Abstract

Constitution law court (MK) have granted application of cancellation of rights condition express opinion of DPR in attending 3 / 4 (three per four) from amount of member of DPR. Even so, this decision do not at moments notice water down the existence of impeachment to president of MK cancel section 184 sentence (4) UU 27 year 2009 about MPR, DPR, DPD, and DPRD arranging rule of conditions 3 / 4 quorum in plenary meeting of approval of rights suggestion express opinion. MK express that section opposes against UUD 1945 and do not have the power of law remains to. MK also consider that without going into effect it rule of section 184 sentence (4) UU 27 / 2009 this rule of conditions of decision making concerning suggestion usage of rights express opinion go into effect rule of simple majority. Member of DPR requests items test of UU. Interconnected Concept body politic in Indonesia in impeachment still weakens because tending to be influenced by political configuration. Therefore, rule of law have to be always strengthened, so that punish and constitution can be upheld without political intervention. Furthermore, state law concept in Indonesia has to always respect rule of law, which free from power intervention, and also importance of politics in straightening of law in every jurisdiction, including jurisdiction of MK.

Abstract

Batik Malangan craftsmen SMEs need a presence in the world of business development. The main problems faced by batik SMEs are 1) lack of good management which covers Planning, Organizing, Actuating and Controlling (POAC) as the focus of management implementation within the context of developing Batik Malangan products, 2) lack of entrepreneurial funds, 3) lack of Batik Malangan socialization (marketing), owing to the lack of web and social media presence 4) Not having financial reports, especially reports within the framework of Triple Bottom Lines (Sustainability Report). The possible solutions are in the form of assistance in the preparation of management procedure systems and the establishment of a marketplace specializing in batik products of Malang. The methods used are in the form of mentoring and training on the use of the procedure system, and the application of a web-based marketplace. The results of this community service, with the existence of Batman Ribone standard operating procedure (SOP), which contains a production planning SOP, SME owners have become increasingly aware of the importance of production planning. The existence of this web-based marketplace increased the number of customers by up to 20% and has made it easier for them to access Batik Malangan products.

Abstract

Pelatihan kewirausahaan budidaya ikan lele pada Yayasan Al-Husna dilaksanakan dengan tujuan untuk meningkatkan perekonomian Yayasan Al-Husna serta memberikan bekal pengetahuan wirausaha untuk anak asuh di yayasan tersebut. Kegiatan pengabdian masyarakat berlokasi di asrama Yayasan Al-Husna Kecamatan Dau Kabupaten Malang. Yayasan Al-Husna telah melakukan budidaya ikan lele sebelumnya, namun karena kurangnya pengalaman dan ilmu tentang budidaya ikan maka usaha tersebut tidak berlanjut. Berdasarkan hal tersebut, maka pelatihan ini diberikan agar pengelola dan anak asuh di yayasan tersebut medapatkan ilmu budidaya ikan lele sehingga dapat dimanfaatkan menjadi sumber penghasilan. Selain itu ilmu budidaya ikan lele tersebut dapat dijadikan tambahan wawasan dalam berwirausaha bagi anak asuh di yayasan tersebut.

Abstract

The Bank, as an intermediary institution, in managing public funds should be conducted with sufficient expertise, so that public trust is maintained and there is no withdrawal of public funds deposited in banks that may result in economic activities. The presence of an institution that serves to oversee banking institutions is needed to ensure public trust so that banking management can be done in accordance with the rules of banking management is good and true. The existence of an independent authority becomes the determining factor in the smooth operation of the financial services sector. With the formation of the Financial Services Authority, it is expected to solve problems arising from the complexity of the existing financial system in Indonesia and to reorganize the organizational structure of the institutions Which carries out regulatory and supervisory tasks in the financial services sector covering the banking sector, capital markets, insurance, pension funds, financial institutions and other financial services institutions. Structuring is done in order to achieve a more effective coordination mechanism in dealing with problems arising in the financial system, thus ensuring the achievement of financial system stability. The regulation and supervision of the entire financial services activities must be done in an integrated manner.

Abstract

Today the growth of the business world is growing so rapidly, it is also supported to expand the business which is more varied, including through franchise (Franchise). Which of these principles for some entrepreneurs is considered more effective, effective and profitable in the development of a business. In Indonesia, the regulation of franchises is based on agreements made by the parties on the basis of the applicable law, in this case the Government Regulation and the Minister of Trade Regulation. Franchise is a form of business that gets a lot of attention from business people, because it can be one way to increase economic activity and give opportunity to weak economic class to try, this means, Franchise can provide job opportunity, equality and also create field work for the community. In addition, the profits of this business are low cost and the materials already provided are also not too take place so vast, franchise recipients no longer need to bother developing their business by building a good and famous image. It is enough to ride on the famous fame of the franchisor, so franchisees who are generally small entrepreneurs will enjoy the success and luck of large-scale companies without having to carry out their own research and development, marketing and promotion that usually requires enormous expenses that the small businessman is unlikely to bear.

Abstract

This study discusses the juridical aspect of contract renegotiation during the Covid 19 pandemic as an effort to mitigate risks and losses in business activities based on Presidential Decree Number 12 of 2020 concerning the Determination of Non-Natural Disasters for the Spread of Corona Virus Disease 2019 ( Covid-19 ) . Many business actors in the business world interpret the disaster as a force majeure, which is an extraordinary event that causes people to be unable to carry out their achievements due to an event beyond their capabilities. The research method used in this research is a normative legal research method. The results of this study are expected to provide debtors with an opportunity to resolve obstacles to their inability to pay installments by being allowed to apply for renegotiation or contract review in order to reach a mutual agreement. through the Regulation of the Financial Services Authority of the Republic of Indonesia Number ll/POJK.03/2020 concerning Stimulus The national economy which aims to maintain financial system stability and support economic growth.

Abstract

Abstrak      Menurut hukum internasional, negara memiliki batas-batas tertentu dalam menerapkan yurisdiksi untuk kasus yang melibatkan kepentingan negara lain. Salah satu batas tersebut dalam bentuk kewajiban setiap negara untuk menghindari kesulitan negara lain dalam upaya menerapkan yurisdiksi. Hukum  Indonesia yang mengatur cybercrime adalah Undang-undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik ( UU ITE), bagian mengatur yurisdiksi yang bagian ke-2 mencakup dasar teritorial subjektif bagi setiap orang melakukan cybercrime dan dikualifikasi berbahaya di  Indonesia . Namun, dalam prakteknya, hal ini sulit untuk dilakukan jika kejahatan dilakukan dari luar Indonesia karena belum tentu setiap negara akan menyampaikan, meskipun UU ITE telah mengikuti ketentuan substantif dalam Konvensi tentang cybercrime,kecuali Indonesia ikut meratifikasi Konvensi cybercrime. Keuntungan Indonesia meratifikasi,  Indonesia dapat menjalin kerjasama dengan peserta dalam hal kasus cybercrime yang merugikan Indonesia terutama jika pelaku melakukan cybercrime di luar wilayah Indonesia, posisi Indonesia dapat mengajukan ekstradisi terhadap pelaku akan menjadi lebih kuat.Kata kunci: cybercrime, yurisdiksi, hukum internasional

Abstract

ABSTRACT A business requires business legality as evidence of ratification of a business entity. Legality must be proven by valid documents according to applicable laws and regulations so that businesses are protected. In addition to business legality, catering services must also carry out tax obligations. Catering services are one of the objects of income tax (PPh). If the catering business takes the form of a corporate body, income tax art 23 will be collected and income tax art 21 will be collected if it is an individual business (as a non-employee receiving unsustainable income). This Community Service Activity is expected to provide knowledge about business legality and taxation aspects, especially with the enactment of the Job Creation Act and the Law on Tax Regulations Harmonization.
