Abstract

The legal practice of Islamic (Sharia) economics in the real sector of Indonesia’s national economic development by way of various institutions or Islamic (sharia-based) economic centers has had a positive impact on the growth and development of the national economy. The practice is based on Islamic principles, which have been shaped into a wide variety of regulations or legislation in effect. In the legal concept of Sharia economics, the state as represented by the government that implements Sharia-based economic practices must apply the principles of Islamic economics to achieve the goal of Islamic economic law. The purpose of this Sharia economic law emphasizes the benefits for society based on the balance and fairness thus attained to present a showcase of the politics involved in Islamic economic law. The actual reality of legislation in Sharia-based economic activities issued by the government still falls decidedly short of expectations when compared to conventional economic activities and legal certainty in other countries, due to the role that Islamic economic law plays in determining the government’s political direction and ways of formalizing Islamic economic law in Indonesia.

Abstract

Hakim bertindak sebagai pengambil keputusan (legal decision maker) untuk kasus konkret di lembaga yudikatif, maka tugas hakim tidak mungkin dilepaskan dari kegiatan penalaran hukum. Putusan hakim merupakan hasil dari suatu kegiatan penalaran hukum yang paling komprehensif dilakukan oleh hakim di suatu peradilan, termasuk pengadilan agama. Kebebasan hakim dalam kegiatan penalaran hukum untuk menemukan hukum dalam suatu perkara menjadi tolok ukur dinamika putusan hakim. Tujuan dari penelitian dalam artikel ini, yaitu melakukan analisis dan evaluasi penalaran hukum yang dilakukan hakim terkait masalah pengenaan denda ta’zir dalam putusan yang dibuat di Pengadilan Agama. Berdasarkan metode penelitian yuridis normatif, diperoleh kesimpulan bahwa pengenaan denda ta’zir dalam putusan hakim Pengadilan Agama sebatas suatu perbuatan yang melanggar norma positif, dikarenakan model penalaran hukum yang dilakukan hakim Pengadilan Agama adalah model penalaran hukum dari aliran positivisme hukum. Belum terlihat hakim menggali kemanfaatan dikenakannya denda ta’zir tersebut. Hal ini terlihat dari ontologi dan epistemologi putusan hakim, lebih mengedepankan aturan yang tertulis sebagai hukum dan menafsirkannya secara tekstual dalam peraturan/ penafsiran autentik. Aksiologi atau tujuan dalam putusan hakim lebih mengedepankan aspek kepastian hukum. Hakim tidak berupaya untuk melihat dari pendekatan lain dalam memutus perkara ekonomi syariah dengan menggunakan pendekatan ekonomi yang dilihat dari segi nilai (value), kegunaan(utility) dan efisiensi (efficiency).Kata Kunci:Model Penalaran Hukum; Ontologis; Epistemologis; Aksiologis; Positivisme Hukum. AbstractJudges act as decision makers (legal decision makers) for concrete cases in the judiciary, so the task of judges cannot be separated from legal reasoning activities. The judge's decision is the result of the most comprehensive legal reasoning activity carried out by a judge in a court, including a religious court. The judge's freedom in legal reasoning activities to find the law in a case becomes a benchmark for the dynamics of the judge's decision. The purpose of the research in this article is to analyze and evaluate the legal reasoning carried out by judges regarding the problem of imposing ta'zir fines in decisions made in the Religious Courts. Based on the normative juridical research method, it was concluded that the imposition of the ta'zir fine in the decision of the judges of the Religious Courts was limited to an act that violated positive norms, because the model of legal reasoning carried out by the judges of the Religious Courts was a model of legal reasoning from the flow of legal positivism. The judge has not seen the benefits of imposing the ta'zir fine. This can be seen from the ontology and epistemology of judges' decisions, prioritizing written rules as law and interpreting them textually in authentic regulations/interpretations. The axiology or purpose in the judge's decision prioritizes aspects of legal certainty. Judges do not try to look at other approaches in deciding sharia economic cases by using an economic approach in terms of value, utility and efficiency.

Abstract

Islamic Credit Cards and Consumptive Behaviour of Society. The credit card as one means of payment utilising cards, is a payment system that is growing rapidly, brought about by the security and risk of carrying cash in large amounts, efficiency, speed and ease of transaction that is offered. Islamic banks are glancing consumer funding products as one of the products services to be offered. There is a very important limitation that must be realized for Islamic banks, namely the provisions of the shari’a principles regarding the provision of credit card and influence on consumer  behaviour  society,  particularly  the  Muslim  community.  It  is  not  impossible  for  the  existence  of  Islamic credit cards that are presented for the ease of transacting to become a card for the ease of indebtedness and cause a consumptive/wasteful attitude that is definitely forbidden in Islamic economic concept.DOI: 10.15408/ajis.v14i2.1287

Abstract

Abstract Foundations in Indonesia are the result of transplanting and adopting laws originating from the Dutch legal system. The presence of foundations in general is a response to the paradigm of realizing a civil society that prioritizes justice and human rights, which leads to general welfare, giving rise to an impetus to form a body with social goals in order to promote prosperity. General, on a non-profit basis. However, in practice and development in Indonesia, many have been abused and deviated from their original function and purpose as a non-profit social institution. Based on the normative juridical investigation that was carried out, the cause of the malicious functioning of the foundation was because from the very beginning the foundation was transplanted and adopted from Dutch law, had grown and developed maliciously. This is because the foundation is not accompanied by firm and clear regulations, but depends on the usual practices of the foundation, and is also driven by the need for the foundation to obtain funds that can be managed for social activities, thus giving birth to various types of foundations. Where each type appears opportunities for malicious occurrence. Efforts made to overcome the misuse of the foundation's function were carried out by issuing regulations on foundations. For this reason, legal comparisons were made to the regulation of foundations in various legal systems, including the Dutch and British legal systems. Keywords: foundation; legal transplants; malicious; comparison. Abstrak Yayasan yang ada di Indonesia merupakan hasil tranplantasi dan adopsi hukum yang berasal dari sistem hukum Belanda. Kehadiran yayasan pada umumnya adalah sebagai suatu respon terhadap paradigma mewujudkan masyarakat madani (civil society) yang mengutamakan keadilan dan hak asasi manusia, yang bermuara pada kesejahteraan umum, sehingga menimbulkan adanya dorongan untuk membentuk suatu badan yang memiliki tujuan sosial agar dapat mendorong ke arah terwujudnya kesejahteraan umum, secara nirlaba. Namun dalam praktik dan perkembangannya di Indonesia, justru banyak yang disalahgunakan dan menyimpang dari fungsi dan tujuan semula sebagai lembaga sosial nirlaba. Berdasarkan penelusuran secara yuridis normatif yang dilakukan, penyebab terjadinya penyalahgunaan fungsi yayasan yang menjadi malicious adalah karena sejak semula ditransplantasi dan diadopsinya yayasan dari hukum Belanda, telah tumbuh dan berkembang secara malicious. Dikarenakan yayasan tidak dibarengi dengan adanya peraturan yang tegas dan jelas, tetapi bergantung pada praktik-praktik yang biasa dijalankan yayasan, serta didorong pula oleh kebutuhan yayasan untuk memperoleh dana yang dapat dikelola untuk kegiatan-kegiatan sosial sehingga melahirkan berbagai macam tipe-tipe yayasan. Dimana masing-masing tipe inilah muncul peluang-peluang terjadinya malicious. Upaya yang dilakukan mengatasi penyalahgunaan fungsi yayasan dilakukan dengan mengeluarkan peraturan tentang yayasan. Oleh karenanya dilakukan pula perbandingan hukum terhadap pengaturan yayasan di berbagai sistem hukum, yatu sistem hukum Belanda dan Inggris. Abstract

Introductioan: Investment is a necessity that cannot be denied in development activities, especially economic development. This can be seen in studies or in the field of development economics, investment is one of the important factors to obtain capital for the economic development of a country. The goal of development in Indonesia is to realize social justice for all Indonesian people. So that the principle of togetherness is the basis and effort to realize the ideals of welfare and social justice for all Indonesian people.Purposes of the Research: The purpose of writing this article is to identify and analyze the principle of togetherness as a legal politics of the Job Creation Act in an interdisciplinary manner.Methods of the Research: The method used in this article uses a normative juridical research method with a multidisciplinary approach.Findings of the Research: One of the regulations in the investment sector is the Job Creation Law, the principle of togetherness in legal politics that underlies and focuses only on investment interests, so that the goal of realizing social justice is a very long goal. This can be seen from a number of articles in the Job Creation Law, both explicitly and implicitly, indicating several provisions that must be regulated in investment law according to various investment theories.

Abstract

As a financial intermediary institution, Sharia Financial Institutions (LKS) have the responsibility to carry out their business activities by complying with sharia principles, which in the Indonesian context are stated in a number of Fatwas from the National Sharia Council-Indonesian Ulema Council (DSN-MUI). This article discusses why compliance with sharia principles has so far been a problem in LKS business activities, even though the presence of LKS in Indonesia has been nearly a quarter of a century. In this article it is shown that the legal substance of the principles of sharia, as stated in a number of DSN-MUI Fatwas, is still general in nature, so it is not operational and leads to inappropriate interpretations. As a result, the intermediation function of LKS is equated with the intermediation function of conventional financial institutions, and Islamic financing is also equated with credit or receivables. Apart from the fact that the provisions in the DSN-MUI Fatwa are still abstract, another factor that causes the practice not to comply with sharia principles is the weakness of the supervisory element in the LKS, namely the sharia supervisory board (DPS), which is placed parallel to the board of directors, making supervision difficult to be effective. Moreover, DPS membership turned out to be possible to be concurrently in several LKS, so that the supervisory function was not focused and was potentially biased. In the future, it is hoped that the fatwa will contain more operational content and institutional supervision must be made effective and focused. Abstrak Sebagai lembaga intermediasi keuangan, Lembaga Keuangan Syariah (LKS) memiliki tanggung jawab untuk melaksanakan kegiatan usahanya dengan memenuhi prinsip syariah, yang dalam konteks Indonesia sebagaimana tercantum dalam sejumlah Fatwa Dewan Syariah Nasional-Majelis Ulama Indonesia (DSN-MUI). Artikel ini membahas mengapa kepatuhan prinsip-prinsip syariah sejauh ini masih menjadi persoalan dalam kegiatan usaha LKS, padahal kehadiran LKS di Indonesia sudah hampir seperempat abad lebih. Dalam artikel ini ditunjukkan, substansi hukum tentang prinsip-pinsip syariah, sebagaimana yang tercantum dalam sejumlah Fatwa DSN-MUI, masih bersifat umum, sehingga tidak operasional dan menimbulkan interpretasi yang tidak tepat. Akibatnya, fungsi intermediasi LKS disamakan dengan fungsi intermediasi Iembaga keuangan konvensional, dan pembiayaan syariah disamakan pula dengan kredit atau utang piutang. Selain ketentuan dalam Fatwa DSN-MUI yang masih abstrak, faktor lain yang menyebabkan ketidakpatuhan pada prinsip syariah adalah lemahnya unsur pengawas dalam LKS, yaitu dewan pengawas syariah (DPS), yang ditempatkan sejajar dengan direksi, sehingga pengawasan menjadi sulit efektif. Terlebih lagi keanggotaan DPS ternyata dimungkinkan untuk dirangkap dalam beberapa LKS, sehingga fungsi pengawasan tidak terfokus dan potensial bias. Ke depan diharapkan fatwa berisi materi muatan yang lebih operasional, dan kelembagaan pengawasan juga mesti dibuat efektif dan terfokus.
