Abstract

Tujuan penelitian ini adalah untuk mengetahui dan mengkaji implementasi, implikasi dari Pasal 53 ayat (3) Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan khususnya yang terkait dengan Keputusan Fiktif Positif dalam praktik penyelenggaraan pemerintahan dan hambatan pelaksanaannya serta solusi untuk mengatasi hambatan tersebut.Dari hasil penelitian yang ditemukan, Badan Pertanahan Nasional Kota Semarang telah mengetahui dan memahami ketentuan fiktif positif, namun tidak dapat sepenuhnya dilaksanakan karena ada ketentuan Standar Operasional Pelaksanaan (SOP)dalam instansi yang juga harus ditaati. Implementasi ketentuan fiktif positif dalam prakteknya masih kurang efektif guna meningkatkan kualitas pelayanan publik. Implikasi dari ketentuan fiktif positif dirasa  menyudutkan posisi pejabat administrasi pemerintahan karena berbenturan dengan SOP dalam instansi. Terdapat beberapa hambatan yang ditemui dalam pelaksanaan ketentuan ini antara lain, baik badan dan/atau pejabat adminsitrasi pemerintahan maupun masyarakat belum memahami dengan baik dan benar ketentuan ini dan putusan pengadilan yang mengabulkan permohonan pada prakteknya akan mentah kembali karena proses penerbitan keputusan akan berbenturan lagi dengan SOP di setiap instansi. Solusi dari adanya beberapa hambatan tersebut adalah perlu dilakukannya pendalaman pemahaman mengenai ketentuan fiktif positif baik untuk pejabat pemerintahan dan untuk masyarakat dan perlu dibentuk Peraturan Pemerintah yang mengatur lebih spesifik petunjuk pelaksanaan yang lebih implementatif.

Abstract

The capital market that is widely used by people is not in accordance with the provisions contained in sharia principles. Therefore, a capital market with sharia. Conventional capital markets and Islamic capital markets have a similar concept but differ in principles and have different types of contracts. This difference between conventional capital market principles and the principles contained in the Islamic capital market results in the need for regulations that specifically regulate the Islamic capital market. so it is necessary to update the Law No. 8 of 1995 concerning Capital Markets. Judging from the legal system, the Sharia Capital Market still has weaknesses related to the legal substance, legal structure and legal culture so that reconstruction of Islamic capital market regulations must be conducted. The method used in this writing is analytical descriptive and uses a normative juridical approach.

Abstract

This study aims to discuss issues regarding the legal certainty of criminal acts of abuse of authority and problems regarding the return of state financial losses in handling corruption cases in Indonesia. To examine these problems, a normative juridical research method was used using secondary legal data consisting of primary legal materials and secondary legal materials. Based on the results of the study, it is known that the handling of cases of Corruption Crimes cannot be separated from the influences of the bureaucracy and political factors, both from the legal provisions that govern it and from unscrupulous government officials with strategic positions in the Government who are perpetrators of abuse of authority that is detrimental to finances. country. However, there is a discrepancy in the regulation regarding abuse of authority in the Law on government administration and the Law on criminal acts of corruption in Indonesia, especially in terms of recovering state financial losses.

Abstract

Kebijakan nasional yang secara selektif menentukan warga negara asing yang boleh masuk atau keluar dari wilayah indonesia dan sanksi hukum apa saja yang  harus dikenakan terhadap warga negara asing tersebut. Pengawasan yang dilakukan oleh Kantor Imigrasi Kelas I Semarang yakni: Pengawasan administratif dan pengawasan lapangan, sebagaimana diatur dalam Ketentuan Umum 1 Poin (31) UU Keimigrasian. Permasalahan terbesar yang dihadapi oleh Direktorat Intelijen Keimigrasian adalah masih kurangnya produk intelijen yang dihasilkan. Padahal produk intelijen tersebut akan menjadi dasar bagi para pemangku kepentingan (stakeholders) untuk mengambil keputusan. Mengingat Direktorat Intelijen Keimigrasian sebagai instansi strategis untuk melakukan deteksi dini (early warning) dalam pengamanan keimgrasian secara keseluruhan.

Abstract

Kebijakan tax amnesty saat ini diragukan kemampuannya untuk mampu memberi peningkatan kontribusi terhadap penerimaan negara serta meningkatkan investasi di Indonesia. Kebijakan tax amnesty dianggap tidak memberi keadilan terhadap wajib pajak patuh. Hal yang perlu dikaji bagaimana kebijkan tax amnesty dikaitkan dengan asas keadilan? dan bagaimana model pengampunan pajak yang berkeadilan serta mampu meningkatkan iklim investasi di Indonesia ? Penelitian ini menggunakan metode pendekatan socio legal reseach.Kebijakan tax amnesty harus dipandang dari asas manfaat, yaitu peningkatan penerimaan negara. Upaya memberi keadilan, wajib pajak yang telah diampuni, harus membayar uang tebusan, serta harus ada komitmen penegakan hukum yang tegas. Peningkatan iklim investasi di Indonesia perlu didukung adanya kemudahan birokrasi perijinan, iklim politik yang kondusif, terjaminnya kerahasiaan dan kepastian hukum.

Abstract

Sejarah ketatanegaraan menunjukkan sebelum adanya amandemen UUD 1945 ada ketidaktegasan sistem pemerintahan yang dianut.  Perubahan UUD 1945 sistem pemerintahan yang dianut di Indonesia disepakati dipertegas dengan memilih sistem pemerintahan presidensiil. Meskipun dalam  perubahan UUD 1945 sampai perubahan keempat terlihat adanya upaya kesungguhan menuju purifakasi sistem presidensial tetapi masih ada beberapa hal yang tertinggal dan dianggap masih belum mendukung pelaksanaan sistem presidensial dan hal demikian tentunya mempunyai implikasi dalam sistem ketatanegaraan. Hal ini terlihat dalam mekanisme legislasi sebagaimana diatur dalam Pasal 20 ayat (2,3) UUD NRI tahun 1945. Hal lain yang masih belum sesuai dengan sitem presidensiil adalah terkait dengan sistem multi partai yang dianut. Sistem multi partai dapat menimbulkan praktik kenegaraan yang tidak sehat baik dalam penyusunan kabinet, legislasi, implementasi kebijakan pemerintah.

Abstract

The Act No. 28 of 2009 of Regional Tax and Retribution is intended to support regional head through tax sector in order to conduct implementation of regional autonomy. There are significant changes in the new law among others are transfer of BPHTB as Districts Tax and implementation of close list system.Implementation of closed list system has several weaknesses such as local government unable to act much if there are provisions of multiple interpretations, which disadvantage the region. Such thing should be demonstrate on regulation related to BPHTB therefore it will create implication of regional disadvantage.

Abstract

Aceh is a unique area in Indonesia based on Law Number 11 of 2006 concerning the Government of Aceh. One of its features is the establishment of the Wali Nanggroe Institution which is the highest customary institution that aims to maintain peace in Aceh and participate in the world peace process. It is unique in the Indonesian constitutional system because its officers are former combatants of the Free Aceh Movement. This study would like to examine the opportunities and role of the Wali Nanggroe Institution in realizing peace domestically and globally. There are several opportunities for the Wali Nanggroe Institution in peace efforts in a conflicted country; among others, the Wali Nanggroe Institution can carry out the function of peace at the local, national and international levels. It can apply due to the legitimacy of laws and regulations, support from local political parties that dominate Aceh's parliament, and good relations with several foreign countries, such as the "Moro" separatist group from the Philippines had studied with Wali Nanggroe how the peace process from civil war can be realized

Abstract

Imbalances and difficulties when workers experience industrial disputes bring out possibility of defeat in the trial. So the Government has an obligation to fight for justice by providing the budget for legal aid derived from the state budget and allocated to the budget of the Ministry of Law and Human rights. The research method used is normative, which is research that sees the effectiveness of prevailing laws. The results showed that the provision of legal aid budgets hasn’t been able to run optimally because government hasn’t provided a forum for applying legal aid budgets to legal remedies of cassation in Industrial disputes.

Abstract

One of the people’s needs in terms of effort to manifest the purpose of the state which is to establish national well-being is by providing social security. Social security is a form of social protection to meet citizens' basic needs. Associated with the implementation of national social security, the government obligates its citizens to participate in the program. However, the fact was there are still many citizens which are reluctantly participating in the program. It is leading to funding collection to be not optimal and affecting the implementation of social security. The research is adopting normative approach, which is stressed on the secondary data. The research specification is an analytic description with qualitative analysis. The national social security is a compulsory program for all of the Indonesian citizens particularly for the independent level, however, not all have joined it particularly self-referred participants. Several aspects causing this problematic program, such as the lack of people's awareness. The lack of people discipline toward the payment, ineffective sanctions and lack of service, are proved with the abundant number of payment arrears by independent participants. The reconstruction of optimization of National Social Security Program is managed with the improvement of legal substance, legal structure and legal culture.
