Abstract

Pengembangan wisata budaya di Desa Wisata Tapak Tilas Sultan Agung dan Desa Wisata Songgo Langit ini merupakan bagian dari Program Pengembangan Desa Mitra (PPDM) ini memfokuskan pada program Desa Mangunan Sebagai Wisata Desa Unggulan Yang Kompetitif dan Berbudaya. Tujuan program ini adalah menjadikan mitra sebagai model pusat pertumbuhan ekonomi kerakyatan dan kesejahteraan masyarakat berkelanjutan melalui potensi desa wisata yang dipadukan dengan budaya. Program pengembangan yang dilakukan, meliputi: legalisasi perkumpulan dalam bentuk sanggar seni. Untuk melakukan legalisasi Sanggar Lestari Budaya dan Sanggar Ngesti Budoyo dibuatlah akta notaris agar dalam beraktivitas memiliki keabsahan dan dilindungi oleh Peraturan Perundang-undangan yang berlaku. Program lainnya adalah pelatihan inovasi pengembangan seni budaya, pemaketan wisata budaya.

Abstract

The Pro’s – Con’s of the Constitutional Court in the review of law in a regulated of the authority, since, it was a conflicting of procedural principles between “ius curia novit” with “nemo judex idoneus in propria causa”. Morever, the background by implication of Constitutional Court decisions, sometimes Constitutional Court making a “rule breaking”,  for examples: nullify of some of law if had reduction of  the authority, addition of constitutional authority to review of law before the 1945 Constitution amendment, additional authority to review of Government Regulation in lieu of law, and used non-constitution as a standard in the formal review, and others. On the other hand, the Constitutional Court also sometimes to choose a   legal logic doesn’t precise and anti-accountability principle. The Conflicts of the procedural principles can  be  resolved  by  understanding  philosophy  of  purposes of law (justice value, legal certainly, utility principle), so that, the Court will have been prioritizing to “ius curia novit” principle and it ignored “nemo judex idoneus  in propria causa”principle, it is intended that the enforcement of the constitution (values) and the state of the Indonesian rule of law, as well as for the Court to aims decided of constitutional issues and to aim the protection of constitutional rights.

Abstract

Artikel ini membahas tentang penataan kelembagaan pengujian norma hukum di Indonesia, yang diawali dengan pembahasan problematika kelembagaan dan praktik pengujian norma hukum saat ini dan gagasan penataaan lembaga kedepan. Hasil kajian menunjukkan bahwa beberapa persoalan, meliputi (1) kelembagaan yang tidak ideal dan tidak sesuai dengan checks and balances system, hal ini terbukti banyaknya lembaga yang terlibat dalam pengujian norma, yakni MK, MA, dan Mendagri–Gubernur (Wakil Pemerintah Pusat); (2) persoalan objek pengujian yang tidak memiliki batasan yang jelas; (3) dalam praktik, persoalan tolok ukur pengujian terjadi kerumitan, terutama dalam penggunaan tolok ukur dalam menilai pertentangan norma hukum. Gagasan penataan kelembagaan ini di desain untuk kelembagaan satu atap pada MK, yang didasari argumentasi bahwa: MK sebagai pengawal Pancasila dan UUD 1945, dalam rangka penataan kelembagaan yang berbasis pada mekanisme checks and balances system, mewujudkan hierarkisitas peraturan perundang-undangan yang berkelanjutan, implementasi pengujian formil dalam praktik pengujian peraturan perundang-undangan di bawah undang-undang, penataan regulasi menjadi lebih tersistem, pengujian produk hukum tertentu merupakan pintu masuk untuk melihat semua persoalan pertentangan normanya pada setiap hierarki. Pada sisi yang lain, objek dalam sistem pengujian peraturan perundang-undangan juga belum terintegrasi menurut konstitusi dan belum mengarah pada penataan sistem heirarki norma hukum dan upaya harmonisasi norma hukum. Sistem konstitusi dengan paradigma “the supreme law of the land” mengharuskan seluruh peraturan dibawahnya harus bersumber dan tidak boleh bertentangan, dengan berpijak pada prinsip “tidak boleh satu detik pun ada peraturan perundang-undangan yang berpotensi melanggar konstitusi tanpa bisa diluruskan atau diuji melalui pengujian yudisial”.This article is discussed the institutional arrangement of regulation reviews in Indonesia. It’s begins with a discussion of the institutional problems and practice of regulations review and the design of institutional arrangement in the future. The results of the study shows several issues including: (1) institutions which are not ideal and contradicted with checks and balances system, it’s proofed by amount of institutions has authority about the functions, namely: Judicial review (Constitutional Court, Supreme Court), and Executive Review (Minister of Home Affairs and Governor; (2) the object of review doesn’t clear boundaries; (3) in practice, the problems of standard reviews is complicated, especially in the use of judging standard in the conflict of legal norm. The idea of institutional arrangement is designed for one institutionalization at the Constitutional Court, which is based on the argument: The Constitutional Court as the guardian of the Pancasila (ideology of state) and the 1945 Constitution, in the framework of institutional arrangement based on checks and balances system, realizing the sustainable in the heirarchy of regulation, in practice of formal review to reviewing regulations under a law, arrangements of regulations more systematic and comprehsnsive, regulations review is the entrance to see all the issues of it’s conficting in each hierarchy. On the other hand, the object in the system of regulation reviews is also not integrated according by the constitution, and it’s not in accordance with the arrangement system in hierarchy of the regulation and efforts to harmonize the legal norms. The constitutional system with the “supreme law of the land” paradigm requires that all the regulations below should be sourced and not be contradictions, with the principle of “no regulations may be conflict againts the constitution without judicial review.

Abstract

This study aims to examine the Constitutional Court's Decision which carries out General Elections simultaneously from the Syiyasah Syar'iyah perspective, especially on the principle of justice. This research is a doctrinal research and uses two approaches namely the statutory approach and the concept approach. Based on Syiyasah Syar'iyah's perspective, the decision of the Constitutional Court is fair for political parties participating in elections for people who are willing to become candidates/vice presidents, and for people who want to test their electability. This decision also aims to reduce the number of non-voter groups. The Constitutional Court's decision also contains the principle of unity and alliance, because it aims to stop the practical political interests that lead to the collapse of unity.

Abstract

This study is about interpretation of constitution, this study is based on the extent authority of the Constitutional Court on the  interpretation of  the constitution,  including various verdicts that are considered as controversial.The result of the study shows that Constitution 1945 giving authority of the constitution  interpretation of the Constitutional Court to evaluate the conflict of  legal norm, this could be meant that the Constitutional Court is “the guardian of  the constitution and the sole interpreting of constitution” and as the legitimate interpreter of  the constitution.  Some  interesting  in implementing  the  interpretation of  the constitution as a  standard  toevaluate  the conflict of  legal norm, consists of: First, essentially,  that the  interpretation of  the constitution  is one of the ways to elaborate understandings contained in constitution text. Second, related to the independence and the  freedom of judge in using an interpretation method which  is not  regulated by positive  law, therefore the judge is  free to use those interpretation methods which are appropriate with the conviction of the Justice. Justice  in  using  the  interpretation method  doesn’t  only  have  function  as  funnel of  the  act,  but  also  has functioned as the funnel of justice since a judge is required the value of the law and the sense of justice which exists in the society (substantial justice). Refer to  the theory of living constitution, therefore Constitution 1945 should be  understood  as  a  constitution which has  textual  and  contextual  dimention  Third,  the  restriction  in using the interpretation method, the constitutional judge couldn’t only focused into the originalism interpretation method which  only  based  to  original  intent  /  the  formulation  of  Constitution  1945  or  using  the  other interpretations  (non  originalist) which oppositely  those  interpretation  the 1945  Constitution doesn’t work according to system and/ or contended with  the main idea underlying the constitution itself entirely  related to the  purpo  se  that would  like  to be  realized.  Fourth,  the  use of  interpretation method  should  be  able  to  be accounted to  the publics, therefore the validity could be examined  in certain cases. This is very essential to dosince Constitutional Court has an extent interpretation authority so that it could keep justice of Constitutional Court  to avoid it from misuse of authority  in interpreting of 1945 Constitution.

Abstract

The success of free and fair local elections is not only measured by the voting process, but also determined on how the settlement of the disputes follows it. In connection with that, the institutional dispute settlement of local elections in Indonesia has experienced ups and downs that have not been interminable. The issuance of the Act Number 10 of 2016 which mandates the establishment of special judicial body for settlement of regional head election disputes still leaves a ‘homework’ of the shape or design of that special judicial institution, its authorities and procedural law that must be established ahead of national simultaneous elections in 2027. This paper is the result of a normative research with statute, analytical, and case approaches regarding the background of the existence of special judicial body which is needed to be established to resolve regional head election disputes in Indonesia as an antithesis on the weaknesses and problems ofinstitutional settlement of regional head election disputes that been there for years, namely: Supreme Court and the Constitutional Court. In order to provide an overview as well as an alternative institutional model of special court for regional head election disputes settlement to be formed onward.

Abstract

tatacara adopsi anak yang sesuai dengan peraturan perundang-undangan dan penanganan tindak kekerasan dalam rumah tangga. Pengabdian dilakukan dengan maksud untuk memberikan informasi yang akurat untuk meningkatkan pemahaman masyarat Dusun Kemiri mengenai adopsi anak dan penanganan kasus kekerasan dalam rumah tangga. Permasalahan yang ditemukan adalah sebagai berikut: (1) proses adopsi anak dilakukan berdasarkan kebiasaan yang berlaku di masyarakat, (2) kesadaran masyarakat masih rendah mengenai pentingnya bukti formal adopsi anak; (3) ketidakjelasan status anak adopsi menimbulkan tindak kekerasan dalam rumah tangga; dan (4) kasus kekerasan dalam rumah tangga masih belum belum teratasi dan terselesaikan. Metode pelaksanaan pengabdian adalah sebagai berikut: (1) melakukan sosialisasi tata cara adopsi anak sesuai hukum Indonesia; (2) melakukan sosialisasi penanggulangan kekerasan dalam rumah tangga; (3) melakukan Pelatihan dan Pembentukan Kader Pelindung Anak dan Satgas Anti kekerasan dalam rumah tangga; dan melakukan pendampingan Penyelesaian Kasus Adopsi Anak dan Kasus kekerasan dalam rumah tangga. Simpulan yang dapat diambil dari pelaksanaan pengabdian masyarakat adalah semua program kegiatan yang direncanakan telah terrealisasi dengan baik dan sesuai dengan jadwal dan rancangan yang telah ditentukan. Permasalahan adopsi anak sudah terpecahkan melalui beberapa tahap pengabdian. Demikianhalnya dengan penanganan Kasus kekerasan dalam rumah tangga. Pengabdian ini telah memberikan pemahaman yang komprehensif mengenai tata cara adopsi anak dan perlindungan kekerasan dalam rumah tangga. Pemahaman hukum dan kesadaran hukum mulai meningkat dan terjaga, karena senantiasa ada Kader Perlindungan Anak dan Satgas Anti kekerasan dalam rumah tangga yang aktif melakukan sosialisasi dan upaya-upaya penyadaran sosial bagi masyarakat.

Abstract

The study elaborated on the construction of “conflict of legal norms” in constitutional review scheme. There are eleven problems as result of this study, which include: The ideology of the state “Pancasila” as a standard review of “conflict of legal norms” act against 1945 constitution; Constitutional court has a review of act passed before and after 1945 Constitution amendment with standard of 1945 constitution; 1945 constitution is “the living constitution” for the enforcing of law and justice; Constitutional court has authority to review of act against 1945 constitution by vertical and horizontal perspective; enforceability aspect of constitutional review is a part of material review, not formal review; the meaning of “conflict of legal norms” must be comprehend elaborated in the decisions to enforcing of law and justice; Constitutional Court does not used priority of the original intent interpretation and remained unfulfilled of other model interpretation if original intent interpretation caused ineffectiveness of constitution; non constitution be permitted for the formal review, but in material review is not implement; “nemo judex idoneus in propria causa” of procedural law principle can remained unfulfilled by “ius curia novit” principle to promote of the 1945 constitution; the formal review of “conflict of legal norms” can remained unfulfilled by utility principle to priority of legal substance; the retroactive decision caused legal  uncertainly.
