Crime is a social phenomenon that occurs at any place and time. One form of the crime is rape against children. This research is motivated by the condition of the large number of rapes that occur against children. But the threat of criminal penalties against perpetrators of child rape with imprisonment of a maximum of 15 (fifteen) years is considered not reflect the sense of justice for children as victims and that provision is not in accordance with the development of the people of Indonesia are mostly Muslim. This encourages the comparison between positive criminal law with Islamic criminal law and the need for reform of criminal law in the future. Descriptive-analytic approach-comparative, used to analyze criminal sanctions in rape against children in Indonesia. Criminal sanctions rape of children as contained in the Criminal Code and the laws establish child protection imprisonment. Viewed from the objective of sentencing in criminal law rape Indonesia that criminal sanctions against children in positive criminal law does not accommodate the interests of the protection of victims but only oriented to act so that the objective of sentencing offenders to provide a deterrent effect against perpetrators have not been up to materialize. While the Islamic criminal law does not mention explicitly about rape, but rape in Islamic criminal law can be in groups into jarimah adultery even more cruel. Islamic law had explained that rape is hirabah (QS. Al Maidah: 33). Punishment in the form of the death penalty, crucifixion, hand cut legs crossed or exiled. Thus, the formulation of sanctions in criminal law reform on child rape can be adopted with a choice of criminal sanctions as contained in the criminal law of Islam.

Corona Virus 2019 (Covid-19) adalah salah satu jenis penyakit menular yang diakibatkan oleh virus Sars-CoV-2, dimana penderita akan mengalami sindrom pernapasan akut. Kabupaten Indragiri hilir sebagai bagian dari wilayah Provinsi Riau juga merasakan efek dari penyakit covid-19. Setahun kemudian baru ditemukan vaksin yang mengatasi penyakit tersebut. Vaksin-vaksin yang digunakan oleh pemerintah adalah Astrazeneca, Sinovac, Sinopharm, Moderna, Pfizer, dan Novavax. Dalam pelaksanaannya, Vaksinisasi covid-19 masih saja mendapatkan penolakan dari sebagian masyarakat yang ada di Kabupaten Indragiri Hilir dengan alasan bahwa vaksin covid-19 tidak akan dan bisa menyebabkan kematian, vaksin covid-19 tidak halal dan lain-lain. Adanya keraguan dan ketidakpercayaan dari masyarakat tentu dapat menurunkan minat masyarakat untuk mengikuti vaksinisasi covid-19, dan pada akhirnya akan menyebabkan pemberantasan covid-19 di Kabupaten Indragiri Hili menjadi terkendala. Metode yang dipakai dalam pengabdian ini adalah metode langsung turun ke masyarakat dengan melakukan  pendidikan  kepada masyarakat, yakni dengan memberikan penyuluhan kepada masyarakat di Desa Simpang Jaya Kecamatan Batang Tuaka Kabupaten Indragiri Hilir. Dalam pengabdian ini diberikan penjelasan bahwa vaksinisasi covid-19 wajib untuk diikuti oleh masyarakat, ketentuan tersebut diperkuat dengan dikeluarkannya Perpres No. 14 Tahun 2021, bagi masyarakat yang menolak vaksin dapat dikenakan sanksi administratif sampai sanksi pidana denda. Penolakan akan vaksin biasanya didasarkan bahwa vaksin tidak halal, namun hal tersebut telah dijawab oleh MUI melalui Fatwa MUI No. 02/2021 bahwa vaksin covid-19 dari Sinovac  hukumnya adalah suci dan halal.

The misuse and circulation of illicit drugs is a widespread, complex, and complex issue facing the Indonesian people lately, as it can have many negative effects, especially among the younger generation. Therefore, massive prevention efforts must be made through integrated legal counsel such as the Faculty of Law of the Islamic University of Islamic Universities in schools. One of the selected schools is the Junior High IT IT High School located in the Sungai Intan Village of West Suburban Suburban Suburban Hulu district. In the implementation of the counseling the aim is for students to understand the dangers of drugs and to avoid the dangers of drugs so that they can become better generations and work better. This method of implementing community service activities is done with data collection techniques through Library and lecture studies. The source of data obtained in the practice of public service counseling is secondary data consisting of: primary legal materials, and secondary legal materials. While analyzing data using a deductive thinking method, it is a mindset based on common things and then draws on specific conclusions. Results and discussion. Commitment activities to the community of legal counsel on Drug Danger and its Prevention for Students / Junior High School IT High School People in Sungai Intan Suburban Suburban District Upstream from the stages of activity preparation, implementation and closure. At the time of implementation each drug dealer presented the drug and its preventive material. The activity received excellent response from the participants as evidenced by the many questions from the participants and the increased knowledge of the participants about the dangers of drugs and their prevention

ABSTRAKPenyelundupan rokok ilegal merupakan perbuatan melawan hukum yang mengakibatkan kerugian pendapatan negara dan persaingan ekonomi yang tidak sehat. Oleh sebab itu, untuk mencegah perbuatan tersebut, pemerintah kini memberlakukan cukai. Namun pada kenyataannya upaya itupun tidak mampu membendung terjadinya penyelundupan rokok ilegal. Hal ini terbukti dari kasus penyelundupan rokok ilegal yang masih kerap terjadi sekalipun bagi pelakunya telah diterapkan sanksi pidana. Permasalahan yang dikaji dalam penelitian ini adalah bagaimana tinjauan yuridis penerapan sanksi terkait tujuan pemidanaan terhadap pelaku tindak pidana penyelundupan rokok ilegal dalam Putusan Nomor 234/PID.SUS/2019/PN.TBH, dan apa strategi hakim dalam memberikan putusan terhadap tindak pidana penyelundupan rokok illegal agar kepastian dan keadilan hukum terwujud. Penelitian ini merupakan penelitian hukum normatif dengan mengolah data sekunder dengan bahan hukum primer dan peraturan perundang-undangan relevan lainnya. Analisis yang digunakan berupa analisis deskriptif. Dari hasil penelitian ditemukan bahwa secara yuridis penerapan sanksi bagi pelaku tindak pidana penyelundupan rokok ilegal dalam perkara tersebut, yaitu berupa pidana penjara satu tahun enam bulan, masih tergolong ringan dan belum mampu memberikan efek jera bagi pelaku, serta masyarakat pada umumnya. Dengan demikian diperlukan rumusan sanksi pidana yang maksimal oleh hakim dan pidana yang lebih berat bagi pelaku. Selain itu, hakim juga harus memiliki strategi dalam menjatuhkan putusan melalui pertimbangannya yang terdiri atas aspek yuridis dan non-yuridis. Hakim tidak boleh hanya condong pada aspek yuridis tetapi juga perlu memperhatikan aspek non-yuridis agar terhindar dari kesalahan dan perekayasaan dalam memeriksa perkara dan menerapkan sanksi terhadap terdakwa.Kata kunci: penyelundupan rokok illegal; perbuatan melawan hukum; aspek yuridis; non-yuridis. ABSTRACTIllicit cigarette trade is an unlawful act that causes loss of state revenue and creates unfair economic competition. As an effort to prevent this from happening, the government imposes excise duties. Yet, in actual fact it is still powerless to stem the smuggling of illegal cigarettes. This is evidenced by the frequent occurrence of cases of illicit cigarette trade even though the perpetrators have been charged with criminal sanctions. The problem in the analysis is to elaborate the juridical view of the implementation of sanctions aiming to penalize the perpetrators of the criminal act of illegal cigarettes trade in Court Decision Number 234/PID.SUS/2019/PN.TBH, and the judge’s strategies in giving a decision on this case as to achieve legal certainty and justice. This study uses normative legal research methods by processing secondary data with primary legal materials and other relevant laws and regulations. The analysis used is descriptive analysis. The study found that judicially the implementation of sanctions for perpetrators of criminal acts of smuggling illegal cigarettes, in this case, a prison sentence of one year and six months, is still relatively light and has not been able to provide a deterrent effect for perpetrators, as well as the public in general. Thus, judges need to formulate maximum criminal sanctions and heavier penalties for perpetrators. In addition, judges must also have a strategy in making decisions through every consideration that consists of juridical and non-juridical aspects. Judges should not only lean on the juridical aspect but also need to pay attention to the nonjuridical aspects in order to avoid mistakes and manipulations in examining cases and imposing sanctions.Keywords: illicit cigarete trade; unlawful act; juridical aspects; non-juridical aspects.

The general election or regional head election (hereinafter referred to as the Regional Head Election) in a country is an effort to realize good governance and the realization of a democratic state. However, it raises legal problems in the field, such as the occurrence of the attitudes of state officials or state apparatus in this case, one of which is village officials who participate in efforts to win one of the candidates for election and post-conflict local election. This needs to be investigated through legal studies using normative legal research methods, with legal research sources namely primary legal materials and secondary legal materials and the analysis used in this study using qualitative analysis. The Village Head is one part of the Government Bureaucracy which has been clearly regulated in the Election Law. All government bureaucracies may not be involved or support one candidate, including one of them is the Village Head, but in practice there are still many Village Heads who support certain candidates. In article 66 clause 2 part C about The General Election Commission Regulation Number 7 of 2015 was emphasized in the campaign, candidate pairs and/or campaign teams are prohibited from involving “village head or other designations/lurah and village apparatus or other designations/kelurahan.” The prohibition to include village heads and village apparatus is contained in Article 280 paragraph (2) of the Election Law. It is clear that if the campaign involves the village apparatus, it is included in the election violation and is included in an election crime and can be given a criminal sanction if it is proven to have committed an election crime. Pemilihan umum ataupun juga pemilihan kepala daerah (yang selanjutnya disebut dengan Pemilukada) dalam suatu negara merupakan upaya untuk mewujudkan pemerintahan yang baik serta terwujudnya negara demokrasi. Namun menimbulkan persoalan-persoalah hukum di lapangan seperti terjadinya sikap-sikap aparat negara atau perangkat-perangkat negara dalam hal ini salah satunya adalah perangkat desa yang ikut serta dalam upaya memenangkan salah satu calon peserta pemilu maupun pemilukada. Hal ini perlu diteliti melalui kajian hukum dengan metode penelitian hukum normatif, dengan sumber penelitian hukum yakni bahan hukum primer dan bahan hukum sekunder serta analisa yang digunakan dalam penelitian ini dengan menggunakan analisis kualitatif. Kepala Desa merupakan salah satu bagian dari Birokrasi Pemerintah yang telah diatur secara jelas di dalam Undang-Undang Pemilu. Semua birokrasi pemerintahan tidak boleh terlibat ataupun mendukung salah satu calon termasuk salah satunya adalah Kepala Desa namun dalam pelaksanaannya masih banyak seorang Kepala Desa menjadi pendukung bagi calon tertentu. Pada pasal 66 ayat 2 bagian C Peraturan Komisi Pemilihan Umum Nomor 7 tahun 2015 ditegaskan dalam kampanye, pasangan calon dan/atau tim kampanye dilarang melibatkan “kepala desa atau sebutan lain/lurah dan perangkat desa atau sebutan lain/kelurahan ”Larangan mengikut sertakan kepala desa dan perangkat desa terdapat dalam Pasal 280 ayat (2) Undang-Undang Pemilu. Jelas bahwa apabila dalam kampanye melibatkan dan perangkat desa termasuk dalam pelanggaran pemilu dan masuk dalam tindak pidana pemilu dan dapat diberi sanksi berupa pidana apabila terbukti melakukan tindak pidana pemilu.

The election of the head is an embodiment of democracy in determining the leadership in the village. In addition, it is an instrument of community participation in advancing the village by giving full voting rights. However, women as members of the community still have very minimal participation in village head elections, especially in the nomination of village heads. This needs to be investigated through legal studies using normative legal research methods, with legal research sources namely primary legal materials and secondary legal materials, and the analysis used in this study uses qualitative analysis. Law Number 6 of 2014 concerning Villages replaces Law Number 32 of 2004, in article 31 paragraph 1 and hence the election of Village Heads is carried out simultaneously in all Regency/City areas. The election of the Village Head is an opportunity for the people to show their loyalty and local preferences. Indragiri Hilir Regency in 2021 has held a democratic party at the village level (Pilkades) simultaneously on October 12, 2021, with a total of 96 villages spread throughout Indragiri Hilir Regency. It is related to legal awareness that legal awareness, especially community participation in the implementation of the Pilkades for women is quite good. However, in the nomination of village heads, women's participation has not been adequate, this is driven by factors in the community that women do not understand politics, giving rise to the idea that women's nature is only without the need to be involved in public activities. Pemilihan Kepala merupakan perwujudan demokrasi dalam menentukan kepemimpinan yang ada di desa. Selain itu merupakan salah satu instrumen partisipasi masyarakat dalam memajukan desa dengan memberikan hak suara sepenuhnya. Namun perempuan sebagai bagian dari anggota masyarakat masih sangat minim partispasinya dalam pemilihan kepala desa lebih khususnya pada pencalonan kepala desa. Hal ini perlu diteliti melalui kajian hukum dengan metode penelitian hukum normatif, dengan sumber penelitian hukum yakni bahan hukum primer dan bahan hukum sekunder serta analisa yang digunakan dalam penelitian ini dengan menggunakan analisis kualitatif. Undang- Undang Nomor 6 tahun 2014 tentang desa yang menggantikan undang- undang nomor 32 tahun 2004, dalam pasal 31 ayat 1 dan maka pemilihan Kepala Desa dilaksanakan secara serentak di seluruh wilayah Kabupaten/Kota. Pemilihan Kepala Desa merupakan kesempatan bagi rakyat untuk menunjukkan kesetiaan dan preferensi lokal mereka. Kabupaten Indragiri Hilir pada tahun 2021 telah menggelar pesta demokrasi di tingkat desa (Pilkades) secara serentak pada tanggal 12 Oktober tahun 2021 dengan jumlah 96 desa yang tersebar di seluruh Kabupaten Indragiri Hilir. Kaitannya dengan kesadaran hukum bahwa kesadaran hukum khususnya partisipasi masyarakat pada pelaksanaan Pilkades bagi perempuan cukup baik. Namun pada pencalonan kepala desa partisipasi perempuan belum memadai hal ini di dorong oleh faktor-faktor dimasyarakat bahwa perempuan kuran faham dengan politik, sehingga menimbulkan pemikiran bahwa kodrat perempuan hanyalah tanpa perlu terlibat dalam aktivitas publik.

The act of vigilante (eigenrichting) is an act that punishes a party without going through a process in accordance with the law. The Criminal Code does not specifically regulate sanctions for the perpetrator of the vigilante (eigenrichting), but the offender (eigenrichting) can be subject to criminal sanctions as contained in the article on persecution namely article 351 of the Criminal Code, in addition according to the criminal law a person who performs vigilante action (eigenrichting) may be subject to criminal liability if it meets elements of: criminal acts, capable of liability, intent or negligence, and no excuse for forgiveness. If it is associated with human rights, then the act of vigil (eigenrichting) is contradictory to Law Number 39 Year 1999 on Human Rights Article 3 Paragraph (2) which reads "Everyone is entitled to the recognition, guarantee, protection and fair treatment of law as well as obtaining legal certainty and equal treatment before the law.

Indonesia is not a religious state, nor a secular state because religion can not be separated from state affairs. Recognition of the existence of the state of religion in Indonesia is realized in the form of official recognition of certain religious institutions in the country as well as the adoption of values and religious norms in the national system. However, the current phenomenon occurs sacrilege (desecration) to religion that is a violation of applicable law in Indonesia. According to the criminal law of defamation positive (desecration) religion can be imposed sanctions in the form of imprisonment. However, sanctions imposed for perpetrators of the desecration (penistaa) religion in the positive criminal law in Indonesia is relatively lower, it can be found on the article 156 of the Criminal Code which only impose sanctions in the form of imprisonment to five years so that these penalties do not give a deterrent to perpetrators of sacrilege religion. Whilst Islamic criminal law sanctions against perpetrators of sacrilege (desecration) religion with more severe sanctions by the death penalty. It is based on the opinion of the jurists who established that religious treason or blasphemy included in offenses (jarimah hudud) and the witnesses in the form of the death penalty. The imposition of severe sanctions for defamation (desecration) religion in Islamic criminal law aimed at protecting religion in order to avoid abuse (desecration) religion done by humans who make mischief on earth.

Islamic law is prescribed by Allah SWT with the aim of realizing and realizing and protecting the benefit of humanity, both for the benefit of individuals, society or both. But Islamic criminal law is not understood correctly and deeply by society, even by the Islamic community itself. in the meantime, the position of Islamic law in the field of civilization has been broadly established in positive law, whether it is an element of influence, or as a modification of religious norms, which are formulated in civil laws and regulations, or which are covered by a substantial legal environment. Law No. 7 of 1989 concerning religious justice. Whereas Islamic criminal law has not yet gotten a place like the positive law of Islamic civilization. Whereas Islamic criminal law has the same opportunities as civil law in the national legal system based on three factors, namely philosophy, sociology and juridical. Wabah virus corona (Covid-19) yang bermula di Wuhan, provinsi Hubei, Cina pada akhir 2019 dinyatakan sebagai darurat kesehatan global oleh Badan Kesehatan Dunia (WHO). Kondisi ini berimplikasi kepada berbagai aspek terutama aspek hukum pidana, salah satunya kebijakan pengeluaran narapidana dari lembaga pemasyarakatan. Kebijakan pengeluaran dan pembebasan narapidana melalui proses asimilasi dan integrasi akibat dari wabah covid-19 ini tentu saja menuai kontroversi. Tidak hanya pembebasan narapidana umum, namun wacana pembebasan narapidana khusus juga ikut menjadi kontroversi. Sebagian kalangan menilai keputusan tersebut merupakan langkah yang tepat guna menghormati hak asasi manusia dalam sistem peradilan pidana. Di sisi lain, tidak sedikit yang justru menyayangkan keputusan tersebut dengan berbagai alasan, khususnya kekhawatiran akan dampak kerentanan aspek sosial dan keamanan selepas narapidana tersebut bergerak bebas di masyarakat. Pembebasan narapidana untuk mengurangi penyebaran Covid-19 ditengah padatnya lembaga pemasayrakatan merupakan solusi yang bersifat sementara. Padahal persoalan utama yang ada dilembaga pemasyarakatan tersebut bukan pada penyebaran covid 19 namun kepada persoalan over capacity yang ada dilembaga pemasyarakatan tersebut. Besarnya persentase penggunaan penjara dalam peraturan perundang-undangan dan penjatuhan pidana tidak diimbangi dengan sarana prasarana yang mencukupi. Selama pemerintah tidak mengubah kebijakan penegakan hukum dalam bentuk penahanan dan pemenjaraan maka lembaga pemasyarakatan yang ada di Indonesia akan selalu padat dan berisiko dalam penyebaran virus. Pemerintah perlu memikirkan pendekatan restorative justice sebagai upaya mengurangi over kapasitas penjara. Konsep restorative justice merupakan suatu pendekatan yang lebih menitikberatkan pada kondisi terciptanya keadilan dan keseimbangan bagi para pelaku tindak pidana serta korban.
