Abstract

Penulisan artikel ini bertujuan untuk memberikan gambaran normatif mengenai perbuatan pencemaran lingkungan hidup sebagai perbuatan melawan hukum sesuai ketentuan Pasal 1365 KUHPerdata. Ketentuan tentang perbuatan melawan hukum sebagaimana dimaksud pasal tersebut relevan digunakan untuk meminta pertanggungjawaban kepada pelaku perbuatan pencemaran lingkungan hidup secara keperdataan. Untuk menelaah hal tersebut, metode penelitian yang digunakan dalam penulisan artikel ini adalah metode penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan serta menggunakan sumber bahan hukum berupa materi hukum yang memiliki kekuatan mengikat secara yuridis. Sementara hasil studi/penelitian yang didapatkan mencakup hubungan timbal balik antara kerugian yang ditimbulkan dari perbuatan pencemaran lingkungan hidup sebagai perbuatan melawan hukum serta kaitannya dengan tanggung jawab keperdataan. Kata kunci: perbuatan melawan hukum, pencemaran lingkungan hidup, tanggung jawab keperdataan. ABSTRACT This article aims to provide a normative description of environmental pollution acts as an act against the law in accordance with the provisions of Article 1365 of the Civil Code. The provisions regarding acts against the law as referred to in the article are relevant to be used to hold accountable people who do environmental pollution in a civil manner. To examine this, the research method used in this article is a normative legal research method using purposive approach and legal material sources in the form of legal material which has a legally binding force. Meanwhile, the results of the study / research obtained include a reciprocal relationship between the losses arising from acts of environmental pollution as an act against the law and its relation to civil responsibility. Abstract

Penelitian ini bertujuan untuk menganalisa Efektivitas hukum penerapan Alterntive Dispute Resolution dalam sengketa hubungan Industrial antara perusahaan dengan pekerja serta batasan-batasan penerapan Alternative Dispute Resolution dalam sengketa hubungan industrial. Dengan menggunakan metode penelitian hukum normatif serta pendekatan kasus (case approach) penelitian ini menganalisis efektivitas dan batasan penerapan Alternative Dispute Resolution dalam Putusan pengadilan negeri Denpasar Nomor:2/Pdt.Sus-PHI/2021/PN Dps yang ditinjau berdasarkan UU No.30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa dan UU No.2 Tahun 2004 tentang Penyelesaian Hubungan Industrial. Hasil penelitian menunjukkan bahwa efektivitas penerapan ADR dalam penyelesaian sengketa hubungan industrial dapat dibagi atas 2 yakni ; a. Efektif bila ditinjau berdasarkan tujuan diberlakukannya hukum yakni kesamaan derajat para pihak (equality before the law), dan b) Belum efektif bila ditinjau berdasarkan indikator keberhasilan ADR yakni terselesaikannya sengketa tanpa melalui jalur pengadilan dengan prinsip win-win solution. Selain itu, hasil penelitian juga menunjukkan bahwa dalam penyelesaian sengketa hubungan industrial, ADR berada pada tahapan perundingan tripartit. By using a normative legal research method and a case approach, this study analyzes the effectiveness and limitations of the application of the Alternative Dispute Resolution in the Denpasar District Court Decision Number: 2/Pdt.Sus-PHI/2021/PN Dps which is reviewed based on Law No.30 of 1999 concerning Arbitration and Alternative Dispute Resolution and Law No. 2 of 2004 concerning Settlement of Industrial Relations. The results of the study indicate that the effectiveness of the application of ADR in the settlement of industrial relations disputes can be divided into 2 namely; a. Abstract

Tujuan dari penelitian ini adalah untuk mengetahui kendala-kendala yang dihadapi oleh Pemerintah Kabupaten Badung dalam penerapan perizinan berusaha terintegrasi. Jenis penelitian yang dipergunakan dalam jurnal ini adalah yuridis empiris dengan mempergunakan pendekatan peraturan perundang-undang, pendekatan kasus dan pendekatan komparatif. Lokasi penelitian pada penelitian ini adalah pada Kantor Perizinan Kabupaten Badung dan beberapa sarana akomodasi pariwisata di daerah Kerobokan, Seminyak dan Canggu. Teknik Pengumpulan data dengan wawancara dan observasi, teknik analisis menggunakan metode deskriftif kualitatif. Hasil dari penelitian ini adalah pemerintah telah berupaya meningkatan stabilitas iklim investasi di Indonesia karena melihat fakta bahwa perkembangan jumlah penduduk yang terus meningkat yang secara otomatis mengakibatkan kebutuhan akan kesejahteraan bertambah, baik secara jumlah maupun kualitasnya. Demikian juga perkembangan globalisasi dan teknologi yang semakin hari semakin meningkat, dimana perkembangan tersebut bisa dipergunakan sebagai daya dukung meningkatkan kesejahteraan masyarakat melalui peningkatan investasi dan pembangunan nasional di segala bidang khususnya sektor kepariwisataan. Tata kelola tujuan pariwisata sangat penting agar dapat dipelajari, diimplementasikan, dipahami untuk mewujudkan pariwisata berkelanjutan yang bertanggungjawab serta untuk mengurangi dampak negatif yang ditimbulkannya. Sehingga untuk mengimplementasikannya tersebut pemerintah mengeluarkan Sistem Perizinan yang berbasis Online atau yang di sebut Online Submission System (OSS). The purpose of this research is that to find out what obstacles are faced by the Badung Regency Government in implementing integrated licensing. The type of research used in this journal is juridical empirical by using the statutory approach, the case approach, and the comparative approach. The research location in this study is at the Badung Regency Licensing Office and several tourism accommodation facilities in the Kerobokan, Seminyak and Canggu areas. The technique of collecting data by interview and observation, the analysis technique uses a qualitative descriptive method. The result of this research is that the government has made efforts to improve the stability of the investment climate in Indonesia since the depelopments of the populations continue to increase which automatically result in the need for increased welfare, both in therms of quantity and quality. Likewise, the development of globalizations and thecnology which is increasingly increasing day by day, where this development can be used as supporting capacity to increase the welfare of the community through increased investment and national depelopment in all fields, especially the tourism sector. The management of tourism destinations is particularry important so that it can be studied, implemented, and understood to realize responsible sustainable tourism and to reduce the negative impacts it causes. So, to implement it, the government issue an online based licensing system or what is called One Submission System (OSS).

Abstract

Tujuan studi ini untuk mengkaji kepastian perlindungan hukum bagi konsumen yang mengkonsumsi pakaian impor bekas atau yang dikenal dengan thrift fashion serta mengkaji bentuk perlindungan hukum bagi konsumen atas kerugian yang dialami menurut Undang – Undang Perlindungan Konsumen. Studi ini mempergunakan metode penelitian normatif dengan pendekatan perundang-undangan. Hasil studi menunjukkan bahwa terdapat problematika perlindungan hukum terhadap konsumen sehingga menimbulkan konflik norma dalam pengaturan barang impor di Indonesia antara UUPK dengan UU No. 7 Tahun 2014 Tentang Perdagangan. Dengan diberlakukan Peraturan Kementrian Perdagangan Nomor 51/M-DAG/PER/7/2015 tentang larangan impor pakaian bekas diharapkan menciptakan kesejahteraan bagi masyarakat dan tidak menimbulkan ketidakpastian hukum. Penyelesaian sengketa konsumen atas kerugian yang diderita dapat melalui 2 cara yaitu pengadilan dan di luar pengadilan. The purpose of this study is to review the certainty of legal protection for consumers who consume used imported clothing or known as thrift fashion and review the form of legal protection for consumers for losses suffered under the Consumer Protection Act. This study uses normative research methods with a statutory approach. The results of the study showed that there are legal protection problems against consumers that cause conflict of norms in the regulation of imported goods in Indonesia between UUPK and Law No. 7 of 2014 on Trade. With the enactment of The Ministry of Trade Regulation No. 51 / M-DAG / PER / 7/2015 on the prohibition of imports of used clothes is expected to create welfare for the community and not cause legal uncertainty. The resolution of consumer disputes over losses suffered can be through 2 ways, namely the court and outside the court.

Abstract

Penulisan jurnal ini bertujuan untuk mengetahui serta memahami perang tarif pada penyedia layanan ojek dalam jaringan dalam perspektif hukum persaingan usaha di Indonesia dan juga untuk mengetahui tugas Komisi Pengawas Perlindungan Usaha dalam mengawasi kasus persaingan usaha. Metode penelitian yang digunakan dalam jurnal ini adalah penelitian hukum normatif yang dimana mengkonsepsikan hukum dalam bentuk hukum yang sudah tertulis seperti undang-undang tertulis, dan bersifat deskriptif yaitu diartikan penelitian yang dilakukan dengan cara menggambarkan secara lengkap. Hasil penelitian menunjukkan bahwa perang tarif antara para penyedia layanan ojek daring yaitu PT. X dan PT. Y terdapat beberapa tanda dan pola praktik predatory pricing penetapan harga oleh perusahaan transportasi daring. Menurut UU No. 5 Tahun 1999 dikatakan bahwa PT. X dan PT. Y melawan hukum dengan tidak mengikuti aturan Pasal 5 ayat (1) UU No. 5 tahun 1999. Berdasarkan pasal tersebut sudah terbukti bahwasanya pihak PT. X dan PT. Y melanggar karena kedua perusahaan ojek daring tersebut melakukan perjanjian antara keduanya untuk menaikkan harga pada pelanggan ojek daring. Persaingan usaha memiliki lembaga pengawas yaitu Komisi Pengawas Persaingan Usaha (KPPU) yang dalam masalah persaingan usaha antara PT. X dan PT. Y ini berperan sebagai salah satu lembaga penegak hukum, dan tanggung jawabnya mengawasi perilaku persaingan usaha tidak sehat para pelaku usaha. In order to writing this journal is to know and understand the rates war between two corps who will be start to be some perspective from business competition in Indonesia and also to determine the role of the Business Protection Supervisory Commission. The research method used in this journal is normative legal research which conceptualizes law in the form of written law such as written law, and is descriptive in nature, which is defined as research that provides data about a situation or social symptoms that develop in the midst society in accordance with the facts and without any engineering. The results show that the tariff war between online motorcycle taxis, namely X Ltd. and Y Ltd., has several signs and patterns of predatory pricing practices by online transportation companies, including discounts that reach unreasonable prices, long-term promotions that exceed standards. With that it can be said that X Ltd. and Y Ltd. violate Article 5 paragraph (1) of Law no. 5 of 1999. From this article, it has been proven that X Ltd. and Y Ltd. violated it because the two online motorcycle taxi companies entered into an agreement between the two of them to increase prices for online motorcycle taxi customers. In business competition, there is the Business Competition Supervisory Commission (KPPU), which in the business competition case between X Ltd. and Y Ltd. plays a role as a law enforcement agency, and its responsibility is to supervise the unfair business competition behavior of business actors.

Abstract

Tujuan penelitian ini yaitu untuk mengkaji pelaksanaan daripada bentuk perlindungan dan kepastian hukum oleh pemerintah terhadap pekerja yang mengalami Pemutusan Hubungan Kerja (PHK) karena force majeur pada masa pandemi corona virus serta memahami pedoman yang sehubungan kewajiban perusahaan dalam memberikan pesangon terhadap pekerja yang mengalami pemberhentian kerja selama pandemi corona berdasarkan perundang-undangan yang berlaku di Indonesia. Metode yang digunakan dalam penelitian ini yaitu jenis penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa otoritas publik telah memberikan beberapa kebijakan untuk melindungi dan mengamankan hak-hak kebebasan pekerja dalam menghadapi PHK pada masa darurat kesehatan. Untuk menghasilkan kualitas daripada tenaga kerja, otoritas publik juga berfokus untuk melakukan penciptaan lapangan kerja seluas mungkin dan mencapai peningkatan dalam memberikan perlindungan hak baik saat pekerja sedang bekerja maupun pekerja telah berada di pasca berakhirnya hubungan kerja. Perlindungan yang sah oleh hukum terhadap pekerja yang mengalami pengakhiran atau pemberhentian karena alasan force majeure diatur dalam Pasal 164 ayat (1) UUK. Pedoman kewajiban perusahaan dalam memberikan pesangon bagi pekerja yang di berhentikan selama pandemi corona di Indonesia telah diatur dalam Pasal 153 ayat (1) sampai dengan Pasal 153 ayat (3) UUK sebagaiamana direvisi dalam Undang- Undang Cipta Kerja pada pasal 153 ayat (1) sampai dengan Pasal 153 ayat (2). Dengan mengikuti perundang undangan yang berlaku, aturan turunan UU Cipta Kerja telah mengatur secara detail mengenai pembayaran pesangon dalam ketentuan Pasal 41 hingga Pasal 57. Kata Kunci: Perlindungan Hukum, Pesangon, Force Majeur, Covid-19. ABSTRACT The purpose of this study is to to review the implementation of the form of protection and legal certainty by the government for workers who experience termination of employment during the COVID-19 pandemic due to force majeure and understand the guidelines regarding the company's obligations to provide severance pay to workers who experience termination of work during the corona pandemic based on legislation -laws in force in Indonesia. The method used in this research is a normative legal research type, with a statutory and conceptual approach. The results show that public authorities have provided several policies to protect and secure the rights of workers' freedom in the face of layoffs during a health emergency. In order to produce a quality workforce, public authorities also focus on creating the widest possible employment opportunities and achieving improvements in providing protection for rights both when workers are at work and when workers have ended their employment relationship. Legal protection for workers who experience termination or dismissal due to force majeure reasons is regulated in Article 164 paragraph (1) of the UUK. Guidelines for the company's obligation to provide severance pay for workers who have been terminated during the corona pandemic in Indonesia have been regulated in Article 153 paragraph (1) to Article 153 paragraph (3) of the UUK as revised in the Job Creation Law in Article 153 paragraph (1) to with Article 153 paragraph (2). By following the applicable laws, the derivative rules of the Job Creation Law have detailed severance pay in the provisions of Articles 41 to 57. Abstract

Clinical Legal Education is an interesting subject to be developed at the Faculty of Legal, Universitas Udayana. Unlike other subjects, clinical legal education participants get an education in the classroom and go directly to the field (community) to increase students' knowledge and practical abilities in solving problems in society. The purpose of writing this journal is to find out how the form of clinical education-based learning, especially in the form of Street Legal Clinic at the Faculty of Law, Universitas Udayana, and to find a model for developing learning methods based on clinical legal education in the form of street legal clinic that can answer legal problems that develop in society. More optimally, the author uses normative legal research methods with the statutory approach and conceptual approach. The results showed that the form of the clinical legal education which is implemented at the Faculty of Law of Universitas Udayana consisted of three stages of the process, namely the planning component, the experiential component, and the reflection component with the learning models that had been used so far, namely In House Clinic, Out House Clinic, Combination and Street Legal Clinic. The development model suggested in implementing the Street Legal Clinic is to be more optimal in answering problems in the community, namely by accommodating several stages in its implementation, namely the pre-implementation, implementation, and evaluation stages into a single unit that is packaged creatively and comprehensively in collaboration with Clinical Partners.

Abstract

Penelitian ini bertujuan untuk mengetahui cara penyelesaian sengketa melalui mediasi serta mengetahui peran mediator dalam penyelesaian sengketa pembagian harta peninggalan. Mediasi adalah penyelesaian sengketa secara menengahi guna tercapainya akta perdamaian. Penelitian ini memakai jenis penelitian hukum yuridis normatif dengan menggunakan metode pendekatan peraturan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Kajian ini menggunakan sumber yang didapat dari sumber bahan hukum primer dan sumber bahan hukum sekunder. Adapun hasil penelitian ini yaitu mediasi terdiri dari dua jenis yakni, mediasi di Pengadilan dan mediasi di luar Pengadilan serta proses mediasi mengacu pada PERMA No. 1 Tahun 2016 di dalamnya dijelaskan bahwa mediasi dapat dilakukan melalui dua tahap yakni, tahap pra mediasi dan tahap mediasi dan pada saat mediasi pihak yang bersengketa berhak memilih mediator yang sudah bersertipikat resmi. Kemudian, mediator sebagai fasilitator dan penengah, tetapi mediator dalam memediasi tidak semudah yang dibayangkan selalu saja dipertemukan dengan hambatan yang muncul dari pihak yang bersengketa itu sendiri. Kata Kunci : Mediasi, Mediator, Sengketa Pembagian Harta Peninggalan ABSTRACT This study aims to determine how to resolve disputes through mediation and to determine the role of mediators in resolving disputes over the distribution of inheritance. Mediation is the settlement of disputes by mediating in order to achieve a peace deed. This study uses a normative juridical legal research method using the statutory approach and conceptual approach. This study uses sources obtained from primary legal sources and secondary legal sources. The results of this study are that mediation consists of two types, namely, mediation in court and mediation outside the court and the mediation process refers to PERMA No. 1 of 2016 it is explained that mediation can be carried out through two stages, namely, the pre-mediation stage and the mediation stage and at the time of mediation the disputing party has the right to choose a mediator who has an official certificate. Then, the mediator acts as a facilitator and arbiter, but the mediator in mediating is not as easy as imagined, he is always met with obstacles that arise from the disputing parties themselves. Abstract

Artikel ini bertujuan untuk mengetahui dan memahami tanggung jawab pelaku usaha atas penjualan obat palsu di Platform E-Commerce, serta bagaimana sanksi hukum bagi pelaku usaha atas penjualan produk obat palsu tersebut. Dalam penulisan jurnal ini menggunakan metode penelitian hukum normatif. Hasil dari penelitian ini menunjukkan bahwa tanggung jawab pelaku usaha atas penjualan produk obat palsu di Platform E-Commerce adalah memberikan penggantian ganti rugi berupa uang atau barang terhadap konsumen sebagai akibat dari produk obat palsu yang diproduksi lalu diperjualbelikan. Kemudian mengenai sanksi hukum bagi pelaku usaha atas penjualan produk obat palsu di Platform E-Commerce adalah pelaku usaha dikenai sanksi pidana penjara atau denda dan dapat dijatuhkan hukuman tambahan sesuai dengan ketentuan Peraturan Perundang-Undangan. The purpose of this article is to understand and find out the responsibilities of business actors selling counterfeit drug products on E-Commerce Platform, as well as legal sanctions given to business actors for selling counterfeit drug products. The method of doing research used in this journal is normative legal research method. The results of study indicate that the business actor’s responsibility is to give compensation to consumers in the form of money or goods as a result of counterfeit drug products they produced and traded. Then regarding the legal sanctions, business actors are subject to imprisonment or fines and additional penalties can be imposed in accordance with applicable legal provisions.

Abstract

Penelitian ini bermaksud untuk mengetahui kewenangan bank tanah(Land Bank) dalam perolehan tanah terlantar dalam menjamin ketersediaan tanah untuk kepentingan umum. Dewasa ini, penelataran tanah masih marak terjadi hal ini sungguh menganggu cita cita dari negara Indonesia itu sendiri. Jika kita melihat berdasarkan pembukaan konstitusi UUD 1945, dengan seiringnya Penelataran tanah yang marak terjadi sungguh menganggu kepentingan umum sekitar, hal ini disebabkan karena tanah tersebut tidak dipertanggungjawabkan oleh pemegang haknya. Metode penelitian yang digunakan di dalam penelitian ini ialah Penelitian Normatif atau dikenal dengan Studi Kepustakaan, hal ini untuk meneliti kekaburan mengenai pengaturan mengenai Bank tanah dalam memperoleh tanah terlantar dalam menjamin kepentingan umum.Di dalam penelitian ini penulis bertujuan untuk mengetahui apakah badan bank tanah ini dapat mengelola tanah yang terlantar dengan memenuhi asas kepentingan umum yang terdapat pada UU No 5 Tahun 1960 Tentang Peraturan Dasar Pokok-pokok Agraria. Jika kita melihat dari segi eksistensinya badan bank tanah mempunyai tugas sebagai eksekutor dalam mengelola tanah sehingga diharapkan bank tanah dapat menjalani tugasnya dengan baik. This study aims to knowing the authority of the land bank agency in the acquisition of abandoned land in ensuring the interest Nowadays, neglect of land is still rife, this really disturbs the ideals in Indonesian state itself. If we are based on the preamble to the constitution of the 1945 Constitution, that the ideals of the Indonesian people are to prove the Indonesian nation and all the spilled waters of Indonesia and to promote public welfare, educate the nation's life and implement a world based on independence, eternal peace and social justice. The widespread neglect of land really disturbs the surrounding public interest, this is because the land is not designated by the right holder. The impact of neglect of land is very disturbing to people in Indonesia, for example, empty land is used as a garbage disposal. This is very disturbing community activities, the need for policies that must be issued by the government. This policy is implemented with the creation of an independent or special institution (Sui Generis), namely the land bank agency. Land Bank Agency is the agency as the executor in managing the land. In this study the author will discuss whether this land bank agency can manage abandoned land by fulfilling the public interest contained in. seeing from the basis of Article 3 paragraph (1) PP no. 64 of 2021 concerning the Land Banking Agency has the functions of planning, land acquisition, land management, land use and land distribution. If we look at the function of the bank agency, it has the task of being an executor in managing land, so it is hoped that the land bank can carry out its duties properly.
