Abstract

A lot of government aid which is allocated for village development is kind ofgovernment attention to rural areas. However, in this case the potency of Villagefinancial fraud is more likely to happen. It is not apart from the lack of thesupervision from district government officials on the funds flow process. In addition,which is also important is the human resources of government officials in the villageitself were generally weak. The amount of the Village Fund Allocation (ADD)received by the Head of Village is quite small and is not comparable with theresponsibility of the head of the village which is expected to organize villagedevelopment. Even worse, the ADD fraud culture by unscrupulous bureaucracy hascaused the fund received by the village was pretty small.Keywords: Regional Autonomy, Village Fund Allocation.

Abstract

By the increasing of the population and the economic structural development, the need of land for non-agricultural activities are likely to rise. This phenomenon leads a conversion of agricultural land, especially the unavoidable paddy. The causative factors of agricultural land conversion are: (1) Population; (2) The need of non-agricultural soil; (3) Economy; (4) Socio-cultural; (5) Autonomous Region; and (6) Lack of regulation. The Impacts of this conversion not only threatening food security but also interfering the stability of the economy, social, political, and development of the general population. There are three ways in controlling the use of land, they are: (1) Regulation; (2) Acquisition and management, those are perfecting the system and rules of land selling and the perfection of land tenure patterns (Land Tenure system) in supporting efforts towards maintaining agricultural land; and (3) Incentive and charges.Keywords: Agricultural land conversion, Food Security, Land Tenure System

Abstract

The rise of sirri marriage or underhanded (without involving state law) and the lack of public knowledge of the law supported by the powerlessness and inability to access and act before the law as a result of geographical location and the low level of public education gave birth to the legal consequences of marital legality demands which would be used as marriages the legal basis for civil relations, for that we need a model of marriage legalization through an integrated community court approach based on rural communities. The aim is to provide solutions to the legal requirements of marriage law for rural communities and are unable to research methods using doctrinal and nondoctrinal legal methods. The data used are primary data and secondary data. Secondary data consists of primary, secondary and tertiary legal material. Data collection techniques include observation, in-depth interviews, focus group discussions, questionnaire distribution, and literature study. Data analysis techniques using qualitative normative analysis methods and interactive analysis models. The results and conclusions show that rural communities with limited health insurance seeking justice, economics and science are in dire need of protection and law from Sirri or under-hand marriages for civil purposes.

Abstract

Kebijakan isbat nikah berlaku terhadap perkawinan dalam rangka penyelesaian perceraian, hilangnya akta nikah, adanya keraguan tentang sah atau tidaknya salah satu syarat perkawinan, dan terhadap perkawinan yang terjadi sebelum berlakunya Undang-Undang No. 1 Tahun 1974  juga terhadap Perkawinan yang dilakukan oleh mereka yang tidak mempunyai halangan perkawinan menurut Undang-Undang No. 1 Tahun 1974, namun kebijakan tersebut juga dimanfaatkan oleh pasangan suami istri yang menikah  dengan cara siri dan perkawinan campuran. Metode penelitian menggunakan pendekatan normatif yuridis berupa analisis deskriptif. Sumber data yang digunakan adalah data primer dan data sekunder berupa peraturan yang relevan dengan penelitian. Hasil penelitian menunjukkan adanya indikasi pemanfaatan celah hukum dari kebijakan isbat nikah oleh masyarakat dan warga Negara asing dalam menikahi wanita Indonesia guna menghindari syarat administrasi perkawinan.

Abstract

Tanah adalah karunia Tuhan Yang Maha Kuasa yang harus dikelola sebaik-baiknya demi kemakmuran dan kesejahteraan rakyat secara berkeadilan dan berkelanjutan. Untuk mengelola tanah, maka diperlukan aturan main dalam hal menguasai dan menggunakannya yang bersifat adil, suatu potensi dan menjaga kelestarian lingkungannya. UUD 1945 Pasal 33 ayat (3) yang menyebutkan Bumi dan air dan kekayaan alam yang terkandung didalamnya dikuasai oleh negara dan dipergunakan untuk sebesar-besar kemakmuran rakyat. Kabupaten Sukabumi harus mendaya gunakan dan memaksimalkan potensi yang dimiliki sehingga menjadi daerah yang tangguh dan kompetitif, yaitu dengan kebijakan pertanahan dan tata ruang yang mempunyai tujuan menciptakan kesejahteraan masyarakat khususnya mengoptimalkan untuk kesejahteraan masyarakat lokal. Dengan demikian diperlukan aparatur Pemerintah Daerah yang profesional dalam mendorong percepatan peningkatan kualitas pelayanan publik melalui dinas pertanahan dan tata ruang Kabupaten Sukabumi.
