Abstract

Elections are a means of implementation of the people's sovereignty implemented in general, free, confidential, honest, and fair in the Republic of Indonesia based on Pancasila and the Constitution of 1945. In the general election is very common violations include criminal offenses, then for it needed serious treatment by Law Enforcement Center integrated , but in practice problems still occur. The purpose of this thesis , namely : First , how the effectiveness of the Integrated Law Enforcement Center in handling criminal offenses legislative elections in 2014 in Riau Province, Second, barriers Sentra Integrated Law Enforcement in handling criminal offenses legislative elections in 2014 in Riau Province, Third, efforts are being made to overcome the obstacles Sentra Integrated Law Enforcement in handling criminal offenses legislative elections in 2014 in Riau Province. This type of research can be classified into types of sociological research. This type of research is descriptive analysis. Source of data used were obtained through three (3 ) legal materials are the primary legal materials, secondary and tertiary. The data collection techniques were done using two methods ie interviews and review of literature. From the results of research and discussion, there are three main things that can be inferred. First, Handling General Legislative Crime Pemimihan 2014 in Riau province conducted by the Center for Integrated Law Enforcement Riau province is still not effective because of the many cases handled only one case reached the court level, as well as in handling frequent debates which it caused and can lead to the abandonment of the case that is being handled together. Second, barriers in law enforcement by Sentra Gakkumdu election there are two factors: internal factors such as: lack of coordination in Gakkumdu Sentra, Sentra lack of understanding in Gakkumdu, lack of quality and quantity in the Sentra Gakkumdu and external factors such as: people who are less active to report offenses elections are also facilities and infrastructure to support the complete lack of personnel Sentra Gakkumdu. Third, efforts in Overcoming Barriers Sentra Gakkumdu in handling criminal offense namely elections. improving the quality of personnel, utilizing the available infrastructure, and to disseminate Saran, First, the Sentra Gakkumdu Members should equate understanding in handling criminal election. Secondly, Sentra Gakkumdu improve coordination, eliminate sectoral ego, improve the quality and to disseminate to the public. Abstract

Criminal sanctions aim to give preferential suffering to the offender so that he felt as aresult of his actions. In addition aimed at imposing suffering against the perpetrators,criminal sanctions also constitute a statement of disapproval against offenders act. In the caseof money laundering narcotics proceeds of crime, criminal sanctions is necessary as adeterrent effect imposed by the judge to the perpetrators of money laundering narcoticsproceeds of crime. But often found differences in criminal sanctions against the judgeimposed the same case, or better known as the Criminal Disparities resulting in theemergence of injustice. Criminal is a criminal disparity unequal application of the samecriminal acts without apparent justification. This study examines the problems of (1) How isthe construction of thinking judges in decisions in the case of money laundering narcoticsproceeds of crime in the case Number: 593 / PID / SUS / 2012 / PN.PBR and case Number:258 / PID / SUS / 2014 /PN.PBR? (2) Are the causes of dispartitas verdict against moneylaundering narcotics proceeds of crime. The goal in this study to determine construction thinkjudges in imposing criminal verdict in the case Number: 593 / PID / SUS / 2012 / PN.PBRand case Number: 258 / PID / SUS / 2014 / PN.PBR? and also to determine the factors thatcause disparities verdict against money laundering narcotics proceeds of crime. From theresults of this study concluded (1) that in case Number: 593 / PID / SUS / 2012 / PN.PBRdefendant is proven guilty of money laundering as stipulated in Law No. 8 of 2010 withsentenced to imprisonment for 3 (three) years and a fine Rp.800.000.000, - (eight hundredmillion dollars) and in case Number: 258 / PID / SUS / 2014 / PN.PBR defendant was legallycommit money laundering continues, the defendant shall be sentenced to prison for 1 ( one)year 2 (two) months and a fine of Rp. 100.000.000, - (one hundred million rupiah). (2) Thecause of the disparity verdict against the same criminal act caused by the law itself factors,factors resources law enforcement officials, a factor of self-judge itself (both internal andexternal) and also the factors of the situation inside the defendant. This study suggested thatthe government mengandemen Law on Money Laundering which so no criminalclassification is based on the type of predicate offenses, the amount of money obtained fromthe predicate offense, and specifically for money laundering predicate crime that his narcoticcrime to establish regulations for the amount and type of drugs so that the judge in makingthe interpretation of the statute can be limited.Keywords: Disparity, Criminal, Money Laundering.

Abstract

Terrorism, including the category of extraordinary crimes, would require extraordinary measures. Thus the birth of terrorism legislation is not separated from the emergence of the pros and cons. Pros and cons occur because of differences in the starting point of looking at terrorism with the issuance of terrorism legislation. Abstract

Indonesian is a country consisting of various ethnis groups and languages starting from Sabang to Merauke. Diversity and pluralism which exist in Indonesian has established a wide range of cultures and philosophy of life Indonesian. Therefore the founders of this country. Has thought and formulate how to unite cultures and philosophy of life is variegated into a single unit. Pancasila with the motto unity in diversity. Before religion enfered Indonesia, former Indonesian society has adapted a system of cult, some of which are animism and dynamism. Flow belief system is not only used in Indonesia alone, but almost the entire world community earlier. Evidence that the cult was once lived in Indonesian.This study uses a method used in this study of primary legal materials , ie materials materials science of law that are closely related to the problems studied, namely , the Constitution of 1945, Act No. 39 of 1999 on Human Rights . Secondary law material , namely legal materials that explain or discuss matters that have been investigated on the materials of primary law , the State of Law Books , Books on Human Rights, various papers , journals , newspapers , magazines , documents , and data from the internet relating to the law penelitian.Bahan Tertiary , ie materials that give an explanation of the ingredients of primary and secondary law , namely Indonesian Dictionary and Dictionary of Law.The first study results , is the existence of cult pursuant to Article 29 paragraph 2 of the Constitution of 1945. Second , the factors difficulty cult gained recognition from the state . Third , an ideal concept cult pursuant to Article 29 paragraph 2 of the 1945 Constitution Suggestion writer , First , synchronize the legislation relating to religious freedom so that communities are able to implement the values of diversity to strengthen the morale of the nation . This decree then could be implementedbecause of the support of the military, and the people of Indonesia, and then thisdecree was added to the state No. sheet 75 of 1959 and become decision of thePresident No. 150.On 30 April 2001, the House of Representatives of the Republic of Indonesiathe Plenary Meeting have dropped Memorandum II as outlined in the Decision ofthe Board of Representatives of the Republic of Indonesia No. 47 / IV / 2000-2001dated 30 April 2001 to President Abdurrahman Wahid which states that 1) thePresident has violated the Guidelines of State Policy (Guidelines), 2) Within 3(three) months, the President does not regard Memorandum, and 3) Provide 1(one) month to the President to respond to the Memorandum.Escalation of the conflict increased when President Abdurrahman Wahid onJuly 23, 2001 at 1:10 pm President of the Republic of Indonesia edict establishesthat contains clotting Indonesian People's Consultative Assembly and the Houseof Representatives of the Republic of Indonesia, to restore sovereignty to thepeople, as well as to take action and prepare bodies required to hold electionswithin a year, saving a total reform movement of the barrier elements of NewOrder to freeze the Golkar Party's decision to wait for the Supreme Court of theRepublic of Indonesia. Abstract

Indonesia-Australia relationship has existed since the beginning of the independence of Indonesia. Australia is one country that gives political support to the struggle of the people and the nation of Indonesia in achieving independence. In the implementation of foreign relations possible actions or circumstances are contrary to or inconsistent with foreign policy, national legislation and international law and practice. Action and such circumstances should be avoided According to the constitution and international law.The act of espionage obtain information prohibited under international law, because they can interfere with the sovereignty and security of the State Recipient In accordance with the above description, the writer interested to do research with the title Termination While Bilateral Relations Between Indonesia-Australia Related Tapping By Australian Government Seen From the International Law. Then to determine whether termination while Indonesia-Australia bilateral relationship is right or espionage cases related to wiretapping under international law and the latter are the implications of bilateral interim termination of the Indonesia-Australia ties. Results of the discussion in this paper is, international law regards action the Australian government wiretapping is not illegal. But in particular the tapping action has hurt the provisions of the Treaty of Lombok. The impact of these intercepts is reduced confidence in the Government of Indonesia to the Australian Government, while the termination of the cooperation in the field of intelligence and the military until the completion of the tapping issue is clearly not just the negative impact of this wiretapping issue, but there were also the positive impact that pushed the two countries, namely Indonesia and Australia to develop a code of conduct together in conducting international relations ensure legal certainty from any action outside of the code of conduct.Kata Kunci: Pemutusan sementara, hubungan bilateral antara Indonesia- Australia, terkait enyadapan

Abstract

The court is the last place for the parties to solve problems that occur, because the court considered a place that has equity in accordance with applicable law, the court is run by a judicial peripheral devices such as the Presiding Judge, Judge, the Registrar, the Public Prosecutor and apparatus other countries designated by the State directly, but nowadays in Indonesia itself has raised a lack of confidence by the public towards the judiciary dikarenkan negative behavior caused by the state apparatus itself, as the judge who is in the region of Kupang in particular, the judge has violated the code judicial ethics, because the judge handling his own case, the judge has to know that it was his brother but does not resign, the consequences arising Kupang because the judge does not resign impact on peoples sense of a lack of judicial institutions in Indonesia.Context of judicial independence in a world of justice does not mean that judges are free to do anything in the process of examination and trial, but the judge also has certain limitations, restrictions stipulated in the code of conduct of judges of the judiciary, judges do not assume that all the king should be considered correct decisions , but the judge has rules and limits of its own in the process of investigation or trial.This type of research can be classified in a normative law research which the author examines the judicial authority law and the judicial code of conduct with the legal principles that apply in Indonesia, this research is also reinforced with the interview data to pekanbaru district court judge in order to strengthen the existing data ,Keywords: Court-Judge-Violation of the Code of Justice

The high level of crime in the theft of the tourist attractions in the city of Pekanbaru causing public anxiety and fear, so reluctant to visit tourist attractions in the city of Pekanbaru. Abstract

Developments in technology and the globalization of the banking sector, This makes the current banking has become the main target for money laundering activities because this is the sector which offers many services and financial instruments in traffic which can be used to hide the origin of a fund one of them with private banking mode. Indonesia itself has made efforts with the implementation of the law on Prevention and Combating Money LaunderingHowever, various modes arising causes are still many cases of money laundering one mode of private banking, this is the challenge that INTRAC (PPATK) able to increase its role in the prevention and combating of money laundering in private banking mode. with the necessary efforts to overcome the obstacles preventing and combating money laundering in private banking mode should be further enhanced by conducting periodic breakthroughs and improvements.The role carried out by INTRAC (PPATK) as FIU in the prevention and eradication of pencuican money with private banking mode is to receive reports, perform analysis, and forwards the results of the analysis to law enforcement officers.Keywords : Role - PPATK - Prevention of Money - Laundering

Abstract

In 2005 at Payakumbuh City, West Sumatra threre was an uproar case, a premeditated murder of a Japanese citizen named Tomoko Ishizawa aka Mochhi. In this case there was a disparity the country court decision and the high court decision, which is the decision numberd 122/Pid.B/2005/PN.Pyk convicted 20 years in prison while the decision numbered 57/PID/2006/PT.PDG convicted the death penalty. The problems are how the judge consideration in deciding conviet for the first level and the higher one, and whether factor that cause the dicision disparities in the decision numbered 122/Pid.B/2005/PN.Pyk and the decision numbered 57/PID/2006/PT.PDG.After the research by using descriptive or normative legal research, data sourees supported by three legal matcrials which is primary data, secondary data and tertiary data, while the data collection teehniques were the study of literature, decisions and legislation relating to the discussion. After the data were collected then analyzed qualitatively to address problems in this script and the conclusions were deductively taken.Based on the results of research that the judge consideration of the high court focused on the judgment against the defendant and denied the considerations that relieve the defendant in the country court. The high court judges convicted the death penalty based on the maximum sentence of Article 340 of the KUHP, while country court judges convicted 20 years in prison based on the minimum sentence of Article 340 the KUHP. Then the factors that lead to disparities in the decision numbered 122/Pid.B/2005/PN.Pyk and the decision numbered 57/PID/2006/PT.PDG were grouped into 3 sections based on the sources which is the legal system and the philosophy of punishment, the of the judge and the defendant.
