Abstract

This research discusses the rights of workers / laborers during the COVID-19 pandemic and what if the employers do not meet these rights. Problem which is more in-depth about the employment that emerged during this pandemic, namely the occurrence of massive layoffs. The research was conducted using the Normative Juridical method. By applying the Statute Approach, Conceptual Approach, and Case Approach, the results show that employers have not been able to fulfill workers / labor rights during the COVID-19 pandemic. There are companies that have not implemented the clean lifestyle and occupational health standards K3 protection such as masks, hand sanitizer and personal protective equipment. Prevention and handling policies are still not optimal, the principle of maintaining social distancing has not been implemented optimally, there are still many workers who are jostling for work when they come to work, not to mention during the trip to work in public transportation.  This situation makes them vulnerable to infection. However, they still have to go to work because of the risk of losing their income. Efforts that can be made if wages are not paid are to take the route or methods as regulated in Law Number 2 of 2004 concerning Settlement of Industrial Relations Disputes. The basis of a dispute between a worker/ laborer and an entrepreneur is a dispute over rights.

Abstract

Penelitian ini bertujuan untuk mengkaji mengenai legalitas aborsi yang dilakukan oleh anak korban perkosaan inses. Merujuk pada catatan Komnas Perempuan tahun 2021 telah terjadi kasus perkosaan inses terhadap perempuan sebanyak 215 kasus dimana 15 kasus terjadi pada anak. Dari perkosaan inses tidak menutup kemungkinan terjadi kehamilan pada anak dan ketidaksiapan fisik maupun psikis membuat seorang anak memilih jalan untuk aborsi. Sehingga patut dipertanyakan tentang legalitas aborsi sebagaimana Pasal 75 Ayat 2 Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan jika yang melakukan aborsi adalah anak korban perkosaan inses. Metode penelitian yang digunakan adalah metode yuridis normatif yang dilakukan dengan studi kepustakaan. Hasil penelitian menunjukkan bahwa aborsi dengan indikasi perkosaan adalah legal karena adanya trauma psikologis yang diderita oleh korban dan dimungkinkan adanya indikasi kedaruratan medis akibat perkosaan inses. Aborsi dapat dilakukan pada saat usia kehamilan tidak lebih dari 6 minggu dihitung dari awal pertama haid, namun tidak menutup kemungkinan aborsi dilakukan ketika usia kandungan melebihi batas tersebut. Sehingga penegak hukum harus dapat memastikan bahwa aborsi akibat perkosaan inses tidak dapat dituntut pidana karena telah dilindungi oleh hukum. Kepastian hukum yang ada harus dapat ditegakan agar tercipta keadilan dan kemanfaatan yang menjadi tujuan dari hukum. Selain itu, diperlukan adanya suatu edukasi mengenai kesehatan reproduksi oleh ahli kesehatan agar kasus aborsi dapat diminimalisir.

Abstract

The purpose of this study was to build access to justice for women who became commercial sex workers. The issue of women was chosen as a component in access to justice because of the existence of women as part of a disadvantaged group. The law as commander in chief in its enforcement involves law enforcement officers and in particular the government. Women as human beings whose rights are protected should be protected and respected regardless of their work. This study used the normative juridical method. The results of the study showed that actually women who became commercial sex workers were victims. The high cost of living and economic demands made a person accepting easily job offers and big salaries. So that when they enter the world of prostitution, there would be many cases of sexual violence experienced by commercial sex workers because users felt that they have paid and were free to do anything. That in fact the form of legal protection in the context of guaranteeing human rights has existed in several laws and regulations. However, we know that its implementation is not easy, so cooperation between institutions and law enforcement officers is needed so that the legal objectives of justice, certainty and benefit can be realized

Abstract

Abstrak: Tujuan pengabdian kepada masyarakat ini untuk merealisasikan ide-ide solusi agar dapat diimplementasikan ke masyarakat. Target kegiatan ini adalah agar UMKM dibawah Jalan (Ruang Milik Jalan) Tol Depok – Antasari, khususnya di Kelurahan Pangkalan Jati, Cinere, Depok mengerti dan memahami manfaat melakukan legalitas dan pengembangan usaha. Hasil pelaksanaan dalam tahap sosialisasi ternyata para pedagang UMKM dibawah jalan tol tersebut tanpa ada legalitas dan belum ada regulasi pemanfaatan ruang dibawah Jalan (Ruang Milik Jalan) Tol, sehingga terjadi pungutan dan iuran tidak resmi. Mereka sebenarnya sangat mengharapkan legalitas usaha mereka. Problematika UMKM antara lain: ketimpangan struktural dalam alokasi dan penguasaan sumber daya, diskriminasi negara pada upaya pengembangan ekonomi rakyat dalam kebijakan dan pengembangan strategi industrialisasi, struktur pasar yang bersifat oligopolis, kinerja yang relatif terbatas pada hal yang klasikal. Masalah utamanya adalah dalam pendaftaran izin usaha serta pengembangan usahanya itu sendiri. Metode yang digunakan dalam kegiatan pengabdian kepada masyarakat ini berupa penyuluhan dan pendampingan dan dilaksanakan dengan dialog, diskusi dan pendampingan kepada para pedagang UMKM tersebut. Berdasarkan data yang diperoleh di lapangan, data tersebut dikonsultasikan pada perusahaan jalan tol dan pemerintah daerah setempat untuk mendapat soulusi. Kesimpulan dalam pelaksanaan pengabdian masyarakat untuk pengembangan UMKM di bawah Jalan Tol ini adalah pengembangan UMKM tersebut harus didukung oleh regulasi pemanfaatan Ruang Milik Jalan di bawah Jalan Tol oleh instansi berwenang yaitu dalam hal ini adalah Direktorat Jenderal Bina Marga dan Badan Pengatur Jalan Tol (BPJT) Kementerian PUPR. Pemberian izin konsesi ini tentu saja memperhatikan aspek-aspek teknis, keamanan konstruksi jalan tol dan keselamatan, dengan persyaratan yang ketat, yang semuanya didasarkan pada rasa keadilan, kepastian hukum dan asas manfaat bagi masyarakat. Hasil dari kegiatan ini berupa peningkatan UMKM dimana yang tadinya mereka masih liar/ilegal namun setelah adanya kegiatan ini, UMKM yang dibawah Jalan telah mendapatkan perizinan dari RT/RW setempat. Abstract: The purpose of this community service is to realize solution ideas so that they can be implemented in the community. The target of this activity is so that MSMEs under the Depok - Antasari Toll Road (Road Owned Space), especially in Pangkalan Jati Village, Cinere, Depok understand the benefits of carrying out legality and business development. The results of the implementation in the socialization stage, it turns out that the MSME traders under the toll road have no legality and there is no regulation on the use of space under the Toll Road (Road Owned Space), resulting in unofficial levies and fees. They actually really expect the legality of their business. The problems of MSMEs include: structural imbalances in the allocation and control of resources, state discrimination in efforts to develop the people's economy in policies and development of industrialization strategies, market structures that are oligopolistic, relatively limited performance on classical matters. The main problem is in the registration of business licenses and the development of the business itself. The method used in this community service activity is in the form of counseling and assistance and is carried out through dialogue, discussion and assistance to the MSME traders. Based on the data obtained in the field, the data were consulted with toll road companies and local governments to obtain solutions. The conclusion in the implementation of community service for the development of MSMEs under Toll Roads is that the development of MSMEs must be supported by regulations on the use of Road Owned Space under Toll Roads by the authorized agencies, namely in this case the Directorate General of Highways and the Toll Road Regulatory Agency (BPJT) of the Ministry PUPR. The granting of this concession permit, of course, takes into account technical aspects, toll road construction security and safety, with strict requirements, all of which are based on a sense of justice, legal certainty and the principle of benefit to the community. The result of this activity is an increase in MSMEs where previously they were still wild/illegal but after this activity, MSMEs under the road have received permits from the local Neighbourhood/Hamlet.

Abstract

Penelitian ini bertujuan untuk mengetahui faktor-faktor penyebab terjadinya tindak pidana romance scam pada situs kencan online di Indonesia dan bagaimana perlindungan hukum bagi korbannya. Metode penelitian yang digunakan ialah metode pendekatan yuridis normatif melalui pendekatan peraturan perundang-undangan dan pendekatan konseptual. Faktor penyebab terjadinya romance scam karena adanya faktor ekonomi dan faktor ekstern yakni adanya kesempatan. Perlindungan hukum yang diberikan oleh Undang-Undang Republik Indonesia Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik berupa penyelesaian perkara dan pemberian sanksi pidana yang diberikan kepada tersangka atau terdakwa. Bentuk perlindungan hukum bagi korban romance scam berupa pemberian hak dan kewajiban. This study aims to examine the factors that cause the crime of romance scam on online dating sites in Indonesia and how legal protection is for victims. The research method used is a normative juridical approach through a statutory approach and a conceptual approach. The factors causing the romance scam are due to economic and external factors, namely the opportunity. The legal protection provided by the Law of the Republic of Indonesia Number 19 of 2016 concerning Electronic Information and Transactions in the form of settlement of cases and imposing criminal sanctions given to suspects or defendants. The form of legal protection for victims of romance scam is the provision of rights and obligations.

Abstract

Di masa pandemi COVID-19 yang dimana hampir segala kegiatan manusia beralih menjadi online ini, platform sosial media menjadi sebuah kekuatan yang sangat besar. Melalui interaksi yang ada di sosial media, pengguna internet dapat menjalin hubungan nyaris tak terbatas serta tanpa dibatasi jarak dan waktu. Akibatnya, dengan segala kegiatan yang dilakukan secara online, kekerasan berbasis gender siber, salah satunya non-consensual pornography meningkat drastis. Oleh karena itu, diperlukan usaha untuk memerangi kasus tersebut. Usaha tersebut dilakukan dengan mengkaji lebih lanjut bagaimana penegakan hukum terhadap pelaku tindak pidana non-consensual pornography. Artikel ini bertujuan untuk mengkaji penanganan dan kebijakan pemerintah dalam memberantas non-consensual pornography. Penlitian ini menggunakan metode penelitian yuridis normatif, dengan menganalisis data yang sudah ada dan mengkaji data tersebut. Hasil penelitian ini adalah peraturan yang sudah berlaku dinilai belum berperspektif korban dan komprehensif. Aparat penegak hukum juga masih banyak yang kurang kompeten. Maka, pengesahan RUU PKS adalah jalan utama untuk memberikan kepastian hukum dan memberikan keadilan bagi korban.During the COVID-19 pandemic, where almost all human activities have turned online, social media platforms have become a huge force. Through interactions on social media, internet users can establish nearly unlimited relationships without being limited by distance and time. As a result, with all activities carried out online, cyber gender-based violence, one of which is non-consensual pornography, has increased dramatically. Therefore, efforts are needed to combat this case. This effort is carried out by further reviewing how law enforcement is carried out against perpetrators of non-consensual pornography crimes. This article aims to examine the handling and government policies in eradicating non-consensual pornography. This study was structured using normative juridical research method, by analyzing existing data and reviewing these data. The result of this study is that the regulations that have been in force are considered not to have a victim perspective and are comprehensive. There are still many pornography law enforcement officers who are incompetent. Thus, the ratification of RUU PKS is believed to be the main way to provide legal certainty and provide justice for victims.

Abstract

Saat ini perkembangan teknologi informasi menjadi sarana untuk melakukan perbuatan tindak pidana yang sering kali melanggar norma-norma, salah satu contoh yaitu banyaknya kasus penyebaran konten asusila berupa gambar maupun video. Peraturan hukum terhadap penyebaran konten asusila pasal 27 ayat (1) Undang-Undang Nomor 19 Tahun 2016 Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 terkait ITE Tansaksi elektronik serta informasi. Penelitian memiliki tujuan memahami peraturan pembuktian dan problematika pembuktian tindak pidana penyebaran konten asusila. Metode yang dipakai pada penelitian ini yakni yuridis normatif. Sumber hukum yang digunakan yaki hukum sekunder. Pendekatan yang digunakan yakni Statute Approach (Perundang-undangan) dan Conceprual Approach (Konseptual). Hasil penelitian ini menjelaskan bahwa pembuktian terhadap penyebaran konten asusila tidak hanya menggunakan alat bukti yang diatur pada Pasal 184 (KUHAP) selain itu menggunakan alat bukti yang diatur pada Pasal 5 (UU ITE). Pembuktian secara elektronik didapati belum adanya kejelasan dalam penafsiran kepastian dari alat bukti elektronik yang didapatkan oleh aparat hukum.

Abstract

This study aims to determine the legal protection for consumers of Indihome internet services who feel they have been harmed by the services provided by Indihome, then further discuss the liability of PT. Telekomunikasi Indonesia as a provider of Internet services to consumers who have sued the problem. This study uses a normative juridical method with a law approach, a case approach and a conceptual approach, with primary and secondary legal sources. The results of the study show that legal protection for consumers also includes consumer rights as regulated in Article 4 of Law Number 8 of 1999 and Article 45 of Law Number 8 of 1999. There are obstacles to damage or losses experienced by consumers related to the quality of services provided is the responsibility of PT. Telecommunications Indonesia as a business actor. In addition to demanding rights, consumers must also pay attention to their obligations such as reading or following information instructions and procedures for the use or utilization of goods and/or services, for the sake of security and safety which aims to prevent consumers from things that will harm consumers later. The form of responsibility of PT. Telekomunikasi Indonesia that is given to IndiHome consumers, namely providing compensation according to company regulations, providing compensation, resolving disputes regarding the implementation and/or interpretation of subscription contracts, are jointly resolved by PT. Telekomunikasi Indonesia and customers by deliberation

Abstract

Abstrak: Disahkannya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja (UU Cipta Kerja) diharapkan dapat mendukung dan membantu dalam pertumbuhan ekonomi pada masa pandemi Covid-19 maupun pasca endemi Covid-19. Secara umum semua sektor Usaha Mikro dan Kecil (UMK) memiliki permasalahan legalitas dan lemahnya strategi berbisnis serta minimnya informasi atas kemudahan dari Perusahaan Perseorangan khususnya dimasa pasca endemic Covid-19. Tujuan dari pengabdian melibatkan Perangkat Desa sebagai perpanjangan pengabdi untuk dapat tepat pada sasarannya yaitu UMKM yang membutuhkan, agar dapat ditindak lanjuti pada proses pendampingan secara real time. Berdasarkan hasil survey kepada perangkat Desa Mangunjaya, menghasilkan bahwa masyarakat Desa Mangunjaya membutuhkan peningkatan strategi pemasaran dan kesadaran hukum dagang untuk meningkatkan pendapat para pelaku UMKM di wilayah Desa Mangunjaya . Kegiatan pengabdian ini disusun menggunakan metode Plan - Do - Check - Action disertai pelaksanaan dialog dan praktik lapangan untuk menghasilkan bukti yang nyata kepada masyarakat Desa Mangunjaya. Penggunaan metode Plan - Do - Check - Action menjadi solusi praktis untuk pelaksanaan proses kegiatan. Pendampingan peningkatan kesadaran hukum yang dilaksanakan tim pengabdi menghasilkan 4 buah sertifikat Nomor Induk Berusaha. Sosialisasi peningkatan strategi bisnis menghasilkan peningkatan pengetahuan ilmu ekonomi kepada 85% peserta yang mengikuti kegiatan.Abstract: The enactment of Law Number 11 of 2020 concerning Job Creation (Job Creation Law) is expected to support and assist in economic growth during the Covid-19 pandemic and post-endemic Covid-19. In general, all Micro and Small Enterprises (MSE) sectors have problems with the nature and weak business strategy and lack of information on the convenience of Individual Companies, especially in the post-endemic period of Covid-19. Thepurpose of service involves the Village Apparatus as an extension of service to be able to be right on its target, namely MSMEs in need, so that it can be followed up on the mentoring process in real time. Based on the results of a survey of the Mangunjaya Village apparatus, it was found that the people of Mangunjaya Village need to improve marketing strategies and awareness of trade laws to increase the opinions of MSME actors in the Mangunjaya Village area. This service activity was prepared using the Plan - Do - Check - Action method accompanied by the implementation of dialogue and field practices to produce concrete evidence to the people of Mangunjaya Village. The use of the Plan - Do - Check - Action method is a practical solution for the implementation of the activity process. Assistance in increasing legal awareness carried out by the service team produced 4 Certificates of Business Identification Numbers. Socialization of improving business strategies resulted in an increase in knowledge of economics to 85% of participants who participated in the activity.

Abstract

Abstrak: Masalah yang terjadi adalah tentang pemenuhan hak-hak penyandang disabilitas dalam bidang ketenagakerjaan, sebagian dari mereka menganggap bahwa pemerintah tidak memberikan kesempatan untuk bekerja layaknya manusia pada umumnya. Nyatanya, hak-hak untuk bekerja bagi disabilitas telah ada pengaturannya dalam Undang-Undang Nomor 8 Tahun 2016. Sehingga, jelas bahwa kegiatan ini bertujuan untuk meningkatkan pengetahuan dan pemahaman mitra penyandang disabilitas di bidang ketenagakerjaan atas dasar persamaan hak. Metode pelaksanaan adalah Sosialisasi dengan tema“See Ability Not Disability”. Mitra adalah ‘penyandang disabilitas’ pada Balai Rehabilitasi Sosial Penyandang Disabilitas Sensorik Rungu Wicara (BRSPDSRW) Melati yang beralamat di Jl. Gebang Sari Nomor 38, RT. 02/RW. 05 Bambu Apus, Kecamatan Cipayung, Kota Jakarta Timur berjumlah 20 (dua puluh) orang. Monitoring dan evaluasi yang dilaksanakan adalah dalam bentuk wawancara kepada seluruh peserta Pengabdian. Hasil menunjukkan bahwa dari semua materi yang disampaikan oleh tim terdapat peningkatan pemahaman dan pengetahuan mitra terutama terhadap hak-hak penyandang disabilitas dalam bidang ketenagakerjaan sebesar 45%. Dengan dilaksanakannya kegiatan ini dapat memberikan manfaat yang besar terutama perhatian yang diberikan oleh pemerintah kepada penyandang disabilitas dalam bidang ketenagakerjaan. Selain itu, mitra semakin paham akan peluang kerja dan peluang usaha yang dapat dilakukan dengan mengembangkan potensi diri dan tentu hal ini membutuhkan kerja sama dengan ahlinya.Abstract: The problem that occurs is regarding the fulfillment of the rights of persons with disabilities in the field of employment, some of them think that the government does not provide opportunities to work like humans in general. In fact, the right to work for persons with disabilities has been regulated in Law Number 8 of 2016. Thus, it is clear that this activity aims to increase the knowledge and understanding of partners with disabilities in employment based on equal rights. The method of implementation is socialization with the theme "See Ability Not Disability". Partners are 'persons with disabilities' at the Melati Social Rehabilitation Center for Deaf Sensory Disabilities (BRSPDSRW) located on Jl. Gebang Sari Number 38, RT. 02/RW. 05 Bambu Apus, Cipayung District, East Jakarta City, totaling 20 (twenty) people. Monitoring and evaluation is carried out in the form of interviews with all participants in the Service. The results showed that from all the material presented by the team, there was an increase in understanding and knowledge of partners, especially regarding the rights of persons with disabilities in the field of employment by 45%. The implementation of this activity can provide great benefits, especially the attention given by the government to persons with disabilities in the field of employment. In addition, partners are increasingly aware of job opportunities and business opportunities that can be done by developing their potential and of course this requires cooperation with experts.
