Abstract

The charismatic power of ondoafi as a leader in customary government can determine the direction of the policy including the resolution of problems of indigenous people. In the new order Era, ondoafi was not involved further in resolving land issues, so he would not be labeled as part of the Free Papua Movement (OPM). In the Special Autonomy era, the roles of ondoafi got stronger as indicated by the privileges given by the government to indigenous people in Papua. This paper explores the roles of ondoafi in resolving the conflict over the customary land in Sentani, Jayapura, Papua, using a qualitative approach with secondary data. The result of the research shows that ondoafi could not resolve the conflict over the customary land in Sentani effectively due to the discrepancy of values between the conflicting parties. Nevertheless, ondoafi should become a mediator to resolve the conflicts between indigenous people and non-indigenous people; including privates or corporates and the central government. An ondoafi should be able to become a diplomat who can bridge the values differences between the conflicting parties and urge the conflicting parties to understand others’ interests and values so that conflicts can be resolved in a peaceful manner.

Abstract

Abstract: The COVID-19 pandemic has an impact on all aspects of community life. The central government stipulates rules for limiting community activities that have an impact on the community's economic decline. This condition becomes the basis for the Yogyakarta City Government in making anticipatory and adaptive policies in the management of traditional markets. The policy is oriented towards achieving two benefits at once, namely the protection of life and property. This article analyzes the policies of the Yogyakarta City Government in managing traditional markets during the pandemic and to what extent these policies can achieve social and economic protection for the community. The analysis of these problems uses the maqâşid al-sharîa approach with the interconnectivity theory of maşlaḥah. The results show that the Yogyakarta City government's policy places social protection (ḥifẓ an-nafs) and economic protection (ḥifẓ al-mâl) as the interests of the community that must be protected. The Yogyakarta City Government continues to implement the central government's instructions by limiting operating hours and the number of visitors to traditional markets, but at the same time reducing user fees and encouraging online shopping promotions. The protection of the two benefits is carried out interconnectively, so that the achievement of one benefit does not cause damage to the fulfillment of the other's needs. The Yogyakarta City Government places these two protections as primary needs that must be protected so as not to cause social and economic damage.Abstrak: Pandemi covid-19 berdampak pada semua aspek kehidupan masyarakat. Pemerintah pusat menetapkan aturan pembatasan kegiatan masyarakat yang berdampak pada menurunnya ekonomi masyarakat. Kondisi ini menjadi dasar bagi Pemerintah Kota Yogyakarta dalam membuat kebijakan yang antisipatif dan adaptif dalam pengelolaan pasar tradisional. Kebijakan tersebut berorientasi pada pencapaian dua kemaslahatan sekaligus, yaitu perlindungan jiwa dan harta. Artikel ini menganalisis bagaimana kebijakan Pemerintah Kota Yogyakarta dalam pengelolaan pasar tradisional pada masa pandemi dan sejauh mana kebijakan tersebut dapat mewujudkan perlindungan sosial dan ekonomi masyarakat. Analisis terhadap masalah tersebut menggunakan pendekatan maqâşid al-sharî’a dengan teori interkoneksitas maşlaḥah. Hasil penelitian menunjukkan bahwa kebijakan Pemerintah Kota Yogyakarta mendudukkan perlindungan sosial (ḥifẓ an-nafs) dan perlindungan ekonomi (ḥifẓ al-mâl) sebagai kepentingan masyarakat yang harus dilindungi. Pemerintah Kota Yogyakarta tetap menerapkan instruksi pemerintah pusat dengan membatasi jam operasional dan jumlah pengunjung pasar tradisional, namun pada saat yang sama memberikan pengurangan retribusi dan menggiatkan promosi belanja online. Perlindungan kedua kemaslahatan tersebut dilaksanakan secara interkonektif, sehingga pencapaian kemaslahatan yang satu tidak berdampak kerusakan pada pemenuhan kemaslahatan yang lain. Pemerintah Kota Yogyakarta menempatkan kedua perlindungan tersebut sebagai kebutuhan primer yang harus dilindungi sehingga tidak menimbulkan kerusakan sosial dan ekonomi.

Abstract

This article discusses Islamic civilians' struggles in gaining recognition of ‘positivization’ of Zakat Law No. 38/1999 and analyzes dynamics of relations between religion and the state in Indonesia. A period of democratic transition from Suharto to B.J. Habibie (Reform era 1998) marked an entry point for a new phase of state juridical recognition to Islamic law. In this paper, the dynamics of political recognition of zakat law are elucidated from a historical-critical analysis. The findings are twofold. Firstly, the zakat law was enacted during B.J. Habibie’s administration, where waves of democratization began. Secondly, the Islamic civilians played an important role in institutionalizing zakat and providing political support for the Ministry of Religion's efforts in proposing Zakat Management Bill (RUUPZ) to the House of Representatives. The state acknowledged multicultural society by adopting their living religious law whose application does not threaten the nation's unity.

Abstract

The background of the study is the existence of Fiqh Muhammadiyah and Fiqh Nahdlatul Ulama in coping with disaster, in response to the phenomenon of disasters happened in Indonesia, which has taken many victims and caused various losses. Muhammadiyah and Nahdlatul Ulama are two largest Islamic community organizations in this country, so the way on managing the society is always interesting to study, including FIQH (ISLAMIC JURISPRUDENCE) of coping the disaster. Based on the reasons above, the backgrounds of the study are how do muhammadiyah and nahdhatul ulama apply their fiqh (islamic jurisprudence) to cope with disaster? and why do they apply their fiqh? This study is library research using qualitative design and comparing between the two fiqhs from both Muhammadiyah and Nahdatul ulama. The researcher applies Philosophical approaches, through the term epistemilogi bayani, burhani dan irfani as instruments to clarify the content of both fiqhs to find the answer for both research problems above. The findings are the guideline and methodhology used both Muhammadiyah and Nahdatul ulama covered in both fiqhs; there are several differences on the Basic conceptions related to beliefs and Aqida; ethical and moral formulations and practical things. Muhammadiyah Fiqh explained in details regarding with practical procedures and steps of worship in coping with disaster, while Nahdlatul Ulama Fiqh explained only practical guidelines in coping with disaster. The other finding is related to the triple epistimology. The point of bayani on both fiqhs are relatively similar, same level and size. The point of burhani on Muhammadiyah fiqh gave deeper understanding than Nahdlatul Ulama fiqh. And the point of irfani neither muhammadiyah nor Nahdlatul Ulama seem to use it. The fact of the differences refers to the basic methodology from both organizations; Muhammadiyah refers from verse and hadith, while Nahdlatul Ulama refers from aqwal ulama, although both of them refer to the verse, hadith and the decree of classical ulama (preachers)
