Abstract

Tujuan studi ini untuk mengkaji mengenai perlindungan hukum bagi konsumen terhadap peredaran obat melalui online yang tidak sesuai dengan komposisi obat asli serta untuk mengetahui upaya hukum yang dapat dilakukan oleh konsumen atas kerugian-kerugian yang ditimbulkan oleh pelaku usaha. Studi ini menggunakan metode penelitian hukum normatif, dengan melakukan pendekatan terhadap sumber hukum primer serta sumber hukum sekunder. Hasil studi menunjukkan bahwa pelindungan hukum bagi konsumen dalam kegiatan jual beli diatur dalam UU Perlindungan Konsumen. Pelindungan hukum bagi konsumen dapat dilakukan melalui perlindungan preventif dan perlindungan represif. Pelaksanaan jual beli melalui e-commerce telah diatur dalam UU ITE. Pengedaran obat-obatan oleh seseorang yang tidak memiliki kewenangan dan keahlian mengenai obat, telah dilarang oleh UU Kesehatan. Tidak sepenuhnya perlindungan hukum dapat berjalan sesuai yang dijanjikan, sering terjadi pelanggaran terhadap hak daripada konsumen, yang berujung dengan lahirnya sengketa antara para pelaku usaha dengan konsumen. Upaya hukum dapat dilakukan oleh pihak konsumen jika merasa haknya dilanggar melalui jalur pengadilan atau di luar pengadilan, berdasarkan ketentuan Pasal 45 sampai dengan Pasal 48 UU Perlindungan Konsumen. The purpose of this study is to examine the legal protection for consumers against drug distribution via online that is not in accordance with the original drug composition and to find out legal remedies that can be taken by consumers for the losses incurred by business actors. This study uses normative legal research methods, by approaching primary legal sources and secondary legal sources. The results of the study show that legal protection for consumers in buying and selling activities is regulated in the Consumer Protection Law. Legal protection for consumers can be done through preventive protection and repressive protection. The implementation of buying and selling through e-commerce has been regulated in the ITE Law. Distribution of drugs by someone who does not have the authority and expertise regarding drugs, has been prohibited by the Health Act. Not fully legal protection can run as promised, there are frequent violations of the rights of consumers, which leads to the birth of disputes between business actors and consumers. Legal remedies can be taken by the consumer if they feel that their rights have been violated through court or out of court, based on the provisions of Articles 45 to 48 of the Consumer Protection Law.
