Abstract

The city of Pekanbaru does not yet have a Social Home as a HomelessRehabilitation Site and Beggars only have a Shelter House. This shelter is atemporary place and is intended as a place of residence for recipients of servicesprepared to obtain further services. At this halfway house only have rehabilitationin the form of mental counseling and religious counseling, without the provisionof skills. Non-governmental organizations (NGOs) that work with the SocialService only handle neglected children. And while entrepreneurs only providesocial assistance. In its implementation, Regional Regulation Number 12 of 2008concerning Social Order has not been implemented optimallyThis type of research can be classified as a sociological jurid, namely aresearch approach that emphasizes the legal aspects relating to the subject matterto be discussed, related to the reality in the field. This research was conducted atthe Pekanbaru City Civil Service Police Unit and the Pekanbaru City SocialService, while the sample population was all parties related to the problem understudy. Data sources used, primary data and secondary data and tertiary data,data collection techniques in this study with questionnaires, interviews andliterature studies.In the results of the problem research there are three main things thatcan be concluded. First, the implementation of Regional Regulation Number 12 of2008 concerning Social Order does not work as it should. Second, the inhibitingfactor in the implementation of these Regional Regulations is the limited budget,limited human resources, lack of facilities and infrastructure and implementationof regional regulations are not working. quality of human resources and completeexisting facilities and infrastructure.key words: Implementation, Rehabilitation, Homelessness and Beggars

Abstract

Waiver of criminal cases for the sake of public interest or can be referred to as “deponering” is the embodiment of the opportunistic principle that has been legitimized by the state through Article 35 letter c of Law No. 16 of 2004 concerning the Republic of Indonesia Attorney General's Office and Article 14 letter h of the Law Code. Criminal Procedure. In fact, what should be an important note for the government and law enforcement officials is that from the perspective of the general public who do not understand the law comprehensively.This type of research is normative juridical research. In this research, the researcher discusses the principles of law, namely the principle of equality before the law, namely equality before the law. Then also using the legality principle which is the principle that determines that no action is prohibited and punishable if it is determined in advance in legislation, known in Latin as Nullum Delictum Nulla Poena Sine Praevia Lege Poenali (no offense, no punishment without advance regulation).The conclusions that can be obtained from the research results are: First, there is no derivative regulation in interpreting the meaning of the "public interest" so that it becomes a multi-interpretation area and contradicts the legality principle where the legality principle requires rules first, because the regulation does not can be applied if legality is not written about the derivative rules. This means that there are misinterpretations and legal findings that occur in interpreting waivers in the public interest so that it is not relevant to our ideals as a rule of law. Second, the criteria for the Attorney General to link legal interests and public interests in granting deponering basically do not have standard rules and contradict the principle of legality which requires prior rules in order to achieve legal certainty. If it is in the public interest basically the Attorney General, before making a waiver of the case in the public interest, he first discusses it with the state power bodies that are related to the case, either directly or indirectly.Keywords: Deponering, General Attorney, Equality Before The Law, Attorney

Abstract

Law enforcement against narcotics crime has been carried out by law enforcement officers and has received a judge's decision in a court hearing. In the Supreme Court Circular Letter Number 3 of 2011 concerning the Placement of Narcotics Abuse in the Institute of Medical Rehabilitation and Social Rehabilitation, every narcotics addict and victim of narcotics abuse must undergo medical rehabilitation and social rehabilitation.The purpose of this thesis is: First, to find out the implementation of the Supreme Court Circular Letter Number 3 of 2011 concerning the placement of narcotics abuse in medical rehabilitation and social rehabilitation institutions in the Pekanbaru District Court. Second, to find out the inhibiting factors for the implementation of the Supreme Court Circular Letter Number 3 of 2011 concerning the placement of narcotics abuse in medical rehabilitation and social rehabilitation institutions in the Pekanbaru District Court.This type of research can be classified as a type of sociological legal research, because in this study the authors directly conduct research at the location or places that are examined to provide a complete and clear picture of the problem under study. This research was conducted at the Pekanbaru District Court, while the population and sample were all sections related to this research, the data sources used included primary data, secondary data and tertiary data, data collection techniques, namely interviews and literature studies.From the results of the research and discussion it can be concluded that, First, the Implementation of the Supreme Court Circular Letter Number 3 of 2011 in the Pekanbaru District Court has not been going well and maximally. Second, Obstacles in the Implementation of the Supreme Court Circular Letter Number 3 of 2011 in the Pekanbaru District Court, namely that doctors have not been checked or delayed for narcotics abusers before trial in court, the second is budgetary problems, and thirdly the lack of cooperation with other Pekanbaru agencies in providing a place that is feasible in carrying out rehabilitation because so far in Pekanbaru City the place to do rehabilitation is done at the Tampan Mental Hospital.Keywords: Narcotics – Abuser – Implementation – Rehabilitation.

Abstract

Local elections democratically elected as mandated by the Constitution of the Republic of Indonesia, to prioritize the people's democratic sovereignty so dilaksanakanlah local elections directly elected by the people. The elections based on Law No. 8 of 2015 held simultaneously. Implementation of simultaneous elections in 2015 led to the implications for the Constitutional Court and also has implications for the judgments of the Constitutional Court.The conclusions in this study, First, some things that have implications on Law No. 8 of 2015 in the Constitutional Court that the buildup of cases in the Court, when the settlement is only 45 days in the Constitutional Court, filing an application for a maximum of 3 x 24 hours, and terms petition filing that is the difference in vote totals at most 2 percent. Second, There are three (3) things that have implications on the judgments of the Constitutional Court on the settlement of election disputes, namely, implications on the Constitutional Court itself, have significant implications for candidates who dispute and also the electoral commission local area, and impilcations for local area influential for the wheels of local government in the dispute. Advice writer, first, not the accumulation of cases the need for special court established to resolve election disputes so that the completion of election disputes more effective, Second, to avoid the occurrence of a Constitutional Court ruling does not lead to justice the Constitutional Court to take a decision in election disputes this should really consider that it is a matter of dispute the local elections is indeed in violation of the TSM so no results.Keywords: Implications – Law Number 8 In 2015 – To Guardian Constitutional

Abstract

Corruption is one particular crime that is serious, organized that has caused serious problems and threats, because it can endanger the stability and security of the country. In eradicating criminal acts of corruption, judges as law enforcers have the power of the judiciary to hold justice in order to uphold law and justice by recognizing the principle of free and impartial justice. In imposing a sentence the judge is free in searching for the sentence that was handed down to the accused properly. In the context of the judge's freedom to determine the severity of the sentence where he can move within the maximum limits of the sentence or to choose the type of sentence, it can be stressed that these reasons, both made the basis for the burden of the sentence or to ease it. In its application, judges tend to impose corruption cases with minimal punishments both in Article 2, Article 3 and Article 12 of Law Number 31 of 1999 in conjunction with Law Number 20 of 2001 concerning Eradication of Corruption.The purpose of writing this thesis, namely; First, knowing the conviction for perpetrators of corruption under Law Number 31 of 1999 concerning Eradication of Corruption in the Corruption Court at the Pekanbaru District Court, Second; find out that judges tend to impose the shortest criminal sentences of corruption perpetrators in the Corruption Court at the Pekanbaru District Court.From the results of the research based on two problem formulations it can be concluded, First, in the implementation of judges, the criminal act of corruption is in accordance with the provisions of the applicable law. As the basis for the judge in deciding a case of corruption is referring to Law Number 31 of 1999 jo. Law Number 20 of 2001 concerning Eradication of Corruption Acts as material law and Act Number 8 of 1981 concerning Criminal Procedure Law as formal criminal law, as well as Law Number 48 of 2009 concerning Judicial Power. Second, in the implementation of criminal punishment for perpetrators of corruption under Law Number 31 of 1999 jo. Law Number 20 of 2001 concerning Eradication of Corruption. Criminal is known as the shortest and longest. Which stipulations regarding criminal sanctions in the Act are relatively none that are formulated extraordinary (extraordinary) either related to the severity or related to the type of criminal. So that we can see the legal culture of judges and the paradigm of judges thinking in passing verdicts. In the legal culture of judges there are 3 typologies: first Judge typology (1): Positivistic and Nonpositivistic, second Judge typology (2): Textual and Contextual, third Judge typology (3): Materialist, Pragmatic, and Idealist.Keyword : Criminal Act, Corruption, Criminalization

Abstract

One corollary of the doctrine of territorial decentralization in particularbore the tiered system of government, which in the context of the system ofadministration commonly known in Indonesia with the central government(central government) and local government (local government). In the context ofthe Unitary Republic of Indonesia (Republic of Indonesia) the establishment oflocal government is a process that has been, is and will be ongoing. Done throughthe formation of regional expansion, the region that gave birth to the process ofexpansion of new regional governments although philosophically intended toconduct regional arrangement, in fact also leaves many issues one of them aborder dispute between Kampar regency with Rokan Hulu is related that fivevillage , village of Muara Intan, Intan Jaya, Rambah Samo, Tanah Datar, RimbaJaya, and Rimba Makmur. The occurrence of the border dispute between theKampar Regency of Rokan Hulu certainly cause a lot of problems in society, onethat is fundamental to the uncertainty yuridisdiksi disputed territory, then thepublic administrative services, community identity and political rights of thepeople. Of course it should look for a solution see already so many rules thatestablish the village setatus five. therefore the purpose of this thesis, namely; FirstLegal Aspects of Settlement between Kampar Regency Village Five with RokanHulu. The second implication of Juridical five disputed village on theimplementation of the Government.This type of research is classified in this type of normative research,because in this peneletian authors conducted a study of the principles of law andlegal systematics. While the source of the data used is using secondary data. Datacollection techniques in this study the authors use the method of assessmentliterature or documentary studies.From the research problem, there are two main things that inferred. Thefirst aspect of the legal dispute between Kampar five village with Rokan Hulu related closely with the region of Constitutional Law relating to AdministrativeLaw Second Border Dispute implications for the implementation of obscurity.Advice Writers, First Minister of the Interior to immediately execute the SupremeCourt Decision No. 395 K/TUN/2011 as respect for the rule of law. Abstract

The general elections to choose Regional Head and Regional Head Vice (regional election) directly by the people under the Act (the Act) 32 of 2004 on Regional Government, as amended by Act 12 of 2008 in conjunction with the Government Regulation (PP) No. .6 in 2005, seen as a step forward in the democratic political system in our country, in order to realize the ideals of the Unitary Republic of Indonesia (Indonesian Republic) safe, orderly, fair and prosperous. Abstract

Alternating behind the prosecution of the case file to the investigator so contrary to the interests of the suspect or the principles of justice are fast, fair, free, simple, and inexpensive. The purpose of this thesis, namely: First, To Can Know In Prapenuntutan Problems Associated With Human Rights of Suspects, Second, To Know Settings Can Prapenuntutan In Criminal Case, Third, Can Knowing Due To Legal Prapenuntutan Against Investigation and Public Prosecution. This research uses normative juridical research method, the research done by first examining the materials library of the law relating to pemasalahan or study of regulations is standard / recorded, whereas the data source used, primary data, secondary data, and data tertiary, data collection techniques in this research with the study of literature or study methods documentary. From the research there are three main issues that can be inferred. First, the problems in prapenuntutan associated with the human rights of suspects, that there are no settings to how many times prapenuntutan can be done. The absence of sanctions for investigators when the case file is not submitted to the public prosecutor. Secondly, setting prapenuntutan in criminal cases, while the settings are: the Code of Criminal Procedure which consists of Article 8, Article 14, Article 109, Article 110, Article 138, Article 139, Explanation of Article 30 of Law No. 16 of 2004 About Kejasaan, Attorney General of the Republic of Indonesia Regulation No. PER-036 / A / JA / 09/2011 on Standard Operating Procedures (SOP) General Crimes Case Management. Third, the result of Prapenuntutan Law Against Investigation and Public Prosecution, while the consequence that in the conduct of the police arrest should not be mistaken. Abstract

Position the House of Representatives (DPRD), which is referred to as the local legislative body by the public, it is not so. Parliament is one of the elements of the regional administration together with the Regional Head, so that Parliament is a partner of the Regional Head, located parallel to the regional head. Parliament only perform the function of legislation in the area by establishing rules and regulations along the regional level Regional Head, as the regional regulation. The purpose of this study is to determine how exactly the position of Parliament in the regional administration together with the head of the region, as well as how to do with the implementation of the concept of the Unitary Republic of Indonesia (NKRI). This study was included in the normative legal research is the study of law with a review of the legal materials in the form of legislation and study books or library materials available. While the nature of this research is descriptive research is research that provides a clear and detailed picture of the problems studied. The data used is primary data that materials are binding law, as well as secondary data derived from primary legal materials, secondary and tertiary. Data was collected by the method of literature review. The result of this study is that the position of the Council is a partner in running the Regional Head of the regional administration. Indeed, the legislative power is in the realm of the center instead of on the local level, in Parliament ought to be regular penenrapannya position themselves as partners in helping both the Regional Heads in making regulations or the regional administration. Efforts are expected in order to Act No. 23 of 2014 may be revised or amended by the Act which tebaru, so that the absence of any reinterpretation of the Local Government Act.Keywords: Position - Parliament
