wants to pay off at the beginning but does not get an installment discount. The sense of injustice in an annuity can be eliminated and then realized, namely by making a deduction on the installments for each customer who pays off obligations at the beginning of the transaction.
